It's not like the case is extremely solid.

The judgment is based on the discretion of the judge but she chose to resolve the case again the defendant.
First, the Justice Ejembi Eko who delivered the lead judgement is Male and not female. Perhaps you are under the impression as some others, that because the panel was led by Justice Mary Odili, she also authored the judgment. Panels are always led by the most senior in hierarchy who may not necessarily author the lead judgement; for this panel Justice Mary is the most senior.

Secondly, forgery does not necessarily mean that there must be someone else that bears the names other than the one claiming them. The issue arose from having dissimilar names on multiple documents, claiming ownership of all and yet not using the proper legal means of correcting names if you claim they are wrong. It is on these basis that the Supreme court arrived at its decision and properly chastised the Court of Appeal for agreeing with some preposterous positions canvassed by the respondent.

Take it easy! A peaceful protest is a completely lawful way of expressing displeasure with a situation or position. That is completely different from declaring that the judgment of the Supreme court will not be carried out or obeyed which is what Oshiomole's statement amounts to. PDP did not make any statement or gesture towards obstructing the judgement of the court. Rather it is deploying all legal means to get a review which is also legal.

Stop brandishing ignorant ideas around please.

What is the role and function of affidavits?
Is the discrepancies in names a 100% proof of forgery? What tangible proof shows that those names does not belong to him and that he does not possesses those certificates?
Were witnesses called to testify that he doesn't possess those certificates? Were proofs brought that someone else bears those names? Did the authorities testify viva voce that those results were forged?
Forgery is a very serious issue and must be conclusively proven beyond doubt,it is criminal in nature.wike,lalong etc have similar issues but they were acquitted.
Those are questions for APC and it's legal team to respond to. The court is expected to be an unbiased arbiter and will therefore not descend into the arena of dispute to direct the parties or counsel on what procedures or witnesses to call.
I personally did not follow the proceedings at the high court where all of those would have been established. The appellate courts will not start the matter afresh by calling witnesses or entertaining any fresh witnesses.

The law is clear, all parties are aware and signed up to contest knowing the implication of the law and it's application. Why cry foul when they run afoul of the same law they agreed to be bound by? Besides how do you mean the proof of forgery is not conclusive?

If APC had kept their usual callous disregard for the law aside and conducted credible screening of its candidates and those ones contested elections, we can then say which party was victorious. Justice Mary Peter Odili is from Mbaise in Imo state. The same town with Emeka Ihedioha that was recently sacked by the Supreme Court. While Ihedioha is from Aboh Mbaise, Mary is from Ezinihite Mbaise.

Her husband Peter is in the same party with Ihedioha a PDP chieftain and a former Governor of Rivers State.


Wondering..... Any connection with her ruling in Bayelsa case?
She led the panel as most senior but some other judge read the lead judgement which the other 6 merely concurred to and agreed with. Take it easy with propaganda

Faleke was allowed to continue as the deputy governor while Yahaya Bello was brought in as the governorship candidate. The same thing should have happened in Bayelsa. Lyon should have been allowed to continue while the deputy is disqualified. In the alternative, the Bauchi situation where a fresh election was ordered after the deputy governor was disqualified should have happen.

There is nothing democratic about giving victory to a candidate that was overwhelmingly rejected by the people. This is not democracy.
First, I have edited my post. Secondly, please fill me in on the Bauchi scenario. I don't quite have the details so I can't comment just yet.
Back to this issue, for Kogi, silly as that was, the greater common sense would have been for Faleke to become the governorship candidate and not nominate one over him just as would have been the case if Audu had died after they had been sworn in. Placing Yahaya over him was based on religious and tribal considerations plus the working relationship would have definitely been sour so that is why Faleke turned it down. Bottom line though is that there was no disqualification and elections had yet to be concluded.

For Bayelsa however, this issue was a pre-election matter. Again by the electoral law, a ticket is joint except that of legislative positions. The fates of both parties are tied and what affects one affects the other too. Like I said, grounds for disqualification do not include death. If the Bayelsa deputy candidate had died(God forbid), we would not be having this scenario. However, he's been caught in a crime of forgery! Since they haven't been sworn in, they are still joined together. Even if they had been sworn in, because it's a pre-election matter, it would have still affected them both because the implication of the judgement is that APC did not have any candidate.

No party can nominate a governorship candidate without a deputy, INEC will not accept such incomplete nomination. The court is therefore saying that since the deputy was not qualified, he was not a candidate ab initio. APC therefore did not have a candidate so their participation in the election is an exercise in futility.

Death is not a ground for disqualification. Deficient or forged academic qualification is. One party cannot be allowed to pick n choose just because!
For me, the Kogi case you refer to is an aberration because death was the issue not a disqualification and elections had yet to be concluded. I hope you know Faleke was not allowed to continue instead a fresh candidate who wasn't on the ticket was nominated ie Yahaya Bello. If you feel the governor elect should not be affected, why was the deputy governor elect in Kogi affected then? It is the yeye APC abracadabra that no one has bothered to challenge.

The point is, the party should have reasonably foreseen the issue of academic qualification and addressed it satisfactorily before nomination. That is why the fallout like in this Bayelsa case is stringent. On the other hand, no one can foresee death unless they chose to field an already terminally ill candidate.

Did he swear the affidavit? Is it PDP that will do that one for him too? Besides time is of essence. I hope you know he couldn't have gone to swear that affidavit while the matter was in court because it had become subject of litigation. Rather he ought to have had such affidavit at the time of his nomination and submitted it to INEC along with his documents/qualifications to regularise the discrepancies.

Legal issues have clear procedures that must be complied with.

Academic qualification is a constitutional requirement and also a ground for disqualification. Forgery is a crime! Do you really think this is a mere technicality? In fact criminal proceedings should be instituted against the APC deputy governorship candidate for forgery and perjury because he swore to those forged documents under judicial oath!

From one horrible judgment in Imo, where total votes the Supreme Court passed to Hope was greater than the total INEC acccredited voters, to another horrible judgment in Bayelsa where the people's electoral power to choose their own leaders is cancelled and their choice removed because a deputy candidate forged documents. Is it not the deputy alone that ought to be removed or substituted with someone else? So if Osinbajo is guilty of forgery, will the supreme court remove Buhari too? The supreme court under Buhari has gone totally bunkers, a national shame and disaster with evil judgments that turns justice upside down on its head. Everything under this Buhari regime has turned into a disaster, even the Supreme Court.

Actually, by our electoral laws, the ticket of president or governor is a joint one, no party can nominate just one without the other, they won't even be qualified. So also, where one is disqualified, it nullifies the entire ticket for that party unless there is still time for fresh nomination/replacement of previous nominees.

True, the judgment of the court has come at a time when elections have already been conducted but it is a pre-election matter and should be treated as such. If the deputy candidate is not qualified, then it is taken that the governorship candidate could not have stood for elections alone. Same would have been applicable for the presidential elections if it had come up as an issue and was sustained by the court.

That is why APC should bear the responsibility for this because they are supposed to screen candidates before nomination.

Feel free to protest the way PDP has done and is still doing! Just remain peaceful as has been the case for the Imo elections. There has been no record of violence anywhere since PDP has been engaged in its protest and has even embarked on seeking a review by the Supreme Court. They said maintain peace, not go and sleep!

Without consideration for the costs of fresh elections, the psyche of the affected people that have to go through the same process, the likely dangers of violence and insecurity usually caused and fostered by the same security agencies that should preserve peace etc.

What about punishment for the party that failed to do its job by making sure its candidates are qualified? Are they not supposed to screen candidates before nomination to INEC? Why should they be allowed to reap even after presenting the people a poisoned chalice?

APC knew it had room for victory because of dissatisfaction within PDP and choice of candidate, why abuse the likely outcome of an easy electoral victory by presenting unqualified candidates? In fact, it should tell Bayelsa people that APC is not trustworthy and wanted to give them a fraudulent forger as deputy governor! What a gross abuse of trust!
Qualification is a basic requirement! Why subject the people to the trauma of elections again (especially in Bayelsa where the violence is usually crazy)! Who compensated them for previous losses of property and lives and injuries?

There must be an end to the electoral process. It cannot be that there will be fresh elections and most likely fresh litigation again from the tribunals! The court has other things to do too, it's not set up to accommodate the deliberate deficiencies of APC.

You are calling the electoral law obsolete instead of demanding that the qualification benchmark even be raised to at least masters degree for presidential candidates and first degree for all other positions!

This was a pre election matter. If candidature has been voided as you rightly stated, it therefore means that in the eyes of the law, APC had no valid candidate and ought not to have even participated in the elections at all!

It should be clear by implication that any vote in APC's favour is a void vote ie it doesn't exist. It is a waste, it shouldn't have happened and therefore stands discountenanced!

The official language of communication in China is Chinese. On the contrary, our official language is English. Every person that passes through formal education in Nigeria is required to have a credit in English and the language of instruction is also English language! Unless he is in his hometown or among his kin, it is an absolute embarrassment and shame that he and those ones in NYSC camp are unable to communicate comfortably in English language.

The OP didn't post the full news even though the Army doesn't have any viable excuse in my opinion.
The story by the Army makes one wonder at their preparedness to deal with this terrorists! By implication, they are saying that the same Army personnel are on duty 24 hrs, guarding roads by day and going to attack in the bushes by night. So they aren't rotated by shifts? How can such soldiers be alert and operate optimally?

It means they don't have enough personnel yet they have dumped hundreds of soldiers in Abia state because of Nnamdi Kanu and IPOB that pose no threat to the community!

Reacting, the Theatre Commander, Olusegun Adeniyi, said the attack would not have happened if travellers plying the road had heed the directive of the military which banned movement on the road once it is 6pm.

“By the day we are busy securing the Maiduguri-Damaturu road ensuring that commuters were able to move, and the road has been safe since and that’s why since the last attack the road has remain safe; and by night we go after these Boko haram that are actually coming to attack people in their communities,” Mr Adeniyi said.

“The army usually carry its night attack and ambushes on Boko Haram with the understanding that the road has been closed to commuters and there are no vehicles on the road. And the incident of yesterday was still surprising and we must examined it; if that road is really safe. If you know that this road closes by 5 o’clock, from either Maiduguri or Damaturu side, then why are you plying it at about 3p.m? You will find out that there were about 200 vehicles lined up in Auno, in Jakana, in Mainok, in Ngamdu and even in Kukareta.

“Many times they would even be seen insisting that the soldiers should open the roads for them to get to either Damaturu or Maiduguri. It is not safe to be lining up such a large number of vehicles in this village especially knowing the wicked intentions of Boko Haram.

“If you are going to ply the Damaturu-Maiduguri road, for a slow car, make sure you are on that road by 3 o’clock in the afternoon so that you can clear off before 5 o’clock. And if you are driving a big truck, make sure you have started your journey around 12 or 1pm so that within 5 hours you have cleared all the road. The public must understand the soldiers expected to go on night patrols in the bushes cannot again be drawn to the road to protect vehicles of people that refused to obey the law; they refused to obey rules and regulation. Nigerians have to look into this matter critically. Soldiers shouldn’t be diverted from their night operations to go and protect vehicles of people that found themselves where they were not supposed to be. That road closes by 5p.m. You cannot be on the road that has been closed to prevent Boko Haram movement; now that they cannot move, they came to set the place on fire.

“The press should help me to communicate to the public, this is an appeal that we don’t want to see vehicles plying that road once it is 5 o’clock,” he added.

Meanwhile, President Muhammadu Buhari, whose administration had severally claimed to have decimated the terrorists, described the attack said to have occurred on Sunday as “cowardly.”
