S/Court to hear Sokoto governorship appeal March 1 Wednesday, 09 February 2011 02:31 John Chuks Azu E-mail Print PDF Share The Supreme Court yesterday fixed March 1 to hear an application by a Democratic Peoples Party (DPP) Governorship candidate in Sokoto State, Alhaji Muhammadu Maigari Dingyadi praying it to set aside part of its decision made on November 26, 2011 which dismissed his appeal pending before the Sokoto Division of the Court of Appeal. Dingyadi, in the application dated December 17, 2010 is asking the apex court to set aside that part of its decision on the grounds that it lacks the jurisdiction to make it. The DPP governorship candidate has challenged the election of Governor Aliyu Wamakko as the state governor in the April 2007 governorship election at the apex court. A five-member panel Justices of the apex court in a unanimous judgement delivered last year by Justice Mitchel Chukwuma-Eneh made a consequential order dismissing Dingyadi’s appeal pending before a Court of Appeal in Sokoto as an abuse of court process. The court ordered that the written address in support of the application filed on December 30, 2010 be served on all the parties and gave the respondents seven days to file their addresses and gave the applicant five days to respond. Dingyadi went to the apex court following dispute over whether or not he could withdraw the interlocutory appeal which arose from the refusal of the Appeal Court to allow him amend his prayers in the substantive appeal. The DPP governorship candidate, in a notice of withdrawal of his appeal filed by his counsel on June 8, 2010 sought the court’s permission to discontinue with the matter and consequently asked for a unilateral withdrawal of the appeal against all the respondents. http://dailytrust.dailytrust.com/index.php?option=com_content&view=article&id=11751:scourt-to-hear-sokoto-governorship-appeal-march-1&catid=1:news&Itemid=2 |
