Iriruaga100: Why Datti holding press conference with Okowa? For he mind PDP did not rig them in Delta, Bayelsa, Akwa-ibom and Edo? LP should better hold their press conference alone. Happy to see Okowa in serious pain!
Okowa is not a bad guy like that. I prefer am to Uduaghan
Ofunaofu: The court have become a joke reason no one trust it
How can you explain a situation where a governorship candidate in Imo state that came a distance fourth was announced as the winner by the supreme Court
Officialgarri: We can see what IPOB/UGM/Obidients are doing. It's a win or destroy game for them . Fake news, propaganda, intimidation, violent threats.
They want to set this country on fire when they couldn't even clinch the second position. 5% minority .
Jagaban, we are solidly behind you and we will defend your mandate on which we stand
Balogunodua: You can't delete the section 299 to favour 134 Oga it won't be possible. The sec 299 is also part of the law and still applies to Abuja.
Problem is we don't agree on the meaning of 299. I follow exactly what is written in 299. It says "as if it were". Meaning it is not but should be treated as if it is.
which part of the 299 are you using to buttress your point?
Balogunodua: No matter how they try to spin it, the constitution states clearly that Abuja is a state.
Maybe the people that wrote this constitution are just confused.
You're dwelling too much on the state thing. 299 does not cancel out FCT status of Abuja. Abuja remains the FCT according to the law. If Abuja is still the FCT then 134 still applies. You must get 25% in the FCT.
Misterone: oga what it means is that whenever the constitution is to be interpreted as regards FCT, it would be treated as if it were a state. In this case, FCT is a state.
INEC violated no law most especially the electoral Act in this election.
INEC has the right to follow whichever guidelines it chose to so long it's in consonance with the Constitution.
That's why Melaye walked out, they have agents in all the polling unit Nationwide and must have seen that they've lost the election, instead of accepting the people's wish, they want to burn down the country.
Pastor Paul Enenche and Melaye should be arrested immediately by the DSS.
Asiwaju has won this.
No. The 25% requirment in FCT has stopped Tinubu. INEC cannot argue 134. It's not their prerogative. Tinubu has not met the requirement. The real trouble starts when INEC decides to attach their own interpretation to it.
Balogunodua: The Abuja is the FCT nobody will argue that, but it a state according to the constitution.
36 States + FCT makes 37 states.
In fact the whole thing can be argued till thy kingdom come.
Lol. True. But I doubt that will be an argument for INEC to make. INEC is not mandated to argue the law. Their work is to obey the law. They will follow section 134 as it is written.
That's why no leading aspirant has gotten less than 25% in the FCT in 23 years. They always made sure to get the minimum.
Tinubu is the first to get less than 25% and therefore becomes the case of reference for future elections 😉
positivelord: Falana was just trying to be clever by half... he talked about 25% for 24 state and then switch to outright winning FCT as not part of the requirements. The constitution is very specific here ...it mentioned the name FCT Abuja. ... the ONLY place mentioned.
Balogunodua: He already addressed it when he said the FCT is regarded as a state. Which means the FCT as no special status and is no different from any other state in the federation.
As long as he gets the majority vote and 25% in 25 States in the federation, he is good to go.
Two different things. Lol. That's why I also said 299 does not overwrite 134. 299 did not end the FCT status of Abuja. It didn't say Abuja shall cease to be FCT and become a state. It said "as if it were" a state.
Therefore section 134 is still valid because Abuja is still the FCT.
famouscargo4u: Even at that, chapter 8 and section 299 of the Constitution states that for interpretation, the FCT should be regarded as a state.
"As if it were":
The provisions of this Constitution shall apply to the Federal Capital Territory, Abuja as if it were one of the States of the Federation; and accordingly -
I'm not married but I ask you to treat me as if I was married. Does that make me married?
TruthsFM: Falana is just a senior advocate of nuisance. You read law and still you are misinterpreting the law. Very shameful
No he was misquoted. I also was upset at the nonsense a learned SAN was saying but I took a closer look. The caption the Nairlander used was mischievous. That's what caused this whole debacle.
VoteTinubu2023: 2/3 of 36 states + (1 other state called) FCT
You can either get 25% in 24 states + FCT
OR
You get 25% in 25 states + no FCT.
Dumbfuçcccks
You can't say or when there's no provision for it in the constitution. Conjunctions play a huge role in the law.
Section 134 of the constitution states that a candidate will be declared winner of a presidential election if he has “(a) he has the majority of votes cast at the election; and (b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.
Falana never spoke about this. Maybe you need to go and ask him to make another statement concerning the 25%. Remember that the law is the law and INEC must abide by the constitution.
TruthsFM: Announce the results transmitted from the polling units. Obey your acts once and for all. No one will accept the sham collation of results here. Tinubu will never be declare the winner of the poll. Obey your law Inec. Up till today, the results of the polling unit in the server hasn’t reached 50% since Saturday
Lol I wonder how an umpire changes the rules of a match in the middle of the match and expects everyone just just keep silent.
Tensions are high at this point and we must be careful about the way we disseminate information.
Falana never said 25% in the FCT was not a requirement to emerge president. He was talking about winning the FCT.
Legal luminary, Femi Falana says a presidential candidate does not need to win the Federal Capital Territory (FCT) to be declared winner of the February 25, 2023 poll.
“It is not a requirement that you must win the FCT,” the Senior Advocate of Nigeria said on Channels Television’s Sunrise Daily programme on Tuesday.
“Today, the courts have ruled that pursuant to Section 299 of the constitution, that the FCT should be treated as a state. That is the law.
"You don’t have to win the FCT; if you meet the requirement; that is two-thirds of the majority of states in the country. You don’t have to win the FCT,” the rights activist stressed.
