The CPC Chairman Tony Momoh has been denied a UK Visa by the UK Embassy on the ground that he does not have an established presence or strong ties to Nigeria. Furthermore, he could not prove to the Embassy through a bank statement that he has enough money to maintain and adequately accomodate himself whilst in the UK.

No wonder he is very willing to join Osama Bin Buhari to destroy Nigeria since obviously he has nothing to lose.

I wonder why people are complaining about curfew. When militant activities created insecurity in the Niger Delta, we had loads of curfews imposed in PH yet some people in Abuja were less concerned. I remember one mallam in the House of Reps even suggesting on the floor of the house that they should wipe out everybody in the Niger Delta so that the rest of Nigeria can live in peace. Now insecurity is in Abuja and dem impose ordinary curfew, una dey complain!

The documentary really calls for a sober reflection. It got me wondering why leaders ( and in the Afghan's case - militants), would make thier countries so undesirable to the point that thie citizens would prefer to die or be subjected to the most inhuman treatment just to escape from the own country. The amount of funds required, and the acceptable evidence of funds in support of a Tier 4 visa application is clearly stipulated in the PBS Tier 4 Policy Guidance and has been stressed severally on this thread (as recently as June). If you show maintenance funds of £5000 ( for a course that is at least 9 months long) or submit you sister's statement of account, you would get a definite refusal.

As promised earlier, find below the rule that exempts you from being banned.

320 (7B)
In addition to the grounds of refusal of entry clearance or leave to enter set out in Parts 2-8 of these Rules, and subject to paragraph 321 below, the following grounds for the refusal of entry clearance or leave to enter apply:,
, subject to paragraph 320(7C), where the applicant has previously breached the UK's immigration laws by:

    (a) Overstaying;

    (b) breaching a condition attached to his leave;

    (c) being an Illegal Entrant;

(b) where the individual was under the age of 18 at the time of his most recent breach of the UK's immigration laws.

You have no reason to worry. You have done the right thing by coming back to Nigeria to apply. Just ensure that you answer all the questions you are asked truthfully. Bear in mind that most of the questions would be centered around verifying the genuiness of your marriage/relationship with your spouse and your immigration history. Just to add that you are not going to get banned as this does not apply to the category of visa you are applying for. Would check up the exact rule and post it here

In a ThisDay published article of June 10, 2011, a leading member of General Buhari’s Congress for Progressive Change (CPC) set out to paint an unfairly gloomy picture of President Goodluck Jonathan’s barely eighteen months in power as President of the Federal Republic of Nigeria.

In his pathetic piece of preposterous prose titled “Jonathan’s Tough Choices” Mallam Nasir El-Rufai gave himself up as a deeply ungrateful man by setting out to malign, undermine and impugn a sitting President who not too many months ago, granted him a quiet presidential pardon and restored to him the freedom with which he (El-Rufai) returned to a Nigeria that he had exiled from shortly after his own kinsman, former President Yar’Adua took over the reins of power in 2007.

Mallam Nasir El-Rufai had run away from the laws of the Federal Republic of Nigeria, the claws of former President Yar’adua and the jaws of an arrest-hungry Economic & Financial Crimes Commission (EFCC).

In beginning the rude commentary of his portrait of a gloomy Nigeria, Mallam El-Rufai stated that Nigeria remains a “Clique Democracy” as against a real people driven democracy.

For someone who was seen as a leading member of Obasanjo’s “Clique Democracy” and one who was noted to have flaunted that he was part of those that chose late President Yar’Adua who eventually scared him into exile, this leaves much to be said.

In continuing, the Mallam questioned the vision, character and will of the current Jonathan government to defy vested political and business interests and govern decently. He did not waste any time in concluding that President Jonathan’s government could not!

The question I ask the CPC Mallam is “What vested political interest”? Or “What vested business interest”?

What interest is greater or deeper than that which President Jonathan has firmly committed to? What deeper commitment can be greater than that of a President who boldly and emotionally declared that “I will never never fail you”? I wonder.

In his sordid attempt to gravely misinform and misguide gullible Nigerians, Mallam El-Rufai stated that “Jonathan’s politics of deliberate division and militarization has pitted Northerners against Southerners and Christians against Muslims to the point that obtaining the cohesion and social harmony necessary for economic development will be difficult in the short and medium term”

This short statement, coming from a man who served in various capacities in Obasanjo’s government, reveals in very clear terms, the treachery and extreme capacity for evil that abounds in the minds of all those who incited ignorant Northern youths to murder, rape, slaughter more than 200 young southerners including members of the National Youth Service Corps (NYSC) in the gruesome post election violence that erupted across some states and cities of Northern Nigeria.

What politics of deliberate division did President Jonathan orchestrate? Militarization of the Niger Delta by oil-thieving Northern military cartels? Or the hypnotic incitement of ignorant youths of Northern extraction? Paranoid incitement of muslims in the North against voting for a Christian?

Why did El-Rufai not elaborate on this very warped accusation? Mallam El-Rufai should know better.

We understand that Mallam Nasir El-Rufai may feel strongly frustrated as he was not given any appointment by President Jonathan after his return from exile even when he sought fervently to be considered for various positions in the Jonathan cabinet. Yet we do not believe that his inability to get a good appointment should push him to this measure of treachery and outright malfeasance.

The CPC Mallam went further to accuse President Jonathan of depleting the Excess Crude Account (ECA) without any infrastructure to show for it. He accused President Jonathan of depleting this account down to $500 million from the $6 billion that former President Yar’Adua left behind alleging that President Jonathan shared out this ECA savings account to state governors, party apparatchiks and traditional rulers to buy their support for his presidential bid!

Again, how grimly preposterous! It becomes immediately clear that Mallam Nasir El-Rufai who has served in top level government either does not have any functional knowledge of the workings of government OR harbors an intensely deep seated grudge against President Jonathan OR has just chosen to be outlandishly mischievous.

Does Mallam El-Rufai even know what the Excess Crude Account (ECA) is all about OR why it was set up in the first place?

When the ECA was set-up by President Obasanjo, it was meant to be savings against periods of sustained fall in oil prices. When there were high oil prices, it went up. However, in 2008, oil prices fell from about $147.

Such fall situation is what the ECA was created to contain, to cater for the budgetary adaptations that accompany such fall in oil prices.

If government did not save any money and no money was available to be used, then we would be faced with two options, bearing in mind that our economy is heavily dependent on government spending and oil revenues.

The two options are (a) Go and borrow and (b) Do nothing. Option B would clearly cause a complete closure of the economy and certainly not a choice.

Thus money was withdrawn from the ECA and it was put into what the Account was established or set-up to do.

Clearly, for mischievous reasons, Mallam El-Rufai may have deliberately refused to realize that the Federal Government, in partnership with the various other tiers of government (states and local) jointly invested about $5.5 billion into the National Independent Power Project (NIPP). This is beside the $1 billion seed money for the take-off of the National Sovereign Wealth Fund (NSWF).

How could El-Rufai not have researched about this especially when Mallam Atiku and his goons had raised so much heat on this matter during the build-up to the 2011 elections? More especially with Finance Minister Aganga’s regular explanations at the time.

El-Rufai went on to accuse President Jonathan’s government of also borrowing massively. Even though he nauseously doctored the figures, it was really worrying that he deliberately refused to see that with the renewed drive to push infrastructural development and set the foundation for an ambitious and progressive transformation agenda, processes had to be quickened.

And so in his quest to further misinform the gullible, he refused to mention that in the last few months the Federal Government had been settling key legacy issues most of which had been pending for about seven years now. These included the payment of N200 billion to Power Holding Company of Nigeria, payment of N387 billion representing 53% salary increase to civil servants and the release of N87.7 billion to the Independent National Electoral Commission (INEC) in preparation for the 2011 General elections.

In another spasm of neurotic arrogance typical of professional misleaders, El-Rufai stated that there had been no investment in physical and human capital even with the high oil prices that the administration had enjoyed and therefore reasoned these have caused renewed threats of militancy in the Niger Delta, kidnapping in the east and the growth of violent anarchist groups in the North.

At this point, it became clear to us that Mallam Nasir El-Rufai had lost it, even as we prayed fervently that this late entrant in Tunde Bakare’s Save Nigeria Group (SNG) will find the humility to first save himself.

Increased budgetary allocation for education (for the first time, the budget for education outmatched that for Defense), Establishment of about six new federal universities across all the geo-political zones, provisions of billions of naira to revamp and upgrade existing ones, establishment of new airports, upgrades of old airports, revamping of the textile industry in the North and the reopening of Northern Nigeria’s most prominent textile manufacturing facility, establishment of a fast-rail project in the North, commencement and completion of various phases of rail projects in the North and South-West, US FAA Category 1 Certification awarded to the Nigeria Civil Aviation Authority months after many aviation experts thought it was impossible, improved international ratings for Nigeria, increased budgetary allocations for the Niger Delta Development Commission (NDDC), re-invigorated and acceleration Amnesty Programme for ex-agitators in the Niger Delta etc…

Haba Mallam!

On the matter of national security, The President, like every other Nigerian understands the value of peace, security and the safety of life and property and so he appointed a former Deputy Chief of Defense Intelligence, Former Director of Military Intelligence (DMI), Former General Officer Commanding (GOC) 1st Division, Former Chief of Army Staff, Former Chief of Defense Staff, holder of the Corps Medal of Honor (CMH), Meritorious Service Star, Distinguished Service Star, Grand Service Star and the Recipient of President & Commander-in-Chief’s Merit Award (for best all round performance) of The National War College as well as Recipient of the Commander of the Federal Republic (CFR) national award, General Owoye Andrew Azazi as National Security Adviser.

So you see Mallam, President Jonathan is in charge. He knows his onions.

New Changes to Tier 4 Visa from 4TH JULY 2011


Intending students to the UK should note that from 04 JULY, UKBA would:
 
1. Restrict work entitlements to migrants studying at higher educational institutions (HEIs) and publicly funded further education colleges only;
    restrict the sponsorship of dependants to those studying at postgraduate level at HEIs on courses lasting at least 12 months, and government-sponsored students on courses lasting at least 6 months;

2. Require education providers to vouch that a new course represents genuine academic progression;

3. Ensure that maintenance funds are genuinely available to the applicant, by introducing a declaration on the visa application form;

4. Commit to publish a list of financial institutions that we consider, on the basis of experience, do not verify financial statements to our satisfaction in more than 50 per cent of a sample of cases;

5.  Introduce a streamlined application process for low-risk nationals applying to attend courses with Highly Trusted Sponsors;

6. Extend the list of courses for which students must receive ATAS clearance;

7. Restrict the ability to deliver accountancy courses accredited by the Association of Chartered Certified Accountants (ACCA) to those sponsors accorded platinum or gold status by ACCA; and

8. Clarify the position of overseas universities with campuses in the UK.

Abeg go find better thing critique![/quote]Have you made an FOI request before? Have you indeed read the FOI Act? From your comments, its obvious you have not. Furthermore, your comments also confirm that you have no idea how government works. For your information, the government has a standby department of lawyers (Ministry of Justice) and do not need to engage a lawyer or incur any additional expenses for going to court. Accordingly, any serious lawyers knows that issuing an ultimatum to the government and warning of the consequences of their inaction (when the only consequence that can arise is a court action) is an empty threat.
If you have read the FOI law, you would also have realised that SERAP is just dancing to the gallery by requesting the information from the governor when such request ought to go to the relevant government agency. I can assure that the governor can rightly ignore,and would indeed ignore, their request and the threathened case would be futile.

BTW, are you one of those Nigerians mentioned in a thread on NL who think they are smart when they are not?

Mr Poster there is a time line on FOI request. I did the course about 3 months ago in my organisation. In the UK you must acknowledge the letter on receiving the letter and then reply within 2 weeks. If you require more time you must inform the petitioner for more time.

We are actually saying the same thing in different ways. Of course, there are timelines provided in the FOI which is why the person requesting for the information(SERAP in the case)  simply makes his request without issuing threats and ULTIMATUM since a time is already specified in the Law!

The Socio-Economic Rights and Accountability Project, (SERAP) is writing to request you to urgently provide detailed and up-to-date information on the spending relating to primary education in your state. The information should cover the period from 2005 when the first budget was released for the Universal Basic Education Commission (UBEC) program in your state.
SERAP is a human rights non-governmental organization whose mandate include to promote and seek respect for socio-economic rights of Nigerians, and to promote transparency and accountability in the public and private sectors through human rights.
SERAP is bringing this request pursuant to the newly enacted Freedom of Information Act, which is directly applicable to your state. The Act among others aims to make public records and information more freely available, and makes provisions for public access to public records and information. Section of the Act grants the right to access or request information, which is in the custody of any public official, agency or institution.
Under Section 1 (2) “an applicant under this Act needs not demonstrate any specific interest in the information being applied for.”
We believe that it is in the public interest that the information requested is provided. The information requested is not covered by the exemptions under the Act.


We note that since 2005 over N119 billion have so far been granted to the 36 states of the federation, including your state. Despite huge sums of money that have been budgeted and allegedly spent to improve the school infrastructure and environment, primary schools across the country still lack basic facilities.
We note that education at the basic level is one of the most important targets of the Millennium Development Goals, (MDGs). We believe that without transparency and accountability on the spending of education funds, the goal will remain unrealized for millions of Nigerian children.
The FOI Act was enacted pursuant to exercise of Constitutional powers. Similarly, national interest, and the interest of human rights, democracy, rule of law, transparency and accountability is sufficiently dominant in the Act. Therefore, your government is precluded from exercising any discretion that would undermine, restrict or obstruct the direct application of the Act in your state.
Having your government to exercise discretion whether or not you wish to allow the application of the Act in your state would be an inversion of the principles of government. It would be like having the brain subservient to limbs of the body. Also it would subject the residents of your state to a less democratic, transparent and accountable form of government; and this will not correspond to the aim and purpose of the 1999 Constitution.
SERAP is therefore requesting you to provide detailed and up-to-date information on:
1. The total amount of the Universal Basic Education Commission, (UBEC) education intervention funds allocated to states that have been accessed by your state through the State Universal Basic Education Commission, SUBEC. If your state has accessed any intervention funds, information on the exact projects and the details of the spending on such projects since 2005 should be provided. And if your state has not accessed the intervention funds, information on why this is the case should be provided.

2. The total amount of the counterpart fund your state has provided since 2005 when the first budget was released for the UBEC program in your state, and detailed and up-to-date information on the spending of such fund

3. Details of projects on which the intervention and the counterpart funds were spent. For example, information should be provided on the breakdown of the amount spent on: infrastructural development, including classrooms’ construction and renovation; purchase; renovation or rehabilitation of furniture; acquisition of laboratory/workshop equipment; borehole construction as well as construction of toilets; school feeding programme, caring for the physically/mentally challenged children; and training and re-training of teachers.

T[b]AKE NOTICE that if your government fails or refuses to provide the requested information within 14 days of the receipt and/or publication of this letter, the Registered Trustees of SERAP shall take all appropriate legal actions under the Freedom of Information Act to compel your government to comply with our request. Why is it that things that work so simply in other climes are always made complex in Nigeria? I am completely disappointed at SERAP and have lost the little respect I had for them for this shameless request for information, FOI laws have been inn existence in other nations for so many years so I expected to learn how to make requests for information if they had no idea how it is done. No law, including the FOI gives you the power to issue ULTIMATUM to the government over an information or to go about WARNING the government to release any information to you. Indeed, FOI requests are to be kept as simply, concise and as clear as possible. You simply request for the information you need and allow the government or relevant body to decide whether they want to release the info or not. If they refuse, you go to court. so why issue EMPTY threats?

Up to last year, you could argue that you can use money in your husband account to apply for student visa provided you submit convincing evidence that you have access to the funds. However, following the decision in this case <http://www.ergensharif.co.uk/Immigration%20RulesVGuidance%20Policy.aspx> , the immigration rules was amended to make it clear that you CAN ONLY use money in your account, your parents account or an official financial sponsorship letter. In other words, you CANNOT use money in any other account, including money your spouse's account.

For more info see Appendix C of the immigration rules. I have however reproduced below the most relevant portions for ease of reference.

13. Funds will be available to the applicant only where the specified documents show the funds are held or provided by:

    (i) the applicant (whether as a sole or joint account holder); and/or

    (ii) the applicant's parent(s) or legal guardian(s), and the parent(s) or legal guardian(s) have provided written consent that their funds may be used by the applicant in order to study in the UK; and/or

    (iii) an official financial sponsor which must be Her Majesty's Government, the applicant's home government, the British Council or any international organisation, international company, University or Independent school.

This is a going to be a big problem for  the executive arm of government. PDP dont have 2/3rd majority in the house and it will be difficult for them to  come to an agreement and i dont forsee a situation were CPC nor ACN will be in agreement with PDP.

These are the kind of comments that makes me beleive that there is hope for Nigeria. i.e people analysing political issues devoid of North vs South. Its really a fresher from all the myopic analysis on this thread simply based on North vs South. Its high time, we the followers grow up if we want the leaders to do the same!

Wonderful! The South thought they have something by winning the presidency. But look at this: VP - North; Senate Presidency - North; Speaker - North; Chief Justice - North; President of Court of Appeal - North; Chief Judge of Fed High Court - North.

The end product: the North retains power from the back and controls Jonathan and could get him impeached at the narrowest of chances.

I do hope Nigeria remains at the end of the whole drama.

Perphaps you did'nt realised that Tambuwal got 261 votes meaning reps from the SOUTH also voted for him. So, it is not a South or North thing. The reps voted for who they wanted. Why cant Nigerians see beyond tribal politics?? Haba!

I want to know if she can use dis as a place for me to stay during my visit or she should get an off campus accommodation OR I would have to make Hotel reservations?
I also want to know what Important documents she needs to get across to aid my application at the embassy.

I have the marriage certs, wedding pix, 1.5m bank statement and a relatively bouyant monthly income >150k.

U guys are doing a great job on this forum,

If your wife has a Tier 4 (general) Student Visa, then the best thing to do is to apply for a PBS DEPENDANT Visa. This is because although the application fee is higher for the Dependant Visa, it is more straighforward. And it doesnt matter if you intend staying for one week only ( as long as you don't state that in your aplication form).
To do this, you should ensure that the 1.5Million stays in your account for a minimum of 28 days and then in addition to the documents you already have(i.e marriage certificate and wedding pix), you also need photocopies of your wife's passport details page and student visa, a letter confirming her student's status( which she should get froom her school) and an invitation letter from her. If you apply under this category, you DO NOT need to show evidence of arranged accomodation as this is covered by the maintenance fund.

Nigeria is a suspect when it comes to fraud BUT not marriage fraud. If you recall sometime last year, student visa applications were suspected in these countries I mentioned for these reasons.

I really do not get this your calculation oh. The £4800 you mentioned is about the requirement for someone who is applying for a dependant visa where the main applicant is studying in London and this is for a maximum of nine months. For a visitor visa, the amount required is far less.As to what money he would use when he comes back, the poster has not said,(neither is it plausible) that he would spend his entire N1.5 million on the trip. Furthermore, he stated that he was working and earning N150, 000 per month!.

So, you may encourage him to apply for the visa if you want him to loss his money; But i will confidently tell you that it would take a special miracle for a visa officer to issue a visa to an applicant whose life savings would be badly affected by a visit to the UK. You did' nt need to remind us of your experience and knowlegde on immigration issues here. Rather it would have been better to point us to the "what is written in the requirement terms" that you mentioned. For your info, some persons here are actually qualified immigration lawyers and such persons (who obviously know thier worth) do not flaunt it at the slightest provocation because they are not soliciting for clients on NL but just contributing and learning (yes, some of us learn everyday!) from people's experience.
To conclude, N1.5 Million is MOR THAN ENOUGH to meet financial requirements for a VISIT VISA to any country in the world. All the applicant has to prove further is his personal and economic situation in Nigeria in order to demostrate the source of the N1.5 million and his economic and social ties to Nigeria. I don talk my own finish!

I can understand what you mean, but unfortunately you don't expect Visa Officers to show you same understanding without documented proof. It is important to be aware of the fact that Visa Officers are trained to have suspicious attitude toward applicants, and even marriages are suspected to be fraudulent until proven otherwise; therefore, if you don't have any evidence of communication with your wife, then you are just not prepared for the visa application.

While I agree that evidence of subsisting relationship is a requirement, applicants from Nigeria can easily satisfy this requirement by producing thier marriage certificate and some wedding pictures because Nigeria is not among the countries for high risk iin terms of marrage documents. (high risk countries for arrangee marriage are india, pakistan and nepal).

I also disagree with this point. Under the point based system, the financial requirement to get a dependant visa is a maximum of £3600 if the school is outside of London (i.e 400 X 9 months) or £4797 if it is inside London (i.e 533 X 9) . It is therefore illogical for a visa to be refused in this case where the available amount is even more than that required for a dependant visa which has a longer duration.

Would appreciate if people with recent experience of applying for a UK visit visa in the VFS centre in Lagos.

1. On submitting your application, do you pay the visa fees at the VFS office?
2. Do you submit the biometric details [finger print, etc] immediately or are you given a different appointment date.
3. what is the crowd like in these centres and how organised are the staff
4. what is the average waiting time for a visit visa application nowadays.

Submitted a visa application for my wife,son and i on 21/05/2011 and picked up the visa today. Took 2 weeks exacltly and was given 6 months visa.

21/05/2011 was a Saturday. Do they now accept visa applications on saturday

If you have 10 million guranteed votes even before doing any sort of campaingn in the NE and NW, it would be stupiid to throw that political capital away..

Obviously you did'nt read or hear any news which shows that among the 10 million are underaged voters and corpers forceful multiple thump printing.

I guess you did not also realised that 10 million votes for Buhari did not translate to 10 million votes for CPC. For a classic example, pls see the presidential, NASS and gubernatorial elections in Kano State. In order words, the fact that people voted for Buhari does not mean that they love CPC or would vote CPC in every elections just as the fact that people voted GEJ did not mean that they love PDP or would vote PDP in every elections.

FOI bill will benefit the opposition more to do their job by having access to all sorts secrets of governance, hence their appreciation.

FOI was intended to, and would benefit NIGERIANS more as it would provide NIGERIANS access to hitherto secretly held government information which ultimately would make the government to sit up! It was for this singular reason that GEJ signed the FOI and definitely NOT to give opposition tools to do thier job. And in case you have not realised, such laws are mostly used by the MEDIA and NOT opposition for the PUBLIC INTEREST.

There were global happenings 20 years ago, and then there were also global happenings 10 years ago .  . . even 2 years ago, there were global happenings . . .  We could have made history even then by maximizing the opportunities even then . . . so I see no reason why we celebrate every time we read this. "All things been equal" applied 10 years ago -- even 20 years ago. The problem has never been the lack of opportunity or the lack of resources. We have been the problem, and we still remain the problem. Sachs is not new to this. Many have done exactly the same before now.  We celebrated this very same truth during the yar adua years -- we do this about every other month.

I agree that Nigeria's problem has never been that of opportunity, however, you seemed to shy away from stating the obvious that the problem has been that of leadership. Yes, Leadership. Why do we celebrate now? For the first time in the history of Nigeria, we have elected a Fresh Air as President, someone who has studied enough to undertand economic analysis and appreciate the abundant opportunities we have. It is for this reason that some of were against Buhari, and unabashedly so. We are therefore VERY OPTIMISTIC that this time, we would make progress. Don't forget that the BRICS countries were also told the same things for years and that did not stop it from coming to pass when they finally got the right leadership!
