I got this new apartment in April, through a caretaker/agent, we did all necessary discussion though no any written agreement. I paid him both the rend and commission and he gave me my receipt, I move into the apartment in June. I got home last night and got information that my landlady said he has sold the house out that they need to start working on the house before August rain. So we should start preparing on how to move out.

After my findings from the person that passed the information to me I discover that she is having money issues with the caretaker because my neighbour told me that she claim not to know that they are new tenants in the house, she heard it from people that they are new tenants in the apartment which she is not aware of so i just concluded that for her not to be aware the money has not be giving to her by her caretaker.

Now, the information reaching me is that the caretaker claim he want to balance the people that pack out of the house. He said their rent did not expire before they move out.

I told my neighbour that she sent to us(me and the other guy), if she is having issues with her caretaker they should resolve it within themselves for me I no dey pack.
I need your advice on what to do

Firstly, what do you want from your landlord and caretaker? Refund of monies paid, relocation to another suitable property or a longer time to enjoy the property.

If the property is in Lagos, contact the Citizens Mediation Centre. If it is in any other state, contact the Citizens Rights Department of the Ministry of Justice. There are lawyers there who would mediate on your behalf and try to settle it based on the principles of equity and justice and for free too.

I suggest you talk to the landlady and let her know that you're not against her selling the property, but it's wrong to do so with sitting tenants on the property. Tell her that you made payment to her validly appointed agent and she didn't and as at when you paid, there was no notice that the agent was no longer representing her.

Now, tell her what you want. Either a refund of your complete rent or a longer notice. Tell her you have spoken to your lawyer and they want to take the matter to court and put an injunction on the property but that you want to speak to her first and see if she's a reasonable person before you proceed.

Whatever you do, be very fair, firm and just as you'll be a landlord one day.

Since it belonged to your late Dad, you need a legal document empowering you to sell. This could be a Will or Letter of Administration.

To answer your question, let the new buyer reach out to the person(s) who sold to your late Dad. These previous sellers would sign the Land Agreement for the new buyer as if he's buying from them directly.

Your mom and all siblings can sign a contract of sale or other documents transferring equitable rights to the buyer.
