POLITICS NIGERIA learned that the presidential panel, in its interim report submitted to President Muhammadu Buhari on Wednesday, also recommended that Magu should be prosecuted over allegations of corruption and abuse of office. The panel also recommended the immediate appointment of a new chairman for the anti-graft agency. But in a swift reaction, Wahab Shittu, counsel to Mr Magu, denied knowledge of any report, adding that no such interim report was sent to the President. He noted that Justice Salami had informed him that before any report is submitted to the President, his client will be carried along. Shittu added that Magu had yet to open his defence and given a fair hearing and it would be unjust for the panel to recommend his sacking. He said, “I don’t understand why we should be talking about a reaction to something that is blatantly falsehood. First, the panel is still calling witnesses. Two witnesses appeared before the panel today. So, if there were ongoing proceedings on Wednesday, Thursday, Friday and the panel has adjourned till Monday, if witnesses are still being taken and interrogated, and documents are still being submitted, what that should suggest to you is that proceedings are ongoing and have not been concluded. Does it (then) make sense for a report to be submitted?” He added, “Ibrahim Magu, my client, has not opened his defence and the panel has repeatedly indicated that he would be allowed to defend himself only after witnesses have been exhausted. So, somebody who has yet to defend allegations against him, can he be indicted? “Whether interim or final, you cannot issue the report without listening to all the witnesses and then take the defence. All persons indicted in the escape are to be identified and made to face the wrath of the law. July 13, 2019, The Punch in an exhaustive investigative report, detailed how Vice President Yemi Osinbajo aka Pastor RUGA, was involved in an alleged N100bn scam. In what could be termed Linkage Scam Group, N100bn was laundered among four different companies owned by the same people. Simmons Cooper Partners is linked to Ocean Trust Limited. Ocean Trust Limited is linked to Alpha Beta Consulting Limited. Alpha Beta Consulting Limited is linked to Alpha Beta LP. The four companies were accused of being a “conduit for diversion and laundering of funds”. Simmons Cooper Partners is linked to Osinbajo. Garba Shehu, Senior Special Assistant to General Muhammadu Buhari, said Simmons Cooper Partners was listed as a company in which Osinbajo has a stake in his assets declaration form in 2015. Dapo Apara, the erstwhile managing director of Alpha Beta, alleged that Alpha Beta owed the federal government N100bn in unpaid taxes spanning over 10 years. Osinbajo as the then Attorney General of Lagos State and Wale Edun the then Commissioner for Finance, recommended to Bola Ahmed Tinubu the then Lagos State governor, that Alpha Beta Consulting be given the exclusive rights to collect taxes on behalf of Lagos State government with 10 per cent commission. Alpha Beta raked in N600m per month from the contract. Pro-transparency groups and those close to Tinubu business empire confirmed that Tinubu owns Alpha Beta. In 2012, Dominic Adegbola, Lagos-based medical doctor, filed a Freedom of Information (FOI) request to Lagos State government seeking detailed information on all Alpha Beta contracts with Lagos State since 1999. Ade Ipaye, the then Lagos State Attorney General now Osinbajo’s chief of staff, turned down the request saying the FOI was a federal law that did not apply to the states. In November 2017, a state judge ruled that the FOI was applicable to Lagos State. The judge said “The law was duly enacted by the National Assembly and did not require domestication to take effect in states.” What happened to the N100bn Alpha Beta scam? Like all other high profile corruption cases, the EFCC deleted the case from its docket. During the Buhari-Osinbajo presidency, corruption has flourished in previously unthinkable ways, and at such a remarkable rate, that it’s almost impossible to keep tabs on it. The Senate of the University of Lagos, Akoka, has rejected the removal of Prof Oluwatoyin Ogundipe as Vice Chancellor of the institution by the Governing Council. Led by Wale Babalakin, Pro-Chancellor and Chairman of Governing Council, the decision-making organ on Wednesday in Abuja removed Ogundipe as VC of UNILAG, accusing him of gross misconduct and acts of corruption. But in a meeting held on Thursday by 88 members and anchored by Prof Chioma Ago, a former Dean of the Faculty of Law, the institution’s Senate said the removal of Ogundipe was against UNILAG’s regulation, adding that the Council removed Ogundipe without giving him the opportunity to defend himself. They also kicked against the appointment of Prof Omololu Soyombo as Acting Vice Chancellor of the institution. “Part of the condition for the removal of a Vice Chancellor is that a joint committee of the Senate and Governing Council must sit and investigate with three representatives from each side but the Senate was never represented, the Senate was never consulted, the Senate never knew the allegations against their member. “The removal of Prof Ogundipe did not follow the Act establishing the university. There were strong indications on Wednesday that the Mai Mala Buni-led All Progressives Congress Caretaker/Extra-Ordinary National Convention Planning Committee was battling against time ahead of the expiration of its six-month tenure, which began in June. The PUNCH gathered in Abuja that although the tenure of the caretaker committee would end in December, it had yet to make substantial progress on its main assignments, which include the withdrawal of court cases instituted against the party and or its leaders, the reconciliation of aggrieved party members and preparations for the national convention. It was learnt that the caretaker committee would seek an extension of its tenure to enable it to deal with these issues, which would ultimately lead to the shift of the national convention initially scheduled for November. A member of the APC National Executive Committee, who confided in our correspondent on Wednesday, said the committee would be hinging its request on these realities. There were indications on Wednesday the party might hold a NEC meeting where the tenure of the caretaker committee would be extended to enable it to complete its assignment. Recall that the APC’s NEC had, during a meeting held at the Presidential Villa on June 25, dissolved the Adams Oshiomhole-led National Working Committee and set up the committee headed by Buni. Following the decision reached by the party’s NEC at its last meeting held in June, the caretaker committee’s tenure is six months which ends by December 2020. The APC is required to have held a national convention where substantive officers of the party will emerge. However, Article 25 A (ii) of the party’s constitution states, “Without prejudice to Article 25 (A) (i) of this Constitution, the National Executive Committee may summon an emergency National Convention at any time provided at least seven (7) days’ notice of the meeting shall be given to all members eligible to attend.” Before the June NEC meeting, the party had been battling a protracted crisis, which led to the suspension of the National Chairman, Oshiomhole, by a Federal High Court in Abuja, a decision which was subsequently upheld by the Court of Appeal on June 16. Soon after his suspension, 14 of 20 members of the NWC announced the late governor of Oyo State, Abiola Ajimobi, who was then the Deputy National Chairman, as acting National Chairman. However, the next day, the former Deputy National Secretary of the party, Victor Giadom announced himself as acting national chairman citing a court order. Just as he left the media briefing at the APC National Secretariat, the group loyal to Oshiomhole and Ajimobi, addressed a press conference announcing the National Vice Chairman (South South), Hilliard Eta, as National Chairman, to act on Ajimobi’s behalf because the former governor was then bedridden. The President, Major General Muhammadu Buhari (retd.), during the June NEC meeting directed members, who had filed cases against one another to withdraw them. However, a number of these cases are still before the courts. The Buni-led committee was also mandated to reconcile aggrieved members before the planned national convention. The NEC member, who spoke to one of our correspondents, said that the committee had not started its real task of reorganising the party. The source said, “The November date for the convention is no longer feasible. The chairman is already reaching out to his colleagues on this issue. The truth is that while the committee has started on the right footing by reaching out to our leaders and winning over some of our aggrieved members especially those who left, which is a good beginning, the Edo and Ondo elections have taken the centre stage. The committee has not been categorical on the fate of the Chief Bisi Akande-led National Reconciliation Committee set up by Oshiomhole.” Another highly placed member of the party, who also confided in one of our correspondents, said, “They have few options in this matter, unless they get an extension, they can’t do much. What is at stake is larger than platitudes. There are issues of our party register and the amendment of the constitution. “They are currently preoccupied with the Edo and Ondo elections. Nothing else is happening seriously.” A member of the dissolved Adams Oshiomhole- led APC NWC, who also spoke on condition of anonymity for fear of retribution, said they had yet to be approached to make any impute into repositioning the party. The source said, “They don’t believe that we matter. They have not met with us, not even the courtesy of reaching out to us. They are talking about extension. Some of them feel that all is fair in love and war. I believe that an inter-party disagreement is not war, it is just a battle. It is when you are fighting another party that you can consider it a war of some sorts. Some of them are doing everything for us to lose Edo so that Oshiomhole will be seen as nothing.” PGF DG writes committee, seeks another NEC meeting Amidst these concerns, the Director General of the Progressives Governors Forum, Dr Salihu Lukman, has written a memo to the caretaker committee recommending steps which should be taken before the proposed national convention. In the memo titled, “Appeal for reconciliation and peace-building in APC,” addressed to the caretaker committee chairman, Lukman recommended among other things that the committee should convene another NEC meeting to approve proposed activities of convention working committee up to the national convention; “commence the process of membership recruitment/verification, leading to reformation of leadership of the party from wards, local government, states to the extra ordinary national convention; as well as set up a constitutional review/amendment committee,” which should be able to submit proposals for review/amendment of the APC constitution. Oshiomhole, others deploying unfair means for Edo election – PGF DG He also revealed a plot by some people within the party to make Oshiomhole, a contender in the forthcoming national convention. Lukeman also said “Everybody in the APC is being blackmailed to accept the way the Edo 2020 governorship campaign is being organised as the best way to win the election under the control of Comrade Oshiomhole. This is wrong and in the long run it will be injurious to the electoral viability of the party. “Even more disturbing is the clear indication that Comrade Oshiomhole and section of the APC leadership that is working with Comrade Oshiomhole are not preparing to approach the Edo election based on fair contests. “Not even the request of President Muhammadu Buhari for “a transparent process so that the confidence of the people will be strengthened” is guiding the management of the Edo campaign.” But a former Edo State Commissioner for Information, Kazeem Afegbua, said Lukeman was still embittered by his inability to secure a senatorial ticket. The Petroleum Tankers Drivers Association has said its planned strike will begin on Monday (tomorrow) as planned because the association has not reached any agreement with the Lagos State Government. The National Chairman of PTDA, Mr Salimonu Oladiti, said this in an interview with The PUNCH in Ibadan on Sunday. He said the issues which forced the drivers to plan to embark on an indefinite strike had not been addressed. He noted that talks between officials of the Lagos State Government and petrol tanker drivers failed to achieve the desired result. Oladiti said, “We don’t have much to say. If the issues of extortion and harassment of our members are addressed, we won’t go on strike but if the issues are not addressed, we will go on with it. “We are not happy to disrupt fuel supply because we know the effect but we cannot continue to cope with the problems. “Security agents and hoodlums are extorting our members and officials of the Lagos State Traffic Management use taser on our drivers and this can kill. “We have been trying to cope with this for a long time but it has got to a point that our members are accusing us of feeling unconcerned about their welfare. So, there is nothing we can do than to go ahead with the strike. “We have been reporting to the government but nothing has come out of it. The state government called us to a meeting but nothing came out of the meeting. We are still waiting for them to call another meeting. “We will still present our demands to them and if they are ready to address them and we see their commitment, we will not go ahead with the strike. Boko Haram Releases Footage Of Members Observing Eid Prayers In Niger State The Shekau-led faction of BH has released its first video exclusively featuring members claiming to be from Niger State. It shows about one hundred persons praying Eid in the heart of a bush before showing three fighters sending Eid greetings in Hausa, English and Fulfulde. It’s interesting that two of the fighters were respectively wearing Nigerian military & police uniforms. This indicates that they might’ve recently killed security forces and got their uniforms. This is because in their past video, the only speaker from Niger was in mufti. This video, if genuine, is further evidence that BH has expanded to the northcentral. The dense forest there is a perfect haven for terrorists and if the group is able to consolidate its presence in Niger, it can easily target Abuja as well as to other states like Kwara and Kogi. I won’t get tired of urging the FG and the Niger State Govt to take this threat seriously. We shouldn’t wait until the situation gets out of control before we start running helter-skelter. President Muhammadu Buhari on Monday approved the appointment of Barrister Amos Isaac Azi as Chairman/Chief Executive Officer for the Investments and Securities Tribunal (IST). Azi, before this appointment, was a staff of the Securities & Exchange Commission. A statement from the IST said “his appointment is for an initial period of Five (5) years in accordance with the provisions of Sections 275(2) and 277(1) of the Investments & Securities Act (ISA), 2007. The appointment is with effect from 17th July, 2020.” Also on Monday, President Buhari approved the reappointment of Barr. Nosa Osemwengie as full time member of the Investments and Securities Tribunal, for a second and final term of Four (4) years. Monday edition of the Punch checks all the boxes in terms of an abject failure to honour these time-tested traditions with its news piece: “NIGERIA EXPORTS USD81.48bn ELECTRICITY ON CREDIT AS COUNTRY’S BLACKOUT PERSISTS,” is to say the least, hyperbolic and terribly misleading. Apart from the fact that the figure quoted is far from accurate, out-dated and therefore not reflective of the current reality, the overall cost of power generated and sold by Nigeria in the period covered by report is not anywhere close to what was mentioned by the paper. The actual cost of electricity generated within the said timeframe (2018-2019) by all the electricity generation companies in Nigeria was about N1.2 trillion ($4 billion). Over 90% of the electricity generated was distributed and consumed by consumers across the 11 electricity distribution companies in the country. Power exported to Niger, Benin and Togo based on Multilateral Energy Sales Agreement with the Government of Nigeria is on the basis that they would not dam the waters that feed our major power plants in Kainji, Shiroro and Jebba. As of the last review in 2019, the amount of indebtedness to all three customers stood at $69 million, subsequent upon which several payments were made to NBET. Much of this has been repaid by the debtor nations. As of today, Niger owes only USD 16 million and Benin, USD 4 million, adding up to the Naira equivalent of about N1.2bn. The essence of said bilateral agreements, by which we give them power and they do not build dams on the River Niger means that Nigeria and her brotherly neighbours had avoided the unfolding situation of the Nile River between the sovereign states of Ethiopia, Sudan and Egypt. In the future, we advise the newspaper to seek clarity from the market operator which is the Transmission Company of Nigeria, TCN.
