The Economic and Financial Crimes Commission on Tuesday expressed delight at the confession of ex-governor James Onanefe Ibori before a Southwark Crown Court in London by pleading guilty, saying it awaits the sentencing of the embattled former governor on April 16. The commission also indicated that the former governor would also be tried in Nigeria after serving his jail terms in the UK. A statement by the spokesman for the EFCC, Mr. Wilson Uwujaren, said the EFCC had been vindicated that the ex-govenor had a case to answer. He said, “The interesting aspect of the development in London is the fact that Ibori chickened out of a full blown fraud and money laundering trial by changing his plea. “This was purely a gambit to run away with a lighter sentence, rather than the product of a plea bargain as erroneously reported earlier in sections of the media. For the avoidance doubt, plea bargain is not recognised in UK criminal justice system. “Sadly, it has taken five years of legal rigmarole and high drama for the former governor to own up to having committed some of the crimes for which Justice Marcel Awokulehin of the Federal High Court, Asaba, sensationally acquitted him in December 2009. The commission challenged the ruling. That appeal is still pending before the Court of Appeal, Benin City, Edo State.” |

February 27, 2012 by Friday Olokor, Abuja 7 Comments A legal practitioner and Executive Director of Human Rights and Accountability Initiative, Mr. Peter Odia, has sued the Central Bank of Nigeria Governor Lamido Sanusi for the donation of N125m to victims of bomb blasts in Kano and St. Theresa’s Catholic Church in Madalla, Niger State. The apex bank and Attorney-General of the Federation and Minister of Justice, Mr. Mohammed Adoke, were mentioned as 2nd and 3rd respondents in the suit. The plaintiff wants the the Federal High Court, Abuja to declare that the defendants’ action of making the N100m donation to the Kano State Government and N25m to St. Theresa’s Catholic Church contravenes the CBN Act and is therefore illegal. Odia also wants the court to declare that the donation “is misappropriation/misapplication of public funds, illegal, unlawful and unconstitutional”. According to him, by virtue of Section 6 of the National Emergency Management Agency (Establishment) Act 2004, the action of the 1st and 2nd defendants “is a usurpation/assumption of the responsibility and functions of NEMA and therefore unlawful, null and void”. Odia added, “By virtue of the CBN (Establishment) Act 2007, and the Laws of the Federal Republic of Nigeria, the 2nd defendant, being an agency of government, is not empowered to make donations in exercise of corporate social responsibility. “The objective of the 1st and 2nd defendants as clearly defined in the Act establishing it does not include making such voluntary donations, nor does it give powers to the CBN Board to create any special fund to give donations. “It is also clearly stated in section 80 (3) and (4) of the 2009 constitution of the Federal Republic of Nigeria (as amended) on how public funds are to be appropriated and expended.” http://www.punchng.com/news/n125m-donations-lawyer-sues-sanusi-agf/ |

Michael Prest, the 50 year-old founder of Nigerian energy trading firm Petrodel Resources, split from his wife in an acrimonious divorce in 2008. During a British High Court hearing on the divorce in October last year, the presiding judge ordered the tycoon to pay his former wife cash and assets worth over $20 million. However, Prest has applied to appeal the court’s decision on the grounds that his Petrodel’s assets do not belong to him, but are held in trust for his children, siblings, nephews and nieces in Nigeria, under Nigerian Itsekiri customary law. The oil baron claims that his company, Petrodel Resources Ltd, was established in 1992 with $13,000 in start-up capital which was provided by his late father. As a result, under traditional law, his company and assets are not owned entirely by him, but by his extended family; he mainly acts as custodian of the wealth. The tycoon’s attorney Martin Pointer disclosed to the court that under customary law in Nigeria, Prest (who is the first-born son of his family) has a historic responsibility to use the family “inheritance” to look after his siblings and their children. Prest’s case is also helped by the fact that his younger brother went to a Nigerian High Court in 2009 and obtained a declaration which states that Petrodel Resources is a part of their late father’s estate. Michael Prest also previously acquired a court order from a Nigerian court which forbids him from sharing information about Petrodel and its assets with third parties. Hence, it is difficult to ascertain the true market value of Petrodel resources. But the former wife, Yasmin Prest, 49, is crying foul. She told the court that Petrodel is “100 per cent owned and controlled” by her former husband. Last October, during the original court case in London, she had claimed that her former husband was worth ‘many tens, if not hundreds, of millions of pounds’. She demanded a divorce payout of about $40 million, plus about $1 million a year for upkeep of herself and the four children she bore with the tycoon. Prest had previously offered her the equivalent of $35,000 a year and a lump sum of about $2.5 million. The court has not yet set a date for the full appeal. Michael Prest, an extremely reclusive oil trader and former protégé of controversial commodities trader Marc Rich, founded Petrodel resources in 2001. Super Eagles’ Head Coach, Stephen Okechukwu Keshi, has dispelled news making the rounds that he has an axe to grind with Chelsea’s midfielder, John Mikel Obi, hence his non-inclusion in the team that will battle Rwanda next Wednesday. Team's Media Officer, Ben Alaiya, quoted Keshi as saying: “This camp is a national team's camp of love and not of hate, how can a father like me quarrel with a son like Mikel. The young man is full of talent and is a player who has several years left in him, but he was just coming back from an injury lay-off and we thought it wise to leave him to settle down before we call on him again to come and fight for his fatherland”. Keshi pleaded with the media, whom he said were partners in progress to always cross-check facts with the appropriate quarters before going on air or publishing them. Another issue that Keshi also took time off to clear was the alleged injury to returnee midfielder, Sanni Kaita. Keshi said Kaita was not injured and had been playing regularly for his club, urging those in doubt to call on his Russian club to find out details. “We have taken time to select the best for the national team and we find Kaita to be one of them, those who say he's injured should call his club to find out the truth, from our end we have a fully fit Kaita ready to represent his fatherland”.
