Tinubu won on the results on IREV. It was compiled by an Obidient Mark Essien. And Tinubu still won the election.

The only state where the results on IREV was different from INEC results was in Rivers State where Obi won and Tinubu took second. But on inec results, Tinubu won Rivers and Obi took second.

Even if you give all Tinubu votes in Rivers to Obi on IREV, Tinubu will still win the results on IREV.

If Supreme court do what you are suggesting, Tinubu will still be declared the winner because he won both in IREV and INEC manual collation.
By the time Mike essien compile the results, more election results was yet to be uploaded to the INEC irev portal. The INEC chairman don't have an excuse to have use bad BVAS machine to take photos of election results after much money was spent for them to do a better job

If the supreme Court decide to use technicality of INEC irev portal election results, they are likely to cancel the 2023 presidential election.
Logically, Atiku and Peter obi are on point to challenge the 2023 presidential election because the the votes margin of BAT, Atiku and Peter obi are not too high, when you want to compare it between BAT and kwankwaso. The 2023 presidential election produced 3 President. The first one is BAT that was selected by INEC chairman, the second one is Atiku who claimed to have the highest votes from the manual collected election results, the third president is Peter obi, who claimed to have the highest votes from the INEC irev portal election results.
The law did say that when a political party can't make use of election results from their party agents as evidence in court, they can make use of election results from the INEC irev portal to use as evidence in court. These law apply to LP that didn't had enough party agents to cover all the polling unit.
When you look at election results uploaded to the INEC irev portal, it contains election results that are clear and the election results that are not clear, which is because INEC good bvas machine and bad bvas machine to take photos of election results before sending it to the INEC irev portal.
The question is:
If INEC chairman gave an excuse on why they couldn't upload presidential election results into the INEC irev portal in real time, what excuse does the INEC chairman has for using a mixture of good and bad BVAS machine to take photos of election results?
But then it all will depend on how Peter obi LP lawyers will present their cases in the supreme Court. Peter obi LP also need to provide more details on where they won in the INEC irev portal to the judges in the supreme Court

But more questions should even be asked on why the PEPC didn't accept the evidence from Atiku PDP lawyers on having the highest votes, because Peter obi party LP was a weak party that didn't had enough structure and didn't had enough party agents to cover all the polling unit, that is why they depended on the INEC irev portal results, of which most of their hope there were the ones that was blurred

Before now many Nigerian didn't know what the PEPT court was made of, thanks to the lawyers of LP and PDP, Nigerian now know that the PEPC court is made of judges who are badly compromise, corrupt and toxicated by the APC FG. I don't know if the lawyers of LP and PDP were deliberate in not meeting the demand of the PEPC, but they may have known how desperate the judges in the PEPC where ready to do the bidding of their pay master in APC, that is why they didn't take their demand seriously.
Presidential candidates for next election will know that it'll be better for political party like PDP, LP and NNPP need to be united in coming together to form a merger that will produce a new party for them to stand a good chance of winning the 2027 presidential election, than to wast their time going to the PEPC.
The PEPT court was put on trial by Nigerian, the media and the international community, but they failed the trial test for the first time in Nigeria history. The supreme Court has started their trial test, we will rate them after they passed their judgement on PDP and LP cases.

The common sense there's for the Constitution to be amended to make the FCT look like a 37 state, where the people of the FCT can vote for who they want to be their governor or who they want to be their FCT minister before the election

The people of the FCT don't have the opportunity to vote for who they want to be their FCT minister, which is like a governor of a state, the only opportunity they have is to have a say on who should be the president of Nigeria, by giving that person a minimum of 25% of votes.
One important questions to ask is:
If the INEC chairman think that the people of the FCT votes is not important at all in the presidential election, then why did he allowed them to come out to vote in the day of the presidential election?
If the reason why the people in the FCT votes is for the mandatory 25% in the FCT, then why was that part of the Constitution not implemented?
By just looking at the PEPC judgement, one will wonder of what use or contribution was the votes from the FCT in the 2023 presidential election
Once a court is compromise, they will look for loop holes to apply technicalities in favour of the ruling party. Had it been Peter obi was announced by INEC to have the highest votes but failed to get 25% of votes in the FCT, the PEPC will have used that against him, I am not surprised on how they controversial rule that a hard drugs case is a civilian case

But it's Democratic in the sense that the people of the FCT don't have the opportunity to vote for who they want to be their FCT minister, so the only opportunity is just for them to have a say on who should be the president of Nigeria. There are two types of cases presented in court by the opposition party, which are; (1) election petition cases (2) cases that has to do with the 1999 constitution.
At the end of the day, the judiciary will either confirm the 1999 constitution in passing their judgement or modify it into the 2023 constitution in passing the judgement. It's factor like this that would definitely determine if military coup happen in Nigeria or not, because the Nigeria military are the protector and defender of the 1999 constitution which gave way for democracy in the 1999 election.
Nigerian will know if the judiciary is working for the Democratic process or working for the interest of a political party

The reason why people say that the judiciary is on trial is because they are being faced with cases that has to do with the 1999 constitution. I've taken time to study election judgements in court, I discovered that 98% of them were credible from both the PEPC and SC, which is to show that judges pass their judgement based on what is presented to them, but not people say on the media

(1) the minimum of 25% requirement in the FCT: this is the first time a case like this will be presented to the court. For those with the argument that the FCT can be treated like a state are like those who quote words from God holy books for wrong interpretation. The 1999 constitution did say that a candidate should have a minimum of 25% of votes in 24 States "And" the FCT, what this mean is that even if a candidate get 25% of votes in 28 states, with the word "And" it mean that the candidate also need to get a minimum of 25% of votes in the FCT
(2) INEC certified copies of registered voters: on June 21 of 2023, Peter obi legal team presented at the presidential election petition court the certified true copies of the documents detailing the total number of registered voters and PVC. This are things judges in court can use to identify those places where over voting happened
(3) EU reports on the election: this will be the first time that judges in court will be accepting EU reports as evidence
(4) BAT hard drugs case: the judges in court will want to find out if BAT repented from his hard drugs business after fined by a US court. If BAT is still directly or indirectly into the hard drugs business, he could be in big trouble with judges in court

Judges in court are expected by law to have a reason for passing judgement on a case in court. In the 2007 presidential election petition case, the judges in court gave their reason for accepting the election victory of MYA, which was that the evidence of ballot stuffing and phantom voting booths presented by buhari and atiku was not enough to overturn the 2007 election results.
In 2019 the supreme Court gave their reason for accepting the judgement from the PEPC , which was that Atiku PDP did not provided credible witnesses and they fail to prove issues of over- voting, when they couldn't produce authentic voters register & also INEC didn't used a server in 2019 as was claim by Atiku PDP

The reason why the supreme Court restored Ahmed lawan as the APC candidate for the Senate is because:
(1) the consider APC to have a final say on that
(2) sheriff machina didn't presented his case properly in court

The FCT is the place that has the special status, where all the tribe in Nigeria are equally balance in numbers. The FCT represent Nigeria as a country. Judges can't rule against direct cases.
No matter how close or friendly judges are to you, they can't rule against direct cases. They're 2 type of cases in court, which are cases of technicality and direct cases.
Technicality cases are cases where a judge will have an option to decide on who he or she wants to win the case, but in direct cases, the judges in court will have no option but to judgement from the way they've seen the case.
If BAT APC like, he can change most of the judges and replace with new set of judges, but then, if those judges are presented with direct cases, they will have to pass judgement on what they have seen in the case.
Example of technicality cases LP and PDP have presented in court are:
(1) the 25% of votes requirement in the FCT
(2) evidence to show that BAT VP was not qualified to be his VP

Example of direct cases presented by LP and PDP in court:
(1) a video evidence to show inec chairman guidelines on how the 2023 election is to be done
(2) evidence to show that BAT was not qualified to run for the presidential election
