Ubani was reported to have slumped and rushed to an undisclosed hospital in Abuja after he collapsed in the detention facility of EFCC, Vanguard reports. Ubani and Senator Christopher Enai from Bayelsa State, were detained by the EFCC on March 19 for failing to produce chairman of the Nigeria Social Insurance Trust Fund, Ngozi Olejeme, who they stood for as sureties. Olejeme is facing a N6.4 billion fraud allegedly perpetrated while she was chairman of NSITF. A member of Ubani’s family told Vanguard that Ubani collapsed in the EFCC detention facility on Tuesday morning after suffering severe dehydration and high blood pressure. The family member said: “Ubani would have died today (yesterday) if some persons had not intervened and rushed him to the hospital after he collapsed in EFCC cell. “ It is very disheartening that the EFCC has chosen to continue to detain him despite a court order that instructed that he be released or be charged to court. “ We are begging well-meaning Nigerians to appeal to the EFCC chairman to comply with court order and release Ubani.”

Martins Owerem, of the Nigerian Air Force (NAF), for raping a 14-year old displaced girl. President of the Court, Maj.-Gen. Yakubu Auta, held that the court found Owerem the guilty on the two counts of rape and assault. The convict was charged with defilement; assault and disobedient to standing order. Auta held that the prosecution, through five witnesses and four exhibits, have proved their case beyond reasonable doubts. He held that the court found the officer guilty on the first and second-count charge, while it discharge and acquitted him on the third-count charge. The judge, therefore, ordered for dismissal from service of the convict on the first count charge and sentenced him to demotion by one rank on the second-count charge. Earlier, the Judge Advocate, Capt. Aminu Mairuwa, told the court that the convict on Sept. 29, 2018, while on patrol duty at Kawon Jiya community in the outskirts of Maiduguri, arrested some girls, who were collecting firewood, on the pretext that they crossed into the restricted area. Mairuwa argued that the convict took one of the girls into the bush and raped her. However, Defence Counsel, Mr Abbas Abba, sought for lenience in view of the selfless service and contributions of the convict in the counter insurgency campaign

The rejected bill with seven others were forwarded to him by the National Assembly in February this year. In separate letters read on the floor of the Senate Tuesday by the Senate President, Bukola Saraki, Buhari cited several reasons ranging from infractions on extant laws, duplication of responsibilities of existing agencies, to financial constraints for refusing assents on the bills. The President in his refusal to sign the Ajaokuta Completion Fund Bill as stated in a letter dated March 19, 2018, said appropriating $1billion from the Excess Crude Account ( ECA) as requested for in the bill by the federal lawmakers is not the best strategic option for Nigeria at this time of budgetary constraints. He said: ” The Nation cannot afford to commit such an amount in the midst of competing priorities with long term social and economic impact that the funds can be alternatively deployed towards. “Bills which seeks to make an appropriation of revenues to fund public expenditure should be consolidated in the annual Appropriation Act such that these proposals pass through the traditional scrutiny that budget proposals are subjected to by the Ministry of Finance, Ministry of Budget and National Planning and the National Assembly. “Furthermore, as the Excess Crude Account Funds belong to the Federation, it would be proper to consult with the National Economic Council where the States are represented. “Relevant stakeholders such as the Ministries of Mines and Steel Development, Industry, Trade and Investment were not fully consulted. “The inputs of key stakeholders are necessary to create the optimal legal and regulatory framework as well as an institutional mechanism to adequately regulate the steel sector ” In another letter of refusal of assent dated March 27, President Buhari cited provisions contained in section 32 of the Small and Medium Enterprises Development Agency Bill 2018 as the major reason for refusing assent to it. He said, “Section 32 of the Bill , introduces (I) a 2.5% levy on the profit before tax of the target companies which will increase the tax burdens of the companies while offering no direct benefit to them : (ii) a1% levy on imports which will also add to the cost of doing business in the country , (iii), a 5% levy on luxury goods which duplicates efforts by the Federal Ministry of Finance to raise excise on such goods in a more sustainable manner to the benefit of the Federal Government treasury “. He added that if signed into law, the Agency will have similar objectives to the Bank of Industry particularly with regard to the funding of Small and Medium Enterprises. “Accordingly, it is important to streamline its functions to avoid duplication or overlap of functions with other government institutions performing similar functions aside from the likelihood of increasing public recurrent expenditure by the proposed creation of new public sector bodies “. Other bills declined assents by the President through separate letters forwarded to that effect to the Senate are, the Nigerian Aeronautical Search and Rescue Bill 2018, Chartered Institute of Training and Development of Nigeria ( Establishment) Bill 2018 and Federal Mortgage Bank of Nigeria Bill 2018. Others are, the National Housing Fund Bill 2018, National Institute of Credit Administration Bill 2018 and National Bio-Technology Development Agency Bill 2018.

El-Rufai made the appeal after receiving his Certificate of Return from INEC on Thursday in Kaduna. He stressed that the people should not allow the divisions and pains of the past to shape the state’s destiny, “as the future can be better when people work together.” The Governor said it was time for unity of purpose, as such the residents should not wallow in narrow divisions, but collectively work for progress in recognition of the state’s common heritage as children of Adam and Eve. “Our government is committed to uniting the people of this state, as diversity is no excuse for not working together. “We should see and embrace diversity as a source of strength, let us remove barriers and not allow religion or ethnic identities to deter us from respecting the rights of others, acknowledging their citizenship and obeying the law,’’ he stressed. The governor expressed gratitude to the people of Kaduna State for the verdict they delivered at the polls, adding, “we shall always prove ourselves worthy of your trust.’’ El-Rufai said that he appreciated the significance of his re-election as a mandate for putting people first in the discharge of his responsibility. “With their votes, the people of Kaduna State have shattered many myths of the entitled elites. They have demonstrated that they know who is standing up for their interest. “They have shown that they appreciate the difficult and top decisions intended to deliver for them the quality of opportunities,’’ El-Rufai said. According to him, ordinary people in the state have eagerly embraced the idea of their children having quality education and treated in decent hospitals and not having their wives die while giving birth to the next generation. In her address, while issuing certificates to the governor and elected lawmakers, INEC National Commissioner for North Central, Prof. Antonia Okoosi, said there is improved integrity in the electoral system after six successive elections without hitches. “The elections are becoming more competitive as the margins between winners and runners-up are decreasing to the extent that in many instances, elections into executive and legislatures are increasingly becoming inconclusive,’’ she said. She however lamented that the phenomenon of inconclusive elections can be attributed to the crisis of lack of internal democracy in the parties and the desperation of candidates and their supporters to win at all cost. “Unfortunately, the 2019 elections marked a new trend in which some parties and candidates engaged in violent behaviour. “This included the manhandling of duty officials and intimidation of voters. The commission views the trend with concerns and assures of voter enlightenment for mandate protection,’’ she said. Okoosi however commended Kaduna State residents for their peaceful conduct during the polls. “The commission had noted Kaduna as a high risk state but everything went well without any report of violence across the State,’’ the commissioner said. The Professor advised disgruntled persons and parties to seek judicial remedy to pursue their cases. The National Commissioner also applauded members of the NYSC that served as ad-hoc staff and the CBN that secured the election materials.

http://www.titopeblog.com/2019/03/rivers-election-what-happened-in-court.html Justice Inyang Ekwo of the Federal High Court Abuja, has fixed April 2, to deliver judgment in a motion filed by the governorship candidate of the African Action Congress (AAC) in Rivers, Mr Biokpomabo Awara, praying the court to stop the INEC from resuming the collation and announcement of results of the state’s governorship election. Respondents in the suit are the INEC and the Peoples Democratic Party (PDP). NAN reports that INEC National Commissioner for Information and Voter Education, Mr Festus Okoye, announced that the electoral body would resume the collation and announcement of results of the election between April 2 and April 5. Awara is urging the court to stop INEC from concluding the collation and announcement of the result, saying he was the clear winner of the March 9 election having won 15 of the 23 local government areas in the state. INEC had suspended collation following disruption of the process at some collation centres by alleged thugs. Justice Ekwo fixed the date after listening to the arguments of the counsel representing the AAC and the PDP, while the INEC was not represented in court. Counsel to the AAC, Mr David Adegbe, told the court that the matter was slated for hearing and they had filed processes for originating summons on March 8. He said they had also filed a written address in response to the counter affidavit filed by PDP, who was the second defendant in the matter on March 27. Counsel to the PDP, Mr Emmanuel Ukala (SAN) said they had filed their reply on point of law today’s morning which was duly served on the Plaintiff, the AAC. Ukala argued that the court lacked jurisdiction to go on with the matter as all matters relating to elections should be directed to the election petition tribunal. He cited decisions of the Supreme Court and other authorities in support of his arguments. However, counsel to the AAC candidate prayed the court to overrule the arguments of the second defendant, calling the PDP “a busybody’’ in the matter. He said that the election was disrupted by violence and that the INEC should adhere to its word by conducting a rerun election. On the March 23, Awara, the AAC governorship candidate had filed a motion urging the court to stop INEC from further collation and announcement of results. In the motion, he said he was the winner of the governorship election held in Rivers state, having won 15 of the 23 local government areas in the state. Justice Ekwo however, did not grant the motion as requested by the AAC candidate, saying it had been overtaken by events

APC National Publicity Secretary, Mallam Lanre Issa-Onilu, explained that the party settled for Lawan as the next Senate President after wide consultations with President Muhammadu Buhari and other leaders of the party. He said the party “ranked Senators from all zones of the country who are qualified to contest the position, but only one of them can be Senate President.” Addressing journalists in Abuja, Issa-Onilu said the stand of the party not to share power in the national assembly with the Peoples Democratic Party, PDP, was borne out of the fact that it has a clear majority and does not need the opposition to run a successful government. Issa-Onilu said having “settled for Lawan as Senate President, the party is working out an acceptable zoning formula for all other positions both in the Senate and House of Representatives, including the position of Speaker of the House.” He, however, observed that the party was aware of the fact that there are other Senators interested in the position. The APC spokesman insisted that the party won’t allow what happened in 2015 to repeat itself.

The electoral umpire added that the exercise in Enugu State, unlike in some states, witnessed no case of “violence, snatching of ballot boxes or all sorts of electoral malpractices”. The INEC commendation was made by the National Commissioner in charge of Information and Voter Education, Barr. Festus Okoye, during the presentation of Certificates of Return to Gov. Ugwuanyi and Governor-elect, his deputy and the Deputy Governor-elect, Hon. Mrs. Cecilia Ezeilo and the elected members of the State Assembly led by the present Speaker of the House, Rt. Hon. Edward Ubosi. Barr. Okoye, who congratulated the recipients, on behalf of the Chairman of INEC, Prof. Mahmood Yakubu, for their victory at the polls, explained that the exercise “is a formal statutory and confirmatory process that you have won an election in accordance with the constitution and electoral dictates”. He also congratulated “in a very big way, the people of Enugu State for taking ownership of the electoral process and driving it in a very peaceful and conducive atmosphere that fused power and sovereignty back to them”. Offering advice to the recipients, he said: “The sealed Certificate of Return that will be presented to you is not a trophy that marks the conclusion of your service. Rather it marks the beginning of your service to the people. The validity of the certificate rests with the people of Enugu State. It is within their constitutional mandate to renew, withdraw and or elevate it. The key word is service to the people”. Earlier in his opening speech, the INEC State Resident Electoral Commissioner, Dr. Emeka Ononamadu, who rated the peaceful conduct of the elections in Enugu State high, “with all the promises of fairness, openness and neutrality intact”, maintained that the exercise “was a tortuous journey that did not come at zero cost, but it is also a journey that the entire nation is poised to learn from Enugu”. According to him, “we set out for 2019 general election with clear vision which resulted in one of the best elections in Nigeria. On behalf of INEC, I wish to thank stakeholders, particularly the political parties, security agencies, traditional rulers, civil society organizations, media, voters and my colleagues in INEC, for their painstaking support in conducting an election which today is being evaluated as one of the best and most peaceful of our time”. In his brief remark after receiving the certificate, Gov. Ugwuanyi, who appreciated God, thanked INEC and the security agencies for their roles towards the peaceful and successful conduct of the elections in Enugu State. The governor also thanked the people of the state, who he described as “the true heroes of our democracy” for renewing his mandate and reassured them that he “will continue to serve you with the fear of God”. His words: “We all prayed for peaceful, free, fair, credible and transparent elections, and by the special grace of God, it ended in praise. This means that truly Enugu State is in the hands of God and in all we do in Enugu State we give God due glory, honour and adoration”.

The U.S. Secretary of State, Mike Pompeo, on Tuesday, said this as he announced new limitations on the use of federal government funds in Washington. “We can continue to meet our critical global health goals… while refusing to subsidize the killing of unborn babies,” Pompeo said. He said the new measures would include “strict prohibition on back door schemes” meant to help funnel money to organisations working on women’s health and that support abortions. Pompeo is a Christian conservative and has been facing lobbying by right-wing groups on the abortion issue in Latin America. U.S. President Donald Trump, upon taking office, reversed regulations that were in place during the Obama administration to reimpose the so-called Mexico City Policy, which prohibits organisations receiving U.S. money from even using non-U.S. funding for abortions. Critics call the policy the “global gag rule’’ as it not only limits what organisations can do with their own money, but also places restrictions on the types of conversations health care providers can have with patients. Human Rights Watch, a lobby group, warned already in 2018 that Trump was applying the rule not only to the tens of millions of dollars the U.S. gives to family planning programmes but to the more than 8 billion dollars the U.S. donates to global health issues. The reopening order was contained in a statement issued on Monday in Osogbo by Mr Adeniyi Adeshina, the Chief Press Secretary to the Governor, NAN reports. Oyetola had ordered the closure of the three tertiary institutions in the town following a violent protest by irate youths due to the disruption of electricity supply by Ibadan Electricity Distribution Company (IBEDC). The affected institutions in the town were Osun State College of Education, Ilesa, Osun School of Health Technology, Ilesa, and Osun State College of Technology, Esa Oke According to the statement, the decision to reopen the institutions was taken after due consultations with stakeholders, heads of the affected institutions, parents and the leadership of IBEDC. It said parties involved agreed that peace should continue to reign and that the students would henceforth behave in line with the ‘Omoluabi ethos’’ which the state was noted for. The statement said restoration of electricity supply in Ijesaland had commenced. The Governor, according to the statement, advised the students to desist from taking the law into their hands and should always explore legitimate channels to pursue their grievances. Reacting, Wike while receiving Yeeh at the Government House Port Harcourt on Monday said history will be kind to him for placing Rivers interest above personal consideration. Makinde made the promise in a statement made available to journalists on Sunday by his spokesman, Mr Dotun Oyelade. He said, “Events of the past two weeks have shown characteristics of targeted contract awards that were compiled in a haste and randomly awarded to empty government purse before the May 29 swearing-in date. “While the government remains in place till May 28, awarding a N30bn new set of contracts in one day as was the case during last Wednesday’s executive meeting was curious and an aberration, especially when debts, as old as 2011 are left unpaid.” The governor-elect pointed out that information from civil servants, who have the interest of the state at heart, suggested a grand plan to disrupt the smooth take-off of the incoming administration by mopping up all available funds. The tribunal also declared the September 27 rerun election in the state illegal. The three-man panel of the Tribunal gave the judgement on Friday following the petition filed by the governorship candidate of the Peoples Democratic Party, PDP, Senator Ademola Adeleka against the All Progressives Congress, APC and its candidate, Gboyega Oyetola. The Tribunal also ruled that PDP and Adeleke proved that it was the state Returning Officer who cancelled the results in 7 Polling Units, adding that the petitioners also proved that the Returning Officer has no power to cancel election results of a polling unit. The Tribunal deducted 2,029 votes from APC scores and 1,246 votes from PDP votes in 17 polling units where there was non compliance. The State Coordinator, who spoke through the NYSC Public Relations Officer, Rev. Adedapo Tayo, said the set recorded no death during the service year in review. Explaining further, she said two corps members, Seun Albert and Dr Alabi Vincent, won the state award for their effective performance during the service year. The State NYSC coordinator lauded the outgoing corps members for their conduct during the service year, admonishing them to sustain the tempo in their future endeavours. She, however, urged the outgoing corps members to remain focused on becoming self-reliant and sustaining. The coordinator, therefore, advised them to put into practice all the skills and entrepreneurship training they received during their one-year of national service. Mrs Ahile also enjoined the corps members to continue to be good ambassadors of their homes, institutions and the country. She urged them not to rely on government jobs but to strive to utilise the skills they learnt and become employers of labour in the nearest future. The Independent National Electoral Commission (INEC) had on Sunday declared Sanwo-Olu winner of the March 9 governorship election and returned him elected. Sanwo-Olu, of the All Progressives Congress (APC), polled 739,445 votes to defeat Jimi Agbaje of the Peoples Democratic Party (PDP) who polled 206,141 votes, and other contestants in the election. A Primary school teacher, Mr Timileyin Adenekan, said that the elected candidates should endeavour to keep various promises they made during campaigns and make citizens’ well-being their major concern. Adenekan said: “The elected candidates should not concentrate or allocate all resources to the construction of bridges, but they should also invest in agriculture to ensure food sufficiency for the people. “They should also consider people that live below poverty line, and they should ensure payment of civil servants salaries as and when due.” Adenekan scored INEC high in the conduct of the 2019 elections, saying he believed the elections were largely free and fair. “The elections were free and fair in most parts of the country, even though some political parties still engaged in vote-buying,” he said. Oyinwanwa Phillips, a student, told NAN that he expected Sanwo-Olu and the incoming legislators to carry out their duties effectively. He said that candidates elected at the federal level should also work together to ensure greater success of the anti-corruption war. “The elections were good, although there was violence in some places; but we thank God it was successful. “I expect the newly elected candidates to carry out their duties accurately. “When they assume office, the elected candidates should provide basic amenities to citizens and improve infrastructure to provide conducive environment for investment, business and location of manufacturing industries. “I also urge the Federal government not to relent in its anti-corruption war in the country. “Government should support small and medium scale business owners financially through grants and loans, and also educational systems must be upgraded to improve education standard in the country,” Phillips said. Mr Francis Duru, a photographer and graphic designer, said newly elected candidates at both state and federal levels should try their best not to make life difficult for commoners, and strive to achieve better than their predecessors. “Government should invest in the economic sector to provide employment and improve standard of living in the country,’’ he said. Duru urged the federal government to balance national security with human right imperatives, and enhance safety of residents in parts affected by insurgency and herdsmen killing. Miss Aminat Raimi, a student, appealed to Sanwo-Olu to pay attention to areas where Gov. Akinwunmi Ambode did not pay enough attention to, and work on them. She urged him and the others elected to keep the promises they made during campaigns and make life better for the people. Raimi said that the election that brought them in was free and fair, and commended security agencies for maintaining peace during the exercise. Mr Godwin Idamarhare, a dry cleaner, told NAN that he would like the incoming governor to deal with unemployment, food shortage and bad roads in the state. They are: Plateau, Adamawa, Bauchi, Benue, Sokoto, Kano and Rivers states. Returning Officers for the election in Plateau and Adamawa states, made the declaration on Monday in separate announcements at their respective collation centres. In Jos, the Plateau State capital, Professor Richard Kimbir announced that the margin of a lead of 44,929 between the APC and the PDP candidates, is less than 49,377 cancelled votes. Simon Lalong of APC polled a total of 583,255 votes, while Jerry Useni of PDP scored 538,326. Professor Fatima Muktar had given the same reason for her decision in Adamawa and asked those troubled to report to the electoral body. The election was declared inconclusive in both states, following a similar development in Sokoto State. Also in Bauchi, Prof. Mohammed Kyari, the Returning Officer, said that apart from the cancellation of the result from entire Tafawa Balewa Local Government Area because of irregularities, the exercise in some other polling units also suffered the same fate. Late on Monday, the same verdict was passed in Benue state, where a date for the rerun is expected announced within 21 days. Just yesterday, INEC suspended all electoral processes in Rivers state until further notice. In a statement, the commission explained that they took the decision, due to widespread violence in the state during the March 9 governorship and State Assembly polls. The commission also claimed some of its staff were held hostage and materials including results sheets were destroyed. The elections in Kano have also been adjudged inconclusive. The court had ordered Saraki and Sani-Omolori to swear-in Air vice Marshal Isaac Mohammed Alfa (rtd) as the Senator representing Kogi east, just as it ordered Senator Attai Aidoko (PDP, Kogi east) to vacate the seat because he was not validly elected. The presiding judge then, Justice Gabriel Kolawole (now Justice of the Court of Appeal) in addition ordered Independent National Electoral Commission (INEC) to re-issue certificate of return in favour of Alfa. Despite the validation of the Federal High Court judgement by the Court of Appeal and the Supreme Court, Aidoko had through his lawyer, Patrick Ikwueto (SAN) on January 28, 2019, filed another suit before the same Federal High Court, asking it to set aside its order of June 13, 2018. The Federal High Court on February 21, 2019, struck out the suit on the grounds that its order of June 13, 2018, is still valid and subsisting. But Alfa’s lawyer, Reuben Egwuaba, applied for ‘’Form 48’’ which is a ’’notice of consequences of disobedience to order of the Federal High Court, Court of Appeal and the Supreme Court’’. However, the Court yesterday granted Alfa’s application to warn Saraki and Sani-Omolori against further delay to inaugurate him As Senator. Justice Inyang Ekwo held that Saraki and Sani-Omolori should, ‘’take notice that unless you obey the order contained in this order you will be guilty of contempt of court and will be liable to be committed to prison’’. Senator Aidoko’s appeal against Justice Kolawole’s judgement at the Court of Appeal was dismissed on October 24, 2018, thereby affirming the Federal High Court judgement. He further appealed against the Court of Appeal Judgement before the Supreme Court which was struck out on January 23, 2019 on the ground that it was caught by the amendment to Section 285 of the constitution, which took effect from June 7 last year.
