That GEJ meant well for Nigeria must be at the realm of conjectures because a president who meant well for his country will not be arming Dokubo, Tonpolo, Gani Adams, keeping Mrs Allison Madueke inspite of myriads of accusations of corruption against her, patronise dregs like FFK, Doyin Okupe and Reno Omokri who tell lies to keep him in darkness and look away when his own wife was announcing that opposition politicians should be stoned, if you have any other that depict "mean well", let me know, OK!

it is more of GEJ's lack of leadership abilities, if he had provided good leadership and the people of Nigeria have come to see him as a true leader who meant well for them, no foreign power can disrespect and undermine his authority, cheers!

Politics / Global Ploy To Defeat Jonathan, Netanyahu? By Minabere Ibelema by mamajohn(f): 5:24am On Mar 15, 2015
Last Tuesday, Israeli Prime Minister
Benjamin Netanyahu made a curious
allegation: that the world is
conspiring to get him out of office.
The Israelis are going to the polls on
March 17, eleven days before
Nigeria’s election.
“It is a very tight race,” Reuters
quoted Netanyahu as saying.
“Nothing is guaranteed because there
is a huge, worldwide effort to topple
the Likud government.” Nigerian
President Goodluck Jonathan has not
expressed a similar sentiment, but
one has to wonder whether the
beleaguered fellow doesn’t feel the
same way.
Jonathan and Netanyahu are facing
some political parallels. They both
head political parties that seemed
invincible not long ago. Then in both
cases a coalition of opposition
parties emerged to pose a formidable
challenge. What the All Progressives
Congress is to the Peoples
Democratic Party in Nigeria, the
centrist but slightly more liberal
Zionist Union party is to the Likud
party in Israel.
Netanyahu didn’t explain what lead
him to conclude that the whole world
is conspiring to oust him and his
party. Might it be intelligence from
the highly touted Israeli intelligence
agency, Mossad? Might it be the
increasingly strained relationship
with the U.S. President Barack
Obama’s administration? Or the rising
voices of displeasure with his
policies coming from European
capitals?
Along with the Obama administration,
Europe seems finally to be losing
patience with Israeli intransigence in
peace efforts, and Netanyahu is its
current embodiment. For long his
aggressive policy of creating Jewish
homelands on Palestinian territories
was evidence enough that he had no
plans to grant the Palestinians their
own state. Yet the United States and
European powers pretended that
Israel was negotiating in good faith.
With the approaching election,
however, Netanyahu jettisoned all
pretences. He announced last
Sunday that his Likud government
has no plans to cede any portions of
the West Bank to the Palestinians.
Along with Gaza, the West Bank
happens to be the prime territory for
any Palestinian state.
Meanwhile, Netanyahu has intensified
his quest to scuttle ongoing
negotiations to keep Iran’s nuclear
programme from turning into a bomb
producing facility. He would rather
that the United States resort to
bombing those facilities immediately.
And he has repeatedly threatened
that Israel would do it if the United
States doesn’t.
Netanyahu took that argument to the
U.S. Congress recently in an event
that violated all diplomatic protocols
and created further tension with the
Obama administration and many
more. He was invited to speak by
Congressional Republicans who
never seem to forego any opportunity
to thumb their noses at Obama. The
invitation was issued without
consultation with the presidency or
use of normal diplomatic process.
And so Netanyahu’s long-resented
bellicosity has apparently stirred a
lot more ire. So when he said that
there was global effort to have him
defeated, he was not entirely wrong.
He was exaggerating, however, to stir
his supporters’ passion and get them
thronging to the polls.
The Jonathan case
Unlike Netanyahu, Jonathan is widely
seen as an amiable fellow. Still, he
too might have his grouse against
the world. He cannot claim a massive
global effort to end his presidency,
but he can definitely say that the
wind of opinion is not blowing in his
direction.
An indepth article posted online last
Tuesday by The National Interest, a
notable intellectual U.S. magazine,
was essentially a case for the
election of Muhammadu Buhari. First
there is the headline, “Muhammadu
Buhari: Nigeria’s ticket to a strong
democracy?” Underneath the headline
is a large photo of Buhari sitting
statesman-like next to the U.S.
Secretary of State John Kerry. And
underneath the photo is this caption:
“The challenger to Goodluck
Jonathan could do wonders for
Nigeria.”
Much of the rest of the article by
Kevin A. Lees, a Washington-based
lawyer and political blogger, was
about the failures of the Jonathan
administration and why Buhari is the
probable answer. His major case
against Buhari was that he overthrew
an elected government in 1983, but
that was noted just in passing.
Though the magazine is not the voice
of Washington, it is quite influential.
And it is improbable that Lees’ overt
editorial doesn’t reflect broader
leanings. The U.S. business
establishment has hinted as much by
issuing a statement — out of the
blues — that it would have no
problem with a Buhari presidency.
The influential British magazine The
Economist even more pointedly
endorsed Buhari in an editorial that
ran on Feb. 7, one week before the
previous date of the election. To the
editors, the choice is between an
incumbent “who has proved an utter
failure and an opposition leader “with
blood on his hands.” And if they had
to, they would vote for the latter,
though “with a heavy heart.”
Then there was the U.S.
government’s shrill reaction to the
postponement of the election.
Washington doesn’t usually react
that way on matters involving
governments it is happy with. When
Egypt’s General Abdel Sisi sacked the
elected Brotherhood government of
Mohamed Morsi, for example, the
Obama administration refused to call
it a coup. It issued only tepid
statements about restoring
democracy.
The Jonathan administration must
have incurred Washington’s
displeasure by openly criticising it for
refusing to arm the Nigerian military
in their fight against Boko Haram.
And Washington doesn’t take such
criticisms too lightly.
Of course, Washington is concerned
about Buhari’s considerable
baggage. However, in his National
Interest article, Lees dismissed the
concerns as a “knee-jerk distaste.”
Washington has evidently come
around to seeing Buhari as someone
it can do business with.
Britain too seems to be sending a
signal that Buhari is acceptable.
Though unofficial, Buhari’s invitation
to speak at Chatham House in
London has all the appearances of a
feeling out occasion. Opponents’
claim that the visit was for medical
help is entirely plausible. It is within
reason that Buhari may have killed
two birds with one stone.
Lees writes that the trip is a “charm
offensive” to offset the “cozy
relations between the Jonathan
government and Western
governments.” If that is the case, all
Buhari needed to do was to flash his
gap-toothed smile and assure the
West that he is no Islamist, or at
least that he is a reformed one.
All said, whether Jonathan and
Buhari are voted out of office will
depend not on any global allignment,
but what the respective electorate
think is in their best interest.

Jonathan Sends Mbeki, Abdusalami
To Beg Buhari Not To Probe Him
by Abdulgafar Alabelewe, Kaduna,
TheNation
Former South African President,
Thabo Mbeki and Former Nigerian
Military Head of State, General
Abdulsalami Abubakar Monday,
stormed Kaduna to meet with the
Presidential Candidate of All
Progressives Congress (APC),
General Muhammadu Buhari over the
forth coming general elections.
At the end of the meeting which was
held behind closed doors at General
Buhari’s office along Jabi Road in an
eyebrow area of Kaduna metropolis
Monday morning, neither the visitors,
nor General Buhari spoke with
newsmen.
Mbeki and Abdulsalami left to the
Kaduna International Airport to fly
back to Abuja after a photo session
which marked the end of the over
one hour meeting.
However, a source close to General
Buhari told our Correspondent that,
the meeting was unconnected with
the Presidential election rescheduled
for March 28.
According to the source who spoke
unofficially said, “They are here to
prevail on General Buhari not to
probe Jonathan after emerging
President in the coming election.”
He went further to say that, “you see,
they have realized that, all efforts to
turn Nigerians against General Buhari
have failed and all manner of opinion
polls have favoured the old man,
even the ones the government
organized.
“They have also made several
attempts to make the APC national
leader, Asiwaju Bola Ahmed Tinubu
compromise and sell out, but he has
refused. So, having realized that,
Buhari will win the election, they
have been sending people to prevail
on him not to probe Jonathan for his
misdeed.
“So, this delegation was sent to beg
General Buhari not to probe President
Goodluck Jonathan after winning the
election,”he said.

Even in the southwest, the governors of Ondo and Ekiti States are supporting GEJ not because of their love for him or their believe in his ability and competence, but for self preservation since the duo are completely finished politically should GMB win the Presidential race and I can say with all assurance that the two southwest governors are already changing tactics, the governor of Ondo State is PDP in the open but there are insinuations in Akure that the governor is already putting in place machineries to placate GMB and APC since he knows that a GEJ's candidacy if like an impossibility
Let's be fair to Adamu Muazu, this is a man who was governor in 1999 when GEJ was deputy governor, to respect GEJ as president is easy for him since fate and destiny designed it that way but for him to crawl before his illiterate wife is a practical impossibility, ire o!

Politics / Jonathan Renews Efforts To Woo South-west Voters by mamajohn(f): 3:18am On Feb 20, 2015
President Goodluck Jonathan and his
campaign handlers have redoubled
their efforts to get significant votes
from the South-West during the
March 28 presidential election.
The PUNCH gathered on Thursday
that the decision was based on
calculations that the zone, because
of its high number of registered
voters, was critical to Jonathan’s re-
election.
A Presidency official told one of our
correspondents that that was why the
members of the Peoples Democratic
Party Presidential Campaign Council
decided that Jonathan should reach
out more to political, opinion leaders
and traditional rulers in the zone with
a view to getting their support.
He said that Jonathan and his
handlers had therefore decided to
use his ongoing visit to the South-
West to carry out the task.
Jonathan, who was in Lagos on
Thursday to inaugurate four Naval
platforms, is expected to remain in
the zone till Sunday. He later met
with the Yoruba Council of Elders at
the State House, Marina, Lagos.
Our source said the campaign team
believes that the meeting could
easily influence their (YCE ) followers
to support Jonathan.
According to him, barring any last
minute change in plan, Jonathan will
be visiting the Alaafin of Oyo, Oba
Lamidi Adeyemi III, on Saturday.
On the same day, the President will
visit the Ooni of Ife, Oba Okunade
Sijuwade.
He said, “You will recall that when
the President visited Ibadan for his
campaign, he only visited Olubadan.
We have identified the need for him
to also visit the Alaafin of Oyo.
“The same thing happened when we
were at Osogbo for the presidential
rally. He visited the Ataoja of
Osogbo. We have found it necessary
to visit the Ooni of Ife.
“More traditional rulers from the zone
will be reached out to during this
period, one way or the other.
“The simple message for these
monarchs is for them to support the
President’s re-election bid.”
The opposition All Progressives
Congress controls three states in the
South-West(Lagos, Oyo and Osun)
while Jonathan’s Peoples Democratic
Party is in charge of Ekiti and Ondo
states. The PUNCH had reported
exclusively on Tuesday that following
the delay of polls dates, the PDP
Campaign Council had resolved to
begin another round of state-wide
campaigns.
It was reported then that unlike the
just-concluded campaigns that took
Jonathan to about 35 states, about
10 states would be visited during
this round for more “penetration and
consultations.”
Some Yoruba leaders, who converged
on Akure, Ondo State on Thursday to
review the recommendations of the
National Conference, concluded that
a vote for Jonathan would ensure the
implementation of the conference’s
recommendations.
The meeting by the Yoruba leaders
under the aegis of Afenifere Group.
was tagged, ‘’National Conference,
2015 Elections and the Yoruba
Nation.’
The Chairman of the occasion, Chief
Ayo Adebanjo, set the tone of the
meeting, saying that the support
expressed by Afenifere for Jonathan
was not partisan but based on the
interest of the South-West people.
He said the vision of a restructured
Nigeria was being realised with the
convening of the 2014 National
Conference.
Adebanjo said, “We are supporting
Jonathan because of the consistency
of the Yoruba to have this country
restructured so that it can develop.
“People are calling for change. I want
a change in the constitution of
Nigeria. Only a change in the
constitution can truly bring about the
change that we need.”
The convener of the summit, who is
also the Ondo State Governor,
Olusegun Mimiko, stressed the need
for change in the 1999 Constitution
so as to enable the Yoruba nation to
grow its economy independently.
He said, “The Confab report, when
implemented, will create room for
each state to have its own
constitution, its own police force, its
own prison service. Each state can
create its own local government, can
build its own airports, sea ports and
railways in addition.
“In the economic domain, solid
minerals that had been the exclusive
preserve of the Federal Government
since independence, have now been
brought to the concurrent list. States
can now create employment and
develop at their own pace. With all
that, it liberates everybody; it opens
up the political space.”
Mimiko noted that Jonathan was
genuinely committed to transforming
Nigeria through the convening of the
National Conference, adding that the
outcome had proved sceptics wrong.
He said now that those deriding the
conference had been proved wrong,
they had been scheming “to hijack
power so as to throw the Confab
report to the dustbin of history.”
In their goodwill messages, the
Founder of the O’odua Peoples
Congress, Frederick Faseun, and the
National Coordinator, OPC, Gani
Adams, warned that the National
Conference report remained a vehicle
for actualising the Yoruba dream of a
prosperous South-West.
Others in attendance were Kunle
Olajide, Biodun Olujimi, Makanjuola
Ogundipe, Femi Okurounmu, Gboyega
Isiaka, Jide Adeniyi, Yinka Odumakin
and the Minister of State for Works,
Dapo Adeyeye.

1- do you know what is called CIVIL SERVICE COMMISSION PROCEDURE? Nobody is trying to sack Jega but he must go to 3months terminal leave as required by civil service procedure.

2- is INEC really ready to conduct elections on February 14 & 28? The answer is NO. If INEC is ready what happened to over 25% of Nigerians voters who are yet to get their PVC? Was INEC going to conduct a fresh election in 3North Eastern states on a later date or are their votes not needed? Remember Jega told us in 2011 that he was ready but inbetween election he had to shift state elections.

3- If all is well in North East, why did EU observers say they wont be going their to observe votings. Dont you know that what happens over there could be the game changer.

4- why was Jega in a hurry to conduct this election in February? This will be our 5th elections since return of democracy in 1999, tell me how many of the elections took place in February.
Incase yo dont know Jega knew that he will be going on terminal leave on or before March 28 that was why he wanted to hurridly conduct this election before taken off.

Politics / Parties Kick Against Plot To Sack Jega by mamajohn(f): 3:09am On Feb 10, 2015
The plot to sack the Chairman of the Independent National Electoral Commission, Prof. Attahiru Jega, is gathering momentum, The PUNCH investigations have revealed.

Jega’s tenure ends on June 30 but his traducers, especially some Peoples Democratic Party members, are already compiling what they described as his ‘sins’ to ensure that he proceeds on terminal leave before the March 28 and April 11 elections.

Findings on Monday revealed that the “sins,” include alleged transfer of some INEC officials considered close to them out of their departments where their input might not be useful in the conduct of the elections.

It was also gathered that the PDP members, who are close to the Presidency, feel that Jega is becoming unapproachable on issues.

A source in the Presidency, who did not want his name in print, said that the reason the INEC boss gave for the postponement of the elections had negatively affected the credibility of the Presidency and the PDP.

He said, “The way Jega spoke at the press briefing where he announced the postponement of the polls, was meant to implicate the PDP and the Presidency.

“This was why everybody, including foreign governments, have been blaming the leadership of the country for the postponement of the elections.

“The summary of Jega’s presentation was that INEC was ready but that the security agencies, whose headships are appointees of the President, frustrated the commission’s desire to hold the elections on February 14 and 28.”

He added that some national leaders of the PDP would meet with President Goodluck Jonathan and members of his electioneering team this week to review the presidential campaign.

The meeting, according to him, will also “discuss the wisdom in sending Jega on terminal leave any moment from now because of his perceived sins.”

He added, “Close friends of the President in the party and the stakeholders will meet to review the campaigns and I can tell you that the issue about Jega matter would certainly be discussed.

“We have received several reports on this matter and I can assure you that it would be looked into and a decision taken.”

Further investigations however showed that before the postponement of the elections, the military had directed its commands nationwide to prepare operational methodology for the exercise.

A reliable military officer told The PUNCH in Abuja that they were surprised to hear Jega blame the poll postponement on the unpreparedness of the military.

He said, “We were astonished to hear that we were not prepared and all that. How many officers do we have in the North-East? How many of our men were deployed for the last governorship election in Osun State? So there are things we have not been told about the elections.”

However, some political parties under the aegis of the Coalition of Progressive Political Parties, have vowed to frustrate any attempt to stop Jega from conducting the elections.

They warned at a news conference in Abuja on Monday, that Jega’s removal would affect the credibility of the elections.

The Chairman of the Peoples Democratic Movement, Bashir Ibrahim, who spoke for the group, said that though the INEC chairman played into the hands of the PDP by rescheduling the election dates, “we are going to resist the move to remove him from office.

“The role of the election management board led by Jega in shifting the dates of the election may not be the best, but any move to remove him will be resisted,” Bashir added.

The leader of COP said that if the INEC chairman was removed, it would show that the shift was engineered by the ruling PDP for ulterior motives.

Also on Monday, a coalition of 18 civil society organisations called for the immediate resignation of the service chiefs “for arm-twisting INEC’’ and for abdication of national responsibility.

The CSOs which passed a vote of confidence in Jega, explained that they were calling for the resignation of the service chiefs because their action was “a clear indication of the abyss to which the military had descended to.”

The Chairman of the Transitional Monitoring Group, Ibrahim Zikirullahi, spoke on behalf of the CSOs at a news conference in Abuja.

He said, “The most worrisome reality is that the Nigerian military, which is supposed to be nationalistic and patriotic in outlook, has allowed itself to be led by those they serve for expressly narrow interests.

“To say the least, the military has failed the Nigerian people. It is a betrayal of trust for the military in connivance with the National Security Adviser to have allowed itself to be used to suspend Nigeria’s electoral process.

“The grand conspiracy to arm-twist INEC to shift the 2015 general elections to satisfy narrow political considerations is a clear indication of the abyss to which the military has descended.

“The claim that they will not be able to protect INEC personnel and materials for the polls that were to hold on 14 and 28 February 2015, is a national disgrace and embarrassment.”

Zikirullahi stated that the excuse by the military that it needed “to concentrate on the fight against Boko Haram, is untenable.”

He wondered the kind of magic the Chief of Defence Staff and the NSA wanted to perform to deal with Boko Haram in six weeks that it could not do in six years.

Zikirullahi added that the CDS had in the past fed Nigerians with lies pertaining to the ongoing fight against insurgency and therefore called on all security chiefs and the NSA to bury their heads in shame and resign.

“The Civil Society Coalition hereby calls for their immediate resignation, for abdicating a national responsibility, and attempting to drown the voices of the Nigerian people. The current military high command, if they still have any iota of honour and good conscience, should immediately vacate their positions,” he insisted.

Zikirullahi advised Jega to resist any attempt to push him out of office.

“This coalition respects and understands INEC’s position that it was ready to go ahead with the elections, until the military decided to abdicate its constitutional duty,” he stressed.

Politics / Legal Position On Buhari's Educational Qualifications by mamajohn(f): 4:52am On Feb 09, 2015
The controversy over the exact status of the presidential candidate of the All Progressives Congress, Maj. Gen. Muhammadu Buhari’s educational qualifications in relation to his eligibility to aspire for election into the office of the President of the Federal Republic of Nigeria had been generating intense debate in recent time, forcing a closer examination of relevant constitutional provisions with a view to offering insights into the legal position on the matter.

Let me start by saying that the issue as to whether Buhari or any other candidate is eligible in terms of educational qualifications to aspire to the office of the President of Nigeria is not a trivial matter or a non-issue, but one of fundamental and constitutional significance that clearly falls within the realm of issue-based campaign. I therefore disagree with any suggestion that those raising the issue are petty or engaging in any smear campaign against Buhari’s candidacy. It is therefore proposed in this intervention to examine relevant constitutional provisions on the matter, including judicial attitude through the cases in order to assist informed analysis on the subject matter.

Section 131(d) of the Constitution of the Federal Republic of Nigeria (as amended) dealing with qualification for election for the office of the President provides as follows:

“A person shall be qualified for election to the office of the President if -

…he has been educated up to at least school certificate level or its equivalent.”

On the surface, one may be inclined to think that the clear import of this constitutional provision is that the minimum qualification that an aspirant for such exalted high office must possess is education up to at least the secondary school level. What then is the meaning of the phrase ‘minimum’?

The Black’s Law Dictionary, 8th edition, page 1016 defines ‘minimum’ as follows:

“Of, relating to, or constituting the smallest acceptable or possible quantity in a given case…”

The question that arises is whether in the light of the above constitutional provision, such aspirant necessarily must acquire such secondary school certificate or whether merely passing through the four walls of a secondary school without graduation from the said secondary school will suffice to satisfy the provision. In the case of HASKE V MAGAGI (2008) 3 LRECN PG. 127 AT 130 RATIO 2, the Court of Appeal, Kaduna Division held on the meaning of ‘Education up to secondary school certificate level or its equivalent as follows:

“Section 318(1) of the 1999 Constitution defines, “school certificate or its equivalent” in sub-paragraph (b) thereof to inter alia, mean, “education up to secondary school certificate level.” It is the law that where a word or phrase has been legally defined in an enactment, not only will its ordinary or popular meaning give way, its meaning according to its definition in another legislation can also not be imported into the enactment in which it has also been defined. See Yaro v Kurdah & Anor (1989) 1 NEPLER 1. Thus, in a number of decided cases, this court held that the meaning or the definition of the level “school certificate” or its equivalent as contained under Section 318 of the 1999 Constitution, can accommodate a candidate who woefully failed in their bid to obtain a West African School Certificate. They are described as WASC “attempted” to “failures”. In essence, a candidate need not to have obtained the secondary school certificate level or passed the Secondary School Certificate Examination. It is sufficient that such a person has attended a secondary school and read or studied up to the secondary school level, without passing and obtaining the certificate. See Bayo v. Njidda (2004) 8 NWLR (Pt. 876) 544; (2003) 3 LRECN 114. Chukwu v. Icheonwo (1999) 4 NWLR (Pt. 800) 597; (1999) 4 LRECN 332. (Pp. 143-144, paras, G-C).”

Similarly, in the case of AIKULOLA VS. AKOGWU (2006) 41WRN pg. 29 – 111 particularly at 46 ratio 11, the Court of Appeal, Abuja Division, while construing the meaning of the words ‘school certificate’ under Section 318 of the 1999 Constitution, held as follows:

“Under section 318 of the 1999 Constitution, the word “school certificate” or its equivalent means:

(a) Secondary School Certificate or its equivalent or Grade II Teachers Certificate, the City and Guilds Certificate; or

(b) Education up to Secondary school level; or

(c) Primary Six Leaving Certificate or its equivalent plus

(i) Service in the public or private sector at the federal level in any capacity acceptable to the Independent National Electoral Commission for a minimum of 10 years and

(ii) Attendance at course and training in such institutions as may be acceptable to the Independent National Electoral Commission for periods totaling up to a minimum of one year; and

(iii) The ability to read, write and understand and communicate in the English language to the satisfaction of the commission.

In effect, a person seeking to become a candidate for an election to the House of Assembly of any State in the Federal Republic of Nigeria must possess at least one of the qualifications set out in (a) or (b) or (c) above. See Bayo v. Njidda (2004) 8 NWLR (Pt. 876) 544 at 618 – 620.

According to Per Odili, JCA (Pp. 81 – 82) lines 45 – 35, ‘School certificate or its equivalent’ means -

(a) A secondary school certificate or its equivalent, or Grade II Teacher’s Certificate, the City and Guilds Certificate; or (G) education up to Secondary School Certificate level; or (c) Primary Six School Leaving Certificate or its equivalent.”

Per Rhodes-Vivour, JCA (P. 104) lines. 30 – 45, in the case of DIGAI V. NANCHANG (2003) 2 LRECN pg. 513 – 546 at pg. 515 ratio 4 dealing with the requisite educational qualification for membership of a state House of Assembly, the Court of Appeal, Jos Division held as follows:

“From the provision of Section 106(c) of the Constitution of the Federal Republic of Nigeria, 1999, all that is required of a member of a House of Assembly by way of educational qualification, is that he has been educated up to the school certificate level or its equivalent.

“A close reading and analysis of Section 106(c) and Section 318 clearly shows that all that is required of a candidate for the membership of House of Assembly, is that he had attended a secondary school up to school certificate level or its equivalent. To my mind, a testimonial from secondary school showing clearly that the 1st respondent attended and completed a secondary school as prescribed in section 106 (c) of the Constitution is sufficient. What is required under the law is that there must be evidence that a candidate is educated up to the school certificate level, and not that he must produce a certificate to that effect. (Pp. 542-543, paras G-D)”.

On whether the candidate need possess such school certificate to be eligible to contest, the same court held in the same ruling as follows:

“I agree that since there is evidence that the 2nd respondent sat for the School Certificate Examination on May/June 1975, this is sufficient to satisfy the requirement of Section 10(c) of the Decree. While the acquisition of sound education may be desirable to enable one discharge the functions as Chairman of Local Government Council, it is not absolutely necessary that such a person must possess a certificate to enable him to function effectively.” (P. 545, paras. B-D)”.

The other issue that is relevant is the question of who has the burden of proof; whether it is the candidate who is aspiring for the public office that must show that he has passed through a secondary school or the person alleging otherwise that must show that the aspirant does not hold such qualification. The answer to this poser was given in the case of Haske v. Mogaji (supra) where the court held on the question of onus to prove as follows:

“It is both legal and logical that the mere fact that a party has pleaded in his petition that the other party is not qualified to contest an election, because he lacked the requisite educational qualification, is not sufficient for the Tribunal to latch unto it and decide on it, in the absence of cogent and credible evidence of such non-qualification or disqualification being placed before the Tribunal. In the absence of evidence, such a plea in the petition ends and/or terminates with the petition”.

It is clear from the foregoing that it is the person alleging non-qualification of the candidate that has the responsibility of showing by cogent or convincing evidence that such aspirant never attended any such Secondary School as alleged.

The foregoing analysis may have revealed the following:

(a) Buhari’s eligibility to contest for the office of the President of Nigeria can only be challenged if those making the allegation can show either that he has never attended any secondary school, that he never possessed any primary school leaving certificate, that he has never served in any public service for a period of 10 years in addition to his primary school certificate or that he has never sat for any school certificate examination.

It is immaterial whether he passed or failed such examination. To succeed, they must also show that he does not possess any higher qualification above the minimum requirement of secondary school certificate. In other words, they must show that all certificates acquired by the General in consequence of his military training at home and abroad, culminating in his rising to the position of a Major General in the Nigerian Army, were certificates below secondary school level or certificate. It is those making these allegations who must prove the allegations against the General. It is not the General who must show that he possesses such qualifications. The law is, ‘He who asserts must prove’.

(b) The Army authorities had publicly admitted that they have records of Buhari’s educational qualifications in their custody. The Army being a public institution can furnish the Certified True Copies of Buhari’s educational qualifications to appropriate authorities including INEC at the request of those making the allegations without bordering the General for such obligations.

It can be said that those who have raised the issue of the General’s qualifications and eligibility may have served patriotic intentions, but they need to do more by showing through concrete, cogent, compelling and believable evidence that the General neither attended any secondary school nor possesses any primary school leaving certificate including showing that his period of service in the army including service as Head of State of Nigeria in total do not rank up to 10 years for them to succeed in their patriotic crusade.

Finally, having raised the constitutional issue of qualification, no doubt an issue-based campaign, those interested in taking the issue further are advised to be guided by judicial pronouncements quoted copiously above if they want to be taken seriously. However, if they are basing their conclusion on speculations not backed up with empirical evidence, it is wise to advise them to consider the issue as closed while moving to other issues in the campaign that ought to be dictated by issues and not sentiments.
