PoliticsProposed Amendment To CCB And Tribunal Act Illegal, Self-serving - Femi Falana by masterblogger(op): 6:30pm On Apr 17, 2016
Lawyer and human rights activist, Mr. Femi Falana (SAN), has branded as
illegal the ongoing efforts by the two chambers of the National
Assembly to amend the Code of Conduct Bureau and Code of Conduct
Tribunal Act. In a letter to the Speaker of the House of Representatives,
Yakubu Dogara, Falana said though the House of Representatives has not
started deliberations on the bill for the proposed amendment, Falana advised
Dogara not to lend support to the illegal amendment of the Act.

The letter also urged the Speaker to remind members of the House that when
the Corrupt Practices and other Related Offences Act 2000 was amended in
2003 on account of the investigation of allegations of corrupt practices
involving the leadership of the Senate, the Federal High Court set aside the
amendment as it violated the Constitution.

The same fate warned the letter, awaits the Bill to amend the CCB and CCT Act.
It urged the House to persuade the Senate to terminate further debates on the
Bill, which it passed it for second reading last week, barely 48 hours after its
presentation by its sponsor, Senator Peter Nwaoboshi.

Falana, who described the proposed amendment as hasty, added that the fact
that it has coincided with the trial of the Senate President, Dr. Bukola Saraki,
by the Code of Conduct Tribunal (CCT) for alleged false assets declaration is
an indication of insensitivity and opportunism by the National Assembly.
"It is insensitive, suspicious, self-serving and opportunistic. It is also illegal
and unconstitutional in several respects," the letter read.

Falana contended that the illegality of the proposed amendment is inherent in
its design to serve the interests of an individual, a fact that violates Section
4(2) of the Constitution, which has empowered the National Assembly to
make laws "for the peace, order and good government of the Federation or any
part thereof..."

The letter, which was copied to Saraki, also pointed out the Senate President's
decision not to preside over the plenary session whenever the bill comes up
for debate violates the Code of Conduct for Public Officers.
"The whole exercise is a clear violation of paragraph 1 of the Code of Conduct
for Public Officers enshrined in Part 1 of the Fifth Schedule to the Constitution,
which stipulates that 'A public officer shall not put himself in a position where
his personal interest conflicts with his duties and responsibilities, ' the letter
stated.

Falana also argued that Section 3 of Act, which the National Assembly seeks
to amend, is already invalid and inoperative.

"Senator Nwaoboshi was reported to have said that he was proposing an
amendment to Section 3 of the Act to provide 'for an opportunity for the
person whose rights and obligations may be affected to make representations
to the administering authority before that authority makes the decision
affecting that person.'.

"With respect, Section 3 of the Act is in pari materia with Paragraph 3(e) of
Part 1 of the Third Schedule to the Constitution. To that extent, Section 3 of
the Act is inoperative and invalid in every material particular," the letter added.
Citing the matter of Attorney-General of Abia v Attorney-General of the
Federation (2001) 17 WRN 1, Falana said the Supreme Court held thus: "
Where the provision in the Act is within the legislative powers of the National
Assembly, but the Constitution is found to have already made the same or
similar provision, then the new provision will be regarded as invalid for
duplication and or inconsistency and therefore inoperative. The same fate will
befall any provision of the Act, which seeks to enlarge, curtail or alter any
existing provision of the Constitution. The provision or provisions will be
treated as unconstitutional and therefore null and void."

Given this, he explained, the National Assembly lacks the power to make
laws which have similar provisions to those of the Constitution. As such, he
added, Section 3 of the Act has become a duplication of the relevant
constitutional provision. "

Consequently, its proposed amendment is illegal and unconstitutional. In other
words, without amending the relevant provisions of the Constitution, the
proposed amendment of the Act is an exercise in futility," he argued.
He explained that because the proposed amendment cannot alter, enlarge or
curtail the provisions of the Constitution, the Senate should stop wasting time
and resources on illegality.

"Since the Constitution has prohibited the enactment of ex post facto laws in
circumstances of this nature, the National Assembly ought to know that the
ongoing moves to amend the Act cannot have any effect on the celebrated
trial of the Senate President," he stated.

PoliticsINEC Officers In EFCC Custody Make Stunning Confessions by masterblogger(op): 6:20pm On Apr 17, 2016
The Resident Electoral Commissioner (REC) in charge of the 2015 Rivers
governorship election, Gesila Khan has reportedly made confessions in
custody of Economic and Financial Crimes Commission (EFCC).

The REC had been arrested by the zonal office of the EFCC alongside four
others on Thursday, April 14 and the anti graft agency reports that over
N675.1m has been discovered in the bank accounts of different electoral
officers in Rivers, Akwa Ibom, and Delta states.

Reports say the officials of the Independent National Electoral Commission
(INEC) received and shared the said amount during the last gubernatorial
election.

The Punch reports that Khan had been questioned by the Department of
State Security (DSS) in July, 2015, but had no charges against her.
In the recent arrest, however, the residences of all the suspects were
searched and incriminating documents were said to have been recovered by
the commission.

Khan, who has since been deployed to Cross River state, was reported to
have received N185.8m ahead of the March 28 and April 11, 2015,
elections.

A reliable source with the EFCC revealed that Khan made confessional
statements where it was gathered that she received the money through a
special bank account.

“Khan was the REC in Rivers State in 2015 election before she was
transferred to Cross River early this year. She was said to have received
N185.8m. She has made confessional statements,” the source revealed.

Also, one Edem Okon Essanga, a retired INEC official, was picked up by the
anti graft agency alongside his alleged accomplice, Immaculata Asuquo, who
is the head, voter education of INEC in Akwa Ibom.

The source at the EFCC added that “Essanga received N241.1m during the
general election. He admitted receiving the money and confirmed sharing
it with different ad hoc workers during the election. His accomplice
Asuquo has also been arrested.”

Fidelia Omoile, who was the INEC electoral officer in Isoko-south local
government area of Delta, was also picked up and apart the over N112m
traced to her, EFCC also recovered some sensitive electoral materials.
“She received N112.4m during the 2015 general election. A search warrant
was executed at her residences in Asaba and Benin.

“Sensitive materials used in the 2015 elections were recovered, including
evidence of the suspicious bank transaction and land documents that will
assist us in our investigations,” the anonymous EFCC source revealed.
INEC’s administrative secretary in Delta, Oluchi Obi-Brown, was among those
picked up and investigations by EFCC showed that she allegedly received
over N111m and had about $75,000 in an account in the United States.
The source added that “Oluchi received N111.5m during the general
election. Investigations showed that she operates a foreign account with
the Bank of America. As of February this year, the account balance was
$75,857, (N24, 274,240),” explaining further that the total amount found in
the bank accounts of the INEC officials stands at N675.1m.
And according to the anonymous source, the commission was banking on
the confessional statements to catch the ‘big fish’.

This is a very good move. Though am not from any political party, I support Buhari and Ifeanyi Uba on this.

From what I heard from reliable source, it was IFEANYI UBA (CAPITAL OIL) that single handedly initiated and made sure the idea was implemented by Buhari. He said he was ready to risk his investment if the idea did not work.

I think he should appoint Ifeanyi Uba as one of his special adviser especially on economic issues thats if he will accept it. He did brilliantly with the advise.

Let's all give kudos to him.

PoliticsBuhari Caged By 8 Powerful Men – Mbazulike Amechi by masterblogger(op): 5:58pm On Apr 17, 2016
ELDERSTATESMAN and frontline nationalist, Chief Mbazulike Amechi speaks on the state of the nation, insisting that Nigeria is at war and, therefore, should embrace a “declared or undeclared State of Emergency” to confront the “war” headlong. In a frank and sartorial review of the many problems of the nation
, especially under the current regime of Muhammadu Buhari the first republic Minister of Aviation accuses the President of not showing enough capacity that he can change Nigeria; a situation, he says, has fuelled the belief of an “imminent total
collapse of the nation.” The nonagenarian regrets that the setback in the fight against corruption is that “there is corruption in Buhari’s government.” He reveals that Buhari is shackled by eight powerful men who may do something to him
if he fails to toe their way, wondering what he will tell the three founding fathers of the nation( Zik, Awo, And Ahmadu Bello) when he finally meets them. He further speaks on other national burning issues. Sunday Sun met him at his country

PoliticsPrimate Ayodele Reveals Why Buhari Will Fight Obj, Tinubu by masterblogger(op): 12:42pm On Apr 17, 2016
Primate Elijah Babatunde Ayodele has made frightening prophecies about
the present administration of President Muhammadu Buhari.
The Spiritual Leader of INRI Spiritual and Evangelical Church, Oke-Afa, Isolo,
Lagos, in this exclusive interview with Vanguard, explains how he predicted
the present fuel scarcity challenges, reveals what will happen to the leaders
of the ruling All Progressives Congress (APC).

President Muhammadu Buhari and ex-president Olesegun Obasajno will soon
be at loggerheads, says Primate Ayodele.

You made some prophecies that came to pass, and they are the negative
ones. What is the solution?
There are solutions. Like I said before, Buhari will face challenges in what he
is doing. I said it before, he is facing it and I still say it now. After the
challenges, is there not going to be light at the end of the tunnel? What
Buhari has come to do is not to take Nigeria to the Promised Land but to
pave the way for it to happen. He will lay the foundation for a new Nigeria.

Foundation for a new Nigeria?

Yes. A new Nigeria is coming. The area I am skeptical about is that if the
law is not well planned, Nigeria may not be one again and we will then have
a regional system of government whereby each region will operate on its
own and I see a situation where different republics come out of Nigeria
because we failed to find drastic solutions to our problems.
May be there is security report to that effect or not, I don’t know. You
remember I said in one of my interviews in the past that Nigerians would
buy fuel for N200, N250. Has it not come to pass now? It is the same thing
I am saying now, many people may not believe. I said that some states
would collapse economically and that Buhari would become President but
that his government would be fluctuating.
Now, the solution is this, the prophets have to come together. There are
differences between prophets and pastors. I have been taking steps for
prophets to come together and pray for this nation through their anointing.
The country needs prayers. What is happening now to the nation is more
than the government can do alone. Meanwhile, we have people who will
criticize every good move.
I have visited Primate Olabayo. Some people will say Primate Olabayo is not
a prophet, but I say it to you that Primate Olabayo is a genuine prophet of
God. He is a prophet and people have benefited from his prophetic
endowment.
I visited him on the 10th of April 2016 to tell him the way forward for
Nigeria. We spoke at length on how to organize prayers for Nigeria because
Buhari cannot do it alone. We need to move this country forward and we
need people who can do it. Buhari can move Nigeria forward, he has the
intention and mission, but he is surrounded by people who are not with him
in his mission and he does not see it.
We are going to do the prayers for Nigeria. Anybody who wants to
participate can come in. By the time you get my church and other prophets I
want to invite, we will have nothing less than 30,000 that will register for the
prayer. That is one of the ways forward that God said I should take and I
have taken that step. I will move to the South South to bring together the
prophets there for this same mission.

PoliticsAmaechi Invited For Road Inspection By Rivers PDP by masterblogger(op): 9:51pm On Apr 16, 2016
The Rivers State Chairman of the Peoples Democratic Party (PDP), Bro Felix Obuah, says he was ready and would appreciate the Minister of Transport and former state governor, Chibuike Rotimi Amaechi, to undertake a facility tour of the numerous road projects completed and commissioned by Governor Nyesom Wike.

The State PDP Chairman, who stated this while taking inventory of the achievements of Governor Wike’s one year after being voted into office in April 2015, said these impressive achievements have demonstrated that the present administration in the state is fully committed to making life better for the people.

He said he would be glad if the former governor of the state could embark on a facility tour of the state to see for himself what good governance is all about.
The reconstructed roads he said include the Abonnema/Obonnema Link road/bridge, Eagle Island/Iloabuchi road/bridge, Abuluoma – Woji Link road/bridge, the Oyigbo Market Road, the Nkpogu – NLNG road/bridge, the reconstruction of Igwuruta – Chokocho Road etc.

Obuah said that over 120 kilometres of these roads have so far been constructed and rehabilitated across the state since May 29, 2015 when Wike took oath of office as the executive governor the state.

“The facility visit and, or tour has become necessary not only to show the immediate past government and its functionaries led by Rotimi Amaechi as governor and Dakuku Peterside as his works commissioner how to prudently use scarce resources for maximum output, but also to prove that the popularity and goodwill being enjoyed by the Wike administration is not based on fallacy but concrete achievements,” he said.

The PDP state chairman believes that given the rancour free environment by cynics, distracters and self-seeking politicians, the Wike administration will no doubt raise the bar of democratic dividends beyond measure for Rivers people.

“We are also inviting all stakeholders at home and in the Diaspora for on-the-spot assessment of these roads already completed and commissioned by Governor Wike in the State besides other breakthroughs in the health, housing, judiciary, education, empowerment/poverty alleviation, transport and sports sectors etc, and they will be amazed at what the governor has been able to do with the little resources at his disposal and will regret and agree that the eight years of Amaechi administration in the State despite the huge resources he controlled was a colossal waste”, he declared.

PoliticsYobe Hospital Rejects Sabo Garba's Donation by masterblogger(op): 3:59pm On Apr 16, 2016
The Management of the General Hospital, Potiskum, Yobe state, has rejected donations of Hospital equipment from a member of the House of Representatives, representing Nangere/Potiskum Federal Constituency, Hon Sabo Garba.

Investigation made by our state correspondent revealed that, Hon Sabo Garba, who won the election to the Federal parliament on the platform of the People Democratic party (PDP) beat the candidate of the All Progressive Congress (APC) Hon Ali Yakubu Mainasara, at last years general elections.

According to a staff of the hospital, who spoke on the position of anonymity to LEADERSHIP Weekend, it was explained that the management and staff of the hospital believed that they would be punished or lose their jobs if they received the items from the opposition party (PDP).

According to the source, the APC run state government had directed the commissioner of health to warn the staff of the hospital to reject any form of donations from oppositions parties including PDP.

Sequel to this, the PDP lawmaker yesterday accused the state government and the All Progressive Congress (APC) of instigating the people against PDP further stating that the governor had failed the state.

He said that, “the state government has failed to deliver the campaign promises to the citizens. If Yobe APC are blaming PDP and rejecting donations from its members, while also blaming PDP for 16 years of misrule, then we will start the change from my constituency.”

He added that, “ what is wrong if I donated equipment to the general hospital, the hospital was built since the time of late prime minister, Sir Ahmadu Bello in 1956, and is in urgent need of a facelift.

“I personally sent my own donation to help people of the state irrespective of political, religious and tribial differences. I am just doing it in good faith in order to promote our hospital. The hospital is the eldest in the northeast region, yet there is no water or light, and there is a lack of sufficient beds” said Garba.

He however appealed to the state government not to play politics with the state health sectors.
