Penaldo: Yesterday, the Abubakar Bukola Saraki Foundation launched its annual Agricultural Inputs Empowerment Project. This initiative aims to support low-income farmers in Nigeria by providing essential resources such as fertilizers and herbicides. In today’s challenging economic climate, these inputs are crucial for boosting productivity and securing better harvests. With over 986 farmers directly benefiting and an estimated 2,500 more indirectly impacted, this project has a significant reach. Six years after leaving public office, Bukola Saraki continues to improve the lives of everyday Nigerians. https://www.facebook.com/share/v/BLz7kYbX79piS6xG/?mibextid=oFDknk This is wickedness abeg! Difrent: Exactly You used the word "illegal arrest"And I'm telling you the arrest is no illegal. It was a legal process because someone petitioned the police and they are bound to act. If you still don't get it ,no need continuing this back and forth Kobojunkieee: 1. Section 32(2) of the Nigerians Police Act 2020 & Section 8(2)of the Administration of Criminal Justice Act 2015 clearly states that a person shall not be arrested merely for a civil wrong or a breach of contract. So, if you have a problem with a particular person whom you feel has defamed, you can take it to court where it can be decided. Kobojunkieee: And I believe I corrected you several saying that even in such cases, defamation is handled and proven in court, not first with police arrests. Read through Section 373 - Section 381 do not prescribe police arrests before the court is engaged in those cases.
Police arrests can only occur according to that stipulated in Section 35(1) of the Nigerian Constitution, Section 38(1) of the Nigerians Police Act 2020 & Section 18(1) of the Administration of Criminal Justice Act. Any arrest made outside of that is illegal or even kidnapping. |

BuzChi: ↪This is the gospel truth that I am surprised most Nigerians don't understand. How can a fellow citizen rejoice when a journalist is being intimidated, especially when it's an illegal arrest. Go read on free press, and what a democratic government is all about. If only every Nigerian know their rights and take it by force, the politicians will all be afraid and wary on discharging their duties to the country. The vast majority of Nigerians have only gotten their version of civic education from the lies and propaganda of their politicians and their paid cohorts. Most aware not aware of their rights and so feel that they exist as servants to those politicians who steal from them, kill them off, and destroy the future for them and their generations. |

They do have family members, of course, and they also have the right to sue if they feel they have been defamed. That's what the courts are there for. The court is not there to take away the rights of any Citizen. The Constitution, the Supreme Law of the land, supercedes your courts and so your courts cannot do what it is you all seem to desire which is to strip those you love to hate of their rights. It cannot be allowed and should not. |
Politics › Re: Obi Decries The Abuse Of Freedom Of Speech In Nigeria By Security Operatives by Kobojunkieee: 5:03pm On Aug 28, 2024 |
Timmi: ■Below is my original post, and now where did I mentioned that the right to protest be denied. What I said is clear, every citizen have an inalienable right entrenched in the constitution, one is the right to associate and to protest. I said though you have that right but your right to protest doesn’t give you the right to trample on other people’s right. Your right stops where my right is infringed upon. In Florida, you could be shot and killed by protesting on my personal property and the laws is in support of such. Original post: Timmi: ■ PandoraObi, yes fundamental rights is entrenched in the constitution but the right of others are also protected. Your fundamental right to freedom of speech does not entitle you to defame other citizens. Defamation of character either in words (written or spoken) is also protected in the same constitution. ■ Your so-called investigative journalist is nothing but envelope collecting roadside pseudo writers that is available for hire and to the highest bidder, be it foreign or internal agent/agency. To say the least, these so called journalist are agents of propaganda and lies and they can sell their mother for a cup of coffee/tea. And below was my direct response to that initial post of yours which came in at the beginning of this conversation. Kobojunkieee: 1. Defamation is a civil wrong, and not a criminal wrong, and hence does not warrant an arrest without first appearing in court at least - Section 32(2) of the Nigerian Police Act 2020 & sections 35(1) of the Nigerian Constitution. PIDOM's rights were violated when he was arrested.
2. Nothing wrong with being an envelope-collecting roadside pseudo-writer. There is no crime against being just that. Section 32(1) of the Nigerian Police Act 2020 insists that an allegation or charge of committing an offense has to be established by an Act of the National Assembly or under any other Law before the person can be arrested, investigated, and tried or dealt with according to the provisions of the Nigerian Police Act 2020. The Police cannot make up crimes of their own design to charge, investigate, try, or deal with a person for. They are to instead follow the Law. You also have no power to make up ideas of crime as you go. Now, this is your other comment about the denying of protestors their right that I posted the last couple of posts to. Timmi: ■ Mr man, I have been in the USA probably longer than you have. Have you ever seen or heard where protesters block roads and burn tire on the roads because others to join in their cause? NO ■ Civil liberties or labor unions protest but it’s always local protest, such as in front of a store, carrying placards while marching through the street (on a side walk), without disturbing others. ■ The latest case is the march to the Capitol instigated by Trump. The protesters were prosecuted and some jailed for destruction of public properties and for attacking the security personnel. ■ Their right to protest doesn’t confer on them the right to loot and destruction of properties nor intentionally attacking people to cause harm. ■ At least, you witnessed the above as you claimed to be in the USA. Your right - freedom of speech, freedom of association doesn’t confer on you the right to step on my property and damage it. In Florida, where I lived, you have a right to shoot (with a gun) anyone that trespasses on your property. |

I have said this many times, no European country will send its citizen to a country with very bad human rights record such as Nigeria. It is never done If the Nigerian government has any evidence against Simon Ekpa, foward it to the Finnish authorities and he will be prosecuted in Finland... But if you are hoping that Finland will send him to Nigeria, forget it I don't think it is because of lack of evidence per say! Rather, I believe that it is the reputation of the Nigerian government, particularly that of the APC administration of the last 9 years, that would keep a country like Finland avoiding any direct engagement. |

NLCreator666: ■ A group of fanatical lawyers known as Asiwaju Lawyers has threatened to sue bandits if they don't take down a TikTok video they made in the forest mocking Tinubu and tender an unreserved apology to the president within 48 hours. "Bandits, ronu o!" yelled Chief Obafemi, the lead counsel for the self-proclaimed Asiwaju Lawyers. "We give you 48 hours to take down that derogatory, defamatory, and disgusting video you shared on TikTok against our Asiwaju, or else we’ll sue you for… (pauses dramatically) defamation!" "But Chief," Junior Counsel Ayodele interrupted timidly, "how do we sue bandits? We don’t even know who they are! And how do we serve legal papers to them? Do we send a bailiff into the forest or simply tag them on TikTok?" Obafemi grinned. "That’s the beauty of it! We’ll sue them as John Doe. If they don’t show up in court, we win by default!" The room exploded in applause over the sheer brilliance of Chief Obafemi. While the applause was ongoing, senior attorney Funmi came up with a brilliant idea: "Sir, let’s also insist they add 'Long Live the President!' at the end of the apology, in five different languages—Yoruba, Hausa, Igbo, English, and Latin—just to be thorough." "And Arabic, too," Counsel Toby added. "And if they fail to comply, we shall drag them to court! Not just any court, mind you, but the Supreme Court! We'll sue them for defamation, for incitement, for disturbing the peace... and for bad dancing!" Again, the room erupted in applause. "That’s a brilliant idea," Chief Obafemi hailed Funmi and Toby. "We could also launch a counter-video showing the president's achievements," Toby suggested. "But the President doesn't have any achievements yet," Chief Obafemi interrupted. "Let's focus on the lawsuit and leave the achievements to the media aides." Video abi na audio 😂😂😂😂😂😂😂 Na skit? 🤣🤣🤣🤣 |

I don't have more time to waste on such debate because, the world over, freedom of speech does not grant anyone the liberty to malign or make libelous claims without consequences. ■ The journalists in this case, have you or anyone presented evidence they were simply arrested and kept in detention without any recourse to the court? ■ They may have been initially arrested without a court's permission (which is also allowed the police based on their standard operational mode), but they must have also obtained a court's permission to keep them in detention. 1. I never said there were no consequences. I said freedom of speech is entrenched as your right in the Nigerian Constitution as well as the UN Universal Declaration of Human Rights which Nigerian happens to be a signatory to. 2. Have you presented any evidence to show otherwise? 3. Wrong! The policeman can only carry out an arrest without a warrant only under certain conditions. If those conditions are not first met, then you might as well have been kidnapped by the police which is what people have reported said has happened in numerous cases. Police arrests are to be carried out in compliance with Section 35(1) of the Nigerian Constitution, Section 38(1) of the Nigerians Police Act 2020 & Section 18(1) of the Administration of Criminal Justice Act .
