The truth is that APC has not root or bearing in Rivers, with or without any interference APC can never win ward election, the mere mention of APC irritates them. Amaechi is political inconsequential in Rivers. |

Lawyer and human rights activist, Mr. Femi Falana (SAN), has branded as illegal the ongoing efforts by the two chambers of the National Assembly to amend the Code of Conduct Bureau and Code of Conduct Tribunal Act. In a letter to the Speaker of the House of Representatives, Yakubu Dogara, Falana said though the House of Representatives has not started deliberations on the bill for the proposed amendment, Falana advised Dogara not to lend support to the illegal amendment of the Act. The letter also urged the Speaker to remind members of the House that when the Corrupt Practices and other Related Offences Act 2000 was amended in 2003 on account of the investigation of allegations of corrupt practices involving the leadership of the Senate, the Federal High Court set aside the amendment as it violated the Constitution. The same fate warned the letter, awaits the Bill to amend the CCB and CCT Act. It urged the House to persuade the Senate to terminate further debates on the Bill, which it passed it for second reading last week, barely 48 hours after its presentation by its sponsor, Senator Peter Nwaoboshi. Falana, who described the proposed amendment as hasty, added that the fact that it has coincided with the trial of the Senate President, Dr. Bukola Saraki, by the Code of Conduct Tribunal (CCT) for alleged false assets declaration is an indication of insensitivity and opportunism by the National Assembly. "It is insensitive, suspicious, self-serving and opportunistic. It is also illegal and unconstitutional in several respects," the letter read. Falana contended that the illegality of the proposed amendment is inherent in its design to serve the interests of an individual, a fact that violates Section 4(2) of the Constitution, which has empowered the National Assembly to make laws "for the peace, order and good government of the Federation or any part thereof..." The letter, which was copied to Saraki, also pointed out the Senate President's decision not to preside over the plenary session whenever the bill comes up for debate violates the Code of Conduct for Public Officers. "The whole exercise is a clear violation of paragraph 1 of the Code of Conduct for Public Officers enshrined in Part 1 of the Fifth Schedule to the Constitution, which stipulates that 'A public officer shall not put himself in a position where his personal interest conflicts with his duties and responsibilities, ' the letter stated. Falana also argued that Section 3 of Act, which the National Assembly seeks to amend, is already invalid and inoperative. "Senator Nwaoboshi was reported to have said that he was proposing an amendment to Section 3 of the Act to provide 'for an opportunity for the person whose rights and obligations may be affected to make representations to the administering authority before that authority makes the decision affecting that person.'. "With respect, Section 3 of the Act is in pari materia with Paragraph 3(e) of Part 1 of the Third Schedule to the Constitution. To that extent, Section 3 of the Act is inoperative and invalid in every material particular," the letter added. Citing the matter of Attorney-General of Abia v Attorney-General of the Federation (2001) 17 WRN 1, Falana said the Supreme Court held thus: " Where the provision in the Act is within the legislative powers of the National Assembly, but the Constitution is found to have already made the same or similar provision, then the new provision will be regarded as invalid for duplication and or inconsistency and therefore inoperative. The same fate will befall any provision of the Act, which seeks to enlarge, curtail or alter any existing provision of the Constitution. The provision or provisions will be treated as unconstitutional and therefore null and void." Given this, he explained, the National Assembly lacks the power to make laws which have similar provisions to those of the Constitution. As such, he added, Section 3 of the Act has become a duplication of the relevant constitutional provision. " Consequently, its proposed amendment is illegal and unconstitutional. In other words, without amending the relevant provisions of the Constitution, the proposed amendment of the Act is an exercise in futility," he argued. He explained that because the proposed amendment cannot alter, enlarge or curtail the provisions of the Constitution, the Senate should stop wasting time and resources on illegality. "Since the Constitution has prohibited the enactment of ex post facto laws in circumstances of this nature, the National Assembly ought to know that the ongoing moves to amend the Act cannot have any effect on the celebrated trial of the Senate President," he stated. The Resident Electoral Commissioner (REC) in charge of the 2015 Rivers governorship election, Gesila Khan has reportedly made confessions in custody of Economic and Financial Crimes Commission (EFCC). The REC had been arrested by the zonal office of the EFCC alongside four others on Thursday, April 14 and the anti graft agency reports that over N675.1m has been discovered in the bank accounts of different electoral officers in Rivers, Akwa Ibom, and Delta states. Reports say the officials of the Independent National Electoral Commission (INEC) received and shared the said amount during the last gubernatorial election. The Punch reports that Khan had been questioned by the Department of State Security (DSS) in July, 2015, but had no charges against her. In the recent arrest, however, the residences of all the suspects were searched and incriminating documents were said to have been recovered by the commission. Khan, who has since been deployed to Cross River state, was reported to have received N185.8m ahead of the March 28 and April 11, 2015, elections. A reliable source with the EFCC revealed that Khan made confessional statements where it was gathered that she received the money through a special bank account. “Khan was the REC in Rivers State in 2015 election before she was transferred to Cross River early this year. She was said to have received N185.8m. She has made confessional statements,” the source revealed. READ ALSO: Prominent cleric criticizes Buhari over Kanu Also, one Edem Okon Essanga, a retired INEC official, was picked up by the anti graft agency alongside his alleged accomplice, Immaculata Asuquo, who is the head, voter education of INEC in Akwa Ibom. The source at the EFCC added that “Essanga received N241.1m during the general election. He admitted receiving the money and confirmed sharing it with different ad hoc workers during the election. His accomplice Asuquo has also been arrested.” Fidelia Omoile, who was the INEC electoral officer in Isoko-south local government area of Delta, was also picked up and apart the over N112m traced to her, EFCC also recovered some sensitive electoral materials. “She received N112.4m during the 2015 general election. A search warrant was executed at her residences in Asaba and Benin. “Sensitive materials used in the 2015 elections were recovered, including evidence of the suspicious bank transaction and land documents that will assist us in our investigations,” the anonymous EFCC source revealed. INEC’s administrative secretary in Delta, Oluchi Obi-Brown, was among those picked up and investigations by EFCC showed that she allegedly received over N111m and had about $75,000 in an account in the United States. The source added that “Oluchi received N111.5m during the general election. Investigations showed that she operates a foreign account with the Bank of America. As of February this year, the account balance was $75,857, (N24, 274,240),” explaining further that the total amount found in the bank accounts of the INEC officials stands at N675.1m. This is a very good move. Though am not from any political party, I support Buhari and Ifeanyi Uba on this. From what I heard from reliable source, it was IFEANYI UBA (CAPITAL OIL) that single handedly initiated and made sure the idea was implemented by Buhari. He said he was ready to risk his investment if the idea did not work. I think he should appoint Ifeanyi Uba as one of his special adviser especially on economic issues thats if he will accept it. What is happening now to the nation is more than the government can do alone. Meanwhile, we have people who will criticize every good move. I have visited Primate Olabayo. Some people will say Primate Olabayo is not a prophet, but I say it to you that Primate Olabayo is a genuine prophet of God. He is a prophet and people have benefited from his prophetic endowment. I visited him on the 10th of April 2016 to tell him the way forward for Nigeria. We spoke at length on how to organize prayers for Nigeria because Buhari cannot do it alone. We need to move this country forward and we need people who can do it. Buhari can move Nigeria forward, he has the intention and mission, but he is surrounded by people who are not with him in his mission and he does not see it. We are going to do the prayers for Nigeria. Anybody who wants to participate can come in. By the time you get my church and other prophets I want to invite, we will have nothing less than 30,000 that will register for the prayer.
