UPDATES:At 11: 06, the other member of the bench, William Atedze, drew Mr. Jacob’s attention to the fact that Section 349 (7) of Administration of Criminal Justice Act did not say that the representative of a defence counsel doing the cross-examination must be the lead counsel. The two teams are still sparring over how many lawyers should cross examine a witness. Mr. Usoro says the question is more about if the defendant has the right to choose who should represent and cross-examine witnesses on his behalf. The two lawyers have rested their arguments and Mr. Umar is now trying to decide if Mr. Usoro should be allowed to take over the cross examination of prosecution witness, Michael Wetkas, or if Paul Ilokoro, who was earlier called upon to do so, should be the one to continue. Update 2: Prosecution counsel, Rotimi Jacobs, says whoever the defence team chooses to cross-examine the prosecution witness must conclude the process, saying exchange of lawyers will confuse both the witness and the court. Update 3: Paul Ilokoro, a defence counsel, argues that there is no law that backs Mr. Jacobs’ request. He said the prosecution team tendered a huge amount of exhibits against his counsel, Mr. Saraki. “We will take out time to analyse these documents,” he said. “We will not be rushed. This Tuesday, PREMIUM TIMES is bringing you live updates as hearing resumes in the landmark case of Senate President, Bukola Saraki, at the Code of Conduct Tribunal headquarters in Abuja. Today’s proceeding was expected to commence at 10:00 a.m., but the tribunal chairman has not arrived. Mr. Saraki arrived at exactly 10:00 a.m with his aides and supporters, who include his colleagues from the National Assembly. .The courtroom is already filled with mostly lawyers for both prosecution and defence teams, as well as reporters. What you need to know: The Code of Conduct Bureau (CCB) is a pioneer anti-corruption agency set up by the Federal Government of Nigeria. It has the primary responsibility of checking corrupt practices in the Nigerian Public service. (Source: ccb.gov.ng) The CCB was established in order to check fraud in public offices. Some individuals go into public office with intention to steal. They falsely declare assets or declare some assets in anticipation of their loot. The fact that declaration of assets is a process that is shrouded in secrecy makes it easy for politicians and civil servants to falsely declare their possessions. The tribunal is the judicial panel of CCB that prosecutes cases of false and anticipatory assets declaration. On Friday, September 11, 2015, the tribunal slammed a 13-count charge of alleged false and anticipatory assets declaration on Mr. Saraki. He initially ignored the charges. He argued that the charges were politically-motivated and the process by which they were filed were also flawed. “The Code of Conduct Bureau and Tribunal Act clearly state that any prosecution must be authorized by the Attorney General of the Federation,” Mr. Saraki said on September 16, 2015. “Given that the nation last had an Attorney General in May 2015, it is clear that the CCB is acting under outside political influence.” Don’t forget that Mr. Saraki emerged President of the Senate under controversial circumstances, a result that has continued to define his tenure. Mr. Saraki also approached the federal high courts to have his trial quashed. But the tribunal chairman, Danladi Umar, remained steadfast, undistracted. After Mr. Saraki failed to appear twice before the tribunal, Mr. Umar issued a warrant of arrest against him. Finally on September 22, 2015, Mr. Saraki showed up at the tribunal with an estimated 80 senators. After a brief argument, he was docked. The picture went viral, well…. The cases at the high courts dragged to the Supreme Court which ruled in February that Mr. Saraki must stand trial. Succumbing to fate, Mr. Saraki said he was “happy that the trial has commenced.” The status of the trial: Two weeks ago, while prosecutors were still presenting exhibits against Mr. Saraki, the Senate President’s legal team introduced an application to disqualify the tribunal chairman, Mr. Umar. Ajibola Oluyede, one of Mr. Saraki’s counsels, said Mr. Umar lacked the moral standing to hear the case due to conflict of interest. Mr. Oluyede said Mr. Umar is currently being prosecuted by the EFCC for seeking a ₦10 million bribe from an accused, saying the chairman cannot be handling a case in which EFCC has interest when the agency has a case against him. “The EFCC is dangling a sword of Damocles on your lordship’s head,” Mr. Oluyede said. The next day, Mr. Umar struck out the application, saying he’d already been cleared of any wrongdoing by the anti-graft body. The prosecution team, led by Rotimi Jacobs, is still presenting its case against Mr. Saraki. The tribunal has heard several allegations of financial misconduct on the part of Mr. Saraki, including how the top lawmaker allegedly falsely declared his assets and laundered money through aides. The Panama Papers scandal will deepen around the world today when the International Consortium of Investigative Journalists puts most of the digital cache of documents online, accessible to all.
The ICIJ said it will release the documents in a searchable database at 1800 GMT on Monday accessible to the public at offshoreleaks.icij.org. The US-based organization said the release “will not be a ‘data dump’” of the sort the Wikileaks group became known for.
But it will reveal names and information on 200,000 offshore entities set up by wealthy individuals around the world.
The documents are from 2.6 terabytes of data given to a German newspaper, Sueddeutsche Zeitung, over a year ago by an anonymous source using the name “John Doe.”

The data came from nearly four decades of digital archives of one Panamanian law firm specialized in creating and running offshore entities, Mossack Fonseca, which says its computer records were hacked from abroad.
The German newspaper gave access to the trove to the ICIJ, and through it to hundreds of journalists in different countries.
Reports thus far have focused on scores of high-profile individuals: political leaders, celebrities and a few criminals.
– Iceland’s prime minister was forced to resign when his name was linked to an offshore company.
– British Prime Minister David Cameron ended up admitting he profited from an offshore firm started by his father.
– Russian President Vladimir Putin’s closest circle was named in the revelations, prompting Putin to claim the Panama Papers was a US plot against him.
– Argentine President Mauricio Macri was also linked to offshore companies.
– China censored media and online social networks from mentioning links between the families of Chinese leaders with offshore entities.
– Other notable people made uncomfortable by the documents include Argentine football star Lionel Messi, Hong Kong film star Jackie Chan and Spanish movie director Pedro Almodovar. In Nigeria, Senate President Bukola Saraki, his wife, Toyin, Lt. General TO Danjuma, Oando chief, Wales Tinubu, Folorunso Coker, a tourism commissioner in Lagos were among the people named as salting hidden assets away in Panama, Seychelles and British Virgin Islands.
Mossack Fonseca on Thursday issued a “cease and desist” letter to the US-based ICIJ, saying putting up the information publicly would violate attorney-client privilege.
– ‘Should be public’ –
But there is no sign of the ICIJ calling off the online database. The organization says it is important the public be able to look at information on any offshore company in the Panama Papers. “We think that information about who owns the company should be public and transparent,” Marina Walker Guevara, deputy director of the ICIJ, told CNN.
She stressed, however, that “this is not disclosing private information en masse.”
Since reporting on the Panama Papers started at the beginning of April, Panama’s government has been struggling to persuade the world that it is not a haven for tax-dodgers and money launderers. France has already put the Central American nation on its blacklist of tax havens, and other Western countries are considering following suit.
The online release of more Panama Papers could deepen the damage to Panama’s image. “We’re very concerned that the country’s reputation will be affected by this situation,” the minister for government, Milton Henriquez, told TVN-2 television.
Panama’s pushback against being singled out as a facilitator of offshore business was further complicated just days ago when the United States declared members of one of country’s most prominent business families, the Wakeds, among the top global money launderers for ruthless drug cartels.
The US blacklisted many of the Waked’s 68 companies in Panama, whose interests span a bank, an upmarket shopping center, duty free outlets and media. One of the suspects, Nidal Ahmed Waked Hatum, was arrested in Colombia and is awaiting extradition to the United States to face charges. More Nigerians want Nigeria’s embattled senate president, Bukola Saraki, to step down from office as he faces corruption trial at the Code of Conduct Tribunal, a poll conducted by PREMIUM TIMES has shown.
The poll, sampling public opinion on whether Mr. Saraki should resign in view of his trial, ran on the newspapers’ site for two weeks ending May 5. It showed significant public support for Mr. Saraki’s resignation.
The poll had five structured answers from which a total of 5,454 respondents chose.
A total of 3,624 respondents, representing 66 per cent, chose “Yes, he is a corrupt person”, implying the senate president is corrupt and should stand down.
Another 652, representing 12 percent, also wanted Mr. Saraki to resign, choosing “yes, he does not represent APC change agenda”.
In sum, either because “he is a corrupt person” or “he does not represent APC change agenda”, 4,276 respondents, 78 per cent, voted that Mr. Saraki should resign.
Altogether, 647 respondents, representing 12 per cent, voted “No, his travails are just political vendetta”, while 315, representing six per cent, said the Senate President should not resign. The last group voted “No, he is innocent of all charges unless proven otherwise in court”.
Therefore, 962 respondents, 17.6 per cent, elected to stand with Mr. Saraki on his vow to stay in office unless he is ultimately convicted. The remaining 223 respondents, or four per cent, said “I don’t care” whether Mr. Saraki resigns.
The Trial
Mr. Saraki, in charge number ABT/01/15 dated September 11, 2015 and filed before the Code of Conduct Tribunal, is accused of offences ranging from anticipatory declaration of assets to making false declaration of assets in forms he filed before the Code of Conduct Bureau while he was governor of Kwara state.
The senate president is also accused of failing to declare some assets he acquired while in office as governor.
Mr. Saraki is also accused of operating foreign accounts while being a public officer. On April 18, three new corruption charges were added to the initial 13-counts. Mr. Saraki denies wrongdoing, and pleaded “not guilty” to the amended charges.
The prosecution has called one witness, Michael Wetkas, from the Economic and Financial Crimes Commission, to detail how Mr. Saraki allegedly looted Kwara State and brazenly converted state’s funds to personal use. Mr. Saraki is yet to begin his defence.
Penalty if convicted
If eventually found guilty, the Code of Conduct Tribunal is empowered by the paragraph 18 (1)(2), Part 1 of the fifth schedule to the Constitution to remove Mr. Saraki from the National Assembly; bar him from holding any public office for a period not exceeding 10 years; and/or confiscate his properties determined as ones acquired in abuse or corruption of office.
Mr. Saraki has repeatedly accused the chairman of the Tribunal, Danladi Umar, of bias, expressing “big fear” he may not get justice from Mr. Umar.
He has filed a motion in the CCT asking Mr. Umar to disqualify himself from his trial. The motion was dismissed prompting him to seek relief of the Appeal Court to upturn the chairman’s ruling. The senate president also alleges that his trial is politically motivated, having emerged Senate President in defiance of the position of his party, All Progressives Congress, which favoured Ahmed Lawan from Yobe State for the position.
Mr. Saraki has also subtly accused former Lagos Governor, Bola Tinubu, of masterminding his travails, as retaliation for his opposition to Mr. Tinubu’s ambition to contest as Muhammadu Buhari’s running mate in the last presidential poll. I won’t resign
Mr. Saraki has since vowed not to resign. He told his colleagues in 2015 to “stand with me to defend the National Assembly!”

I still find it hard to believe their are pple who don't know this thing has some political undertone. Just overnight, the Fulanis have become some unearthly beasts. SMH
A thread with the caption "Fulani herdsmen with their cattle in front of CBN" got me rolling on the floor laughing..cos it was a photoshop done by an expert like Adekunle Gold..buh pipu these days don't have the patience to attempt verifying any negative thing that has to do with Buhari before throwing stones @ him..
Another thread hit FP two days ago with the caption "Fulani herdsmen enter Abuja Farm"..The cows in this thread were soo white & fresh that No ranch in Nigeria could have produced them. The farm was equally green and fresh..And when the cows left the green farm, it became empty..what was left was the fertile land..hahahahahaaaha. Apart from the fact that those pictures were poorly photoshopped, the twitter user that posted them was soo stupid with her exaggeration..and it takes someone twice as stupid to believe what she posted...
Another question I asked myself was "how can you prove that those cows r not owned by the owner of the farm"..(With the assumption that the pictures were not photoshopped) |
