You are taking it the other way round.
It's the couple that has to get a good lawyer to help dem prove that they were not there for petty robbery or even kidnapping and then trying to quickly pose that they came for a Sex romp wen they got caught.... if doesn't drop the case they could go to jail.

It's like running after a lady naked and she charges u for attempted rape...and u said she has to prove that u actually wanted to rape her. Nobody cares about what's in your mind wheda u r just playing naked running around. It's evidence that is presented in court.

And the evidence here is "unauthorized persons were found in a house inhabited by pple". If it's a fully empty building, then it might be possible they could easily say they ddnt go there to rob but it's just one room that's vacant meaning there are other occupants with valuables and properties still staying in the other rooms
when you charge an offender for a particular crime, it is your duty to prove that the offender actually committed that crime and not the duty of the offender to prove that he did not commit the crime. This is in line with the presumption of innocence enshrined in the Constitution and asking the offender to first prove that he did not commit the crime will amount to a violation of that Constitutional provision. In law, the burden of proof in criminal cases is always on the prosecution to establish the ingredients of a particular offence, only when the burden is discharged by the prosecution can the burden then shift to the offender to disprove the case of the prosecution. You cannot take someone to court and expect the person to make out a case for himself, you will be the one to make out your case first and then the person can defend except where the person is counter claiming that is where he has to make out his own case on his counter claim

The owner could lie he kept something there the person came to steal
he won't still succeed because he is still required to prove that the intent of the couple was to commit a felony and from the facts above it only shows that their intent was to make love and not to commit crime. It is fine if he can go for trespass and leave the criminal aspect of it because the ingredients of the crime is not furnished

That's a three count charge if u don't know:

1)breaking and entring: if found guilty it's 2years imprisonment

2)attempted robbery(though not armed): 6 months in jail


3)Constituting nuisance and upsetting public peace(the public Sex part): 1month in jail or fine
it was in a vacant room and not even in the public place. The mensrea I think is missing

Is it that some people cannot just make one single comment without the word "the children of hate" or referring to a particular region be it any region with the intent to tribalise their comment? I think this is the most stupid and unguarded way to always express your opinion. It is immature and appalling at the same time.
