The NJC will simply ratify Onnoghen's suspension pending the determination of his appeal against his trial by the CCT. They could also suspend Tanko but they would have to recommend 3 justices to Buhari to choose from to act in the capacity of chief justice pending when Onnoghen's matter is concluded at the appeal court and then the supreme court. |

'Shall not be necessary' in that section as it relates to the matter in contention means IT IS NOT COMPULSORY/MANDATORY/A MUST etc for the CJN to be taken to the CCT if HE ADMITS HE COMMITTED A BREACH OR BREACHES to the CCB act. In order words, IT WOULD BE COMPULSORY/MANDATORY/A MUST etc to drag the CJN before the CCT if he DID NOT admit to commiting those breaches. Those who enacted that act used those wordings to give the prosecutors of the CJN a legally-backing excuse not to drag the CJN before the CCT if they so wish, in the event that the CJN coperates with them by admitting his guilt. |

OP, you need a lesson in english. This section does not in anyway exonerate the corrupt former CJN. Take note of the word 'necessary' that ended that section. It simply means the CJN can still be taken to the CCT though it isn't mandatory since he has confessed to the misconduct. It is then left for the CCT to determine whether the breach is worthy of any punishment whatsoever. |
The former CJN may not want to leave willingly. The contract that he entered into with Atiku, Wike and PDP is a critical component of the Dubai strategy and having already received down payments from his sponsors, he is under intense pressure to deliver his part of the bargain. That is why he will be praying for the NJC to go ahead and clamp on him on monday so that he can have a tenable excuse to give Wike and Atiku ![]() |
