OBUKOMENA:Hello, I'm a property lawyer here in Abuja. According to the law, if you are a yearly tenant you are entitled to 6 months quit notice, and after that six months quit notice you are further entitled to a 7 days owners intention to recover possession. If you failed to leave the house after that 7 days notice then he MUST sue you to court and serve you court letter summoning you to come and defend yourself if you have any defence. Then the court will check during hearing if he had properly served you the quit notice as I stated up there or not before giving its judgement. Again, if you are wrongly served the six months quite notice before your rent expired, the landlord would wait for A MONTH after your rent must have expired before serving you the 7 days owners intention to recover possession, in law, you have become tenant at will because you are now owning your landlord. After that 7 days notice, he MUST also go to court, serve you court process, and wait for the court to give judgement before taking any action. He has no right to touch, lock or deny you of the premises until the court give judgment and ordered the court officials and the police to follow him to pack your load out of the house ONLY WHEN YOU FAILED TO LEAVE THE HOUSE AFTER THE TIME THE COURT GAVE YOU TO PACK ELAPSES. However, if there is any prior signed agreement between the two of you as to how you are to be evicted from the house, increase in the rent etc, and the landlord has followed those terms in the agreement, even if it is not in line with the procedures I had stated above, the court will have no choice than to back the landlord's action and give judgement in his favour, that's the power of an agreement. But if he has deviated from the terms of the agreement, you have a good case. Note: The court will still order you to pay the rent for the specific month(s) you used before the case is brought to the court and while the case last in court. Also immediately before the judgment, the court may ask you to suggest a reasonable date and time you will likely leave the house, if it's acceptable by the court, the court will ordered that you be allowed to stay till that time and you MUST also pay for that period before delivering possession to your landlord which sometimes some landlords may decide to let go of the money, they just want you out of their house. So check your options well. That's why it's very important for both parties to engage a lawyer from the onset to be guided properly before entering any agreement or paying for rent. But this is Nigeria, it's when trouble start that the money they don't want to spend for a lawyer, they then spend double in restoring their dignity and sanity. |
It all started in JSS 1, I used to be below average academically. There was this beautiful brilliant girl that used to come first in our class every semester that I love so much, she was my first crush and love. I'm attracted to brilliant girls. I do simp for her in class and I do buy her various 5 naira yoghurt and goodies during break, so the whole class can relate with my state of "sinking" in the ocean of love. She never let me know her intention whether she liked me or not, always looking down on me today because I do sit with "bad" boys at the back of the class and she will do as though she like me the next day. Sometimes, to show my love for her, I do escort her to her house after break, do home work for her junior ones and even go extra mile to learn how to write love letters, but her attitude show she never found me worthy or attractive enough or she was afraid I may not be in her league. But between us, though not official, we knew we were dating somehow but she's been careful not to make it popular which I don't like. When we got to JSS 2, I became more free and popular with ladies in our school and I began to see how jealous and concerned she was, yet she was not willing to date me openly. Then we stop talking altogether to each other and I focused more on playing with other girls without nothing attached. Then came a year we are to be promoted to JSS 3, we were to do Home Economics day and the best student was to be awarded a price. I already joined the group of boys ( the unserious ones in school) to dance for the ceremony and I was finding it difficult to master my dance steps. When the price winner was called, it was this my girl that won that price as the over all best in Home Economics. The turning point for me --- When she was called out to receive the price, she INTENTIONALLY looked around finding me, she found me in my dancing rapper behind the guys dancing for the ceremony looking like a lost child in the market, she then looked at me with disdained and pity and hissed loudly that I felt the breeze from her hiss would carry me to my grave I felt bittered, beaten, belittled and I was gripped with fear for my life and future. Immediately, from that very day, I determined that I would always be the best afterwards in every subject in that school, and I promised myself to revenge. To archive my goal, I disassociated myself from my previous friends we played around together, got a new sitting angle in class and was aggressively attentive in class. Before the end of our JSS 3, I became a genius in mathematics because of my undivided attention, though I was determined to go to Art class. I thought majority of my mates and the whole school math lessons before every exams because I was good at it. Girls were now coming but I never had time for them again, even this my crush, I forgot about her totally but truth be told, I was bitter but still yet in subtle love. Fast forward to SS1, I joined Art class, and I told the Principal I wanted to become a lawyer when she was worried that I should have joined the sciences because of my good result. I became the class captain of my class because of recommendation from my class mates. I continue to be aggressively focused and to teach my class mates and even other students in sciences mathematics after school hour, so I was increasing in popularity. Then here comes the gist, at the end of SS1 3rd term, going to SS 2, the most popular and feared Math teacher called me one break time and said "Dress well tomorrow, you will be receiving an award as the best student in Mathematics for the session" . I looked at myself, tears dropping in my eyes and I replayed the incident that led to this kind of energy and achievement. I could not sleep till the following day, I was practicing in my mind how I will do the eyes rolling and to hiss more louder with my two big eyes fixed on my crush. And that was exactly what happened when I was called out to receive my award. I looked for her in the crowd, looked at her deeply in the eyes, and all the fear, bitterness vanished, mission accomplished. She came back simping for me after that achievement, but guy man now has better and more options. To make it short, the kind of reading and devotion to my studies from that JSS3 to SS2 built me for self actualization. I registered for GCE in SS2 and I made all my papers in one sitting. Now I'm a lawyer and when I looked back, if not for her insulting look and subtle degrading treatment from her that very day at the price giving ceremony, I wouldn't have converted my energy to whom I dreamt of becoming today. Ironically, she's an ND graduate, and still in contact with me. There was a time she posted my old picture and herself of over 15 years on her WhatsApp status, and I asked her, "you never thought nor believed I will become a lawyer?" Her response was "sincerely, I never thought of it" Recently, she wanted to visit me but I was not comfortable welcoming her. That's my own humble experience. |

iInjureHerYansh:What you don't know you don't know. Many scammers with these kind of confident that they are secured are wailing and in shock in EFCC cell wondering how they got caught so easily. If you are still in doubt, I can take you round for a day in EFCC Headquarters Abuja to witness some scene. Crime does not pay, right channel to trace you, and you are picked up like a fallen rotten mango. |

SuperOnyi:Yes, those information with you is enough by the EFCC to track them, those guys are professional trackers. I've worked with them on quite some cases. Instead of wasting precious time with the police and the rest with possibly no result, just go through the right and most effective channel, EFCC. |

They will track them and arrest everyone in connection with the transaction till they lay hands on the real criminals within one or two months. I just need to write petition to them using those information with you. |
frank33:Abuja is a good place though it can be challenging at first only when you don't have money to sustain yourself for the first 2 months before you get your bearing. I am a practicing lawyer and also into real estate and I am currently serving in Abuja but with the mind set of working and exterblishing myself in Abuja during and after my service. It was really tough in the first 2 to 3 months, but currently I have enough money in my account to start my own law firm and invest in real estate. Just because I stayed through. One good deal and knowing your way around Abuja is what you need. I believe opportunities abound in Abuja more than your current location for both growth and exposure for you and your family. As you've been advised earlier, I also supports the Idea that you come to Abuja first, study the environment and you will know exactly what you want to do next before bringing your family to join you.
