Section 6(b) of the Code of Conduct Act says a public office holder shall not, “except where he is not employed on full‐time basis, engage or participate in the management or running of any private business, profession or trade”.

Mossack Fonseca, reputed as one of the biggest providers of secrecy in the world, helped clients register offshore entities, some of which are then used to launder money, evade tax and dodge sanctions.

They also provide details of the hidden financial dealings of politicians and public officials around the world, including in Nigeria.

The trove of 11.5 million files shows how a global industry of law firms and big banks sells financial secrecy to politicians, fraudsters and drug traffickers as well as billionaires, celebrities and sports stars.

The revelations are among the findings of a lengthy investigation by the International Consortium of Investigative Journalists, German newspaper Süddeutsche Zeitung and more than 100 other global news organizations – including PREMIUM TIMES.

PREMIUM TIMES is the only Nigerian publication involved in the investigation, which lasted a year.

A former President of the Nigerian Senate, David Mark, was not telling the truth when he denied knowledge of eight offshore companies linked to him as part of the ongoing #PanamaPapers revelations, a series of leaked documents has shown.

PREMIUM TIMES had on April 5 exposed Mr. Mark as operating shell companies in tax havenswhile being a public official in Nigeria, a violation of the country’s code of conduct law.

But shortly after the story broke, Mr. Mark denied owning any of the companieslinked to him in the British Virgin Islands, a notorious tax haven, claiming this newspaper’s reporting was politically-motivated and calculated at tarnishing his image.

“We reiterate categorically that he is not directly or indirectly connected to any of the companies registered, operated or managed by the Mossack Fonseca Law Firm,” the lawmaker said through a statement by his spokesperson, Paul Mumeh. “We challenge all those behind this propaganda and media outburst to prove or show that Senator Mark’s name was mentioned in the leaks.”
In response to the lawmaker’s challenge, this newspaper is now making public documents that strongly established the links between him and the companies listed against his name in the Mossack Fonseca database.

The documents include a due diligence report submitted to Mossack Fonseca by Helms Trust Company, a Jersey based firm, a reference letter written by an associate of Mr. Mark to the Panamanian law firm authenticating his identity, a copy of Mr. Mark’s valid passport at the time, electricity bill receipt of the former senate president’s home in his native Otukpo as well as his official letterhead.

The due diligent report, dated June 12, 2014, categorised Mr. Mark as a politically exposed person (PEP) and identified him as the beneficial owner of the companies listed against his name. It also showed that the companies were active, at least as at June 2014.

The companies are Sikera Overseas S.A, Colsan Enterprises Limited, Goldwin Transworld Limited, Hartland Estates Limited, Marlin Holdings Limited, Medley Holdings Limited, Quetta Properties Limited, and Centenary Holdings Limited.

The other documents in Mr. Mark’s file with Mossack Fonseca were apparently sent by the lawmaker to the law firm as part of a Know Your Customer (KYC) compliance and identity verification process.

Although Mr. Mark is known within Mossack Fonseca as the beneficial owner of the companies, he used nominee directors for years to mask his relationship with the shell entities.

PREMIUM TIMES also found that one of the companies, Goldwin Transworld Limited is a shareholder in London-based Goldwin Services (UK) Limited, along with one Anne Folkard, a British citizen believed to be Mr. Mark’s long time associate and front.

Company documents in the U.K. show that Mr. Mark himself was a director in Goldwin Services (UK) Limited between October 3, 1994 and January 25, 1996, when he substituted himself with another shell company he had registered offshore, Goldwin Transworld Limited.

Ms. Folkard authored one of the documents in Mr. Mark’s file with Mossack Fonseca.
In 2010, apparently after Mossack Fonseca became suspicion about his business dealings, Mr. Mark sent documents across to the Panamanian firm through Ms. Folkard to convince the offshore provider of secrecy to continue to serve as his registered agents in Panama and the British Virgin Islands

It is not immediately clear when Mr. Mark and Ms. Folkard met, but the letter sent to Mossack Fonseca by Ms. Folkard on behalf of the former Senate President indicated that they had been friends before 1994.

In the letter, dated October 20, 2010, Ms. Folkard wrote:
“You asked if I could confirm Senator David Mark’s address in Nigeria and I am happy to do this for you.

“Please find attached a copy of his senatorial headed paper which I had printed for him when he first became a Nigerian Senator in 1999. I can confirm that the address on the left-hand side of the page, 15 Asa Road, is his constituency address where he resides in Otukpo.

“I first visited that address back in 1994 and subsequently went there for the wedding of his oldest daughter, Caroline Mark, in 2001. If required, I have photos of the actual house. The traditional wedding and reception took place in his garden.

“I have also visited him at his official residence in Abuja. It is in the residential Apo Legislative complex in Abuja which is the residential area specifically built to house the Nigerian Senators when Nigeria became a democracy. The house that he lives in there is assigned with his senatorial job and as such he does not have the traditional bills that we would normally expect householders to have.”

When contacted Tuesday, Ms. Folkard told PREMIUM TIMES she was in a meeting, and unable to comment on businesses she run for Senator Mark.

While not all owners or operators of such offshore entities are criminals, owning or maintaining interest in private companies while serving as a public official is against Nigerian laws.

Prominent leaders and members of the Peoples Democratic Party (PDP) have been hit by anxiety following reports that some chieftains of the opposition party may be extradited home to come and face trial for alleged corruption.
President Muhammadu Buhari is expected to join about 59 other world leaders in London later this month to sign an agreement to check stealing of public funds by government officials.

Sources say he will use the opportunity to seek the extradition of some ex-government officials and PDP chieftains who are currently residing abroad to come and answer questions about their role in the Jonathan administration.

Such include the immediate past Comptroller-General of Customs, Abdullahi Dikko; ex-Minister of State for Defence, Musiliu Obanikoro; ex-Petroleum Minister, Mrs. Diezani Alison-Madueke; and former National Chairman of the Peoples Democratic Party, Alhaji Adamu Mu’azu.
Others are Diezani’s son, Ugonna; a former Chairman of the Pension Reform Task Force, Abdulrasheed Maina; ex-Senior Political Adviser to ex-President and Coordinator of Goodluck Support Group, Prof. Rufai Alkali and immediate past
Attorney-General of the Federation and Minister of Justice, Mr. Mohammed Adoke, who is being allegedly investigated over $1.1bn Malabu Oil deal.

A well placed source at the PDP National Secretariat, Abuja, said that party chieftains have been making endless phone calls to the secretariat for information about the reported extradition plan of the presidency.

“Although, nothing official has been said about the report, I can assure you that the leadership and chieftains of the PDP are aware of the development,” the source said.

“On Friday, following the emergence of the report on the social media, several calls were made by prominent members and leaders of the party from all over the country to ask if the report is true and if the party was aware.

“Discussion of the matter dominated our activities here on Friday. Many wanted to know how the party plans to respond to the move. But like I said, nothing official has been said about it because the report broke late on Friday and we are yet to discuss it.”

It was also learnt that a meeting of prominent PDP chieftains may come up in Abuja tomorrow to discuss the report and how the party should react to it. Party leaders, chieftains and serving political office holders are expected to attend the parley which sources claimed was mooted last Friday.

“I guess from discussions here on Friday that something like a stakeholders meeting may take place on Monday or thereabout to discuss the report. Many chieftains are worried by what they fear may be a renewed attempt to hunt down the opposition by the federal government.

“Some of the people you and I know may be affected by an extradition agreement of the magnitude we read about are leading lights of the opposition. One can only wonder why such a move is necessary when the alleged corruption charges are already in various courts here in Nigeria,” another source, a party official from the South-south, said.

It was also gathered that most of the PDP chieftains currently worrying their heads over the report are scared about the possible fall outs from the responses of the fleeing individuals when they are eventually questioned.

“The anxiety within PDP is not just concerns over the well being of the affected persons, it goes beyond that. At a time when the party is trying to pick the pieces of its unceremonious exit from Aso Rock and move on in preparation for 2019, it is unhealthy for more details of our shoddy past to be exposed. And that is what will happen should the extradition happen.

“Some of us continue to appeal to concerned persons who participated in the looting of the past to come forward willingly and negotiate with the authorities. That way, the scandalous effect on our party will be minimized.

“But I don’t want to image the effect of what those expected to be extradited will say on PDP. Many more chieftains will be dragged into the net by the time these people open their mouth. And the sensationalism will further hurt our party,” a female PDP chieftain from Lagos State said.

Meanwhile, a political associate of the former Minister for Defence, Musiliu Obanikoro, who pleaded for anonymity, has said the politician will not allow himself forced back home to be persecuted by the All Progressives Congress (APC) government.

He said Obanikoro is innocent of the allegations being bandied against him and there is no way the plot to extradite him will succeed.

He said: “In the first place, which of the numerous allegations against Koro (the former minister’s moniker) has been investigated and taken to a competent court of law? So, why do you expect him to surrender himself for extradition by the same government that is not hiding its readiness to nail him at all cost?

“One thing we are happy about is that out there, there is a reliable legal system that can be exploited to ensure sanity. That is the solace we have and Koro will make adequate use of that opportunity. All you hear them say about him are mere slanderous attempts to get him at all cost. We will see how they will succeed,” the source, a former Council boss in Lagos State, said.

A pressure group within the PDP, PDP Rebirth Project (RPP), has condemned reported plans by the federal government to seek the extradition of some leaders of the opposition party currently residing abroad. The group also urged world leaders to be wary of supporting any extradition request from the Buhari administration.

The group, which is in the fore front of the agitation against the continued stay of Senator Alli Modu Sheriff as the national chairman of the party, in a statement in Abuja yesterday, said its decision to oppose the extradition move should not be seen as an obstruction of justice but a move to ensure that opposition figures are no longer persecuted.

According to RPP, it is ironic that the affected PDP leaders have summarily been tried and found guilty by Buhari and his party without being arraigned before any competent court of law. Now, they want to bring them home to be punished according to the dictates of the ruling party.”

Signed by its chairman and Secretary, Emma Wodu and Aderemi Coker, respectively, the statement noted further that “the PDP leaders Musiliu Obanikoro, Diezani Alison-Madueke, Adamu Mu’azu and Mohammed Adoke are not fugitives. If the government has any case against them, let such be taken before a court of law.”

Hon Patrick Obahiagbon paid his tribute to the late Oba of Benin with some very admirable words.

The death of the traditional monarch was announced by the Iyase of Benin Kingdom, Chief Sam Igbe on Friday, April 29.

Hon Patrick said: “You cannot gloss over the fact that Omo N’ Oba Erediauwa, Oba of Benin, was a man of impeccable and unimpeachable integrity with the resilience of a Royal salamander. In him you found a coruscating display of that apothegm which holds that noblesse oblige.

“This sui generis quintessential quality of his came under bold relief especially during the locust and philistine years of the military militocracy. He was practically the only triton among the minnows of Royal hierarchs that resisted and stood up to the military rascality and apacheism that characterized the Abacha era. He stood at all times with the people, eyeballing political and military demagogues and damning their treacherous hooey and blarneys. It won’t be erroneous and superfluous therefore to pontificate that his integrity was altruistically integrious if you permit me that neologism.

“Omo N’ Oba EREDIAUWA,Oba of Benin was a cornucopious emblematization of the rich heritage of the Benin culture both in his modus vivendi and modus operandi. Anwuli Chikere, justice of the federal high court, Abuja, has withdrawn from the trial of Abba Moro, former minister of interior, citing personal reasons.

In March, Justice Chikere granted Moro bail on self-recognition, and had adjourned the case to April 27 for trial.

However, as the case was called on Monday, she announced her withdrawal from it.

“I am sending it back to the chief judge of the federal high court for reassignment on personal reasons,”Chikere said. “When it is reassigned, the prosecution can go after it.”

Moro is accused of defrauding 676,675 job seekers of N676,675,000 in an immigration recruitment exercise that led to the death of at least 20 young Nigerians.

The Senate President, Bukola Saraki has just arrived the Code of Conduct Tribunal, CCT, for his ongoing trial in company of just two senators.
Saraki who is currently standing trial on a 13 count charge bordering on false declaration of assets arrived the tribunal in company of Senator, Tayo Alasoadura of Ondo State while the other Senator is yet to be identified.

This is a significant reduction from the number of Senators that previously accompanied Saraki to the tribunal in solidarity.

Check by DAILY POST shows that the number of Senators have being on a consistent drop since the trial gained momentum.

The ongoing trial has seen the prosecution witnessed disclosing how Saraki used over N522m to purchase a property in Lagos.

The witness, Michael Wetkas, who is an operative of the Economic and Financial Crimes Commission, EFCC, told the tribunal how the Senate President used his account with the Guaranteed Trust Bank to launder money and procure properties while he was governor of Kwara State.

Wetkas had disclosed how Saraki transferred over $73, 000 to a foreign account from his account with Guaranteed Trust Bank.

He had said that documents relating to the transfer were burnt during a fire incident that occurred in one of the branches of the bank.

The National Publicity Secretary of the Peoples Democratic Party, Olisa Metuh on Tuesday fell off a swivel chair as he came into the National Working Committee meeting hall at the party secretariat to witness the inauguration of the caretaker committees of the party in Borno and Kebbi states.

Chief Metuh who came into the hall while the chairman of the party, Ali Modu Sheriff was already seated made for a seat reserved for him but fell to the floor as the swivel chair gave way.

The national Publicity Secretary who remained on the floor for about three minutes before he was assisted by two policemen out of the hall was said to have complained about a waist pain earlier in day.

It was learnt that Olisa Metuh was moved to National Hospital where he was placed on observation as at a time of this report.
