You still don't get it, it's about the rule of law not some sentiment from the judge. I could murder Mr x and it's evident I do, but all evidence points against it. If I get a lady pregnant, so far I'm the father, I have the right over the child and even a right to custody depending on what is good for the child at the moment. If ops friend is doing fine and can afford child care expenses, let him go forward to court as long as the child is his, he might even sue for damages in place of emotional trauma of the child been kept away, and if his lawyer is good, the mistress might loose the child and her money. Discretion is different than going against the judiciary code of conduct. Reference to state vs Abdul, he was remanded for armed robbery for like two years. Dude was a bit over 17 from his looks but his file read 22 I guess error of parallax or so. After the back and forth and guilty plea, an high Court judge sentenced him to two years in prison and reference to time served. Dude robbed a woman with a biro as weapon or so. alas, armed robbery. That was discretion the judge used, but still under the law. Another case is one published here on nairaland about one dude sentenced to over 300 years for drug related offences. That was also discretion but within the law as the guy jumped bail once and ran away.

There is always a maximum sentence and a minimum which judges can't do above or below. Bobrisky sentence was within the criminal code of conduct for such offence.


The case here is civil, and the fact he didn't marry the lady is not an argument. Unless she claim rape which is one of the hardest to prove. Under section 69 of the child right, the father as right to his son regardless of marrying her min or divorcing and that right can't be taking from him. Any attempt to is infringing on his right which he can turn to a criminal case.

The important point remains that the outcome of child custody disputes largely depends on the facts of each case as well as the evidence placed before the Court.

She might end up vacating her seat or even severe consequences.

He should get a good lawyer. As long as they summon them and his lawyer is good, failure to appear will bring them to comtempt and they might be jailed up to a 100 days or so.

It's a crime under the law if they do so. They might be jailed for it depending on what charges the prosecutor can put them in. Someone like me can sue them and new husband for kidnapping, conduct likely among others.

The marriage part as nothing to do with the Constitution. Court will order him to pay for the child upkeep and I believe once the child is 7 or so, he can have almost full custody unless he signs his right over.

Firstly, I am a woman and a graduate of Accounting. I am married with children.
The goal I set for myself is to have my own business and stop salary work by the time I reach 40 years but I could not achieve it because of the following reasons:
1. Underemployment- my salary hardly cover transport and feeding despite my effort to get better job, it is just a little bit better.

2. Marriage Challenges: husband marring additional two wifes when we are still struggling in a rented apartment and me carrying the major expenses, the other wifes have left him, they couldn't endure. 3 No parental Support - even before I got married what my parents were interested is my salary and immediately I got married,they left me with my faith.
4. Closest people I entrusted with the little money I saved doing business with them swindled my money I did not recover a penny .I had to start from scratch.
By the grace of God, I don't have any health challenges.

What I have learned are as follows:
1. Be close to GOD, HE is the director of the universe.
2. Trust no one, your parents can disappoint you, your partner can disappoint you, anybody close to you can disappoint you.

3. Immediately you start work, cultivate the habit of saving so that you will have something to fall back on, as a salary earner save before spending and learn the skill of business because the income is unlimited.

4. Don't do pass your self, nobody cares . don't give yourself unnecessary pressure.
5 Only you can make yourself happy.

I think with the little I have mentioned, I have been able to contribute something.

Bros, leaving father and mother doesn't literarily mean their abode. It more deeper than that. It might mean their control, it might mean been emotionally attached and series of stuffs. The physical house is not even in conformity. I'm in my late 20s and a mummy's boy. I'm very self sufficient even with my own house that doesn't mean I don't go home (mum's place is home to me) to enjoy mum's stew and local delicacies, Even we stay in different cities. After marriage the Bible is against such. And many more. I do tell my friends if not for jobs and all, their is no reason for you to leave your parents house in the name of growing up. I once talked about my doctor friend who got married to his beautiful bride and they still stayed in his parents house. Today dude has finished a very nice 4 bedroom bungalow and tastefully furnished. He had the money for rent as he was doing is residency then already, but it wasn't economically okay simce his parents has a 5bed duplex in the same city he works with his wife.
