The recent and unintelligible rants by the Peoples Democratic Party @OfficialPDPNig is not unconnected to the impending mass defections set to hit the failed opposition party. The management of the Federal High Court (FHC) has scheduled Monday for “sample collection for COVID-19 testing.” In a circular on Friday in Abuja, staff were informed the sample collection is planned to take place within the court premises. A Senior Medical Officer 1, Dr. Adaora Keazor, who signed the circular for the court’s Chief Registrar, said the FHC was working with the Department of Public Health on the exercise. The announcement comes almost a week after the court’s Chief Judge, Justice John Tsoho announced his decision to self-isolate and directed some key staff in his office to do same following a confirmed case of COVID -19 among his official aides. The suspended chairman of the Economic and Financial Crimes Commission, Ibrahim Magu has challenged the Attorney-General of the Federation and minister of Justice Abubakar Abubakar Malami to present evidence to allegations that he fraudulently enriched himself and also collected bribes to shield suspects from prosecution. Magu stated this in a response to a query by the presidential probe panel investigating allegations of corruption and official misconduct made against him by the AGF. The former Nigeria anti corruption chief was alleged to have diverted billions of naira from recovered funds, as well as the interests accruing from the funds but in response denied “vehemently and unequivocally” that suspects sought ways to bribe him or other EFCC investigators as alleged by the AGF. Magu said the claim by the AGF that he received several petitions alleging he is abusing his office and has been enriching himself, “is not surprising as he is bound to step on toes in the discharge of his duties and some of those he has charged for corruption or who are being investigated for same are bound to fight back”. The former acting chairman of the Economic and Financial Crimes Commission also claimed that the audit of the EFCC account fell short of the accepted standard. He added that a committee set up by Malami to look into the books of the anti-graft commission did not uphold the principle of fair hearing enshrined in the Nigerian Constitution as he was never invited to defend himself before the committee made its findings public. Ibrahim Magu is currently facing the presidential probe panel set up by President Muhammadu Buhari to investigate allegations of insubordination misconduct and diversion of recovered loot brought against him by the AGF. He was released from detention on the 15th of July 2020 after spending almost 10 days in police custody. |

ISMA’ILA ISA: SOWORE HAS NOTHING TO GAIN BY ATTACKING A DEAD SOUL. Let’s get the facts straight on the meeting with Sowore in SSS detention. First, it is important to state that the meeting was not instructed by the government. Nobody sent anybody to go and “negotiate” Sowore’s freedom as he put it. The late Malam Isma’ila, on his own called me to ask that I broker a meeting with him and two others with the SSS, which they agreed to. It is important that I state that it was the force of Malam Isma’ila’s argument that made the meeting possible. Vanguard Newspapers publisher, Sam Amuka and ThisDay Publisher and President, Nigerian Press Organisation, Nduka Obaigbena, all agreed that Sowore was a “rascal”, who had used his newspaper “to abuse all of us,” but agreed, nonetheless to go and press for his release. As the late Isma’ila put it, although he (Sowore) got into his problems due politics, not journalism the fact of him being a publisher imposed a duty on the media leaders to seek ways of making free. The meeting ended well, and contrary to the posturing by Sowore, he said he was happy with a resolution proposed but that his lawyer, whoever that was, needed to come on board. The fence mending process, apparently collapsed after the meeting of the trio with the lawyer in Lagos. I don’t know what Sowore wants to achieve by distorting the facts of what transpired, but my advice to him is that he should stop his attacks on a dead, well-meaning intercessor. Knowing the way the secret service works, it should surprise no one if they keep a recording of that meeting. Socio-Economic Rights and Accountability Project (SERAP) has sent an open letter to President Muhammadu Buhari urging him to “use his leadership position to urgently set up a presidential investigative panel to probe grave corruption allegations in the Niger Delta Development Commission (NDDC), including allegations that the agency illegally spent N81.5 billion, on travels, ‘condolences’, consultancy and ‘public communication between January and July 2020.” The organization also asked him to “immediately suspend Mr Godswill Akpabio, the Minister of Niger Delta Affairs and all those implicated in the allegations pending the outcome of any such investigation. Witnesses and whistle-blowers must be protected and the findings of the investigation should be made public. Where there is relevant admissible evidence, suspected perpetrators should be handed over to appropriate anti-corruption agencies for prosecution.” In the letter dated 18 July, 2020 and signed by SERAP deputy director Kolawole Oluwadare, the organization said: “These are extremely serious allegations. Nigerians expect that those who run the NDDC should be free of corruption, and should enjoy no impunity. Nigerians who want to see development and prosperity in the Niger Delta will want you to take the lead to get to the bottom of these allegations and take appropriate and decisive action to address them.” According to SERAP, “A special panel to probe allegations of corruption in the NDDC, and that is able to work closely with anti-corruption agencies would protect the integrity of the forensic audit, remove the possibility of obstruction of justice, and interference in the process by those suspected to be involved in alleged corruption in the NDDC.” SERAP said: “The investigation by the National Assembly has been controversial, and has reportedly turned into a ‘dirty fight’ between the NDDC and the National Assembly. Similarly, the hearings have reportedly indicted lawmakers of both the Senate and House of Representatives.” SERAP also said: “Any perception of politicisation and bias in the investigation of the corruption allegations in the NDDC would undermine public trust in the process, and ultimately, the public interest and good government, as well as justice for the victims of corruption in the Niger Delta.” The letter, read in part: “SERAP is concerned that allegations of systemic and widespread corruption in the NDDC are not only punishable offences but also directly undermine the human rights of Nigerians, especially the people of the Niger Delta.” “SERAP notes that your government has expressed the commitment to ‘get to the root of the problem undermining the NDDC.’ However, the most effective way to ‘get to the root’ of the corruption problem in the agency, and to ensure and protect the integrity of a forensic audit is to establish a special panel to carry out credible, independent, impartial and effective investigations into the alleged corruption in the NDDC.” “A decisive action is needed by you and your government to stop the corruption in the NDDC, ensure that anyone suspected to be responsible is brought to justice, and to fully recover stolen, mismanaged or misappropriated public funds.” “Ensuring an independent, impartial, transparent and effective investigation into the corruption allegations in the NDDC would be entirely consistent with the Nigerian Constitution of 1999 (as amended), the NDDC Act, and Nigeria’s international obligations, including under the UN Convention against Corruption to which the country is a state party.” “Section 15 subsection (5) of the Constitution requires your government to abolish all corrupt practices and abuse of power, including corruption allegations in the NDDC. Similarly, the UN Convention against Corruption requires your government to ensure effective investigation and prosecution of allegations of corruption.” “Specifically, article 26 of the convention requires your government to ensure ‘effective, proportionate and dissuasive sanctions’ including criminal and non-criminal sanctions, in cases of grand corruption. Article 26 complements the more general requirement of article 30, paragraph 1, that sanctions must take into account the gravity of the corruption allegations.” “Your government should send a strong message of intolerance for grave corruption in the NDDC, and show that you are willing and able to enforce important constitutional, statutory and international principles and obligations.” “SERAP also urges you to instruct the police authorities and security agencies to immediately end the harassment and intimidation of Ms Joy Nunieh, former Acting Managing Director of NDDC, or any other witnesses and whistle-blowers. Suspected perpetrators will escape justice if witnesses and whistle-blowers are intimidated, harassed or threatened. “ “Effective investigation and prosecution will not be achieved if such crucial participants in the investigation are not sufficiently protected to perform their roles unimpeded. Stopping the harassment and intimidation would also ensure that innocent people are not wrongfully punished and that suspected perpetrators would not subvert the course of justice and escape sanctions.” “We request that you take the recommended action within 14 days of the receipt and/or publication of this letter, failing which SERAP will institute legal proceedings to compel your government to act in the public interest.” “These allegations and the apparent attempts to weaken the independence, work and freedom of action of the Economic and Financial Crimes Commission (EFCC) including alleged deliberate targeting of some directors of the agency have undermined the public’s confidence in the government’s oft-repeated commitment to fight corruption.” “According to reports, the Central Bank of Nigeria and the Office of the Accountant-General of the Federation have indicted the NDDC of illegally spending 81.5 billion between January and July 2020. PUBLIC STATEMENT The Federal Airports Authority of Nigeria (FAAN) notes with dismay, two acts of infractions on the rules and guidelines for air passengers and airport users. The first incident occurred on Saturday, July 11, 2020, at the Aminu Kano International Airport, when the former governor of Zamfara State, Alhaji Abdulaziz Yari, declined to adhere to the Airport Health protocols and procedures. The second incident occurred on Tuesday, July 14, 2020, when the Governor of Adamawa State, Alhaji Ahmadu Umaru Fintiri, arrived at the Port Harcourt International Airport, in company of eight other passengers. He also fragrantly refused to observe the airport security and port health protocols. As a responsible institution of the Federal Government of Nigeria, FAAN holds all officials of state in high esteem, and accords them all the courtesies their status deserves. Therefore, FAAN has no personal issues with Alhaji Abdulaziz Yari and Governor Fintiri. We are merely implimenting our standard operating procedures (SOPs) to assure the success of our Security and Public health Protocols. The protocols flouted by both personalities were duly approved by the Federal Government through the Presidential Task Force on COVID-19. They were intended to protect all airport users, and to curb the spread of COVID-19 pandemic. By their actions, the two personalities put at risk not only themselves, but also other airport users. These protocols are now part of the new normal all over the world, and no person, no matter how highly placed, is exempted from them, else he would be denied access to our facilities. FAAN wishes to restate the need for all air travelers to strictly adhere to the security, Public health and operational protocols put in place to make air travel in the country safe, secure, and efficient,especially in the midst of this pandemic. Sani Omolori, clerk of the national assembly, says his continued stay in office is backed by law and cannot be voided by the National Assembly Service Commission. In a statement shared with TheCable on Wednesday, Omolori said the commission does not have the powers to set aside the revised condition of service passed by the previous assembly. He directed all staff of the legislative chamber whom the commission asked to proceed on retirement to disregard the directive and “go about their lawful duties”. |

LASG Seals Facilities Contravening COVID-19 Protocols The Lagos State Safety Commission has sealed 33 social facilities including bars, lounges, restaurants, gyms and spas for engaging in activities and operations contrary to the State Government's COVID-19 reopening protocols. Speaking during an enforcement exercise, the Director-General, Safety Commission, Mr. Lanre Mojola disclosed that erring or non-compliant facilities who contravene the established protocols will face the full wrath of the Law. He reaffirmed the State's zero tolerance for establishments that continue to violate laws and regulations, noting, however, that hairdressing salons that have been accredited by Lagos State Safety Commission can now open strictly by appointment with a maximum occupancy of 40% of the total floor space at any given time. The Director-General implored business owners in the entertainment and tourism sector who are yet to comply with the directive, to promptly do so by registering on www.lasgsafetyreg.com in order to receive their provisional safety compliance letters in preparation for the full reopening. Mojola also declared that organisations that have collected their provisional compliance letters, especially in sectors that are still not allowed to open, should remain closed until Mr. Governor’s announcement for reopening of such businesses. President Muhammadu Buhari would on Friday sign the revised 2020 Appropriation Bill into law, The Nation leant on Thursday. He is also to present the 2021 budget to a joint session of the National Assembly in September this year. This is even as the Minister of Finance, Budget and National Planning, Mrs. Zainab Ahmed on Thursday met with the leadership of the National Assembly on plans to submit the 2021-2023 Medium Term Expenditure Framework and Fiscal Strategy Paper (MTEF/FSP) later this month. The Minister while briefing principal officers of the Senate and House of Representatives led by the Senate President, Ahmad Lawan, and the Speaker, Femi Gbajabiamila, in Abuja Thursday, disclosed that President Muhammadu Buhari had given directives for the Ministry to expedite action on next year’s budget estimates to enable him present the 2021 budget proposal to the National Assembly by the end of September this year. Mrs. Ahmed, according to a statement by the Special Assistant (Press) to the Senate President, Ezrel Tabiowo, further disclosed that in keeping strictly with the January – December budget cycle, the President will tomorrow (Friday) sign into law, the revised N10.8 trillion budget for the year 2020 passed by the National Assembly in June. “This for us is a journey towards ensuring that the progress that we have made as a collective to return the fiscal year to January – December is maintained for the 2021 budget as well. “The President has directed that we must deliver the budget to the National Assembly by the end of September,” the Finance Minister said. Ahmed while giving an update on the 2020 budget implementation between January and May 2020 stated that the Federal Government’s retained revenue was N1.48 trillion, an amount representing 56 percent of government’s target. She added that out of the sum generated as revenue, oil revenues accounted for N701.6 billion; non-oil tax revenues N439.32 billion; Companies Income Tax (CIT) and Value Added Tax (VAT) collections – N213.24 billion and N68.09 billion; and Customs collection N158 billion, respectively. “Other revenues amounted to N339.51 billion, of which Independent revenues was N80.22 billion. Recoveries and Stamp duty collected during the period are yet to be booked in the fiscal accounts,” Ahmed said. On Expenditure performance for the same period (January – May 2020), she disclosed that N1.25 trillion was expended for debt service; and N1.32 trillion for Personnel cost, including Pensions. According to the Finance Minister, as at the end of May 2020, only N253.33 billion had been released for capital expenditure. Ahmed while giving underlying assumptions driving the macro-economic parameters and targets of the 2021 – 2023 Medium Term Expenditure Framework, said same was “revised in line with the emergent realities.” She stated that the Oil Price Benchmark for the 2021 fiscal year was pegged at USD$35; and USD$40 for 2022 and 2023, respectively. She said that Oil Production (mbpd) was placed at 1.86 for 2021, 2.09 for 2022, and 2.38 for the 2022 fiscal year; while the Exchange Rate remains at N360 to USD$1. Ahmed stressed that, “although Nigeria’s total production capacity is 2.5 million barrels per day, current crude production is about 1.4 million barrels per day – in compliance with the Organization of the Petroleum Exporting Countries’ production quota – and an additional 300,000 barrels per day of condensates, totaling about 1.7mbpd.” She added that while the World Bank forecasts that crude oil prices will rise gradually from an average of USD$42 per barrel in 2021 to USD$44.5 per barrel in 2022; and USD$47pb in 2023, it is also expected that Brent crude oil prices may average $41 per barrel during the second half of 2020 and $50pb during 2021, climbing as high as $53pb by the end of next year. “The nominal Gross Domestic Product (GDP) is expected to increase from N130,836.1 billion in 2020 to N132,125.4 billion in 2021 and then up to N138,415.8 billion in 2023,” Ahmed said. Though Bola Tinubu, former Governor of Lagos State and National Leader of the ruling All Progressives Congress, denies intention to run for President in 2023, there is everything in his body language that suggests otherwise. After grandly declaring, “I have no decision regarding 2023,” he threw a curve, “2023 will answer its own question in due time.” If that is not a subtle hint about his intention to run, nothing will ever be. This speculation compels the need to find out if he has a national political structure that can carry his vision to all the nook and cranny of Nigeria. In case you don’t understand, political structure in Nigeria means grassroots mobilisers- the mix of city-fathers, faithful, stalwarts, “alright sirs,” and women supporters, clad in “aso ebi.” An effective political campaigner must have “boots on the ground,” to make significant impact on the day of election. Although MKO Abiola, presumed winner of the June 12, 1993 presidential election, might not have had political structures everywhere, he had sufficient goodwill. Uche Achi-Okpaga, National Publicity Secretary of Ohanaeze Ndigbo, recently reminded everyone that, “The presidency of Nigeria, no doubt, is not what a particular tribe or geopolitical zone can aspire to get without reaching out to other zones.” Erm, Uche must remember that Section 134(5) of Nigeria’s Constitution provides that “In default of a candidate duly elected (with a majority of votes cast in the election (and having) not less than one quarter of the votes cast… in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja), a candidate shall be deemed to have been duly elected to the office of the President if he has a (simple) majority of the votes cast at the election.” It is reasonable to speculate that Tinubu has men on the ground, at least in Lagos State, where he has a coterie of young Turk politicians, referred to as “Tinubu Boys,” if not in the entire South-West Nigeria, and the westerly corridor of the South-South. Prominent political figures, including Vice President Yemi Osinbajo, and House of Representatives Speaker, Femi Gbajabiamila, who were discovered and nurtured by Tinubu, are now like “jewels and bright ornaments,” displayed around his neck in the manner described by Prophet Isaiah of the Christian scriptures. This is so, even if some, who are finicky for details, would want to insist that while Vice President Osinbajo might have been nurtured, mentored and nominated for the position he occupies by Tinubu, it was actually a former Minister for Justice and Attorney General of the Federation, Bola Ajibola, who discovered and exposed him. Osinbajo started his political trajectory as an adviser on legal and litigation matters to Ajibola, under the regime of Ibrahim Babangida, who later nominated Ajibola as a Judge to the International Court of Justice, better known as the World Court, at The Hague, in The Netherlands. Other visible Tinubu protégés are Babatunde Fashola, a former Lagos State Governor, currently Minister of Works and Housing in the regime of the President, Major General Muhammadu Buhari (retd.). He started out as Chief of Staff to Governor Tinubu. Another is Minister of the Interior, Rauf Aregbesola, erstwhile Governor of what he refers to as the State of Osun. Aregbesola had been Commissioner for Works when Tinubu was Lagos State Governor. There are a legion of others: Lai Mohammed, Minister of Information and Culture, who was the first Chief of Staff to Tinubu. And then, of course, others, like former Speaker of the Lagos State House of Assembly, Adeyemi Ikuforiji, current Speaker, Mudashiru Obasa, and the slew of current and former members of the state House of Assembly. Dele Aláké, a constant in the Tinubu firmament, deserves a special mention. After serving as Tinubu’s Commissioner of the esoterically named Ministry of Information and Strategy, Dele now functions almost as ambassador extraordinary and plenipotentiary of the Tinubu political family. However, there is somewhat of a crack in the political family, as well as with some possible associates: Some think Iba Gani Adams, Aare Ona Kakanfo of Yorùbáland, gave Tinubu a most unkind cut by suggesting that Tinubu is not quite a fan of restructuring, the mantra of the mainstream Yoruba politics. Dr. Muiz Banire, Tinubu’s Commissioner for Transportation, who was tactically excused from a sinecure as Chairman of Assets Management Corporation of Nigeria recently, may need to speak up, if he is not one of the members of the Tinubu political family that is out of the political deck of cards. It is instructive to note that some who left have been recalled, however: Femi Pedro, Tinubu’s second Deputy Governor, has been reinstated to favour. Former Governor Akinwunmi Ambode, still peeping in from the fringe, hopes his day of reconciliation will be soon. Somebody suggests that Tinubu’s men in regions other than the South-West seem like the invisible hosts of heaven that were only seen after Bible Prophet Elisha entreated God to open the eyes of his assistant, who was trembling at the sight of the Syrian army. And that anyone who thinks the APC state governors will work for Tinubu has not heard Kaduna State Governor, Nasir el-Rufai, say, “If a (Nigerian) politician contests a position, and he doesn’t get it, he will not support the party member that got the nomination.” El-Rufai continued: “(The loser) will rather move to the opposition, and ensure that the person that defeated him… loses the election.” If erstwhile political stablemates spoil the chances of their party’s candidate, you can imagine the damage that political opponents will wrought. The interrogation of who, and where are, the Tinubu Boys, is necessary in the face of speculation that the ouster of Adams Oshiomhole from the position of National Chairman of the All Progressives Congress may adversely affect the chances of Tinubu emerging as the party’s presidential candidate in 2023. The position of chairman of a political party is strategic to the emergence of an aspirant to any elective office. Baba Gana Kingibe almost used his position as Chairman of the Social Democratic Party to wrest the presidential candidacy from MKO Abiola in 1993. His eventual emergence as Abiola’s running mate was certainly boosted by the SDP governors who wanted to compensate him for being instrumental to their emergence as governorship candidates, and for winning the elections in their home states. If you go by the decidedly negative narrative against the presidential ambition of Tinubu, in some quarters, you will likely come away with the impression that there is no ecumenical or national platform that Tinubu can work with. But when you remember that Tinubu has a purse of royalty that often works wonders, you will agree with those who suggest that if he can deploy his vast resource to ensure that his “friends” are elected as officers in the forthcoming APC state, local government, and ward congresses, he stands a good chance of clinching the oyster. But that won’t be easy. Others will be working with the same template. An unidentified APC chieftain says, “No… chieftain of the party will sit by and allow those who are not loyal to him to emerge as officials.
