All you're doing is creating possible scenarios. Which is the same thing I'm doing. That's the reason this case is easy. The fact is it could have been anything. Having the baby in the U.S is not the problem. The problem according to the OP is that they told VO there weren't going visit the doctor (I guess to have a baby), but they did.

The question is did they lie to the VO? once they prove they didn't lie... forget. I can think of many ways to prove it was simply circumstantial and not premeditated. Anyhow sha. I rest my phone.

Law is complex.

Yes, there are many right ways of giving birth in US. Whatever ways they've taken before shouldn't stop them for trying to renew their visa. Only the VO knows what's right for this case. Thats why I asked him to talk to NIV first.

I was directed to the white man at window 21, the first 3 people in the queue all got blue paper. (the blue paper is the closest paper to him so he was dishing it out like its nothing) i told the security guy to show me where to get water that am thirsty, he said press that stuff and put your mouth which i did and came back to the queue. the guy before me was called and as the man was about giving him blue paper omo i tell security say i wan piss. i enter toilet dey pace up and down for like 5 mins and came out. then went back to the queue you join after thumb printing.when it got to my turn, as the security was about directing me to another window i jejely squeeze myself enter window 9 as the spirit directed. the white lady there issued the first three people before me blue papers.

Thank you. This is a similar article my wife sent to me few weeks ago but which I couldn't find when I needed it to support a post here. Yes. It's serious now and they can back track to get anyone. Say no to any assisted program even if you're on a resident status.

It's not like they have proof of a conversation they had to support a preconceived plan to do the above. People change their minds all the time. People come here just to visit for a week, meet a girl with asss so fat, decide they're not going home again, marry the girl and apply for GC, say their plans changed after they got here. Oga mi Sir, they get their GC.

In your case, maybe your sister and her husband honestly had no intention of having their baby here or visit the doctor. Suppose I were in her shoes, and I woke up one day with blood coming out of me, you think I will risk my life and die because I told one VO that I won't be seeing Doctor? No sir, I will call 911 if needed and get the best treatment and that's not a crime.

The case is more complicated than what you explained. A pregnant woman knows when the arrival date would be. They should have left US before or by the 3rd trimester (last 3 months). Emergency in pregnancy like you described would lead to preterm birth. But the guy didn't say they had a prem baby. So, it's a full term baby with a known arrival date. It will take a novice VO who is not supervised to agree that the baby arrival was impromptu. If one is going to get a visa in Nigeria and knows it's going to be under serious scrutiny, then one should have been truthful the first time. In 2011 in Abuja embassy, I saw a lady that had 1 child in US under disguise, denied a renewal for covering up her pregnancy and delivered in US, even with all her receipts. The guy in question should try his luck, who knows what kind of luck he has?

It has always been like this. Don't use that as a excuse not to pursue your dream. Ofcourse they are making money with the refusal. If You are prepared enough and hopefully favoured to meet a V.O that's not too strict, You will scale through. So prepare well and leave the rest for God if you are not an atheist cheesy

We need to stop this self-pity or don't know what else to call it. It hurts when visa is refused but we should stop whinning about it and look for the best way to go moving forward. Generalizing it might only make you feel better for a few days but it won't take the pain away. Rate of denial has always been high here in Nigeria and will continue to be, yet some people still get their visas.

In fact, in 2011 when we were still applying, some people even came up with an hypothesis that student visa for Nigeria has reached it's quota for the year in Sept because of high rejection rate. I disagreed with them vehemently.

I won't be surprised if you are the only one with this scenario. First, most people who might have used this are typically masters students who might not to need to renew their visas before the completion of their programs. Secondly, this is quite dicy because no one can say for sure or not if this will be a problem. If I were you baring any emergency, I will stay put in the US till I finish my program and able to change status. You don't need a visa to be legal in the US as a student so far you have a valid i20 and your sevis is in status.

You're right. Also, I have seen some people here before that have used this option. But they changed status later and don't need to go back to the embassy.

I may have qualified for it based on NM state law on poverty level but such I believe doesn't reach the embassy here in Nigeria. Don't forget that we showed large sum of money when applying for the visa and so we should be able to take care for our staying in US by ourselves. This is why I didn't submit those forms. Also, I only went to the hospital for a reduction in my monthly payment not for any public assistance. Any government assisted program that helps you to pay a bill or gives you aids etc is regarded as public assistant. Everything done in US goes into one's record, so I can't say things like that can't be pulled up if needed by the appropriate body. Lastly, medical bill is not part of hipaa and hipaa rules can be rendered insignificant by government.

As an international student, you're mandated to have health insurance which is usually used for health related issues. However, it's possible to circumvent the system and illegally apply for and use public assistance in some states. It's easier in some states, e.g. Arizon, than others. If a person on a non-immigrant visa is found to have illegally used such services reserved for citizens, it will hinder any future immigration purposes.

In NM state, you don't have to circumvent anything. Your county will pay part of your outstanding medical bill if you submit the necessary forms. But may count against you when you need a new visa.

Yes the hospital will ask you to pay your medical bills but in some counties, the bill can be shared if you don't make enough money. In NM when you don't make enough and can't pay your medical bill, there is a program they run to pay outstanding medical bills for citizen and non-citizen. Davidlan used to be an old member here. In 2012 when I have a medical bill to pay and was advised in the hospital to use this program, this is the message I wrote to him. I had medical insurance before and after this hospital visit but not at the time of visit. Also, I've heard of a kind of medicaid program for pregnant women that foreign students can use but can't remember the program precisely.

Hello, this is imperiouxx from Nairaland. I have a question I should have asked before now from you. My medical insurance expired in June 2 and I went to a general hospital here in New Mexico in June 16 because I was having pain in my right side that I can't breath in properly, did x-ray and confirm nothing, I was given an injection because I was told it's just muscle strain. When the bill came it was $907. I called to setup payment plan and was told $50 is the only minimum I can pay per month. I went with my guardian to the hospital to tell them I can be paying $25. We met the lady in charge of account and she gave me a form to fill and submit today Friday 24. She said that the form will make the county pay some part of my bill and I pay the remaining. The program will last 6 months. My fear is Nigeria-US embassy when I go for my renewal before my PhD. Do you think I should submit this form or just pay on my own to avoid debate at the embassy when in Nigeria? Thanks

My story goes thus:
Sometimes in 2016, my pregnant sister and her husband with their son applied for a US tourist visa and were granted. During the interview, the consular asked whether my sister will visit the doctor and she replied negative. My sister spent 5 months in the US and returned with the child. Their visa expired and the husband is the busy type and has no time for the renewal. Fast forward to this year, the husband was granted admission for a graduate study in the USA and was even offered a little scholarship by the school. The husband applied for F1 visa and was refused. During the interview, the consular stated that the husband travelled with his wife without their child to the USA two years ago and gave birth there after having misinformed the then consular that they will not visit the doctor. She asked where the wife is and the husband answered that she is at home with her business. She also asked how much was paid and the husband answered. The consular also asked for the receipt but the husband answered that when the wife is coming to renew her visa,she will bring it along. My sister's husband doesn't want to miss this scholarship so he wants to apply again before the school resumes late this month. What can he do to be granted the visa? Should he apply with his family again for F1 and F2 visa? Any suggestions from the gurus and VO's in the house?will really cherish one right now. Also, i believe it's the wife that wants to be punished by the VO, is it possible for the husband to be be approved the F1 while the wife is denied for the F2? Please kindly reply. All suggestions are welcome.

A case of false misrepresentation. I hope you didn't use any public assistance? A way similar to naijatisumi's case, only that he hasn't seen the outcome of his F2 application. Talk to NIV on naiaraland. However, naijatisumi case could be 50/50 if he addresses his previous denials, his wife still on status and they didn't use public assistance during her maternity care.

How would I ever think an F2 application was denied 5 times for anyone? My question is how are you're sure the F2 is sure if the reason he was denied F1 5 times isn't properly addressed? Combine that with the fact that his wife had a baby in US after her F1 visa. He should explain the medical part (which can be a very big issue) and talk to the nairaland NIV who can address his case properly.

The black dude must be drunk or high on something. If she's legal and has address, she can pay your sevis for you anywhere in US. She should go to those small businesses doing western union and send money to international countries. Case: Closed

Second interview (27/12/2017)

Almost the same with the first, the only difference was that the same guy that did my biometric interviewed me and he was nice until he looked shocked at something he saw on his screen. He also asked if i was married and i said no, he later asked "what of traditional marriage"?, I said no. He then said he couldn't approve me at that time, I asked him to tell me why but he said he's not allowed to do that. I just said thank you and I left.

What's it with this part?

Not correct.

Most if not all work permits are given way ahead of any green card approval. Most work permits are valid for only a year pending on the type of petitions being filed. Once the green card is approved the work permit is useless because the green card(permanent residence card) supersedes the work permit card's authority to work anywhere.

You're absolutely correct. Not the other way round like Chapecoense said it. My work permit was only useful for 2 months before green card status kicks in.

You are right LagosismyHome. I think what he mixed up is what I quoted below. From work permit approval to GC interview invitation is usually around 30 days. And the interview will likely take place before the next 30 days. So when you tell people, they automatically think everything happens at the same time.

If I'm right you still waiting for fall 2019 to be a student. If I were you, I would focus on getting my student visa first before worrying about green card. That F1 visa is not so easy to get. Go to immhelp and uscis website if you want to know about legal ways of getting green card.
