EB2 National Interest Waiver (NIW): A Self-Petition Path to U.S. Green Card:
Are you considering relocating to the United States? There is a legitimate pathway that does not require a job offer or employer sponsorship. It is called the EB2 National Interest Waiver (NIW) or EB1A (we will discuss this in another post).
I have been helping people with this process, so I want to share some useful information for those interested (you can check my bio/profile for YouTube channel and other pages for more insight).
Who Qualifies for EB2 NIW?
You need one of the following:
- An advanced degree (Master's, PhD, or equivalent)
- A bachelor's degree plus five years of progressive work experience in your field
- Exceptional ability in sciences, arts, or business
What Does 'National Interest Waiver' Mean?
Normally, employment-based green cards require a U.S. employer to sponsor you. With the NIW, USCIS can waive this requirement if your work benefits the United States. You petition for yourself.
The key question is: What are you working on, and how does it benefit the U.S. or contribute globally?
The Three Requirements (Dhanasar Framework)
USCIS evaluates NIW petitions using a three-prong test established in Matter of Dhanasar:
1. Substantial Merit and National Importance
Your work must have real value. It should solve a problem, improve a system, create knowledge, or help people. Examples include healthcare improvements, technology advancement, infrastructure development, job creation, or environmental solutions.
It must also have national importance, meaning it can benefit the U.S. broadly, not just one company. This does not mean you need to be famous. It means your field or project can influence U.S. policy, economy, health, technology, education, or security.
2. You Are Well Positioned to Advance the Endeavor
USCIS wants to see that you have the skills, experience, and track record to succeed in your proposed work. You do not need to be a superstar. You need credible evidence showing you can continue your work in the U.S.
Examples of evidence: publications, citations, project results, awards, certifications, degrees, leadership experience, patents, or industry recognition.
3. It Would Be Beneficial to Waive the Job Offer Requirement
This means granting you a green card would benefit the country, even without an employer sponsoring you. If your work brings innovation, public good, economic growth, health improvements, or scientific advancement, this requirement is typically satisfied.
What Evidence Do You Need?
Typical EB2 NIW submissions include:
- A clear description of your proposed work in the U.S.
- Proof of your achievements and qualifications
- Recommendation letters from experts in your field
- Copies of degrees and work experience documentation
- Evidence demonstrating how your work benefits the U.S.
The key is to be simple, structured, and focused on impact.
Who Typically Uses This Pathway?
Professionals from many fields: researchers, engineers, medical professionals, entrepreneurs, educators, economists, climate specialists, and others whose work can positively affect the United States.
Do not underestimate your work. Many people qualify without realizing it.
How Much Does It Cost?
The filing fee for Form I-140 is $715, plus an Asylum Program fee of approximately $300 for individual petitioners. If you want expedited processing, Premium Processing costs an additional $2,805. These are the fees as of December 2025.
Summary
EB2 NIW is a self-petitioned U.S. green card pathway for professionals whose work has value, benefits the country, and can grow in the United States. It is clear, flexible, and open to global talent.

@Mogullet sorry to hear about that. what category is the I-140 pending approval ? EB1vs Eb-2NIW vs EB2 employer petitioned vs EB3 not clear from the statement you made. response on this will better inform suggestions if there is any to be given.

Take this with a BOATLOAD OF SALT ;I'm not an immigration attorney!!!!! . for an approved I-140, it is possible to retain the priority date of the I-140 petition approved so long it's within stipulated validity period ( this is where someone more knowledgeable in the thread can chip in.Also, look through threads/ forum of South east asians non-immigrants on H1-b, they have more nuanced information on switching jobs with I-140 approvals. You may get better info on how to proceed with this)

Hello my people, please would like to know if anyone lost their job while their i140 was awaiting approval? 
I applied from the UK, my PD is 1st of June but I lost my job in the same month. 
Though I'm interviewing for a new job in the same field as my proposed endeavour, I would appreciate it if anyone could help with any info or ideas on how to update my pending i140 or inform USCIS of the change of employer if need be. 
Better still, would really appreciate any ideas or suggestions from anyone on what I should do so that my pending i140 won't get denied as a result of job loss.

Hello Everyone, I'm new to this thread.

I applied for Canada study permit and got a refusal 2 days ago. I really think their sakara is too much hence my quest to look towards the UK for my Masters.

Please Gurus in the house, I need your help as I have beeing reading the info on this thread and I must say I'm lost.

I want to a cheap school in the UK for a masters in Accountancy and/or Finance. I discovered that some schools have Febuary intake and I think I would prefer those ones. I'm also not informed about locations and their cost of living so I'm open to your suggestions please.

I need your guidance moreso on the packaging of my financials as my source of funds is our family business run by husband and myself and I have Cac doc, business invoices and contracts.

Please what are the first steps and a total novice to the UK thing after investing so much in Canada stuffs.

The heading to this post though. I had my mouth wide open to excitement only to close it towards reading to the middle. The common excitement that comes with such heading here is that of a success story to an approval. smiley

Its good that based on your decision you've decided to apply to a second DLI with a 2yr course choice. However, you may just be overreacting over this PGWP. Since you've already appied for your visa and paid part of your fees, why don't you allow it play out by not requesting for a refund. You may just lose quite some sum which may become regrettable.

Why not just consider the option of extending your SP within Canada and applying for a second program. If you still intend to go ahead, endeavour to enable the change within Canada while keeping an eye on the deadline date for refund of the other DLI.

Thank you so much, I totally agree with you as regards changing in the middle of my study permit application. I have read the schools policy on refund and they made provision for the transfer of the tuition deposit to another institution when you withdraw. So my plan is to apply to another school and secure a seat then when I get my study permit approval, would notify the school of my withdrawal and CIC of my change of school.

Moreso, I checked it out that taking up another program after grad would be expensive because my programme is 21,000 CAD for a 1year PGD and any other one I take up may be in that neighbourhood. Someone posted here an advance Dip in Financial Management @ the Uni. Of Manitoba, the prog is 24,000 CAD and it's a 2 year prog. For me it makes a lot of sense to to change to such program that is gives me 2 years of study and is relatively cheap, than to spend almost 40,000 CAD in Saskpoly.

I hope it turns out well and I'm really grateful for the insights all of you are making available to us, I got the confidence to apply for my study permit myself because of you all and I'm still open to learning more so that myself and other JJCs like me can make better informed decision.

You may wish to check your school's refund policy before doing this. Fanshawe for example provides refunds only where you were refused a study permit.

Also, why not wait until you get your permit before changing schools? Changing in the midst of a study permit application may just complicate things in my own opinion.

Finally, you can proceed with your 1 year programme and simply apply for another 1 year programme upon completion to bag the 3 yrs post study.

Long Post Alert!!!

Big thanks to you guys for the contributions on my request for help with my Acrobat adobe javascript, searched but couldn't find your comments anymore. I was able to solve my probelm by filling the forms at a cyber cafe, saved it to my devise and uploaded from my laptop.

I also did read a lot of comments about the 1/3 year PGWP and I'm really impressed at the amount of information you guys are putting out to help other people with their quest, big kudos to you all! As a result of the info I now have, I intend to change my school of study even though I have paid my tuition deposit and submitted my study permit application.

I applied to Saskpoly because of it's international students pathway,( all you need is that you have six months work experience in your field of study to apply for SINP) and got the admission in Business Accountancy for winter semester. Like someone mentioned during the course of the argument; no one saw Covid 19 come and those who are got the 1year PGWP this year would really need extra grace to scale through this period.

Now the thing is, I have decided to apply to another school with a 2 year PGD so I can get a 3 year PGWP and save myself the impending hassle then ask for a refund from Saskpoly after my study visa is approved.

Please my people I need your help, I want to do a financial management PGD at a school in British Columbia but the tuition fees I'm seeing is too high. Please does anyone know of anyone that is less expensive still in BC or any other province.

PS: I like British Columbia just because of its weather.

Thank you so much @ Engager69, I have done as you suggested but it's still not working. It's really frustrating. Had to download Adobe reader X as suggested on the CIC help page, yet nothing. I clicked to check the properties of this form and the attached is what I saw. It is obvious that the isn't allowing the filling of the form.

I tired, please is there anything else I can try?

open Adobe Reader,
- click “Edit”, then “Preferences”, then “JavaScript”.

Please I still want to ask how you were able to successfully fill the imm1294e form(application for study permit) as the boxes on it that gives options seem frozen. Eg, box for gender, nationality etc just freeze when ai click on them.

I got my AIP today, I was so so afraid cos I felt I didn't attach enough documents to my application. Infact I didn't show any proof of fund except my funding and scholarship letters

Remember! I didn't add any extra proof of fund neither did I show an extra family ties. Few documents were uploaded and God who did it for me will do same for all hopefuls. Amen

Please note that it's not cumpulsory to attach your university transcript for your study permit. You can attach your certificate instead, People have gotten approval without attaching their transcript.

@Mogullet, you can always request a new passport from the immigration office. Tell them you need the passport for a longer period, they will stamp out the old one so you won't use it again and you can proceed with capturing for a new one.

I advise you get a new passport, you can explain that the other is expiring at so so date and you want a new passport that starts from the date the former is expiring. It's just a matter of explaining yourself. Even if you don't get a new one, you can go to the Nigerian embassy in canada before the due date to when your passport is expiring to get a new one.. at least there, no delays and no shady whatever

Happy Sunday my People. Please I have one probelm that I need your advice on.

My passport is getting expired sept 2021 but my PGD prog for Saskpoly would end in Dec 2021.

Please guys, what do you advise I do. I would like to do a new passport and have the visa stamped on it so that I don't have to worry about renewal when I get to Canada.

On the other hand, I being sceptical because I don't know if I can get a new one from our immigration office since the old one isn't expired and I'm afraid the VO may be uncomfortable with me presenting a new passport since the old one isn't expired yet.

Please I need your help to tackle this issue.

Thanks, @luckymama I appreciate your contribution. It would be a really a tough one leaving my kids behind. Yea I know people who applied with maybe one or two of their kids and left the others with their spouse. The challenge for me is that my spouse is always travelling so leaving my kids back would mean leaving them with others.

It's just quite confusing.

Nope it won’t be a misrepresentation. They did not travel with you. That doesn’t mean they can’t apply to visit you. As for me to be completely safe and avoid any stories, family should apply after the student has settled in at the school. I know at least one international student that did so. It took like three months for her husband and kid’s visas to be approved.

Hi. The issue of Company sponsorship has been extensively discussed on this thread. Search for Just.wise contributions on this thread. I am in a somewhat similar position with you.
What I have learnt here is that company sponsorship is shaky as most times the VO don’t look favorably on it, believing that an Applicant may not have access to the company’s finances.
Thus rather than using the company as a sponsor, what you need is to use the company as a source of your income.
1.Use your personal account.Transfer money from your business account into your personal account. Make sure you highlight this in your explanation that the money came from your business and you have earmarked it for your school.
2. Submit any other proof of the business e.g CAC documents including particulars of directors if you or your husband. Account statement of the business, invoices or transactions done by the business. Audit reports of the value of the business. Whatever documents you have to show that you are operating a real business
3. VERY IMPORTANT: get a letter from your bank stating that you are a signatory to the company account. This is the main concern of the VO.

I hail all the Gurus in the house, I'm new to Nairaland and I must say this thread has been of immense help to me. Read thru a lot of the info you guys have put out and it has put strong confidence in my heart to apply for the canadian study Visa by myself. God bless you all.

I have a question to ask please and I have not seen anyone talk extensively about it.

I have a personal business which I run with my husband, got admission to study at Saskpoly, have every required doc but the only issue is that I don't have tax certificate for my business and this business is my sponsor and tie back home. Can I go ahead to submit all the other documents without it, can it be waived by any means?

Please help urgently!
