The Federal High Court in Abuja, Wednesday, adjourned the suit that erstwhile Chairman of the House of Representatives Committee on Appropriation, Hon. Jibrin Abdulmumin, filed to challenge his suspension from the House, indefinitely. Abdumumin Jibrin Justice John Tsoho suspended hearing on the suit based on an appeal that was lodged by two members of the House of Reps, Hon. Nicholas Ossai and Hon. Orker-Jev Emmanuel. Ossai who is the Chairman of House Committee on Ethics and Emmanuel who moved the motion that led to the Jubrin’s suspension for 180 legislative days, are challenging refusal of Justice Tsoho to join them as interested parties in the suit. Counsel to the two lawmakers, Mr. Hakeem Kareem, informed the court that appeal his clients lodged against the dismissal of their joinder application has already been slated for hearing by the Court of Appeal in Abuja. He prayed the court to temporarily hands-off the matter and await decision of the appellate court. However, counsel to the plaintiff, Mr. Femi Falana, SAN, urged the court to go ahead and hear the suit on its merit. Falana accused the two lawmakers of deliberately stalling hearing on the matter, saying the appeal was only aimed at rendering the suit spent and nurgatory. He drew attention of the court to the fact that Jubrin’s suspension which is the subject matter of the suit will lapse on June 28. On their part, the House of Reps and its Speaker, Yakubu Dogara who are original defendants in the suit, through their lawyer Mr. Kanu Onuoha, aligned with the appellants and urged the court to hands-off for the appellate court in line with the principle of judicial heirachy. In his ruling, Justice Tsoho held that he was minded to halt further hearing on the suit in order not to take any pre-emptive step capable of jeopardising the pending appeal. “This suit is hereby adjourned indefinitely pending the decision of the Court of Appeal on the motion for stay of proceedings,” Justice Tsoho ruled. Aside querying legality of his suspension, Jubrin is also praying the high court to award N1billion against the defendants as punitive and general damages for his suspension. He is equally praying the court to declare that his suspension amounted to a violation of his fundamental human right to freedom of expression. As well as to declare that the resolution the House passed to suspend him was in breach of section 68 of the 1999 Constitution, as amended. Besides, Jibrin wants the court to issue an order of injunction restraining the House of Reps from preventing him from participating in the Committees of the House or accessing the legislative chambers to perform his legislative duties. It will be recalled that Jubrin was suspended on September 28, 2016 for 180 days, following corruption allegations he raised against principal officers of the House. Daily Sun is reporting that not fewer than three people have killed by suspected Fulani herdsmen in Tse-Akaa village, Ugondo Mbamar District of logo local government area of Benue state. Trouble began on Sunday, May 7 afternoon when herdsmen moving their cattle away from the village clashed with some villagers and the herdsmen opened fire. The clash left three, several others injured and many still missing. The scared are reportedly presently taking refuge at a nearby village. An eyewitness Margaret Acka said: “Fulani herdsmen were in my father’s house today (Sunday) afternoon shooting and killing at will. Three reported dead and others wounded. When will this end?” Another eyewitness simply identified as James said the herdsmen launched the attack at about 5pm on Sunday just as the villagers were coming out from Sunday evening service. The attackers reportedly came from the Taraba axis, through Abaji, Mbamar, Ugondo and busted out at Akaa while shooting sporadically at the village market square. The incident has been confirmed by the Benue state Police command. The spokesperson for the Command ASP Moses Yamu said the suspected Fulani herdsmen were relocating from the area of the raining season when the clash occurred. A violent clash between farmers and cattle rearers in Ussa and Takum Council areas of Taraba has left at least 15 people dead while several others sustained various degrees of injuries. Alhaji Sahabi Mahmoud, the state Chairman of the Miyetti Allah Cattle Breeders Association of Nigeria in Taraba and Mr David Misal (ASP), the Police Public Relations Officer (PPRO) of the state Police Command have confirmed the incident. However, while Sahabi said at least 15 of his members have been killed and buried in Takum on Friday, Misal said that the police could only confirm five deaths as at the time of filing this report. Sahabi, who spoke in Jalingo on Saturday, also expressed fear that more corpses of his members might be in the bush as more than 150 of them were still missing. He claimed that hundreds of livestock belonging to the herdsmen were wandering in bush as their owners could not be traced. He called on the security agencies and the state government to come to the aid of hundreds of other cattle breeders, who he said were trapped in the forests of Ussa and Takum to get out alive with their animals. Meanwhile, the PPRO said in Jalingo on Saturday that the Commissioner of Police, Mr Yakubu Babas has relocated to Takum to ensure that the crisis was brought under control. The fire at the palace of the Oba of Lagos on Tuesday has nothing to do with the Lagos’ monarch’s relationship with the Ooni of Ife, an official has said. The spokesperson of the Ooni’s palace, Moses Olafare, told PREMIUM TIMES that the Ife monarch, Enitan Ogunwusi, is unhappy with the fire incident. “We are not happy over the fact that the palace of Lagos king got burnt, we can only sympathise with the palace on the development,” he said. PREMIUM TIMES reported the fire incident at the Lagos monarch’s palace. The fire occurred about one week after a video showed the Lagos monarch, Rilwan Akiolu, snub the Ooni. A Nigerian opposition party on Monday demanded visual proof that an ailing President Umaru Yar’Adua was fit enough to govern after weeks in hospital overseas. Yar’Adua, 58, has been absent from Africa’s most populous country and biggest energy producer for more than a month receiving treatment for a heart condition in Saudi Arabia, but there have been few updates on his health. Vice President Goodluck Jonathan has been presiding over cabinet meetings but executive powers have not officially been transferred to him, leading to questions over the legality of decisions made by the government in Yar’Adua’s absence. The opposition Action Congress party said the government must provide “concrete evidence” of Yar’Adua’s physical condition, suggesting a dated video recording of the Nigerian leader in his hospital room in Saudi Arabia. “It is necessary for President Yar’Adua, if indeed he is recovering as Nigerians have been praying he does, to move fast to reassure his compatriots that the rumors surrounding his ill health are unfounded,” said Lai Mohammed, spokesman for Action Congress. A presidency spokesman declined to comment on the demands. Political analysts and senior lawyers say affairs of state are already being affected by Yar’Adua’s prolonged absence, pushing Nigeria to the brink of a constitutional crisis.
