By Onuoha Endurance Ebelechukwu It was since 2007 that a group of 17 members of the Movement For The Actualization Of The Sovereign State Of Biafra (MASSOB) involved in the agitation for a free Biafran Republic were remanded in Onitsha and Awka Prisons custody respectively over the alleged crime of Kidnap and murder and apparently forgotten and abandoned by their Former leader Ralph Uwazurike. The 17 defendants has claimed that they have been in continued detention since 2007 without trial and fair hearing. The grpup had petitioned the Attorney-General of the Federation (AGF) and Minister of Justice Mr Abubakar Salami (SAN) asserting the 17 agitators have been incarcerated in Onitsha and Awka prisons for the last 10 years without bail and fair hearing in the court. Those in detention are: Innocent Orji, Sabastine Amadi, Casmir Odakara, Ojemba Anyanwu, Eni Kalu, Ndubisi Okam, Ikechukwu Chikwem, Chukwuma Kalu, Chidiebere Ezekwem and Mmaduabuchi Asika. Others are Uche Idikaigbo, Uchenna Nicholas, Peter Igbokwe, Ikechukwu Aghara, Ama Onuh, Chukwuebuka Ikenwa (Hightension), Okwudiri Bassey, Chima Asor and Chinwendu Irondi. Since 2007 till today, none of the detainees have been given audience, fair hearing, justice and judgment. The DPP and Judges of the State High Court Onitsha has used their regular absence in court which has resulted in prolonged adjournments as a delay tactic to frustrate the detainees and make them languish in prisons on awaiting trial. “Now almost all of them have lost heir parents, children and relations and could not witness their burial ceremonies. Ahead of his scheduled lunch with Republican senators, President Donald Trump wrote online on Wednesday that GOP lawmakers “MUST keep their promise to America” by voting to do away with the Affordable Care Act. Trump also predicted that his lunchtime meeting would improve the proposal tabled late Monday night by Senate Majority Leader Mitch McConnell. “I will be having lunch at the White House today with Republican Senators concerning healthcare. They MUST keep their promise to America!” Trump wrote on Twitter Wednesday morning. “The Republicans never discuss how good their healthcare bill is, & it will get even better at lunchtime. The Dems scream death as OCare dies!” The president’s latest push to repeal and replace his predecessor’s signature healthcare legislation, also known by its nickname, Obamacare, collapsed this week when enough Republican senators announced their opposition to a GOP leadership-backed bill that would have undone the controversial law. Republicans struggled in their internal negotiations to find compromise at the ideological edges of their caucus, with moderate Sen. Susan Collins (R-Maine) joining conservatives like Sens. Rand Paul (R-Ky.) and Mike Lee (R-Utah) in opposing the measure. It was Lee and Sen. Jerry Moran (R-Kan.) whose announcements on Monday that they would oppose the repeal-and-replace proposal forced McConnell (R-Ky.) into tabling it. The two lawmakers’ announcements took Trump, who was having dinner with other GOP senators in the White House at the time, by surprise. An Information from boomberg.com has it that Bank of America Corp, has told investment bankers to stop working on transactions with HNA Group Co. for now amid growing concerns about the acquisitive Chinese conglomerate’s debt levels and ownership structure, according to people familiar with the matter. The U.S. investment bank joins other Wall Street firms, including Citigroup Inc. and Morgan Stanley, that are largely steering clear of advising and financing the group on deals because they are unable to get internal approvals from “know your customer” committees, the people said, asking not to be identified because the information is private. Senior officials at Bank of America’s Merrill Lynch unit communicated internally last month that bankers shouldn’t currently pitch for new acquisitions and fundraisings, the people said. Scrutiny of Chinese companies came into focus this week after people familiar with the matter said that China plans to cut off some funding for billionaire Wang Jianlin’s Dalian Wanda Group Co., concluding the conglomerate breached restrictions for overseas investments. An internal memo at Bank of America on holding off on deals with HNA for now went to fewer than five bankers who would be in a position to solicit business from the Chinese company, another person familiar with the matter said. The New York Times reported earlier that Bank of America had said in an internal email that it had decided to remove itself from transactions with HNA. Bank of America had advised HNA on several attempted overseas acquisitions in the past few years, people said. The decision has affected deals the firm was working on for HNA, including the planned Singapore IPO of HNA Commercial REIT, two of the people said. Banks regularly reassess their comfort with potential clients, and their stance toward HNA could change, they said. HNA hasn’t done significant fee-paying business with Bank of America in recent months, one person with knowledge of the company said. Citigroup’s and Morgan Stanley’s internal committees have also struggled to get sufficient clarity on the source of funds and ownership structures at HNA, leading those banks to avoid deals for some time, the people said. Still, some firms that shy away from the parent company are willing to do business with HNA units. Morgan Stanley was one of the banks that committed to a total $8.5 billion in financing for Avolon, a business owned by one of HNA’s listed arms, in its purchase of CIT Group Inc.’s airline leasing business last year. “HNA Group partners actively with many global investment banks and continues to do so,” the conglomerate said in an emailed statement. “We carefully select our financial advisers and financing sources on each transaction, based on specific capabilities and expertise, consistent with our commitment to global best practices.” Representatives for Bank of America, Citigroup and Morgan Stanley declined to comment. Support from Western banks has helped fuel a debt-backed buying spree by HNA, as it expanded from its home base on China’s sunny Hainan island to add logistics, hotel and financial assets around the globe, including a $6.5 billion deal to buy a stake in Hilton Worldwide Holdings Inc. announced last year. Chinese regulators have begun assessing local banks’ loan exposure to HNA and are examining examples of acquisitions gone awry, people with knowledge of the matter have said. JPMorgan, UBS Still, banks including JPMorgan Chase & Co. and UBS Group AG have financed and advised on large HNA deals this year, notably the Hilton stake and the firm’s acquisition of a 10 percent stake in German lender Deutsche Bank AG. Even UBS, which has historically helped HNA on multiple transactions, has started monitoring the conglomerate’s debt levels more closely, separate people said. The Swiss bank is increasingly concerned that the Chinese company would struggle in the short term to complete large acquisitions, according to one of the people. UBS continues to do business with HNA, though its internal risk and compliance teams have begun asking more questions about dealings with the Chinese firm, another person said. UBS advised HNA on its $1.5 billion acquisition of Gategroup Holding AG, which completed this year. The Swiss lender has been one of the most active bankers for HNA, advising the firm on almost $15 billion of aviation-related acquisitions since 2015, according to data compiled by Bloomberg. It also provided collar financing to help the conglomerate increase its stake in Deutsche Bank, people familiar with the matter said in May. A spokesman for UBS declined to comment. Paris Gala The pushback comes as HNA has been working to raise its profile in the West, hosting the French Open tennis tournament this year, a first for the firm. Executives including Executive Chairman Li Xianhua and Chief Executive Officer Adam Tan kicked off with a gala celebration in Le Petit Palais in Paris that included politicians, bankers and celebrity chef Joel Robuchon. HNA has recently told bankers it plans to slow the pace of its overseas dealmaking, according to one of the people with knowledge of the matter. The move comes as acquisitive Chinese companies are under increasing scrutiny at home. The China Banking Regulatory Commission asked some banks to provide information on overseas loans made to Dalian Wanda, Anbang Insurance Group Co., HNA, Fosun International Ltd. and the Chinese owner of Italian soccer team AC Milan, people familiar with the matter said in June. China is working to cut capital outflows that may be heaping pressure on the value of the yuan, and late last year moved to temporarily restrict the largest deals valued at $10 billion or more, people familiar with the matter said at the time. Financing practices HNA’s ownership is difficult to decipher as the group is held together through scores of companies -- mostly unlisted entities with little available public information -- holding stakes in each other. Atop the hierarchy is a person named Guan Jun, according to Chinese corporate filings. Little is known about Guan. HNA plays down his role, with CEO Adam Tan saying he’s just a Chinese businessman and Chairman Chen Feng telling the South China Morning Post newspaper that Guan isn’t a significant shareholder as he only owns a “tiny” stake. Yet Guan owns the equivalent of a 29 percent stake in the group, more than any of HNA’s executives including Chen and Tan’s stakes combined, the filings show. HNA’s ownership has also been under attack from Guo Wengui, a fugitive Chinese tycoon who’s been alleging HNA has secret ties to powerful Communist Party officials -- claims denied by the company. Guo is facing defamation lawsuits from HNA and others over his various claims. Its governance has drawn questions from the likes of the New York Times, which on Wednesday reported that HNA has been doing business deals with family and friends of its top executives in the past quarter century, with limited disclosure to investors. In response to the article, HNA said its related-party transactions are reviewed and documented on terms consistent with appropriate standards. HNA’s financing practices have also stood out. Its latest annual report says the company is saddled with $73 billion of debt, which would the second-highest debt level for a non-financial corporation in China if HNA were to be listed, according to data compiled by Bloomberg. What’s more, HNA filings show HNA and its units have pledged at least $24 billion of shares across 15 publicly traded firms to finance its acquisitions, signaling a pattern of reliance on pledged assets that’s triggered concerns from credit-rating agencies and analysts. Bangassou - Bullet-riddled roofs line the "boulevard of death" in Central African Republic's southeastern town of Bangassou, where almost everyone who enters is seen as an enemy. The city, spared sectarian bloodshed until May, now has more than 2 000 Muslim residents forced to take refuge at the local cathedral after attacks by the mostly Christian anti-Balaka militia. More than 300 people have been killed and 100 000 displaced since May as violence that began in 2013 moves into the impoverished country's central and southeastern regions, prompting warnings of a national conflict roaring back to life. In Bangassou alone, more than 150 people have died in fighting between militias and UN peacekeeping forces. "We were driven out by force. We have lost our parents, our homes and all of our belongings," said Djamal Haddine Mahamat-Salle, secretary-general of the organization representing the town's displaced Muslims. "It's been two and a half months since we've been here, blocked without the ability to even go beyond 100 meters." Many said their departure from the cathedral could mean death. "The anti-Balaka are everywhere. And as soon as you risk leaving, they will demand ransom," said Zarah Mahamat. She said she tried to go to the market one day to buy vegetables for her children, who no longer have even rice to eat, and was stopped. "I had to contact my parents in Bangui and they sent me the money to pay the ransom," she said, still wearing the same clothes she had when she fled in May. Another resident, Jean-Claude Gbienza, blamed the UN peacekeeping mission for provoking some of the violence. He said the forces arrived in May and started shooting, causing the local defense groups that are also part of the anti-Balaka to retaliate by burning homes and fighting. Yvette Siolo said her hand was pierced by a bullet when the UN forces came in shooting. She said the rest of her family has fled to neighboring Democratic Republic of Congo, on the other side of the river. On a visit to Bangassou this week, UN humanitarian chief Stephen O'Brien insisted that the UN is there to help, and he warned of the growing violence. "We see the Muslim community who became the victims of attacks and this is an alarming situation. This cycle of violence must stop," he said, calling for more support from the international community. "If we do not act now and keep the faith, we will see increasing need and even greater vulnerability of already weakened people," O'Brien said on Tuesday. The humanitarian crisis in Central African Republic, requiring some $497m, is only 24% funded, the UN says. The world body says nearly 2.4 million people are in need of aid to survive. During O'Brien's visit, children who haven't been to school for months held up signs that read "No to this open prison" and "I have a right to life and education." Central African Republic has faced fighting since 2013, when predominantly Muslim Seleka rebels seized power in the capital, Bangui. Anti-Balaka militias, mostly Christians, fought back, resulting in thousands of people killed and hundreds of thousands displaced. Attempts at peace deals, the latest signed in June by more than a dozen armed groups, have failed. Evans' lawyer, Ogungbeje, has come on air to vehemently criticize the police, alleging that they do not have any justifiable rights of filing charges against the supposed criminal. The lawyer further asserted that the notorious criminal was detained for an unreasonable purpose due to the failure of the police to obtain convincing information about his alleged criminal activities. In an interview with a reliable news agency, Ogungebeje claimed that his client (Evans) was yet to be arraigned before the court as regards the failure of the police to provide obvious proof of his criminal activities. When the insistent lawyer held talks with the Sun, he argued, saying ``Our aim is never directed towards liberating Evans from justifiable detention but we are claiming the right to stand in his defence on any legal grounds. Meanwhile, Ogungbeje went ahead to strongly declare that the police were deceiving the public with disinformation and preventing Evans from contact with his relatives and his already known lawyer -Olukoya Ogungbeje. BIAFREXIT : NIGERIA UNITY IS NEGOTIABLE - SOYINKA The unity of Nigeria as a nation is an issue that must be debated in order to address lingering echoes of marginalisation, Nobel Laureate Wole Soyinka said on Friday. “The claim that the unity of Nigeria is non-negotiable is a false statement,” Mr. Soyinka said. “The right of the people to determine their future is what is non-negotiable.” The Nobel laureate’s comments came when he joined Governor Seriake Dickson to commission a new high school in Kaiama, Bayelsa State. The Ijaw National Academy, which has been running for four months, accommodates up to 1,000 students at the junior and senior secondary levels. After a brief exchange with the students about his exploits as a renowned writer, Mr. Soyinka took a frontal aim at those who maintain that Nigeria must remain as currently constituted and her unity cannot be negotiated. “Don’t tell me that Nigeria, as it is, is non-negotiable,” Mr. Soyinka said. “To me, that’s a fallacy.” Some politicians and top government officials have recently asserted that Nigeria’s structure is not defective contrary to what advocates of restructuring hold. Two weeks ago, Acting President Yemi Osinbajo repeated the administration’s position on Nigeria as an entity. “Our unity is not negotiable. We should make sure that we remain united in order to enjoy the resources God has blessed Nigeria with. A former governor of Abia State, Orji Uzor Kalu has berated the Indigenous People of Biafra, IPOB, under the leadership of Nnamdi Kanu for asking Igbos to boycott elections in the South-East until referendum is conducted. Speaking in Abia State, the former governor and Chieftain of the All Progressives Congress, APC, said it was unconstitutional for Kanu to demand that elections be boycotted in the South East. Noting that Kanu reserved the right to agitate for Biafra, Kalu insisted that the IPOB leader had no right to stop people of the region from choosing their leaders. He said: “It will not be fair for IPOB to say that, it is unconstitutional. They have the right to agitate for Biafra, but have no right of disrupting people’s process of registration or electing their leaders. “IPOB people have every right to agitate, after all, we have free speech in the country, everybody has right to agitate for what he feels is right for him, but that should follow due process. “You know, I went to prison to see Nnamdi Kanu when he was there and I spoke with him. I also almost at the same time visited his parents at their Afara Ukwu, Umuahia country home and I also spoke with them. “That does not mean I’m in support of what he is doing as some people many tend to believe. POPE WARNS THAT ��USA HAS DISTORTED VIEW OF WORLD The news that came in from Reuters had it that Pope Francis warned leaders of the world's top 20 economies meeting in Hamburg against forming dangerous and distorting alliances that could harm the poor and migrants, in an article in Italian daily la Repubblica on Saturday. "The G20 worries me, it hits migrants in countries in half of the world and it hits them even more as time goes by," the Pope was quoted as saying in a conversation with the paper's founder Eugenio Scalfari. Francis, the first non-European pope in 1,300 years, said he was afraid of "very dangerous alliances among (foreign) powers that have a distorted vision of the world: America and Russia, China and North Korea, (Vladimir) Putin and (Bashar al-)Assad in the war in Syria." Pope Francis was also quoted as saying Europe should adopt a federal structure as soon as possible or "it won't count for anything in the world" In May the 79-year old Argentine urged Europe not to see migrants as criminals. He said the greatest danger concerned immigration, with "the poor, the weak, the excluded and the marginalised" juxtaposed with "those who... fear the invasion of migrants". European Union states are at odds over how to cope with a huge influx of migrants, many fleeing war and poverty in countries Syria, Afghanistan and other countries. POLICE RUBBISHES EVANS ESCAPED SAGA, EVANS IS SAFE IN OUR CUSTODY - POLICE Following the speculations that Evans vanishes with 30 armed men, The police have urged Nigerians to not fret over the reported “vanishing” of suspected kidnap kingpin, Chukwudumeje George Onwuamadike alias Evans. The appeal followed a report which alleged that Evans’ whereabouts was unknown and that the suspect had vanished. According to the spokesman for the Force Headquarters, Jimoh Moshood, a Chief Superintendent of Police (CPS), Evans was safe and still in police custody. Moshood said investigation was still ongoing, adding that the suspect would be charged to court as soon as all ends were tied. He said: “The media need to avoid stories that could create fear, tension or misrepresentation among the masses. Where did Evans vanish to? That headline was misleading. The suspect and his accomplices are very much in our custody. “We are working hard to ensure that justice is served at the end of the day. There are certain information that are not for public consumption to avoid jeopardising investigation or even national security. “Evans is with the police. Below are 8 habits that harm your brain that you might not be aware of : (1) Not Sleeping Well Lack of proper sleep is a bad habit that can significantly hurt your brain. It negatively affects the hippo-campus causing a deficit that leads to forgetfulness. Having Too Much Time to Yourself (2) Alone time can be great for thinking : Reflection and mapping out your dreams and goals. However, when the solitude is too much it can damage the mind and body. It can typically cause brain decline, affect the quality and efficiency of sleep making it less restorative, erode arteries, create high blood pressure, undermine learning and memory and generally take a toll on health; although, most of these effects are gradual and experienced over the course of time. (3) Eating Too Much Junk Food Regardless of the fact that you are the kind of person that can eat whatever you like and remain in shape, it is important not be excessive in your intake of junk foods. This is because parts of brain linked to learning, memory and mental health are smaller and less developed in people who excessively consume junk foods. Natural foods like berries, whole grains, nuts, green leafy vegetables preserve the brain function and slow mental decline. (4) You Play Loud Music with Earphones or Headphones Placing the volume of your earphone or headphone at full volume can permanently damage your hearing. OLISA AGBAKOBA REPLIED OBASANJO, NNAMDI KANU CALL FOR REFERENDUM IS NOT CALL FOR WAR. The former President of the Nigerian Bar Association, Dr. Olisa Agbakoba (SAN), on Tuesday condemned the call for the country’s restructuring, describing it as a political calculation by the elite to grab power in 2019. Agbakoba justified the demand for self-determination by the Nnamdi Kanu-led Indigenous People of Biafra, which is seeking a referendum to achieve same. Agbakoba, who rejected the declaration by acting President Yemi Osinbajo that Nigeria’s sovereignty was not negotiable, said IPOB’s quest for self-determination was lawful and found justification in Article 1 (2) of the United Nations Charter and Article 20 (1) of the African Charter of Human and Peoples Rights, to which Nigeria was a signatory. He said the Federal Government must immediately initiate a process to put the continued existence of Nigeria as a sovereign entity to a debate, stressing that restructuring was not the road map to federalism. Agbakoba addressed journalists in Lagos on Tuesday at his Ikoyi office on “The future of Nigeria.” He said, “I see every politician now says restructure but I disagree. I also think the acting President was wrong to say that Nigeria is insoluble. There is nothing sacrosanct about Nigeria. It can blow up anytime. It’s an artificial creation, which was made in 1914 and when it was amalgamated we were not there. It was amalgamated in the interest of the colonialists.” Agbakoba said it was unfortunate that since 1914 when amalgamation was thrust on the people, there had not been any home-grown process to resolve the will of the people to co-exist. Agbakoba argued that the Federal Government goofed by charging Nnamdi Kanu with treasonable felony for seeking self-determination. He said, “For me, the best that he can be charged with is unlawful assembly and an act capable of breaching public peace. Those are the things he can be charged with, but not treason; because Nigeria is a signatory to the United Nations’ Charter, which recognises the right for self-determination.” When asked whether he aligned with IPOB’s call for a referendum towards self-determination, Agbakoba, who said he had nothing against Kanu, responded, “Absolutely! What is sacrosanct about Nigeria? Nothing. What is sacrosanct about Nigeria is our agreement to be part of Nigeria. I’m not suggesting that Nigeria should not exist but to say that Nigeria’s sovereignty is not negotiable, nobody should talk about it.” Agbakoba, who was a delegate at the 2014 National Conference, also said implementing the resolutions of the conference would not quell the various secessionist agitations in the country.
