That would be your London in Bayelsa/Delta State, Nigeria. You think everyone is a dunce you can bamboozle? Do you even think before you spew these lies?

The Kogi state police just handed the appellants the court case. Nobody has to tell anyone what they are doing in Abuja or anybody in the Nigerian state for that matter. This is a carryover of the police-state mentality that years of jackboot military rule has forged into your skull.


What the police needs ensure, if they have a reason to conduct a search at all, is that nothing dangerous goes into the city. If anything dangerous turns up then questioning may begin on that basis. But you cannot stop someone for no reason, conduct a search for no reason and find nothing incriminating, and then still keep questioning them. Do you see how that looks now?

Here is a poser for you: What if they answer any of the following: wedding/funeral/toilet/watch TV/court. . .? What then? The police has a checklist of things people can do in Abuja now?

What is wrong with you people? You expect someone going to Abuja for a negative thing to tell you - because you asked?

Please point to the part of Nigerian law that sanction this new addition to the "fascist" rules you guys are building up daily. Tick tock tick tock. . .

The police are well within their rights and duties to ask you where you are going and what for and if your answer is not satisfactory, to lock you away from sunlight. cool

The aluta's will find that their case will be quite easily thrown out. The police owe the citizens a duty of security and nobody is above the law. They were commanded to turn around for security reasons (which they did), but chose to return and eyeball the police after being negatively energised by a phone call to the lawless Aregbesola. Of course, they were summarily locked away.

The Central Bank of Nigeria (CBN), the Power Holding Company of Nigeria (PHCN) and some Federal Government agencies have abandoned over 500 containers at the Lagos ports. Some of them arrived the country as far back as 2006.

Investigation conducted by The Nation revealed that PHCN may have abandoned not fewer than 250 container loads of energy equipment imported to boost power generation in the country.

A senior Customs official, who crave anonymity, said 140 of the containers were abandoned at the Ports and Cargo Terminal, Tin Can port, Lagos, while the remaining 110 containers have been moved to Ikorodu Custom’s port to rot away as over time cargo, having stayed for over three years without any PHCN official coming forward to clear them.

Investigation also revealed that the Federal Ministry of Agriculture abandoned 59 containers loads of items meant for the development of the agricultural sector by the Federal Government, while the CBN, which came third on the list, abandoned 25 containers at the port.

Also, the Delta Steel Mills has six abandoned containers, Ministry of Power and Steel - 15 containers, while the Ministry of Works has10 containers. Others belong to some state governments.

Confirming these developments, the Comptroller-General of Customs, Alhaji Dikko Abdullahi, warned government agencies to desist from abandoning containers at the port. He said not only had such recklessness been affecting the operations of Customs, but was also causing congestion at the ports

The Comptroller-General said he was not happy when he visited Ikorodu and discovered that 28 containers belonging to the PHCN were abandoned at the Lighter Terminal. The Terminal serves as the government warehouse for safe keeping overtime containers transferred from the various Lagos ports.

“Some of the containers were transferred to the Ikorodu terminal since 2006. The last sets of containers were brought to the terminal during the Port decongestion exercise in 2009. How can we rationalise spending tax payers’ money to import these containers, only to abandon them?” he said.

The Comptroller-General asid Customs has obliged PHCN’s request to clear the containers from the Overtime Cargo list, stating that 104 containers have been so cleared from the terminal in the last three months.

Twenty-three members and leaders of the Action Congress of Nigeria (ACN) have sued the Inspector-General of Police, Hafiz Ringim at the Federal High Court, Lokoja, for N15 billion for allegedly preventing them from entering the Federal Capital Territory (FCT), Abuja.

They said the restriction of their freedom of movement on September 21 and on October 25 and 26 this year is unconstitutional, illegal, and null and void.

According to them, it is a violation of their rights as guaranteed by Section 41 of the 1999 Constitution (as amended) and Article 12 (1) of the African Charter on Human and Peoples’ Rights.

They filed two suits through their counsel, Kunle Adegoke of M. A. Banire & Associates. Ringim is the respondent in both.

The first has the following applicants: Hon. Rasaq Oyesegun Folami, Omotosho Oluwaseyi, Olanrewaju Savage, Kolapo Olatunji, Theophilus Femi Kolawole, Olawale Aina and Hakeem Subair.

Others are Babajide Alli-Balogun, Yakub Akilagun and Lukman Subair, Omoniyi Olayemi, Hon. Babatunde Abodunrin, Hon. Ayo Adesanya, Segun Desalu, Hon. Babatunde Lawson, Azuka Igbue and Lawal Yusuf.

They are asking for a N10 billion compensation from Ringim.

The second suit has Prince Benson Adekunle, Jimoh Olatunde Olayemi, Prince Akin Omolaoye, Ayo Laloye, Oyedeji Abayomi and Rabiu Yekeen as applicants.

They prayed for N5billion compensation from the respondent

The applicants sought a declaration that the act of police, led by Ringim in holding them hostage for hours under harsh weather conditions without any lawful or justified basis is unconstitutional, and, therefore, illegal.

They asked the court to hold that police officers restricting their freedom of movement and preventing them from entering the FCT on account of their membership of the ACN is in gross violation of their right to freedom from discrimination.

The applicants prayed the court for an order restraining Ringim, whether by himself, servants, agents and/or persons acting for or on his behalf from further tampering with, violating or otherwise infringing their rights.

The N10 billion compensation, they said, is for the alleged gross violation of their rights to freedom of movement, right to dignity of human persons and right to freedom from discrimination.

Besides, they argue that there is no provision in the Constitution or any law enacted by the National Assembly restricting their rights to enter or exit the FCT, Abuja or any other part of the federation.

The first group was turned back on their way to Abuja to witness the Code of Conduct Bureau arraignment proceedings of their leader Asiwaju Bola Ahmed Tinubu, while the second group was on their way to attend a meeting at the party’s national secretariat, Abuja.

In an affidavit in support of the fundamental rights enforcement application, Kolawole said the police officers who stopped them claimed that Ringim gave the order.

“As we displayed the ACN banner on our buses, the officials of the respondent were able to identify us and frustrate all efforts to proceed further on our journey and/or enter the FCT.

“All the applicants, numerous ACN members and I were kept by the officials of the respondent under harsh weather conditions, mosquito bites and constant threat of being shot at throughout the night until the following morning.”At about 7.00 am on Wednesday, the 21st day of September, 2011, the policemen ordered us back onto the road, commanded us to enter our various vehicles and with an escort in front and another at the back of our convoy, we were led out of Lokoja back to Okene in Kogi State and told to go back to Lagos and never to attempt to return to Abuja again.”

In an affidavit in support of the second application, Olayemi, a member of the Osun State ACN Executive Council, said the police officers insisted they must return to Osun State as they had Ringim’s instruction not to let ACN members enter Abuja.

“We were kept in the bush and we all had to pass the night there at the mercy of mosquitoes,” he said.

The applicants urged the court to determine whether their prevention from entering Abuja is in any way lawful and justifiable in any democratic society, and whether Ringim should be excluded from liability.

The suits, filed on October 28, are yet to be heard.

Aganga is a problem. He's not a Lagosian, and he's been hobnobbing with the enemy - Bola Tinubu and Oba Akiolu before and after his confirmation. His not being from Lagos has created serious loyalty problems for PDP in Lagos State, How can PDP claim to be trying to help Lagos when they can just blatantly disobey constitutional provisions requiring each minister to be an indigene of the state he represents on the FEC: S147(3), and then appoint an Aganga who not only was not born in Lagos, did not grow up in Lagos and did not even school or work in Lagos for ONE DAYhuhhuh??

It is fraud, and indigenous Lagosians hate the President for it. Trust me, these things run deep amongst Yorubas. We may be quiet, but we NEVER forget.

And you believe that? That he actually said those things to somebody that would expose him. Nigerians can give a dog a bad name, just so they could "deal" with it.

What I heard was that he said "the election will be in Bayelsa and not Abuja" or something like that. Obviously, setting himself up for confrontation with GEJ. I guess they just showed him who is in power in Bayelsa as well.

Tinubu is the one overstepping constitutional bounds because "PDP" is in powerhuhhuh - 16 years and nothing to show.

When at the end of 4 years we are still stuck at 4,000MW we'll all be here. Let them remove the subsidy - Nigerian's will hurt no doubt, but at the end we know who will lose.
Keep turning blind eyes to police excesses, while protecting massive looters of all colors and shape. That is also Tinubu's fault, I see.

Honest results do not come out of dishonest intentions - that is the law of the universe.

If this sounds like an hyperbole, just consider the recurring pattern, starting with the Justice Ayo Salami rumpus with the former Chief Justice of Nigeria (CJN), Justice Aloysious Katsina-Alu and the National Judicial Council (NJC), the contention over the Sovereign Wealth Fund (SWF), the raid on The Nation and arrest of journalists and other workers, the proposed seven-year presidential tenure with a sop of renewable terms for the legislature and, of course, the latest showdown between state commissioners of finance and the Federal Government over the reported N1.3 trillion "subsidy" withdrawal from the Federation Account – announced not as a proposal at the monthly financial forum but as a fait accompli, thus leading the commissioners to boycott the session in protest. 

In all of these, of course, particularly on issues of wrongful arrests and civil liberty, the Police loom large: not as a foremost constitutional civil security organ of state but as a threatening machine to harass, intimidate and eventually crush defenceless but lawful citizens.  If that is not the earliest manifestation of fascism, we wonder what is!

You guys like jumping the gun. Nobody has yet to call for GEJ to resign his own fraudulent election. Like all reasonable people, the LAISEC chair has asked aggrieved parties to go to court.

"Arrest","Treason","Jailed", "Clear evidence of his guilt" from watching a 5-minute video. If only that is how u certify elections? There is usually more than meets the eyes. So hold your horses and let the court speak first.

No wonder the PDP people are calling for Justice Adeyinka's arrest! His action in declaring that ACN won Badagry is the same as treason, trying to take over part of Nigeria by means other than that prescribed by the constitution under S1(2).

I support the call. Adeyinka should be arrested, tried and jailed. At least this is clear evidence of his guilt in this matter!

The high stakes game to remove the current governor of Bayelsa state, Timipre Sylva,  from the line up of People's Democratic Party (PDP) candidates for the upcoming governorship election in the state appears to have taken hold.  A few minutes ago the  Gubernatorial Screening Appeal Committee of the PDP in  Bayelsa State released the names of three candidates approved as gubernatorial aspirants for the upcoming governorship elections in the state. The name of Timipre Sylva was excluded by the committee.

However, the committee cleared Youpele Kalango, Christopher Enai and Henry Seriake Dickson as eligible candidates.

A statement jointly signed by the former deputy governor of Ekiti state,  Mrs Abiodun Olujimi and  Alhaji Abba Anas Adamu stated that  only the three candidates are eligible to contest the governorship elections in the state, leaving out Timipre Sylvia who was reportedly removed for operating foreign accounts and Silverbird TV owner , Ben Bruce, who the panel claimed had dual citizenship.

The president must reverse a string of impunity ominous for this democracy

here is a pattern of arbitrariness by the government of President Goodluck Jonathan that should worry any democratic-minded person.  But the question is: is that arbitrary pattern part of a presidential learning curve?  Or is it indeed shifty but artful foundation of putative fascism? 

This poser is necessary because President Jonathan galloped into the presidency as a rule-of-law dove sworn to giving arbitrary trampling on citizens’ rights a wide berth.  Yet the reality, five months down the line from his May 29 inauguration, would appear the direct opposite: a putative dictatorial hawk sworn to hitting at civil liberties where it is most lethal; and dealing extensive damage to check-and-balance institutions of state.

If this sounds like an hyperbole, just consider the recurring pattern, starting with the Justice Ayo Salami rumpus with the former Chief Justice of Nigeria (CJN), Justice Aloysious Katsina-Alu and the National Judicial Council (NJC), the contention over the Sovereign Wealth Fund (SWF), the raid on The Nation and arrest of journalists and other workers, the proposed seven-year presidential tenure with a sop of renewable terms for the legislature and, of course, the latest showdown between state commissioners of finance and the Federal Government over the reported N1.3 trillion "subsidy" withdrawal from the Federation Account – announced not as a proposal at the monthly financial forum but as a fait accompli, thus leading the commissioners to boycott the session in protest. 

In all of these, of course, particularly on issues of wrongful arrests and civil liberty, the Police loom large: not as a foremost constitutional civil security organ of state but as a threatening machine to harass, intimidate and eventually crush defenceless but lawful citizens.  If that is not the earliest manifestation of fascism, we wonder what is!

The Ayo Salami-Aloysius Katsina-Alu imbroglio is still very fresh.  As a fallout of the judicial losses of the ruling People’s Democratic Party (PDP) in the rigged 2007 elections in Edo, Ondo, Ekiti and Osun states, powerful lobbies in the party decided to make a scapegoat of Justice Salami, the president of the Court of Appeal (PCA).  After a long-drawn investigation which was built against the jurist, the Katsina-Alu faction of the NJC, in a scene reminiscent of the "simple minority" illegality of the Olusegun Obasanjo presidential years, purportedly suspended the PCA from office and recommended that he be compulsorily retired. 

That the allegations against Salami remained fuzzy, moving from "perjury" to allegedly making judicial internal disputes a media affair, was bad enough. Worse was the deliberate evasion of court service by a faction of the NJC, sworn to its premeditated action of willy-nilly giving Justice Salami the boot.  

But despite the brazen show of lawlessness, the Jonathan Presidency played along to appoint an "acting PCA", when it knows you cannot constitutionally remove the PCA without recourse to the Senate.  By this conspiracy, the Jonathan Presidency has not only trampled on the rights of Citizen Jurist Salami, it has also sent partisan warning to the judiciary to think twice before ruling against the federal ruling party, particularly in electoral disputes.  Such conduct could be fatal for democracy, for it is a lethal blow to judicial independence.

Then the SWF issue which, strictly, falls under the purview of federalism.  The Federal Government has come to the decision to "save for the rainy day", which is hardly a crime.  But what is clearly a federal constitutional crime is trying to muscle the 36 states to do its bidding, when the Federal Government could simply save its share of the Federation Revenue and leave the states to decide what to do with their share; or try to reach a consensus on the matter. 

But even as arguments raged back and forth, and even with a subsisting legal challenge to the status of "Excess Crude Account" which was to morph into SWF, the Federal Government unilaterally withdrew US $ 1 billion to kick-start the SWF, hoping that emotional blackmail would trump the states’ legal right to do decide what to do with their legitimate share of the federation revenue.  However the courts decide the case, the motive of the Jonathan Presidency would appear clear: to muscle everyone to willy-nilly do its bidding.  That is bad for democracy and due process.  It is even worse for the federal principle, the military era brazen violation of which has led to the present economic destitution.

The headmaster syndrome to stream-roll the states, as if the Federal Government were some irate head teacher and the states errant pupils, was also at play with the take-it-or-leave-it announcement that the federal authorities had netted N1.3 trillion "subsidy" from the pool of distributable federal revenue.  That behaviour not only lacks tact, it offends the federal principle, which doctrine provides the legal platform on which the Federal Republic is erected.  It is a big blow indeed, to institution deepening in federal-state relations.

The assault on journalists, typified by the raid on this newspaper and arrest and harassment of some of its top editors has been an all-time low battery of civil liberties, since the advent of the Fourth Republic 12 years ago.  Even with its imperial huffing and puffing, not even President Olusegun Obasanjo was that gung-ho in desecrating the Fourth Estate, though the Obasanjo Presidency also had some brushes with AIT and Channels Television, over some news coverage.  What however made the latest raid objectionable was the abuse of state machine to pursue the personal interest of Obasanjo over the authorship of a controversial letter.

And twice in two months of September and October, the Jonathan Presidency has used the Police to obstruct the legal movement of citizens, both times bound for Abuja but turned back at Lokoja, Kogi State.  The latest outrage, after the initial one, was particularly galling: people travelling in an Osun State Government bus were turned back in a clear illegal move to prevent them from reaching Abuja.

Let everyone decry the use of the Police as an oppressive partisan tool.  It could well be the opening chapter of a putative police state, announcing a fascist order.  President Jonathan must play by the legal books.  He must retrace these arbitrary steps and embrace legal order and due process. We know he can.

On a serious note, Nigerians abroad need to be prepared for the longterm fallout of that stupid underwear bomber.

Since that fateful day in Dec. Nigerians became a target of focused investigation. This report is simply an outcome of that beam of light into where Nigerians are and what they are doing in the west. Though you are making an important point, your premise is kind of a bit lopsided. It assumes that somebody rigged in favor of ACN in this election. Given their activities here on NL, PDP was the one seeking all means to rig in Lagos. Several months ago, some people began to claim that ACN was finished in Lagos. They started inflating their population in Lagos like they did before the elections in the north - every state where PDP was facing a tough battle was 40% made up of these people. I think their claims to the population of Lagos was even higher this time. Lagos had a terrible flood (which has being ravaging the world in recent times) but rather than bring Federal resources to the people's aid, PDP's first call was for Fashola to resign. It was all in preparation for stealing Lagos.

Why was Obanikoro who is supposed to be at his post in Ghana roaming Lagos under SSS & Federally-controlled police protection? Although his son was the contestant, it was Obanikoro that was talking with authority, as if he was the LASIEC chair, about results being already on the table.

I dey laugh oooo, when Justice Uwais Panel reccommended that the INEC Chairman should not be appointed by the President who is loyal to a political party that will participate in election, PDP and GEJ rejected the golden reccommendation and appointed Jega. The same law Jonathan used to appoint Jega is the same law Fashola, Tinubu and ACN used to appoint LASIEC that rigged election for them. Yoruba adage says "Ida ahun ni a fii ma npa ahun", that is, tortoise weapon shall be used to kill the same tortoise. I think Tinubu used the LG Election magomago to tell PDP that no political party has the monopoly of rigging.
Maybe with this, PDP will learn lesson and allow Uwais Report to scale through.

However, the police on the other hand, are on the lookout for any rowdy looking groups entering the capital in view of the recent boko haram bombings.

The police have the power to arrest anybody from any party or interest group that look like they are a security risk.

The 29 members of Osun State Action Congress of Nigeria (ACN) prevented by the police in Kogi from traveling to Abuja have demanded an apology from the police.

They vowed to take the police to court. If after 24 hours the police authority fails to apologise without reservation.

Narrating their ordeal yesterday at a news conference in Lokoja, their leader, Chief Ishola Oyewunmi said the police failed to tell them why they were stopped in Lokoja from their legitimate journey to Abuja.

According to the leader, other contingents from other states were seen passing the same route to Abuja for the same meeting, “We don’t know why they stopped us.

“We were stopped on Tuesday night and they asked us to sleep in the bush as we could not go back to Osogbo that night. On Wednesday morning, the state police commissioner ordered his men to escort us outside Kogi state.

“We were on our way to Osogbo when our governor called that we should turn back to Abuja as there was no law stopping movement to Abuja.

As we returned, the same policemen stopped us at the same spot asking us to wait for a order before we could move.

A delay that lasted for over three hours led to the collapse of one of the arrested ACN member who has been complaining of ill-health.

He said: “The questions here are: is Kogi police declaring us a security threat? Is the police saying Osun ACN cannot travel to Abuja. And when has it become a law that someone must explain his mission to Abuja before he is allowed into the FCT?,” he asked.

The ACN leaders in thier Coaster bus marked Osun OSGH 192 was intercepted along Jamata Murtala Muhammed Bridge at about 6 41pm on Tuesday by the police.

He said despite explanation that they were travelling to Abuja for a meeting, the Kogi police command refused to release them as they were asked to go back to Osun.

They therefore called on the police commissioner to tender an unreserved apology within 24 hours, failing which they threatened to drag the police authority to court for unlawful detention and harassment.

Also reacting, the governorship candidate of the ACN in Kogi, Prince Abubakar Audu described the incident as embarrassing and a failure on the part of the nation’s security.

Prince Audu who spoke through his campaign director David Dare urged security operatives to be more concern about the security of lives and properties across the country and to refrain from using the opposition party to cover their inadequacies.

The Osun State Government yesterday accused the state chapter of the Peoples Democratic Party (PDP) of merely playing to the gallery with its apology to Vice President Namadi Sambo over the legitimate complaint lodged by Governor Rauf Aregbesola against the violation of the rights of leaders of the Action Congress of Nigeria (ACN) in Kogi State by officers of the Nigeria Police Force.

In a statement signed by the Director, Bureau of Communications and Strategy in the office of the Governor, Mr. Semiu Okanlawon, the police also came under fire as the government said it was a shame that while the Kogi State Police Command was making itself available as a tool to intimidate the opposition, armed robbers had taken over the state, robbing innocent Nigerians and setting criminals under trial free.
The statement noted, “Characteristic of their stock in trade, the Osun State PDP has demonstrated that they are the instigators and beneficiaries of the recent unlawful and condemnable arrest, detention and illegal deportation of ACN leaders from Kogi State to another part of the country by a police commissioner.

“The act, which the Osun PDP has attempted to gloss over, to say the least, was despicable and undemocratic as it threatens the basis of the constitutionally guaranteed basic rights of citizens to freely visit any part of Nigeria without encumbrances or any restraints whatsoever as long as they are not found violating any law of the land.

“There was no better opportunity for Governor Aregbesola to register his displeasure than the commissioning of the Federal High Court building by Vice-President Namadi Sambo in Osogbo on Thursday.

“Of what value was the commissioning of court rooms when the rights of citizens were becoming the objects of sham political aggrandisement by the ruling clique? It has since become clear that the fire which burnt across the river in Kogi has the backing of charlatans in the ruling party who misuse the police to curtail citizens’ rights for cheap political point.”

Describing the role of the police in the whole crisis as despicable, the statement added that while policemen in Kogi State were busy hounding opposition elements passing through Kogi, armed robbers were let loose as they stormed a court in Ihima in the Okehi Local Government Area of the state, killing a warder and setting one of their own who is under trial free from the court.

The statement added, “How else do we explain the arrest and deportation of a group of people who were merely passing through a state and had to be subjected to such harrowing experience while in the same state, policemen failed woefully in their constitutional duty of protecting the citizens by allowing armed gangs to have a field day terrorising the people and killing innocent souls?”

It, therefore, sympathised with the PDP “for being unable to come to terms with the new political realities in the entire nation.”
