TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 9:57am On Mar 13, 2019
I understand but Please, what do you suggest I do now?
because I pay myself this amount monthly. do I call it a bonus or income?
sh
justwise:
The mistake you made was calling a profit you made from the car business a salary, what you have is pretty much a one-man business and you take home all profit, that shouldn't be called a profit because you decided what to pay yourself and that is not salary works.
TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 8:56pm On Mar 12, 2019
Yes please. note that the company make way more than that monthly and I always reinvest once a car is sold.
justwise:
Ok i get that.that means you pretty much decided what to take from the business as salary since you own 95% of the company?
TravelRe: General UK Visa Enquiries - Part 3 by Micafe:
Thanks for replying.

Yes I pay tax, I'm still processing my tax clearance for 2018, hopefully it will be out before reapplying. I can aswell add my VAT receipt for the past 6 months.
Yes I have an survey and approved plan with an ongoing construction in my name.
I have an investment plan with axamansard where i save 250k monthly, the balance now is about 7M plus and its accessible anytime.
Yes, I have my daughter, wife, dad and siblings.

I have decided to apply as a visitor without adding bill of lading or purchase invoices. I will write a letter to explain why I earn so much.

But can I add my cac documents if applying strictly with my personal account as a tourist?
Also, should I add maybe a year or 10months bank statement to show a steady salary?

thanks.

bigtt76:
You need bill of lading and invoices if you're applying for a business visa but in this case, you're going for visitor's visa ...you might not need all of that.

Like mentioned earlier, the ECO only wants to be sure s/he is not approving a visa to an applicant who would not return back to his or her home country hence the need to show adequate tie to your home country (motivation for you to want to return back) and this is usually (but not limited to) high paying jobs or business, landed properties, immediate family and personal investments.

1. You have a thriving business .....good!
2. You are well paid .....good but you need to justify that salary (the ECO would be wondering how come you earn that much as salary for selling cars, most people would have stated something in the neighborhood of N300K with the rest stashed as commissions on cars sold...to me that looks more realistic) - do you pay PAYE tax to government? If you do ....include the tax certificate.
3. Do you have other landed property in your name?
4. Close family ties?

I would advice you either decide to apply strictly on your personal terms and you won't have to include all the bill of ladings & invoices but rather your personal bank statement, family ties and property documents. On the other hand, if applying as company director, then submit your company documents and a board resolution awarding you an all expense paid vacation as part of your benefits. But again 95% shareholding of a company doesn't sounds good to me but might not be an issue. It makes it all look like a one man business masked as limited liability company .....those ECOs read meanings into all things we take for granted.

Last but not the least, it appears you did not correctly state how much you earn salary monthly and yearly in total. The salary inflow on your bank statement should also correspond with the outflow on your company bank statement. Some businesses maintain multiple accounts - one strictly for business (receipts from goods or services sold) and other for operations (funded with profits made and used to service the company's bills, salary and other expenditures).

All the best though.
TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 7:26am On Mar 08, 2019
Thanks again for your contribution, it has been helpful. However, every month, I state ‘’Salary including the month.
There are frequent transactions. Both inflow and outflow with description of what the money is meant for. There was never a lump sum, its a car business which means every credit is in millions and for every car Sold, I have the bill of lading used in importing it.

I think henceforth I will start using my company name as the consignee, I never knew it could be an issue later.
But reapplying now, can I do without adding the bill of lading?
Also, I’m thinking of attaching 6months invoice of cars that were sold and give an explanation in the cover letter and explain how I import them.

I will consider the board resolution. God bless you.
bigtt76:
The ECO wants to see monthly entries tagged as salary (if you claim to be a salary earner) in your personal bank account statement.

In your business account, they want to see frequent transactions in and out of the account and not some lump sum deposit at varying intervals, if you claim to be a business person.

You also mentioned being a director with 95% shares good, why not include a board resolution stating the company is footing part or whole cost of your vacation as part of your director's benefit?

Depending on how you want to push your case, you might or might not need payslips. You might need to however, state how you arrived at paying yourself the salary.

On the bill of laden being in your name, I think that's a wrong move, it would have been good if it's in the company’s name. I mean, what company would order goods in the name of her employee? Rather in the name of the company with the employee's name as contact person undecided

Gbam!! Said it all.
TravelRe: General UK Visa Enquiries - Part 3 by Micafe:
About 6 including my
Clearing agent. They get paid based on the work they do, Not salary. I have the likes of mechanic, panel beater, painter, driver, etc. most of them are artisans
justwise:
How many people are involved in this company?
TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 6:21am On Mar 07, 2019
Pls, When you say source of income, you mean the source of the credits in my business account or the 950k paid to my salary account?
Because all the credit that comes in into the business account are strictly car sales credits and the only credit in my personal account is my salary paid from the business account. I’m not hiding
anthing, that’s why i added all those bill of lading and car purchase invoice from U.S to show that I import cars steady.
Should I add additional invoices that shows the car I have sold which will tally
with the credits in the business account?
Also, do I need to get a payslip?
Thanks alot for your time
tolani4real:
You were denied because the officer doesn't believe your story. The problem about your application was mainly your source of income as shown in your documents. The officer doesn't believe that you actually owned that money. Next time you apply make sure you explain the source of the income. Also separate company fund from personal fund.
TravelRe: General UK Visa Enquiries - Part 3 by Micafe:
its from the business.
But since I’m getting paid every month a steady amount, should I have applied as a paid employer of that company. Bear in mind I own 95% of the shares and I’m a director.
Also, the Bill of lading of the cars are in my name as consignee and after selling the cars, the payment goes into the business account.

I hope that did not add to the confusion?. Thanks for your help
justwise:
Is that salary from paid employment or from the business?
TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 9:36pm On Mar 06, 2019
Hi,

Thanks for your response.
My salary is 950k monthly and I own the company with 95% of the shares. Its a limited liability so the company stands on its.
As an importer and auto sales agent, I thought the best document to show the ECO the source of the money in the business account is to show the bill of lading I used in importing cars and after selling the car here in Nigeria, the payment goes to my business account and I get paid from the income of the business.

Please enlighten me.. what do you suggest I do?
justwise:
ECO did not believe your source of income because documents you submitted did not convince the ECO, how much is your salary and who owns the company?
TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 2:18pm On Mar 06, 2019
Could it be because I didn’t add a payslip?
I’m so confused ehn
@epotek @justwise help me please o
Opeyemi007:
Noted, i guess we'd have to wait on the experts as i'd love to learn myself.
TravelRe: General UK Visa Enquiries - Part 3 by Micafe: 12:47pm On Mar 06, 2019
Thanks for your response. The business account shows the debit of the 950,000 into my salary account every 26th of each month. Also, 22k is the yearly income, I dont know if it was mistaken for my monthly income because from the form I filled, the question was “how much do you earn from this job in a year” in which i answered 23,979

Also, I don’t spend money for personal use from the business account. Its strictly for business. All my spending comes from my salary account.
I really wish to to reapply but I need advice on what to add or remove. God bless

Opeyemi007:
First. I think one of you made a mistake with the figures. 950k a month is £2,034 while the ECO stated £22k+ a month. There's a discrepancy with that figure. Also, it seems your claimed salary does not reflect on either of your statements. I think it would have flied if you had stated you pay yourself from the profit earned. I know how the business thing works and i might be wrong but its safe to guess you TAKE/SPEND MONEY OUT OF EITHER ACCOUNTS WHEN YOU NEED TO or DO YOU PAY YOURSELF THIS FIGURE EVERY MONTH? I'm not a pro and Justwise would have a better advise to give but the best thing would be to reapply. Your application is solid coupled with a good traveling history, the only thing that has to be figured out is the finances.

So, as promised, I went for my interview today with my wife and we were denied by the vo in window 4.

Vo: Good morning
Me and dw: good morning sir
Vo: why are you going to the us?
Me: for medical purpose. My wife is pregnant with our first baby and we will like to have him in the US
Vo: Which city are you going?
Me: Houston, Texas
Vo: what do you do?
Me; im self employed. I’m into importation and car sales. (Vo nods) I import my cars from USA biggest auction like IAA and Copart
Vo: oh you import from UsA? He sound surprised. And I said yes. East coast to be precise
Vo: faces wife. What do u do madam
Dw: I’m an home maker and I’m also currently running my masters program in University of Ibadan
Vo: what do u study?
Dw: currently media and cultural studies but my first degree is int’ relations and history.. vo keeps nodding and typing
Vo: When is your due date:
Dw: 8th of August
Vo: how many cars do you import in a month
Me: atleast 5 units. I have bill of lading here if you will like to se? He didn’t answer
Vo: How long have you been working?
Me: 5 years but i started my own company 2yrs 3months ago. He keeps nodding and typing
Vo: do you have a dr correspondence?
Me: yes, trying to bring it out
Vo: lets see if we will get to that.
Types for few minutes
Vo: Where have u travelled to?
Me: south africa in 2016, and as couple we have been to dubai, kenya and tanzania for our honeymoon last year
Vo: oh you are married
Me: yes we are.

Types and bring blue paper with a sober face, sorry your visa cannot be granted and said the reasons is in the paper

My wife was dumbfounded coz she was surprised at why we were denied

He didn’t check any of our documents. He has been denying people. I was telling my wife before getting to his front that this guy in window 4 with a straight face is just denying everyone and we were praying not to be pushed to his line. Sigh

We answered confidently and correctly as We filled the forms our selves

The lady in front of us was denied, shes pregnant and going for childbirth also

As for me, I’m not worried at-all, but my wife is devastated.

Any suggestion and where did we go wrong. Can she apply alone and get a new date before august?

Understood. I'm coming to share my testimony. God bless.

Mamaiyanu:
6:30am should be fine.

Yes you need a passport photograph, 5in x 5in I think.

Don't listen to those touts at the gate.. they'd try to tell you that you need colored printouts and stuff... you don't.

You're good to go with your docs. Plenty of prayers needed as well. Dress smartly, be confident, look straight into the interviewers eye.

All the best!

thank you very much. I got it now. Let me get the visa first before asking further questions regarding that.
chloe00:
No you wouldn’t be asked point of entry , you’ll only be asked where you’re visiting( state, city, zip code etc).
Your point of entry is the state the flight you’re boarding to the USA touches down first, e.g you’re headed to ATL you fly BA and it touches down in JFK before proceeding to ATL, your point of entry is jfk
