hello my fellow nairalander... i was jobless for about 3years until August this year when my uncle's friend help me to get a job from one of his friend company in Lagos.. so since i started working, the man wife (that help in getting the job) has being looking at me somehow which am not always comfortable with anytime i see her.. not until yesterday evening when she told me what is in her mind, that Since i started working she has not seen anything from me, that or is it that am waiting till December until i see her... When Amina woke up, she checked the time, it was 4:00am, everywhere was still dark. She was consumed by fear! And because she was afraid of the old woman's caution, she got up, took the cloth and started washing. She scrubbed it so hard that it felt like it was going to tear. Amina was scrubbing the cloth so hard that tears almost started dropping from her eyes when all of a sudden, someone tapped her from behind. She turned and behold, the old woman in her dream had appeared to her in real life! Fearful, Amina got up to run but fell down. The old woman drew closer to Amina and said softly,

Following the dubious suggestion by Senator Dino Melaye that at least two Senators from the state of origin of a ministerial nominee must endorse the nominee to pass the ministerial screening, we decided to do a research on the matter. We found four pertinent provisions in the constitution and one Senate Standing Rule relating to appointment and screening of ministers. None of these laws referred to the compulsory endorsement of a nominee by at least two Senators from the nominee’s state of origin. Our investigation focused on sections 147(1-3, 6) of the constitution, and section 120 of the Senate Standing Rules. For ease of readership, we have endeavoured to explain these laws into three parts as discussed below:

Part 1: Section 147 of the Constitution:

(1) “There shall be such offices of Ministers of the Government of the Federation as may be established by the President.”

(2) “Any appointment to the office of Minister of the Government of the Federation shall, if the nomination of any person to such office is confirmed by the Senate, be made by the President.”

(3) “Any appointment under subsection (2) of this section by the President shall be in conformity with the provisions of section 14(3) of this Constitution:-

Provided that in giving effect to the provisions aforesaid the President shall appoint at least one Minister from each State, who shall be an indigene of such State.”

(6) “An appointment to any of the offices aforesaid shall be deemed to have been made where no return has been received from the Senate within twenty-one working days of the receipt of nomination by the Senate.”

Part 2: The Senate Standing Rules:

Section 120: “That the Senate shall not consider the nomination of any person, who has held any public office as contained in Part 2 of the Fifth Schedule of the Constitution prior to his nomination unless there is a written evidence that he has declared his assets and liabilities as required by Section 11(1) of Part 1 of the Fifth Schedule of the Constitution of the Federal Republic of Nigeria; such declaration shall be required for scrutiny by the senators.”

Part 3: Explaining the legal jargon:

Section 147(1) is the relevant section of the Nigerian constitution that empowers the President to appoint ministers in the first instance. Section 147(2) stipulates that the President’s nominees as ministers shall be confirmed by the Senate. Section 147(3) stipulates that the President should appoint at least one minister from each of the 36 states of the federation. Even though Section 147(3) empowers the Senate to confirm the President’s nominations, section 147(6) empowers the President to ratify the nominees if the Senate fails to confirm them after 21 days of submission of their names to the Senate.

The constitution has clearly favoured the President over the Senate in this matter. This explains why the Bukola Saraki cabal in the Senate has been restless, and misleading the public about an illegal compulsory endorsement of a nominee by two Senators of the nominee’s state of origin. Note that when Dino Melaye addressed the press regarding this issue on Thursday (29/9/2015), he explained sections 147(1-3). However, section 147(6) was conspicuously missing from his explanation.

Despite the fact that the Senate President himself is at the Code of Conduct Tribunal for grandeur theft, money laundering and failure to declare his assets, which makes him hardly a role model for the ministers, for the sake of transparency, integrity and accountability of the screening process, we the masses strongly endorse a strict enforcement of section 120 of the Senate Standing Rules eluded to above.

We however reject the preposterous suggestion that the nominees must be endorsed by at least two Senators from their state of origin. We contend that imposing this bogus condition under the current political climate will simply introduce avenues for bribery, corruption, and unnecessary delay ratifying the ministers.

The Senate Committee on Ethics and Privileges and Public Petitions has aborted the screening of former Rivers State Governor, Chibuike Rotimi Amaechi, as a minister.

Chairman of the committee, Senator Samuel Anyanwu, told the Senate that the report of the petition against Amaechi’s nomination as minister was not ready.

Anyanwu noted that because of the screening exercise on Tuesday, the committee was not able to put the report together.

Senate President, Bukola Saraki, mandated the committee to ensure that the report is ready on Thursday.

As a result of the non availability of the committee’s report, Amaechi may not be screened on Wednesday as scheduled.

“October 1st is a day for joy and celebrations for us Nigerians, whatever the circumstances we find ourselves in because it is the day, 55 years ago; we liberated ourselves from the shackles of colonialism and began our long march to nationhood and to greatness.

“No temporary problems or passing challenges should stop us from honouring this day. Let us remind ourselves of the gifts God has given us. Our Creator has bequeathed to us Numbers – Nigeria is the ninth most populated country on the planet. We have in addition arable land; water; forests; oil and gas; coastline; and solid minerals

“We have all the attributes of a great nation. We are not there yet because the one commodity we have been unable to exploit to the fullest is unity of purpose. This would have enabled us to achieve not only more orderly political evolution and integration but also continuity and economic progress.

“Countries far less endowed have made greater economic progress by greater coherence and unity of purpose.
“Nonetheless, that we have remained together is an achievement we should all appreciate and try to consolidate. We have witnessed this year a change in our democratic development.

“The fact that an opposition party replaced an entrenched government in a free and fair election is indicative of the deeper roots of our democratic system. Whatever one’s views are, Nigerians must thank former President Jonathan for not digging-in in the face of defeat and thereby saving the country untold consequences.

“As I said in my inaugural speech, I bear no ill will against anyone on past events. Nobody should fear anything from me. We are not after anyone. People should only fear the consequences of their actions. I hereby invite everyone, whatever his or her political view to join me in working for the nation.

“My countrymen and women, every new government inherits problems. Ours was no different. But what Nigerians want are solutions, quick solutions not a recitation of problems inherited.

“Accordingly, after consultations with the Vice President, senior party leaders and other senior stakeholders, I quickly got down to work on the immediate, medium-term and long-term problems which we must solve if we are to maintain the confidence which Nigerians so generously bestowed on us in the March elections and since then.

“As you know, I toured the neighbouring countries, marshalled a coalition of armed forces of the five nations to confront and defeat Boko Haram. I met also the G-7 leaders and other friendly presidents in an effort to build an international coalition against Boko Haram.

“Our gallant armed forces under new leadership have taken the battle to the insurgents, and severely weakened their logistical and infrastructural capabilities. Boko Haram are being scattered and are on the run.

“That they are resorting to shameless attacks on soft targets such as I.D.P. camps is indicative of their cowardice and desperation. I have instructed security and local authorities to tighten vigilance in vulnerable places.

On power, government officials have held a series of long sessions over several weeks about the best way to improve the nation’s power supply in the safest and most cost-effective way.

“In the meantime, improvement in the power supply is moderately encouraging. By the same token, supply of petrol and kerosene to the public has improved throughout the country. All the early signs are that within months the whole country would begin to feel a change for the better.

“Preliminary steps have been taken to sanitize NNPC and improve its operations so that the inefficiency and corruption could be reduced to a minimum.

“Those of our refineries which can be serviced and brought back into partial production would be enabled to resume operations so that the whole sordid business of exporting crude and importing finished products in dubious transactions could be stopped.

“In addition to NNPC, I have ordered a complete audit of our other revenue generating agencies mainly CBN, FIRS, Customs, NCC, for better service delivery to the nation. Prudent house-keeping is needed now more than ever in view of the sharp decline in world market oil prices. It is a challenge we have to face squarely. But what counts is not so much what accrues but how we manage our resources.

“We have seen in the last few years how huge resources were mismanaged, squandered and wasted. The new APC government is embarking on a clean up, introducing prudence and probity in public financing.

“At an early stage, the federal government addressed the issue of salary arrears in many states, a situation capable of degenerating into social unrest. The APC government stepped in to provide short-term support to the debtor states and enabled them to pay off the backlog and restore the livelihood of millions of Nigerians.

“Fellow Nigerians, there have been a lot of anxiety and impatience over the apparent delay in announcement of ministers. There is no cause to be anxious. Our government set out to do things methodically and properly. We received the handing over notes from the outgoing government only four days before taking over. Consequently, the Joda Transition Committee submitted its Report on the reorganization of Federal Government structure after studying the hand over notes. It would have been haphazard to announce ministers when the government had not finalized the number of ministries to optimally carry the burden of governance.

“Anyway, the wait is over. The first set of names for ministerial nominees for confirmation has been sent to the senate. Subsequent lists will be forwarded in due course. Impatience is not a virtue. Order is more vital than speed. Careful and deliberate decisions after consultations get far better results. And better results for our country is what the APC government for CHANGE is all about.

“I would like to end my address this morning on our agenda for CHANGE. Change does not just happen. You and I and all of us must appreciate that we all have our part to play if we want to bring change about. We must change our lawless habits, our attitude to public office and public trust. We must change our unruly behaviour in schools, hospitals, market places, motor parks, on the roads, in homes and offices. To bring about change, we must change ourselves by being law-abiding citizens.

“Happy Independence Celebrations. Long live the Federal Republic of Nigeria.”

THE Conference of Nigerian Political Parties (CNPP) yesterday joined other Nigerians in commending President Muhammadu Buhari for opposing a further devaluation of the Naira,

CNPP, in a statement by its National Publicity Secretary, Mr. Osita Okechukwu commended President Buhari for putting in place measures that has stabilised the Naira.

It noted: “We are commending Mr. President because stabilization of the Naira through tighter restrictions on access to foreign exchange will conserve foreign reserves, which is our common wealth, and hence stem round tripping, speculation and illicit financial transactions by rent seekers.

“Whereas, we agree that pro-people economic policies like the Single Treasury Account, ban on commercial banks to stop accepting foreign currency cash deposits and to pay dollar purchase within 48 hours in advance and exclusion of 41 items access to official foreign exchange market will hurt in the short run; however, state intervention in the midst of the dwindling oil revenue will pay off in the medium and long run.

“It is our considered view that retreat of the state as is being advocated by JP Morgan and portfolio speculators, in the midst of scarce foreign exchange will create fierce struggle for few dollars in the marketplace and dangerously depreciate the Naira, especially when oil remains our main foreign exchange earner.

“To be candid, which products will the devaluation of the Naira further to say N500 per $1 induce its export? None, for as Professor Sam Aluko of blessed memory said, ‘The Nigerian economy is not yet modernized or capitalized economy, even though the ongoing reform programmes try to run a capitalist economy, without capital… A largely informal economy does not require reform, it requires tendering, nurturing and propelling by the State. It should not be left alone to the whims and caprices of a nebulous philosophy of free market, free enterprise and global competition.”

OFFICIALS of the National Drug Law Enforcement Agency (NDLEA) yesterday arrested a Bureau de Change operator and five other suspected money laundering syndicate members for allegedly swallowing $156,000 at Excel Oriental Hotel along Airport Road, Lagos.

The suspects were arrested at the hotel while they were busy swallowing the large sums of money with the intention of exporting the said amount of money to Brazil.

Speaking on the arrest, Chairman of NDLEA, Ahmadu Giade, said the suspects had been apprehended in connection with swallowing $156,000.

Giade, who promised to track down smuggled narcotics and currency, warned that operators of bureau de change who fail to work within the confines of the law establishing them would be severely sanctioned, adding: “The agency will continue to rely on manpower training and intelligence-led drug control strategies to out-wit criminal syndicates.”

We shall take reasonable measures to dislodge drug cartels and eradicate narcotics from our society. Any bureau de change operator that violates the law shall be punished accordingly.”

No fewer than 11 persons were killed by flood in Sokoto and Zamfara States in 2015, the National Emergency Management Agency (NEMA), has said. Mr Thickman Tanimu , Deputy Head, Sokoto Zonal Operations Office of NEMA said 10 of the victims died in Zamfara while a seven-year old boy died at Kuchi village in Kebbe local Government of Sokoto state.

Tanimu said on Friday in Sokoto while giving update of damages caused by flood in Sokoto, Kebbi and Zamfara that more than 86, 710 hectares valued N1.58 billion were destroyed in the three states. According to him, a total of 20, 477 homes were also affected, rendering about 50, 000 people homeless.

He said that the flood affected eight out of the fourteen local government areas in Zamafara, which included Shinkafi, Talata Mafara, Gusau, Anka, Tsafe, Bungudu, Zurmi and Maradun. The official explained that 8, 540 houses and 6,450 hectares of farmland valued at N 260 million were destroyed in the affected areas in the state.

Tanimu further said that eleven out of the twenty three local governments in Sokoto state were affected by the flood, while two communities in Wurno and Goronyo local governments were evacuated. “The other local governments affected were Rabah, Kware, Binji, Kebbe, Gwadabawa, Wamakko, Bodinga, Sokoto North and Sokoto South.”

Tanimu stated that 24,750 persons and 6, 922 houses were affected, with 42,800 hectares of farmlands worth N 750 million either totally destroyed or badly affected. In Kebbi state, the NEMA official said that 10 out of the 21 local governments were also affected by the disaster.

They were Argungu, Birnin Kebbi, Bunza, Kalgo, Dandi, Bagudo, Yauri, Danko Wasagu and Suru. He disclosed that 21, 450 persons and 5,015 houses were affected, while 37,460 hectares of farmlands worth N 570 million were also destroyed.

According to him, two communities in Birnin Kebbi, namely Wabbako-Fulani and Wabbako-Hausa, have been submerged by the flood. Tanimu said that the agency had provided food and other essential materials to assist the victims as part of the initial Federal Government’s intervention.

He attributed the high level of losses to the release of water from Bakalori and Goronyo dams located in Zamfara and Sokoto states respectively.
