Falani, a human rights lawyer, also described the move as illegal and unconstitutional.

According to him, Muhammadu Buhari’s administration “has just realised that the deployment of troops without the declaration of emergency rule in many states of the Federation is illegal and unconstitutional”.

He recalled that since 2015, President Buhari has imposed emergency rules in Borno, Yobe, Adamawa, Zamfara, Kaduna and the Katsina States by deploying members of the armed forces to assist the police in the restoration of law and order.

According to the senior lawyer, the President has adopted such extraordinary measures without seeking the approval of both chambers of the National Assembly.

“In other words, since the emergency rule imposed on the North East region by President Goodluck Jonathan expired by effluxion of time, President Buhari has not renewed or extended it,” he said via a statement on Wednesday.

“The National Assembly has not challenged the illegal emergency rule imposed without any declaration as stipulated by section 305 of the Constitution.

“Hence, the threat issued by the Attorney-General of the Federation is an attempt to return to constitutionalism with respect to the imposition of emergency rule in Anambra State and other states in the North-West, North-East and South-East regions where the Federal Government is waging a full-scale war against terrorists and the so-called gunmen.”

Falana insisted that nowhere in the Constitution has the President been vested with the power to remove the elected governor of a state and suspend democratic structures.

He explained that the governor of a state can only be removed by impeachment or resignation and not by imposition of emergency rule, adding that the tenure of legislators is four years in line with the provisions of the Constitution.

“Even though former President Olusegun Obasanjo removed two Governors via the imposition of emergency rule, the PDP-led Federal Government later jettisoned the illegal practice,” the lawyer maintained.

“Hence ex- Presidents Umaru Yar’adua and Goodluck Jonathan never used emergency rule to remove elected governors or suspend legislative houses and local government councils. Indeed, the Federal Government has since realised that it is unjust and immoral to remove a governor of a state since the president exclusively controls the armed forces, the police and other security agencies.

“To that extent, the Federal Government should drop the dangerous plan to remove the Governor of Anambra State and impose a Sole Administrator on the eve of the forthcoming gubernatorial election in the State.”

Declare ‘Golden Dawn’ Operation In Niger, Kaduna States Under Bandits, Terrorists – IPOB Tells Nigerian Army

According to IPOB, it is disgraceful that the military operatives leave Northern Nigeria that is being ravaged with terrorism and banditry.

The Indigenous People of Biafra (IPOB) has condemned the Nigerian Army for launching Operation Golden Dawn in the South-East region of the country.

The group alleged that the operation was another scheme of the military men to embark on a killing spree of residents of the region, similar to what was done with Python Dance in which many lives were lost in 2017.

According to IPOB, it is disgraceful that the military operatives leave Northern Nigeria that is being ravaged with terrorism and banditry, only to concentrate on the South-East and other southern regions.

In a statement by Emma Powerful and obtained by SaharaReporters on Wednesday, IPOB berated political leaders in the region for not speaking against the operation.

The statement partly read, “This operation is another round of secret genocide akin to the infamous Python Dance by the Nigerian Army. This is another ploy by the military to continue their reckless killing of Igbo youths just because we want to have our independence.

“We wonder why a special military operation would be launched in the South-East why the same military has looked away from Kaduna, Niger and other northern states which have become a slaughter ground by Fulani bandits and terrorists decimating Christian communities almost unchallenged.

“The level of insecurity in South-East which of course was created by the same Nigeria security agencies is a far cry to the state of near-anarchy in the northern region. Why is it during special military operations that the Fulani controlled federal government remembers South East but when it has to do with infrastructure and appointments they go North?

“Our message to the operatives deployed for this wicked special operation is to make sure they don't kill any innocent Biafran or IPOB member. If they know where the bandits were created to wreak havoc in the South-East, let them face them. But any day they touch innocent Biafrans in South-East, they will regret their action.

“They should be ashamed of themselves that even soldiers are being killed by Fulani bandits in the North but they are here declaring a special operation in a relatively peaceful region.

“We pity South-East politicians and the political elite who lack understanding of the times. They are only after their political interest in 2023.”

Arewa Youth Consultative Forum (AYCF) on Monday ordered the Northern governors to close any business premises or shop that complies with the Indigenous Peoples of Biafra’s (IPOB) sit-at-home order in the region.

He also decried the inaction of the South-East governors on IPOB’s sit-at-home order, saying “we hope they will continue with the sit-at-home for another 10 years.”

Shettima added that Northern youths would resist any attempt by the group to take its activities to the region.

Former Kano Governor Ibrahim Shekarau Monday supported power rotation to Southern Nigeria after the end of President Muhammadu Buhari’s tenure to foster Nigeria's unity.

“I have said it before (that) as far as the party I belong to is concerned – the APC, my proposal is that now that President Buhari is from the northern part of the country, he has done his eight years, let’s beam the searchlight to the southern part of Nigeria,” Mr Shekarau said on Channels TV’s Sunrise Daily.

“If you say ‘let the other part of Nigeria produce the leader,’ that does not mean you are throwing to the dogs the issue of competence, the issue of credibility, and so on.

“I subscribe to the view that we should be talking of the North and South, but where I disagree with the southern governors is coming together to gang up and say ‘It must be’; I think this is purely the party affairs,” he added.

The former governor’s push for a president from the south, comes days after northern governors rejected a power shift to the south, saying it is unconstitutional.

Southern governors had in July met and in a communique after their meeting said the next Nigerian president should emerge from the southern part of the country.

Governors from the Northern states on Monday, however, said the resolution of their southern counterparts on the zoning of the presidency in 2023 is unconstitutional.

According to the northern governors, the only requirement was for an aspiring president to “score the majority of votes; score at least 25% of the votes cast in 2/3 states of the federation. In the case of a run-up, a simple majority wins the election.”

Basil Ejidike, the APC chairman in Anambra, has promised to secure lives and property if the APC governorship candidate is elected.

He stated this in Awka, claiming that security is in its lowest ebb in Anambra.

The party chieftain also blamed the ruling All Progressives Grand Alliance (APGA) for insensitivity to the plight of people in the state.

He further alleged that political killings had resurfaced in Anambra and assured the public that APC would deploy all its arsenal to stop insecurity in the state if elected.

Mr Ejidike was speaking on the heels of the recent killing of Alex Edozieuno, a former traditional ruler of Mkpunando in Aguleri, Anambra East local government area of Anambra, and his driver, Chukwuemeka.

Edozieuno recently joined APC and since then, as a trusted party member and grassroots person, had promised to deliver the party in his area,” he said.

The Anambra APC chairman expressed disappointment that the late traditional leader was not allowed to rest since the Anambra government dethroned him.

“The man was still serving the suspension order of the government and was replaced by another person. APGA knows his political worth and was afraid of his actions since he joined APC,” added Mr Ejidike. “Our people can talk and talk, do all sorts of things. But as Igbo, we value the sanctity of life and regard human lives. “We have never seen this type of killing in Anambra. That is why we raised the alarm.”
