In every PDP government we've had, the president takes responsibility for problems and calls his appointees to order where needed. It is only in this APC/Buhari era that he is either not aware or it is never it his fault! Las las they will regurgitate their 16 years of PDP BS mantra as if governance was supposed to be a walk in the park! Did past presidents not meet challenges? who did they blame?

Now his wife who is closer to him than any other person can be has come out in the public to tell us that her husband aka Mr president is not in charge of the government and he has allowed the machinery of government to be hijacked by persons he personally appointed and he's clearly unable to do anything about it. That explains why we keep hearing that he is not aware and not to be blamed! We want, sound, intelligent, forthright leaders who know, what they are about, will take responsibility and get things right!

Human rights lawyer, Femi Falana, SAN, has asked the Federal Government to urgently withdraw the charges against the Chief Justice of
Nigeria, CJN, Justice Walter Onnoghen as such move will amount to prosecutorial misadventure.

The Federal Government had earlier asked Onnoghen to vacate his office over failure to declare his assets as required by the law and moved to arraign him at the Code of Conduct Tribunal, CCT.

But Falana, in a statement on Saturday faulted FG”s move to press charges against the CJN.

According to him, “The charge against the Chief Justice of Nigeria, Justice Walter Onnoghen ought not to have been instituted at the Code of Conduct of Tribunal in view of the case of Nganjiwa v FRN (2017) LPELR 43391 wherein the Court of Appeal held that a judicial officer who has not been investigated by the National Judicial Council and sanctioned for misconduct cannot be arraigned in any criminal court in Nigeria.

As all authorities are bound by the Court of Appeal verdict, the case should be withdrawn by the Attorney-General of the Federation without any delay because it is likely to be a prosecutorial misadventure,” he said.

Judicial officers are usually silent, even reticent on things like this. If you paid any attention, you would have noticed that in all that drama of raiding judges' homes and charging them to court, none of them made any statement explaining, accepting or denying anything. That was mainly done by other members of the judiciary and public opinions. Judicial officers have very stringent conditions for making any public speeches or addresses on i]any issue to maintain neutrality and preclude any possible appearance of bias. The fact that the timing is wrong due to the coming elections and the clear ethnic/tribal divisions in this country silences every other question or consideration at this time especially if the FG is deliberately unwilling to follow the rule of law. There is a proper procedure for investigating and arraigning a judge, that was not followed in this instance.

If Buhari can refuse to sign the amended Electoral Act more than 2 months to elections because he feels it is too close and will supposedly cause confusion in its implementation, why will the FG attempt this nonsense now? Oil belongs to the entire Nigeria abi? Is the entire Nigeria bearing the brunt of environmental damage and deprivation as the ND does? The ND indigenes will explain better to you!

If we are to go by what Femi Falana and Afe Babalola have said, that no external bodies can investigate a seating judge for any crime, then wherein lies the doctrine of Separation of Powers.
Even the Executive with its clearly spelt out immunity cannot investigate itself.
Does the NJC have any agency that can conduct a detailed investigation on a criminal case?
Obviously, we have a lacuna here and the Judiciary is exploiting that ambiguity.
But the obvious is inevitable because either way, the chicken will come home to roast.

If the CJN can only be investigated by the NJC then he has a moral burden to step aside for a proper investigation.
The Executive can and does investigate itself; that is why Babachir Lawal was investigated by a committee set up by the same Executive and he was removed yet the Executive refused to bring him before the judiciary for trial and judgment. It is also why when a police officer commits an offence, an orderly room trial is first set up for such an officer by the same police authorities before he is subjected to the judiciary/courts. It is also why the action against the former DG, DSS was handled within the Presidency and he was eased out of office yet no trial for the numerous charges against him. In fact, it the self-regulatory powers of the three arms of government that ensure the principle of separation of powers. The Executive should not be seen to attempt to over-reach itself for any reason!

Every homogeneous region should be allowed to handle its affairs and stop demanding for or expecting crude/proceeds of crude from the SS without commensurate regard and consideration. Nigeria is already sharply divided along ethnic and religious lines. This has been further exacerbated by the actions and utterances of Buhari. Now the South-South already feels shortchanged by the now obvious gang-up against Jonathan and as far as they are concerned, it is because he is from the minority. They let it go for peace. Their son (Matthew Seiyefa) was the most senior DSS officer that should have been allowed to remain at the helm of affairs after the former DG, Daura was removed. Besides he had just about a year to retirement. Same Buhari refused and removed him for a retired, junior, northern DG. That wound still festers and now the CJN is suddenly picked on, again a son of the South-South. They will certainly not take it and as far as they are concerned, their region is the goose that lays the golden eggs so they refused to be emasculated at federal/national levels.

It just so happens that the SS has remained a stronghold of the PDP so whenever reactions to the CJN fiasco is made, it appears that it is a PDP affair. Naturally, no APC chieftain will want to be seen to condemn this action because it is their government that has orchestrated the current turn of events. Very few Northerners will even speak because they too, in their characteristic greed, want their son, (I T Mohammed, JSC) to take over as CJN so they hold the entire machinery of government. The reactions you see are mainly from sons of the SS which is only natural. Even Governors of the region have issued a statement and then members of the Bar. Lots of legal experts have also spoken, are they all PDP?
