Penguin2: Ordinarily I would leave you to suit yourself but I will never allow you twist the clear provision of the constitution in order to prepare a soft ground for a kangaroo judgment.
Look at that subsection D very well.
After the reference to a court in Nigeria, it went to state other possible fines that could be instituted by “any court or tribunal”. English no suppose hard na.
Again, I thought you said it had 10 years expiry date? Can you see it?
U go dey alright las las It is the same thing.a sentence anywhere in the world and sentence is conviction.where is the conviction? |

9jaRealist: It most certainly does NOT..
An elementary rule of legal interpretation is that the more things are specifically provided for or spelt out in a statute, the more it is assumed that those things not specifically so provided are excluded or otherwise NOT covered. Accordingly, while in Section D, the statute specifically provides that the extant death sentence must have been imposed by “any competent court or tribunal in Nigeria” but only provides that fines must be imposed by just “any competent court or tribunal” without including the qualifier “in Nigeria” signifies that there is NO geographical or national restrictions with respect to the latter. > I can agree but you will also agree that the constitution is talking about conviction clearly.it states sentence of fraud, dishonesty or fine and sentences are from conviction and there was no conviction |

Penguin2: Look again…
Can you see “any court”? Of law or tribunal in Nigeria and all the sentences equals conviction |
Politics › Re: Tinubu Never Challenged Forfeiture Order - Peter Obi Tells Tribunal by Lotanna2: 1:44pm On Jul 22, 2023 |
Penguin2: Go back and read that subsection D. This time read it to the end.
How many “OR” can you see? Did you see “any court”?
You can’t read the constitution in piecemeal just to extract the narrative you think suits you.
And whatever is provided for subsection E cannot apply to Subsection D. These subsections are independent and of equal weight. A court in Nigeria qualifies section D.the sentence must be conviction or something equivalent involving fraud or dishonesty.it says death sentence or imprisonment or sentence of fine which means conviction because when you are convicted, you must be imprisoned or alternatively fined.there is no such thing against tinubu |

Tinubu is the only "president" that has failed to score 25% in Abuja
He also lost in his home state Osun and he equally lost in the Lagos he claimed he built
How exactly did Tinubu win? He miraculously won in his opponents strongholds
What a miracle Two third of Abuja is 300k.25% is 75k and tinubu had 90k |

You cannot successfully trade in narcotics without dishonesty or fraud.
When you conceal and do not disclose what you are carrying across the borders, you are both dishonest and fraudulent.
Fraud has a very wide meaning an it includes embezzlement, concealment, illegal business etched It is not within Nigeria |

Can't you see the judge clearly said the funds should be held by the bank pending the final judgement? It was the bank who informed Tinubu of the forfeiture being that the order was given against the bank as you can see in your snapshot. Tinubu was in Nigeria then, not US. Learn to read and understand. Since you claim the settlement was out of court, based on your snapshot, what then is the final judgement of the court? Won't Tinubu rule you for 8 years as well? Why are you APC dunderheads so daft like this? You keep mouthing this rubbish as if Tinubu is president of those who voted Obi or Atiku alone. How much are you buying fuel now? Kukutente23: You're coming around to telling the truth though there are still snippet of lies as is usual with an APC rat. Phase1 Shephard filed the motion for 1m forfeiture based on IRS investigation by Agent Moss. Phase 2 Moss couldn't have filed a motion because he's not an attorney. He was an investigator. He testified against Tinubu. The FBI briefs later showed that the referees for the accounts were indicted for drugs which led Moss to believe the reason why tinubu failed to file tax returns for those accounts was because the were proceeds for the traffickers. He interviewed Mobil who said tinubu was just a junior levering staff on a 2400 salary a month and couldn't have had millions of dollars from his legit earnings. This falsifies the claim tinubu made in an interview with TheNews that he was already a millionaire in dollars while working for Mobil. Mind you, in that interview, he claimed he never worked in Mobil USA but UK. Phase 3 Judge Nordberg never said anything about ex parte order as you claimed. Tinubu was simply informed of the forfeiture by his banks after which he claimed two of those three accounts contained funds kept in trust for his mum and uncle. Phase 4 No out of court settlement anywhere. Since Tinubu couldn't explain the source of funds of the third account, which is the one Agbele and Adegboyega helped him to open, the judge ordered the funds be forfeited and the judgment entered as final settlement in the matter without any indemnity on future claims concerning the funds. Note that tinubu did not go to the US to claim the funds physically. He only hired a lawyer on his behalf. So i guess, the US authorities thought it will be a waste of time trying to get him to the US without strong evidence linking him to narcotics beyond housing funds. Thus, the decided to take the money and die the matter. So your claim like tinubu sat down to negotiate settlement with IRS is a big lie. In summary, obi and atiku are wasting their time reminiscent of pdp and obi bush rats.this prayer is dismissed.tinubj will rule you 8 years.below is the screenshot of the judge order mentioning exparte motion

DesChyko: No. Those are top copies. Any paper they appear on is a hardcopy. In fact, any paper on which something is printed on is a hardcopy. That's basic English.
INEC don't have the top copies, that's why they failed to provide them even when subpoenaed to do so. And the Electoral Act 2022 approves the use of iREV copies in case of any contention. Inec has the top copies, obi presented them in court but failed to lead them in evidence or demonstart them or identify discrepancies there.irev copies must be compared with other copies in times of contention.during cross examination of prof ofoedu, inec compared a top copy with irev and irev was not blurred and had more authentic info |

Kukutente23: And I'm educating you that's the final order with no indemnity. Go and read the court records. You're arguing about what you don't know or haven't read and understood. The judgement which Obi and Atiku is referring to is for the$460k while the first one you're referring to was over over 1m. Go and verify There was no judgement, there are four phases Phase one,us attorney Michael j Shepard filed a complaint motion for for forteiture pending procedures. Phase two,us internal revenue agent Kevin moss also filed a motion for seizure pending court proceedings based on his investigation.he confirmed that tinubu worked with Mobil and Deloitte Phase three, judge nordberh clearly identified that it was an exparte motion brought to it by the us attorney and gave the temporary order pending when all parties are served. Phase four,an out of court settlement supervised by the court or compromise agreement was reached where two accounts were unfrozen and one was forfeited which amounted to 460k via civil forfeiture.the judge merely supervised and formalised it,it was not a judgment or sentence or fine.no guilty charge was found.it was just a court supervised agreement akin to a property or marriage case.obi and atiku as usual wasted their time on this |

Politics › Re: Tinubu Never Challenged Forfeiture Order - Peter Obi Tells Tribunal by Lotanna2: 11:15am On Jul 22, 2023 |
Kukutente23: You're confusing the two. There was a first order to close the three accounts linked to Tinubu with citibank, heritage trust and one other bank. That was the order you're referring to as temporary for not filing tax returns on then. It was after Tinubu showed up to make claims that the issue of drugs came up through IRS agent Kevin Moss. It was at that point that the judgement by the 9th Circuit court of illinois was entered to release the other accounts after he was able to prove he held those other monies in trust for his mother and uncle, while that of heritage was forfeited since it was established that Agbele and Adegboyega, who were both in jail for narcotics trafficking made transfers to, and were actually the referees when he opened the account. Go back and read the court documents. You are going far.obi and atiku are challenging based on that 460,000 dollars forfeiture.they are claiming it is a sentence or fine, they are not talking about the aftermath, they are limiting themselves to that forfeiture entered by the judge and I am also talking based on that that it wasn't a judgment nor a sentence or fine but a temporary order |
