It has absolutely nothing to do with Christianity or Buddhism or any other religion! The part of the OP I quoted which if you had read n understood would have seen you make a more sensible statement, is of an almajiri teacher saying that to stop the begging is equal to stopping the children from learning about their Islamic religion!

If you were not so unnecessarily sensitive in taqqiya style, even you would be worried that an islamic teacher who should be teaching vulnerable children thinks begging is what almajiri should be about! You should be concerned and not looking for areas in the North dominated by Christians! What does that have to do with anything here? Do they send their children on almajiri business too?

That is how the procedure works. The police must first try him, dismiss him if found guilty thereby stripping him of the office/rank of Police officer before he is charged to the High court for trial. This is because members of the armed forces are not subject to civilian law but military/martial law until he is so dismissed from which armed force he belongs to in this case, the Police.

So assuming he committed a crime like assault, robbery all the reasons presented will be valid excuse why he must remain a senator. That implies drug dealers, mad men, thugs, serial fraudsters, rapists, criminals can and have become Senators in Nigeria.
For now, his being in court was as a result of his candidacy to Contest gubernatorial elections. If he was disqualified on that issue, it doesn't affect his senatorial seat. If a criminal case of forgery, lying under oath or such other related offences are is brought against him arising from the Supreme court decision, then a conviction will see him out of office and in jail.
It is the FG ie the Attorney General that should play that role of prosecuting him but alas! This is Nigeria!

Following your line of argument, if the judgment of the CA had been in favour of PDP disqualifying APC so that they didn't participate in the election and then the election took place the next day, are you saying APC would have been expected to proceed to an election tribunal on the issue? What would be the grounds of their petition? That they were unlawfully disqualified by the CA? Can a tribunal overrule a CA? Study the grounds for an election petition and tell me what the argument would have been.

How can a cause of action that arose prior to elections suddenly be referred to an election petition tribunal when it has already been litigated upon? That is an abuse of court process and would have suffered being statute barred!

It's very important to understand the technicality of making a case against an elected official.

Once he or she is elected, only a special court call tribunal can find him guilty..
And I am telling you that a pre election matter doesn't expire because an election has taken place. An election does not stop the right of appeal every party lawfully enjoys. If the Court of appeal had upheld the judgement of the high court excluding APC, elections were conducted and PDP was declared winner, will you toe this line of argument to say APC should not approach the SC when hoping for a chance that the decision of the lower courts would be overturned?

Remember that it was the day after the court of appeal judgement was given that Bayelsa election was conducted.

Bayelsa appeal in supreme court while the election results were already declared.
That is a function of when decisions were entered by the courts. You cannot force the courts to pass a decision until it is ready. It is not a sound argument that elections had been conducted and therefore any existing right of appeal is expired!

Yes, it does because the Appeal court already passed a judgement in favour of the APC before the election.
The Court of Appeal is not the final arbiter on pre-election issues, the supreme court is. The right of appeal had not been exhausted and PDP rightly made use of the available right. Was Zamfara not a pre-election issue? Did Court of Appeal not give judgement enabling APC in Zamfara to contest? Did the Supreme court not overturn that decision hence the PDP leadership in Zamfara today? Did Falana raise this issue?

The fact that an election had been conducted did not negate an ongoing suit which the parties had a right to appeal up to the Supreme court!

I wonder though whether Falana averted his mind to the fact that after the conclusion of a case there is a right of appeal which must be exercised within a certain timeframe if parties wish to and after which the principle of effluxion of time comes into play.

A pre-election matter doesn't suddenly become a post-election matter just because an election has taken place when the appellant party still has a cause of action and has not run out of time to file an appeal. The law does not say that the court of appeal is the court of final judgement rather it is the Supreme court on pre-election issues.

The mere conduct of an election does not override or extinguish the right of appeal of any party.
