I agree there was an executive overreach and also believe the CJN ought not to desperately attempt to stall his trial by chasing loopholes. He should have resigned but his postponement of the NJC meeting was diabolic and the executive had no choice.
The postponement occurred after the executive breach and not before. The question then remains, why breach in the first place and then seek to regularise? That is plain evil done just because the Executive could with all armed security forces under its control and to suit its political interests.

Why breach in the first place and then seek to 'regularise'? By your admission, there was a breach hence your use of the word 'regularize'. How are those who criticized such Constitutional breaches goats? You should be objective enough to criticize wrong when it occurs.

The FG had already breached the Constitution and judicial authority by going to the CCT in the first instance. That is the crux of the matter.

The NJC held its 87th meeting on October 3 and October under the chairmanship of Onnoghen. At the end of the meeting, it recommended the appointment one Supreme Court Justice, three chief judges, three other judges of state high courts and a judge each for the Sharia Court of Appeal and the Customary Court of Appeal. The 88th meeting was to hold on Tuesday January 15, 2019.

But days earlier, the Code of Conduct Bureau (CCB) had slammed fraudulent asset declaration charges against the CJN at the Code of Conduct Tribunal (CCT).

There is no advantage sought to have been taken by the FG, it had already chosen its path of illegality.

Mr Onnoghen actually suspended the NJC meetings until further notice thereby preventing or frustrating due process - he's the chairman of NJC & he left the CCT with no options but to act on his flagrant behaviour.

On the contrary you can see that the NJC can and has convened without the CJN and Tanko there... his postponing the meeting would not have stopped the NJC from meeting but that would have been with a petition before it from the FG against the CJN. The FG deliberately refused to follow statutory and judicial procedure on this until now some illegality has already been perpetrated.. He would not even preside over such a meeting and would have been required to recuse himself. The same Falana asked the FG to withdraw its process/charge before the CCT when it first started and refer it to the NJC isn't it?

I don't know why some of you cannot leave tribe and ethnic bias out of issues. If nothing else, the majority of the legal profession is against this illegality perpetrated by the President and the CCT; the Majority of the South has also kicked against it because he is of Southern extraction yet you must just single out Igbos, why? Which tension? Tension created by Ibos carried out by the ibos. Most of the nonsense illogical statements are made by them. No tension in most part of Nigeria. The temple of justice is being destroyed with corruption. A man who is supposed to be a symbol of an incorruptible judge is being investigated they are citing Abia & Kwara cases. NJC will try to defend the integrity of Judiciary but not protect corruption.

If CJN is not suspended this NJC meeting would not have taken place

If you go back to my comment, I touched on the arbitrary use of power by the executive (Presidency).

My argument is about the judiciary protecting their own thief instead of condemning Onnoghen's action. This behaviour by the judiciary will only embolden the corrupt ones amongst them to continue to dare the potency of the laws of the land.

How has the judiciary protected 'their thief'? This is about due process that everyone must follow in a democratic society. I do not think there is any judicial officer that has said Onnoghen should not answer for any offence alleged to have been committed. Rather, the problem is that the Executive has deliberately meddled and breached provisions of the Constitution and superior court judgements that a judicial officer must first be subjected to the NJC for disciplinary measures before he can be tried by any court.

It is a self-regulatory feature that is meant to allow for some level of independence and is also obtainable in the Executive and Legislature. That is why a committee was set up for the likes of Daura (DSS), Babachir, former DG, NIA and a host of others. It is then let for the same Executive to file an action before the courts and prosecute them for corrupt practices which led to their dismissal in the first place. This as you know, has not been done.

Bottom line is due process and rule of law. You would have made more sense if they had the AGF and F had first approached the NJC on Onnoghen's issues and the NJC refused to act. Garba Shehu is on record for the NHIS Secretary that was removed by the board saying that they had not followed due process to remove him. Why is that so hard to accept now for the CJN?

The CJN will ask Tanko Mohammed to step down as he wasn't nominated, they will also investigate the allegation of Ononghen and may ask him to step down.

Our politicians fathers have now institutionalised corruption in Nigeria. Onnoghen's case shouldn't be contested as there's an admission of wrongdoing by the defendant (Onnoghen), therefore he should be facing prosecution with expectation of a custodial sentence.

In the same light, the executive arm has violated rules & flouted laws with regards to due process - arbitrary use of power.

The judiciary is twisted, the country is....grin

First and foremost the NJC must remember that this meeting is not about whether Onnoghen is corrupt or not but to find out where Buhari got his imaginary powers from to claim to suspend the Head of the Judiciary and where he got another imaginary power from to dare to replace him without any input from the NJC and the National assembly as enshrined in our constitution.

The out come of this meeting must be to uphold the constitutional status quo and to fix another date to hear the trumped up corruption charges against Justice Onnoghen and to decide the punitive measure for the unbecoming behaviour of Justice Tanko.

That is the one I don't understand. I read somewhere that his name is not entered in the roll for all lawyers called to bar at the Supreme Court of Nigeria. If it is really true then it amounts to his being a fraud in his entire legal career both at the bar and the bench.

If it was to be a form of social intervention in the strict sense of it, you would not have the Vice President who is contesting elections travelling from market to market across the country to share money. Rather it would have been domiciled in the relevant ministries at federal and state levels,the recipients properly identified and then funds disbursed. Finally, no one would be asking for their voter card numbers either!
