First of all each relationship is different so you guys are the ones that will sit down and look at things and make a decision whether you will go for K1 or CR1. But i prefer spousal visa than fiance visa. Like i said it is a personal thing. Secondly you have to be a A - student of usa immigrant process. All you need is right here on the internet. With Google you will learn alot about the process. Infact if you will spend some time to research about the process, timeframe, what to file and how to file those form, you won't need a lawyer to help you on anything. Then if you have questions on something that you aren't clear about people can help you with it. Nobody will start to spoon feed you on basic thing. We met through my Aunty who lives in usa. I never for once in my life desire to marry an American. No desperation while we dating. I wonder how people come online to ask question about their personal life or what they should do with their future. You're the one who can decide on what you want in life not counselors from social media. What do you want in life? What is your vision, purpose of living etc? These are ways you make a well thought decision about your future. Not everyone will japa. Some will succeed here in Nigeria. So decide and and stop disturbing people who does know your gender, family, background, education, religion etc with all these kind of question. Secondly i agree with your point that there are some attorney who can complicate issues for someone but there are still some who are expert in cases like this. Thry deal with immigration fraud matters and there are many on youtube. Better still the person involved can post the matter on visa journey. Getting a divorce paper that you never married in the first place is an issue itself. Once your husband get a response from uscis your lawyer will tell you what to do. They know now that you never married in the first place. |

JustwanJapa: Hello everyone, Its my first time here. My case is a bit complicated and I will appreciate your suggestions. I had a child out of wed luck in 2016. In 2019 I applied for a students visa. Scared that I will be denied for being single, I chose "Common Law Marriage" and added my boyfriend's name as a spouse (I know, Big Mistake). The visa got denied, we broke up, I forgot all about it. The child was not added on this application.
Fast forward 2020, I got married to an American Citizen here in Nigeria and he filed an I-130 for me. We went through the NVC process for myself as the wife of a USC and my child as the stepchild of a USC. Everything was approved and we were scheduled for an interview this month. When we got there, the officer was nice and friendly and I gave all my documents. She looked at it and then all of a sudden, sent me to another officer.
The new person I was sent to started asking me questions about my former spouse and that was when I remembered. (I know, so stupid) I said we were engaged to be married but it didn't work out. So he went inside and came out with the white paper stating that my application has been refused under 221g. The agent then told me to tell my husband to call Immigration in the US to get this resolved. My husband has called immigration but they said they haven't received any communication from Lagos regarding our case.
My question now is.
Is it possible to get this resolved? How long is this process of resolving this going to take? Should I just forget about this and relocate to another country and try to get to the US from there?
I'm just so confused, sad and depressed.
Thanks in advance for your tips. You really made a big mistake. It is called misrepresentation in US law. Did they tell you that they denied your visa or revoked it? What they will do is to send your application back to uscis. It usually take 6 to 12 months for them to send it back. Your husband will get mail in regards to it. Sorry about the whole issue. It is a long wait. Of course you guys can appeal but i will advice you guys to get immigration lawyer to help you resolve it. |

chrisaham: Goodday house For someone who had his wedding officially here in naija and the wife is back to the US, what category of visa can the wife file for him(fastest route), since it appears that the K-1 is for the unmarried that intends to get married... When it comes to immigration there is nothing like fastest. You need alot of patience. Your best option is to file CR1 that is immediate relative. A spouse of an American citizen. You guys need to do alot of research about how to file. It is easy but you just need to pay attention to details while filling the form. Some good resources you can use are youtube, Google, visajourneydotcom, also join facebook group on usa CR1/IR1 immigrant. This thread is for fiance visa so you won't get much info here. Good luck |

Jasonb23: Hi guys, my fiancée was supposed to have a interview today after we rescheduled the original one in the CGI portal, she then went to the embassy this morning and was told that her name wasn't on the list of people who were having their interviews today meaning that the embassy stuck with the first interview date which has already passed. 10. Let me see Tax return document .... Ohhh i dont think you have it, go get it and upload it, , and also submit it with your passport at Dhl office, by doing so i will close your case. NB: Guys, i left the premises with smiles cos i knew my Visa iss already here, waited for my wife to wake so that she can send the correct Tax return. Perhaps, i went to dhl office to submit the tax docs and my passport that same day, in 2 days time my status started showing AP, in less than 12hrs, it shhowed Visa issued, in less than 2 hrs, i recieved email that my passport is ready for Pickup at Dhl office. That's it guys. Let God take all the glory, after a long wait and delays, the outcome was successful and cheering😊.
You can ask questions if you want, i will also give some hints with regards to pattern fquestions the COs were asking different applicants. Make sure you frontload your file with enough evidence to prove your marriage is real. Pls, mind how you tell the CO that you met your spouse via faceboook or social media, they twnd to drill the applicant with cocky questions , just be mindful on how you answer your questions, it will either make your interview short and brief or tedious and lengthy.
