In his ruling, Justice Buba held that FAAN failed to comply with the condition that dispute between it and Bi-Courtney must be referred to the Co- ordinating Committee before commencing the suit The application by the Federal Airports Authority of Nigeria, FAAN, seeking to stop Bi-Courtney Group from taking over the General Aviation Terminal, GAT, at the Murtala Muhammed Airport Terminal 2, MMA2, Lagos, suffered a setback, as the Federal High Court, Lagos, ruled in favour of the firm. Justice I.N. Buba struck out FAAN’s application seeking to restrain Bi-Courtney from taking possession of the GAT, despite the Appeal Court judgment, which affirmed Bi-Courtney’s ownership of the terminal. FAAN had filed the application on December 5, 2011, seeking several reliefs against Bi-Courtney in respect of the use and operation of the airpot terminal based on a concession agreement executed between it and the Federal Government. Although FAAN’s ex parte application to restrain Bi-Courtney was granted by the court on December 6, 2011, an application by the concessionnaire seeking an order of court to set aside the order was granted in a ruling delivered on February 27, 2012. Consequently, Bi-Courtney, in a Notice of Preliminary Objection dated April 10, 2012, had asked that the order of court be struck out for failure to fulfil certain conditions contained in the concession agreement between the parties, or the suit be dismissed for being an abuse of court process. Bi-Courtney had argued that FAAN instituted the action without consideration to the dispute resolution mechanism provided for in the concession, which demands that disputes arising from the agreement must first be referred to the Co-ordinating Committee for resolution. Bi-Courtney also alleged that the suit was an abuse of court process, as reliefs sought were substantially the same as those already determined by the Federal High Court and the Court of Appeal. In his ruling, Justice Buba held that FAAN failed to comply with the condition that the dispute must be referred to the Co-ordinating Committee before commencing the suit in accordance with the terms of the Concession Agreement. The court, however, refused the relief sought to dismiss the suit on the ground that it was already declared incompetent. The issue of the ownership of the GAT has been a subject of numerous litigations, including five appeals, all of which have been decided in favour of Bi-Courtney, the most recent being the ruling of the Court of Appeal, Abuja, which affirmed the company’s ownership of the disputed terminal. |

On Jim Iyke Oh please, don’t drag me into that. All I can say is that if a person needs to see a doctor, he should be free to do so. I like the young man. He has been defending himself on the internet. Is he not enjoying a better life now? Are things not working for him? On allegations he pays people to fake miracles How much will I give to the president of a nation to come here? Even when they come, I don’t get any financial gain but I incur cost because I want to ensure that they are well cared for. That is all; I even prefer to spend my time with the poor than to be with the presidents. If a president visits this place today, the whole of the day will be devoted to that visit, I would have lesser time for the poor people, who need my attention. God has been warning me over this trend so much that when some presidents said that they wanted to visit me, I said no. I said it would be better for me to visit them in their countries. Each time they visit this place, I receive query from God because of my time that should have been used to attend to the poor and the needy that are waiting for me. One soul is not superior to the other, why should I continue to receive query? Really out of three presidents that may visit, there will hardly be one that will show good example of the counsel that they received from me. If the needy are more receptive to God, it is better to give them more of my time. |

The Court of Appeal, Lagos, on Friday, struck out an application by the Lagos State Government, seeking leave to appeal the verdict which acquitted Major Hamza Al-Mustapha and Lateef Shofolahan. Al-Mustapha, a former Chief Security Officer to late General Sanni Abacha, and Shofolahan, former aide to late Alhaja Kudirat Abiola, were sentenced to death on January 30 last year, by Justice Mojisola Dada of a Lagos High Court, Ikeja. However, the Appeal Court on July 12 upturned the lower court’s judgment, insisting that the prosecution failed to establish a charge of murder against the appellants. Dissatisfied by the judgment, the state government indicated its readiness to appeal the verdict at the Supreme Court. At the resumed hearing on Friday, the Assistant Chief State Counsel, Femi Adamson, in an oral submission, prayed the court to strike out the application, same having been withdrawn by the respondents, due to effluxion of time. He noted that by the provisions of the rules of court, such application, seeking leave of appeal, ought to have been filed before the expiration of the stipulated 30 days after the judgment. “My lord we have an application before this court, dated August 12 and filed on the same date, for leave to appeal the order of this court delivered on July 12. “This application has however been overtaken by time, and so, this court lacks jurisdiction to entertain same. “We hereby withdraw this application before your lordship, and we shall ensure that we file all necessary processes before the Supreme Court,” Adamson said. The application for withdrawal was not objected by Counsels to the appellants, Adedayo Adedeji and Olalekan Ojo. The appeal panel headed by Justice Shagbaor Ikyegh, in a short ruling, struck out the application. “This application having been withdrawn is accordingly struck out,” he ruled. source : THE NATION NEWSPAPER |
PROTESTERS disrupted a Nigerian awards ceremony in central London last night expressing anger at the awarding of an honour to aviation minister Stella Oduah by the Global Peace Movement (GPM). At a glitzy ceremony at the Radisson Blu Portman Hotel in London, the GPM conferred awards on Ms Oduah, the Kaduna State governor Mukhtar Yero and Nnamdi Udoh, the managing director of the Nigeria Airspace Management Agency. Halfway through the ceremony though, protests broke out as several protesters felt it was inappropriate to be honouring Ms Oduah. Apart from the fact that Ms Oduah is under investigation over the purchase two bullet-proof BMW's valued at $1.6m, protesters said she should also be held culpable for the recent spate of air crashes in Nigeria. President Goodluck Jonathan is under pressure to sack Ms Oduah over the car purchases, which were said to have been bought surreptitiously and she is due to face the Senate to answer questions about air safety. Marian Awolowo of the campaign group Nigerian Global Awakening, one of the protesters who disrupted the ceremony, said: "The management of the aviation industry should be questioned because we have had a spate of air crashes recently and the minister is under investigation for fraud. With thousands of people still grieving, it is not the right time to be giving Stella Oduah a peace award and I told Mike Uyi to postpone it. "It is very insensitive and an abuse to all the victims and their families of the Dana Air crash to be giving Ms Oduah a peace award of all things. We Nigerians are not that wicked, do not worship money that much and are not that low." Governor Yero was there in person to receive his award from the GPM president Michael Uyi but Ms Oduah and Mr Udoh sent representatives. Victor Oche Elias, Ms Oduah's special adviser put up a spirited defence in support of his boss, saying she was not responsible for the accidents as they were mainly down to pilot error and added that the cars were bought for the safety of visiting dignitaries. Mr Elias added: "I am a trained aviator myself and I can tell you that 70% of air accidents are down to pilot error. In the case of the Dana Air accident, the pilot knew there was a fault and should have returned to Abuja but continued flying on to Lagos because he wanted to catch a flight to India for a wedding. "As per the cars, they are not for the minister's personal use. Recently, the head of the International Civil Aviation Organisation visited Nigeria and refused to step out of the plane until a bullet proof car was provided for him." After a series of heated exchanges, the protesters were later removed on the instructions of the GPM president Mr Uyi and the awards ceremony continued. Mr Uyi said he was not bothered with the protests as the GPM investigates whoever it gives awards to properly and is always certain that they are deserving of such honours. He added: "We are never perturbed because we always carry out a full investigation into a person before conferring an award upon them. The GPM is known to take risks in carrying out it assessments and we even went to Iraq to inspect their presidential palaces when it was claimed there were weapons of mass destruction there." Accepting his award, Governor Yero said he believed it was a vindication of what his administration is trying to achieve in Kaduna State by restoring peace and making it an investment destination. According to governor, his government is also trying to empower local people through youth and women's programmes whereby they are given capital to start commercial operations. Governor Yero added: "Kaduna is now an investment-friendly state in sectors such as agriculture, tourism, power, mining, solid minerals, housing and transportation. One of the things we have done is guarantee the safety of such investment and made the state a conducive environment for investors." According to the governor, he is also in London to discuss a £500m investment programme in the state agricultural sector by a British investor. He added that the state is making some progress because it is currently enjoying peace among the disparate religious and ethnic groups that make up its populace. |
Alhaji Ahmed Barata, the senator representing Adamawa South Senatorial Zone has placed a curse on gifts and donations disbursed to members of his constituency. The senator informed beneficiaries of his largesse that they would be punished by God if they refused to vote for him in the forthcoming 2015 general election. The senator’s statement angered some members of his constituency who abandoned the empowerment package and quietly left, while others vowed to collect the gift without voting for him. The Chairman, Independent National Electoral Commission, Plot 436 Zambezi Crescent, Maitama District, FCT, Abuja, NIGERIA Dear Sir, Re: ANAMBRA STATE GOVERNORSHIP ELECTION: A CALL TO SAVE OUR DEMOCRACY. The above subject refers. On the 16th November 2013, the good people of Anambra State woke up with great aspiration and expectation to cast their votes to elect a new Governor for the state. Prior to the date for the Election, the ominous signs of an election that was pre-determined to favour specific interests against the run of the electorate support were already clear. When our great party, the All Progressives Congress (APC) noticed these foreboding signs; we immediately drew the attention of the electoral umpire and the whole world to them. The issues, which our party complained about through official correspondences and various press releases, are several. These include: The unholy conspiracy between the electoral umpire (INEC) and the presidency/PDP to rig the Elections to rig the election in favor of APGA. Mass disenfranchisement of voters through use of multiple voters registers, Deliberate delay in the distribution of electoral materials in the opposition strongholds, The disappearance of electoral officials and result sheets meant for opposition strongholds, The sudden creation of about 3,00 voting units, of which our polling Agents did not receive Tags, The unconstitutional 22-hour curfew, which was a ploy to give the riggers the leeway to actualize their rigging plans while the vigilance of the Electorate was inhibited by the curfew already in place. The unlawful deployment and use of the military during election and purely civil activities. Our complaint about the Anambra Resident Electoral Commissioner, Professor Chukwuemeka Onukogu and other Federal Commissioners who had proven to be biased through his conduct in previous elections. Despite INEC getting information of our complaints, we were doubly assured that our fears were founded. The elections that were superintended over by your commission was grossly below any acceptable standard, whether local or international. The deliberate tactic to prevent democracy and serve the two parties’ interests, PDP and particularly APGA in this case cannot be democratic and in the voters’ interest. And the only face saving decision for you and your commission in this circumstance is to cancel the charade, which you want to reinforce of the electorate as a credible election. We cannot gloat over the dangerous signs and the gathering storms that portend a coup d’etat against the yearnings and aspirations of our people. The reasons why we cannot accept this infamy of your commission as regards the Anambra election are as follows. The Manipulation of the October 12th Delta Central Senatorial District bye- election. The refusal of INEC to conclude the election started since July 29th 2013 in the re-run election to the Imo State of Assembly in Oguta, in spite of the fact that there was a clear winner. The abnormality displayed in the State House of Assembly by-election in Ringim Constituency of Jigawa state. The danger that the shenanigans, the conspiracy and the subversion of the will of the people signifies to our democracy. The question our generations’ yet unborn will ask and their judgment if we refuse to do what is right to arrest the drift of our nation to the straits of destruction which have dire consequence for our people. A flashback into our political history has revealed that the subversion of the will of the people has always ended in a catastrophe for our nation, thereby drawing back our quest for development. The collapse of the first and second republic political experiments are pointer to the dangerous path we are treading once again. We, in the All Progressives Congress (APC) cannot be cowed, for this is a time that calls for all brave men and women to rise to the desperate call of the silent majority to rescue our nation from the assured perdition of a PDP led government at the Federal level. If you recall, the 2011 National Assembly Elections were cancelled due to the failure of your commission to achieve the right parameters for a credible election. Our position is that if you could cancel an election that has already commenced and voting was ongoing due to flaws in that electoral process, your assertion that you do not have the authority to cancel an election that you have acknowledged as flawed and “messed up and sabotaged” cannot be sustained. The observed flaws in the election were deliberately planned as a strategic conspiracy of the Independent National Electoral Commission (INEC) and the Peoples Democratic Party (PDP) to rig the Anambra Governorship election in favour of their surrogate party, the PDP faction of All Progressive Grand Alliance (APGA). With your acknowledgement of these far reaching vitiating factors, your grandstanding to uphold the outcome of the flawed election and your haste to conduct what you call a supplementary election, without first correcting the innate flaws in the electoral process is unacceptable. We have lost confidence in the ability of INEC as it stands today to organize a free, fair and transparent election anywhere in Nigeria if the Anambra style is repeated. OUR REQUEST An outright cancellation of the Anambra Election, having been marred by serious irregularities and non-compliance with the Electoral Act. INEC should discard the present fake multiple voters register and produce one authentic voters register that will not disenfranchise any voter and be published 30 days before any election can take place in Anambra state. The suspension and prosecution of all officials of the commission who have ever been indicted for electoral perfidy to purge the commission of such compromised officials. The immediate redeployment and investigation of the current Anambra Resident Electoral Commissioner, Professor Chukwuemeka Onukogu. We, as a party, we demand honesty and transparency! If our requests above are not acceded, it will confirm that Independent National Electoral Commission (INEC) is deliberately (by either gross incompetence or more suspicious means) interfering in democracy. Finally, we demand for the outright cancellation of the manipulated November 16th Gubernatorial election in Anambra State. INEC prepared three different voters registers for the November 16, 2013 governorship election in Anambra State. Local Government Electoral Officers had voters registers quite different from the voters registers given to the Collation Officers for the said election and evidences of the use of double voters registers were the reason why both the LG Electoral Officers and LG Collation Officers sharply disagreed in the course of submitting and declaring results local government by local government (see live video/television coverage footages) Again, another evidence of use of the two different voters registers manifested when the total number of registered voters 1,770,125 million voters in one register cou;d not balance with the votes allotted until the total number of registered voters 1,763,751 million voters in another voters registers was alternatively used Going by the adopted figures of voters finally used by INEC at the venue of announcement of results of the election, the total number of registered voters is 1,763,751 million, the total number of accredited voters is 451,826 ,total numbr of votes cast is 429,549 votes, the total number of valid votes is 413,005, the total number of invalid or rejected votes is 16,544 and the total number of nullified or cancelled votes is 113,113. From the results announced by INEC, the breakdown of individual scores recorded for the parties are as follows: AA – 236; Accord – 181; ACD – 471;ACPN – 552; AD – 171; ADC – 642; APA – 1521; APC – 92,300; APGA – 174,710; CPP – 853;DPP – 607; ID – 203; KOWA – 313; LP – 37,446; MPPP – 151; NCP – 254; NNPP – 670; PDP – 94,956;PPA – 5056; PPN – 323;SDP – 231; UDP – 153, and UPP – 621. The top four parties viz APC scored 92,300 votes; APGA got 174,710 votes; PDP scored 94,956 votes and LP got 37,446 votes totaling 399,406 votes. The other parties scored a total of 13,209 votes When the total score of 399,406 votes for the top four parties (APC+APGA+PDP+LP) is added to the total score of 13,209 for the remaining parties, the sum total is 413,613 votes. Therefore, all the participating political parties scored a total of 413,613 votes as against 413,005 allocated to the parties by INEC, showing a difference of 390 votes.. Sources are of the opinion that of the 113,113 cancelled votes, 89,997 votes are from Idemili North LGA, APC candidate, Ngige’s major stronghold and highest in voter strength among LGAs. It is believed that the 89,997 cancelled votes belong to Ngige’s APC but cancelled to whittled down his scores. Observers are of the opinion that if the 89,997 cancelled votes are added to the 92,300 votes Ngige got, he will lead the pack and be announced as the winner and issued with Certificate of Return by INEC as the governor- elect. The total number of votes cast is 429,549 and when subtracted from the so-called cancelled votes of 113,113, a total of 316,436 votes is got, which is less than 399,406 votes polled by a combination of just four top runners (APC+APGA +PDP+LP), or even the total of 412,615 votes allocated to all the parties in the election.. What this means is that the number of votes for the four top candidates is higher than the total number of valid votes cast in the election. Again, if, according to INEC’s allocated figures of 429,549 is the total number of votes cast, it means that 316,346 votes were recorded after subtracting the cancelled 113,113 votes. APGA’s candidate, Wille Obiano should have 91,740 votes but INEC went ahead to allocate an additional 82,970 votes in order to push his figure up. If Obiabo is given his due votes of 91,740 votes, he will place third leaving Ngige with the chances f taking the first position while Nwoye will place second. Mathematically or statistically, the number of votes allocated to the candidates by INEC is spurious and fraudulent. Even more fraudulent and inexplicable are the high percentage of polling units and areas in Ngige’s domain which are substantially enough to determine who wins the election if conducted freely, fairly and credibly. |

PDP will use the EFCC and Security to harass and blackmail the G7 & potential APC candidates. 4. PDP will use huge amount of money to infiltrate APC and to buy support from the North. 5. Traditional and religious leaders will receive large amount of money to support PDP or to keep quite. 6. APC will takeover control of the National Assembly. 7. APC will use the media to expose corruption & incompetence in the PDP government. 8. APC will make an attempt to impeach president Jonathan or frustrate his government 9. The unrest in the Niger Delta may resurface. Groups will emerge demanding for Nigeria to be divided. 10. APC will shock many people by their choice of presidential & vice presidential candidates. Some dissatisfied members will leave the party. 11. PDM will become strong and many disgruntled APC & PDP members will move to join PDM. 12. PDP & APC will try to form an alliance with PDM. 13. 2015 elections will be massively rigged by all the parties. It is a familiar script. God knows better! |

There was jubilation in Adamawa State as news filtered in that Governor Murtala Nyako and four other PDP governors had defected to the All Progressives Congress (APC). Many people took to the streets in Yola, the state capital and in the 21 local government headquarters. Those jubilating were chanting the names of former Head of State Gen. Muhammadu Buhari and former Lagos State Governor Asiwaju Bola Ahmed Tinubu, seen as the arrowheads of the APC. They were saying a new dawn had been heralded and chanting slogans like ‘’death to PDP.’’ One Governor Nyako supporter said: “With this development, the PDP has been buried, we are tired of impunity.’’ Also corroborating, Hajiya Larai, a woman leader in Yola said “ it’s well glaring that the new re-alignment has pushed the PDP to the unfamiliar territory of being a weaker and weakened political force in the country,’’ she observed. The APC National Vice Chairman, northeastern zone, Alhaji Umar Duhu, said the two parties agreed “to work together in order to rescue the fledgling democracy of the nation.” He added: “Today I’m one of the happiest chieftains of the APC in Nigeria and in Adamawa state in particular” However the Bamanga Tukur faction in the state wants Nigerians to tarry awhile to see what the new APC merger would bring to the table. The factional secretary Mr.A.T Shehu described the defectors as “drowning men in a sinking ship.’’ |

Equally, the fear of likely being dragged to the EFCC on account of these numerous assets weakened the resolve of Governor of Aliyu to swim with the tide of change. Governor Aliyu, a former permanent secretary/Director General of the Federal Capital Development Authority, FCDA, from where he ran for and became Niger Governor acquired extensive landed properties in Abuja. Investigations also revealed that Governor Aliyu, who alleged to be the owner of what is probably the best Hotel in Abuja today by name Hawthorne Suites. The hotel by every standard is a 5-star hotel. “It is a massive investment”, some sources said. With the knowledge of the way the Jonathan government hound its opponents which among other things include setting EFCC on them or their children, as in the case of Governor Lamido or confiscating or destroying their property in Abuja as in the case of Governor Kwankwaso’s property now being taken over by FCT authority, Governor Aliyu is trying to play safe. A member of the nPDP who pleaded to have his name left out, said he sympathizes with Governor Aliyu. ” He wants the best of both worlds. He wants to remain with PDP and also ride the tide of change with the new PDP, now merged with APC. Its about the courage to let go and make sacrifices.Many of his colleague governors have already made sacrifices. A former vice president and member of the New Peoples Democratic Party, nPDP, Atiku Abubakar, has described the news of the merger of the splinter group of the ruling party and the opposition All Progressives Congress, APC, as “a positive step in both direction.” The APC and nPDP announced their decision to merge after a three hour meeting at the Kano State Governor’s Lodge in Abuja on Tuesday morning. The National Chairman of the nPDP, Kawu Baraje, who read the communiqué of the meeting, which he jointly signed with the APC National Chairman, Bisi Akande, said, “After exhaustive deliberations, the two parties agreed to merge in order to rescue our fledgling democracy and the nation.” In a statement by his media aide, Garba Shehu, Atiku said he believed in true democracy based on freedom of association as guaranteed in the Nigerian Constitution. “I also long for a day where we celebrate a multi- party system where political parties make improving the lives of Nigerians their top priority, instead of our current politics of corrupt cronyism and personal destruction. Today’s news is a positive step in both directions,” the former Vice- President said. Atiku, had joined five governors of the PDP, to walk out of the party’s Special National Convention held at Eagle Square, Abuja, on August 31. The governors were Babangida Aliyu (Niger), Sule Lamido (Jigawa), Abdulfatah Ahmed (Kwara), Aliyu Wamakko (Sokoto) and Musa Kwankwaso (Kano). They were joined by Chibuike Amaechi (Rivers) and Murtala Nyako (both were not at the convention) and some members of the National Assembly at the Shehu Yar’Adua Centre, also in Abuja, where they addressed a press conference announcing the birth of the nPDP. The faction named a former acting National Chairman of the PDP, Kawu Baraje; a former Deputy National of the party, Sam Jaja; and its embattled National Secretary, Olagunsoye Oyinlola as the National Chairman, Deputy National Chairman and National Secretary, respectively. Although, he is believed to be a member of the splinter group, Atiku did not play a prominent role in its activities since that time. He did not attend any of the meetings between governors of the group and President Goodluck Jonathan. He was also not at the meeting the PDP Elders, led by former Presidents Olusegun Obasanjo and Ibrahim Babangida, held with the faction in Abuja; thus, inducing suspicion at the time that he had been sidelined. |
