A 41-day-old baby, Zainab Olajide, has died after she was allegedly poisoned by her father, Kazeem Olajide, in a desperate attempt to divorce his wife. The incident happened at about 7am on Friday at Toluwalase Estate, Ijoko-Abule, in the Lemode area of Ogun State. PUNCH Metro learnt that the mother, Abosede Ogundare, had left Zainab with Kazeem to sweep the compound only to come back and met the baby with foams gushing out from her mouth. It was learnt that Ogundare alerted neighbours to the incident having found a bottle containing pesticide with her husband. Zainab was said to have been rushed to a hospital in the community, where she eventually died. Our correspondent learnt that the suspect, who hails from Abeokuta, Ogun State, attempted to flee, but was held by residents, while the landlord of the house reported the case to the monarch of the community, Oba Solomon Sokunbi. PUNCH Metro gathered that the father was handed over to policemen at the Agbado Police Division after he confessed to the crime before the monarch. The couple’s residence was locked up when our correspondent visited the community on Tuesday. A resident, who identified himself only as Biodun, said Kazeem had been threatening to divorce his wife before the baby’s untimely death. He said, “He doesn’t love the woman and has been trying to divorce her. He poisoned the innocent baby to actualise his mission. They recently moved to this estate. She was their only child.” The landlord of the house, who did not want his name in print, said the suspect had denied being Zainab’s father prior to the incident. He said, “Three days before the incident, Kazeem (Olajide) was looking for a pair of his slippers. When he did not find it on time, he started raining curses. I called him by his daughter’s name, and tried to caution him, but he warned me not to call him by her name again. It was when the incident happened that I realised he might have intentionally killed the child.” Sokunbi, the Oba of Ijoko-Lemode, said Kazeem owned up to the act, claiming that he was pushed by the devil. He said he had been following the case to ensure that the suspect was brought to justice. He said, “It was the landlord who came to report the case to me and I directed my chiefs to bring him and the wife to the palace. I asked the husband and he confessed. He said it was the handiwork of the devil. “I called the police from the Agbado Police Division to arrest him. They said he had been transferred to the state command headquarters. I have been following the case. This is a pure murder case and I want the police to duly prosecute the suspect and let him face the law.” The monarch added that Kazeem’s wife told him in the presence of his chiefs that she saw the bottle with him two days before the incident. He said, “The woman thought the bottle contained herbs. She said she left the child with him to sweep the compound, only to return and met Zainab gasping and foaming in the mouth. She said she smelled pesticide in the baby’s mouth.” The Ogun State Police Public Relations Officer, DSP Muyiwa Adejobi, confirmed that the case had been transferred to the command headquarters, adding that Zainab’s remains had been deposited in a mortuary. Adejobi said, “The corpse of the baby has been deposited in a mortuary. The case has been transferred to the Department of Criminal Investigation for further investigation. “We have the suspect with us and he is going to be properly investigated. The Presidency on Tuesday said despite the dust being raised in some quarters, President Muhammadu Buhari’s appointment of Amina Zakari as the acting Chairman of the Independent National Electoral Commission was in order. The Special Adviser to the President on Media and Publicity, Mr. Femi Adesina, disclosed this to our correspondent in an exclusive interview. Some stakeholders had been describing Zakari’s appointment as unconstitutional because her appointment as a National Commissioner of INEC expired on July 22. They argued that Zakari was appointed to act as the chairman by the virtue of her appointment as a national commissioner and now that her tenure had lapsed, she ceased to be a member of the commission. But Adesina said in appointing the acting INEC chairman, the President only exercised his powers as provided in Sections 154 and 318 of the constitution. He said the President was at liberty to appoint her even when her tenure had expired. The presidential spokesman said since the President was covered by constitutional provisions, Zakari’s appointment stands. “The appointment is covered by Sections 154 and 318 of the constitution. The constitution empowers the President to appoint the woman in acting capacity. It also covers the appointment even if her tenure has expired,” Adesina said. Section 154 of the constitution reads, “Except in the case of ex-officio members or where other provisions are made in this constitution, the chairman and members of any of the bodies so established shall, subject to the provisions of this constitution, be appointed by the President and the appointment shall be subject to confirmation by the Senate. “In exercising his powers to appoint a person as chairman or member of the Council of State or the National Defence Council or the National Security Council, the President shall not be required to obtain the confirmation of the Senate. “In exercising his powers to appoint a person as chairman or member of the Independent National Electoral Commission, National Judicial Council, the Federal Judicial Service Commission or the National Population Commission, the President shall consult the Council of State.” Cc:lalasticlala Source: http://www.punchng.com/news/zakaris-appointment-as-acting-inec-chair-proper-presidency/

The judge, who accused Governor Rauf Aregbesola of financial recklessness, Justice Folahanmi Oloyede, has disagreed with the probe panel set up by the Osun State House of Assembly to investigate her allegations. The judge, who was represented before the panel by her counsel, Mr. Lanre Ogunlesi (SAN) on Tuesday, said the panel ought to have forwarded the governor’s response to the petition to the petitioner. However, the Deputy Speaker, Mr. Adegboye Akintunde, who is the chairman of the seven-man panel, said the committee was not obligated to make the governor’s response available to the judge. Although the Speaker of the House of Assembly, Mr. Najeem Salaam, had said during the inauguration of the panel that their sittings would be done behind the closed-doors, the panel allowed journalists to be present for some minutes before they were asked to excuse them. Ogunlesi, while speaking to journalists after the closed-door session, said the panel ought to forward a copy of the respondent’s reply to the petitioner, saying this would demonstrate to everybody that the panel was ready to do a thorough job. He said, “We believe the response of the governor to the petition should be forwarded to the petitioner. We don’t know what the governor has said and the petitioner needs to know. “It is necessary for the petitioner to be provided with the governor’s response. “What we discussed with them was that for us not to waste time on this matter, answers to the petition by the governor should be made available. “They said the committee was a fact-finding one, but the issue at stake is a serious one and for the sake of posterity and the people yet unborn, they need to forward the answers to her. “To do a thorough job, they should forward the governor’s response to the petitioner. There are allegations already that the committee may not do a thorough job but they should do everything to show to the public that they are ready to be thorough in their investigation.” The counsel to the petitioner said his client might apologise to the governor if she was given a copy of his response and she discovered that she was wrong. Asked how the closed-door session ended, Ogunlesi said, “We would hear from them,” but said the way they spoke showed that they might close the case without allowing her to defend her petition. But the panel said they were not supposed to give the response of the governor to the judge or anybody. The deputy speaker said the judge violated the rule of the House from the time she sent her petition to the Speaker directly without routing it through the member of the House representing her constituency. He explained that Order 26 of the House stated that petitions must come from members of the House only and not from an individual. He added that the petition was supposed to be signed by the petitioner on each of the pages but the judge signed only once. Akintunde said that the petitioner violated another rule of the House by not appearing in person before the panel. This was contrary to the position of the Speaker, who said during the inauguration of the panel that the petitioner or respondent could appear in person or be represented by lawyers. However, he stated that despite the violations, the House still went ahead to act on the petition. He said that the counsel did not come before the panel with any evidence to substantiate the allegations against the governor. When reminded that the two weeks given the panel to investigate the petition would expire on Thursday, the panel chairman said he could request for an extension of time if it became necessary. “We cannot give the respondent’s response to anybody.
