An investigation by SaharaReporters has revealed that officials of President Muhammadu Buhari's administration are blocking an investigation into massive fraud committed by a Nigerian oil firm, Sahara Energy. Operatives of the Economic and Financial Crimes Commission (EFCC) on May 26 raided the Lagos and Abuja headquarters of Sahara Energy. However, EFCC sources told our correspondent that officials of the government ordered the anti-corruption agency not to publicize the raid. SaharaReporters learnt that EFCC agents seized computers from the firm, but interventions from high-level officials of the Buhari regime meant that the investigation has not advanced or see the light of the day. Our sources named Mr. Buhari's Chief of Staff, Abba Kyari, as a key ally of Sahara Energy, and the official behind attempts to scuttle the firm's billion dollar fraud. The current chairman of the Petroleum Products Pricing Regulatory Agency, Mohammed Buba, who was appointed on May 25 during the labor strike against fuel price increase, was a director at Sahara Energy. Our sources said that Chief of Staff Kyari had since his appointment worked to shield Sahara Energy from any serious investigation. Mr. Buba, who is from Borno State, is one of the Chief of Staff’s closest friends. He was a former MD of Pipelines and Product Marketing Company Limited, a subsidiary of the Nigerian National Petroleum Corporation (NNPC). SaharaReporters learned that Mamman Daura, one of President Muhammadu Buhari’s closest friends, is also involved in efforts to cover up investigations into Sahara Energy. An investigator disclosed that EFCC operatives found significant information regarding how former Oil Minister Diezani Alison-Madueke used the firm to funnel funds to third parties. The source disclosed that the funds in question amounted to close to $400 million. Sahara Energy is named as one of the firms that reaped hundreds of millions of dollars through crude oil swap deals introduced by Ms. Alison-Madueke during her ministerial tenure. The former minister's offshore processing agreement with Sahara Energy also involved the owner of Aiteo, Benny Peters, Atlantic Energy, owned by Jide Omokore, and a fugitive oil dealer, Kola Aluko. Investigators believe that the firms made away with at least $4 billion of public funds through the opaque arrangements. Much of the revelations against Sahara Energy has come from fraud suspects currently under investigation by the EFCC. One of our sources said the informants were amazed that Sahara Energy has so far been shielded from the kind of publicity and shame extended to much smaller players. Last month, a company registered by Sahara Energy, Actus Integrated, was revealed as having given $60 million through Fidelity Bank to help former President Goodluck Jonathan rig himself into office during the 2015 presidential election. The House of Representatives Friday rejected the offer of the service provider MTN to pay N330bn instead of the N1.04 trillion it was fined by the Federal Government. In a briefing on the issue Friday, the chairman of the House of Representatives Committee on Communications, Hon. Saheed Fijabi said he wondered why the sudden shift in the position of the NCC offer the issue of MTN fine. A March 1, 2016 memo from the Nigerian Communications Commissions, and in possession of our correspondent reads: ” The proposal to pay the sum of N300 billion as against the N1.04 trillion (and subsequently reduced to N700 billion by the Federal Government of Nigeria “FGN”) is not supported by any verifiable justification. “When considered vis–a – vis the quantum of fine, the present sum is a far cry and there is no verifiable basis for arriving at the new figure.” The lawmaker said the offer of $1.7billion (or N330 billion) by MTN, instead of the total fine of $3.9 billion (N1.04 trillion fine by NCC for violation of SIM card registration laws was unacceptable. According to him the Minister of Communications, Mr. Adebayo Shittu, has been summoned by the committee to explain the new development on Monday. The committee chair noted that it was wrong to accept a reduction while the House was investigating the ongoing negotiations between the Federal Government and MTN on the fine. He said: “It came to us as a surprise to hear that MTN is paying N300bn. How can they be paying that amount when the minister told us that everything was stalled pending the outcome of our investigation? “As a House, we have opposed the reduction of the fine because there is no provision in the NCC’s Act that the fine can be reduced. Deputy President of the Senate, Mr Ike Ekweremadu, has advised security agencies to always be cautious when quelling disturbances and protests to avoid unnecessary loss of lives. Ekerenmadu made the call at the Senate on Tuesday while speaking on Monday’s clashes between Indigenous Peoples of Biafra (IPOB) and security operatives some states in South-East and Delta. He said that the country had witnessed a lot of unnecessary killings arising from clashes by members of the public and security agencies. According to Ekweremadu, the protest by IPOB, which led to bloody clashes in Delta and Anambra could have been handled differently. `I will like to use this opportunity under Order 43 to say that the security agencies must apply caution in trying to quell disturbances. “We have had so much of blood bath in this country under different circumstances and we cannot continue to lose young men and women because the future of this country belongs to them. “It is important that this senate rise to condemn any act of killing in any part of this country, especially with the one that concern the major part of our future which remains the youth. “We are now in a democracy and people should be entitled to speak their minds and to assemble under responsible circumstances. “Security agencies must also be responsible in dealing with those circumstances to ensure that lives are not lost unnecessarily. “I just wish to bring to the notice of the senate for us to take note and possibly, the states involved to set up enquiry to find out what led to these clashes,” he said. The issue was, however, not debated by the Senate. In his remarks, President of the Senate, Dr Bukola Saraki, said that although there could not be any debate on the matter, it was necessary that actions were taken on it. “I think that the point he has raised must draw attention of all and see what necessary action will be taken in other to address this matter,” he said. Socio-Economic Rights and Accountability Project says it has commenced contempt proceedings against the Attorney-General of the Federation, Mr. Abubakar Malami (SAN), and the Accountant-General of the Federation, Alhaji Ahmed Idris, for their alleged failure to publish the details of recovered loots and how the funds were spent. The group had obtained a judgment from a Federal High Court in Lagos ordering the Federal Government to give “(a) detailed information on the total amount of recovered stolen public assets that have so far been recovered by Nigeria (b) the amount that has been spent from the recovered stolen public assets and the objects of such spending and (c) details of projects on which recovered stolen public assets were spent.” SERAP, however claimed, in a statement on Monday by its Executive Director, Adetokunbo Mumuni, that since the judgment was delivered on March 24, 2016 by Justice Mohammed Idris and a certified true copy of it were served on Malami and Idris they had ignored it. It accused Malami and Idris of taking the court for a ride, saying it had since last week commenced contempt proceedings against them by filing Form 48 at the Federal High Court. SERAP in the Form 48 threatened that “unless you (Malami and Idris) obey the orders of the court contained on the reverse side of this process you shall be deemed to have disobeyed the orders of the court and shall be liable to committed to prison for contempt.” “Despite the service of the certified true copy of the judgment on both the Attorney General of the Federation and the Accountant-General of the Federation they have failed and/or neglected to acknowledge the judgment let alone obey it. “It’s unacceptable to take the court, which is the guardian of justice in this country, for a ride. The Nigerian Electricity Supply Industry (NESI) has lost 3,880Mega Watts (MW) to gas constraint, it was learnt yesterday. The Nigerian Electricity System Operator (SO) yesterday said that it sent out 57,256.89 Mega Watts per Hour (MWH) which was also 2,385.70MW . In its system performance posted on its website, the SO noted that the lowest generation from the Electricity Generation Companies (GENCOs) was 2,251.80MW, while the peak generation was 2,797.60MW. The loss of gas following the attack on the Escravos tank farm main electricity feed pipeline reduced gas supply from 2,385.70MW on Wednesday to 2,351MW yesterday. Prior to the attack, the NESI had already posted on its daily report of Wednesday that the power sector lost 3,880MWs to gas constraint. It said in its daily summary that “the reported gas constraint was 3,880MW,” adding that it also recorded 380MW water management constraint . The NESI noted that it recorded 105MW line constraint and “the power sector lost the estimated equivalent of N2, 095, 000, 00 on May 25 2016 due to constraint.” The sector had maintained an average of about 4,000MW till February when the vandals started attacking the gas pipelines . According to a source who disclosed the sector performance to our correspondent, the data has been very dismal, declining an average of about 2,000MW in May. She said: “We were averaging 4,000 in January and it got down by half in four months and I can directly link that crash with vandalism.” The source further said:”Right now ,our transmission capacity is very low and we are talking about 3,000MW to 4,000MW. At peak, what we generate and send out successfully is 5,000MW. So at a best case scenario, it is 5,000MW but right now there is no gas. “ The Nation learnt that only 30 per cent of the power produced is being paid for. The source lamented that “there is no enough money to pay for even the small power we are using. Members of the House of Representatives were angry on Wednesday as a result of the failure of key stakeholders to attend an investigative hearing on the recent killings in Benue State by suspected Fulani herdsmen, particularly in Agatu villages. At least 500 villagers were reportedly hacked to death by the invaders in Agatu in March. The attackers also razed many houses, resulting in more than 7,000 inhabitants being displaced from their ancestral land. There had also been a series of attacks in Buruku, Gwer-West/East, Makurdi and other local government areas in the state, which claimed lives. The House of Representatives had described the development as the “alarming influx of unidentified herdsmen into Benue State and the consequent threat to peace, life and property” and passed a resolution to investigate it. The House Committees on Police, Defence and National Security opened a public hearing on the attacks on Wednesday, but the lawmakers were surprised that the Inspector-General of Police, Mr. Solomon Arase, shunned the session. The Minister of Interior, Lt-Gen. Abdulrahman Dambazzau (retd.), and the Governor of Benue State, Mr. Samuel Ortom, also failed to attend the hearing to the dismay of committee members. None of the government officials sent representations to the session. Their absence forced the committee to suspend the hearing by one day after taking a few submissions from groups such as the Mdzough U Tiv. The Lead Chairman of the hearing, Mr. Haliru Jika, announced the decision of lawmakers to summon Arase and Dambazzau to appear before the panel on Thursday (today). “The National Assembly is the assembly representing the whole nation and we must discharge our constitutional responsibilities,” he stated. Earlier, the Chief Whip of the House, Mr. Alhassan Ado-Doguwa, who represented the Speaker, Mr. Yakubu Dogara, expressed disappointment with the conduct of the key stakeholders.
