N3.3bn scam: EFCC probes Abia gov, others - Confirms exchange of text messages among gov, wife and American contractor

Lanre Adewole, Abuja - 20.11.2009

DESPITE the denial, the Economic and Financial Crimes Commission (EFCC) is probing Governor Theodore Orji of Abia State and three others over a controversial N3.38 billion car supply contract, the Nigerian Tribune can authoritatively reveal.

An interim investigative report filed by the operatives of the commission on the ongoing probe has confirmed that the state governor awarded the contract, despite his denial of same.

There was also no evidence of execution of the contract with the report disclosing that it was controversially withdrawn from the contract, after the contractor had started working on it.

The interim report, a copy of which has been seen by the Nigerian Tribune was entitled “Interim investigation report re: Case of conspiracy, breach of trust, abuse of office and money laundry,” with Mrs. Miranda Nwadeyi, the Managing Director of Western Auto Parts and Services Centre Limited as the complainant, while those listed as suspects included the governor, Commissioner of Works and Transport, Kevin Chima Ugbuaja, Mrs. Agu Ifeoma Obiageli Vivian and Abia State government.

The report also put a lie to the claim of the state government that the governor and his wife had no contact with the contractor by confirming that they exchanged text messages, which are being probed by the commission.

Nigerian Tribune had on Wednesday exclusively reported the commission’s inquest into the controversial contract.

The findings of the commission’s operatives which started running from the second page of the four-page report read “overt and covert investigation into the case vis-a-vis documents recovered reveals that;

•In October, 2007, Western Auto Parts and Services Limited submitted a proposal tagged “Abia State Economic Empowerment Modern Taxi Scheme” to the Executive Governor of Abia State.

•The governor approved the proposal and directed his Chief of Staff (Mascot Uzor Kalu), to forward the approval to the Ministry of Works and Transport for negotiation and implementation of the scheme.

•On 16th October 2007, the Commissioner for Works and Transport (Kevin Chima Ugbuaja) issued the award letter to the company for the supply of 1,500 units of Chevrolet Aveo at the total sum N3.38 billion.

•Based on this development, the company opened a credit line with their supplies in the United States of America, rented an office complex in Umuahia, recruited staff, supplied three sample vehicles (to Her Excellency's office and two to the Ministry of Works and Transport), built a stand with billboard, prepare for the flag off of the scheme and engaged in other logistical issues. However, there was no written agreement drawn between the state government and the company in this respect.

•The scheme was introduced to the stakeholders in December 2007. At the occasion, the commissioner for works and transport represented the state government.

•In January 2008, the governor directed the commissioner for works and transport to keep the scheme in view pending the swearing-in of the local government chairmen. It is important to note that at the time the contract was awarded, the local government chairmen were not elected; hence, seeking their consent was immaterial.

•On 8th November, 2008, one of the three sample vehicles supplied to the Ministry of Works and Transport was returned to the company after a year of usage. The remaining two are still in the state's government possession.

•The state governor used this process to secure political solidarity and gain support from the citizens of the state and later withdrew the scheme and verbally offered the company alternative contracts which the company rejected.

•Based on the withdrawal of the offer by the state government, the company demanded for compensation for the expenses it incurred and other bank loans and charges in the course of scheme to the tune of eight million, two hundred and seventy seven thousand, eight hundred and forty five naira ($8,277,845.00), which the state government considered outrageous.

•At the instance of the commission, the parties had a meeting and the company reduced the amount to three hundred and fifty million naira. The representative of the state government promised to take the message to the government for deliberation and feedback. On 19th August, 2009, through a letter addressed to the executive chairman, the state government reported that 'the complainant company's remedy, if any, which we do not concede, lies strictly in civil litigation'. The government implored the commission to advise the company to 'seek legal counsel on this matter as Abia State government may have no other option but to seek legal redress towards enforcing the rights of the state government and its officials should this investigation and invitation not abate'.

•The governor and his wife exchanged text messages with the complainant, promising her alternative contracts for road construction which she refused.

•On 4/11/09, operatives recovered one of the Chevrolet Aveo cars supplied by the complainant to the governor and his wife. Suspects evaded arrest and none of them was found in his office or residence.

•Investigation into the matter continues.”

Professor Soludo, who was speaking on Thursday at the Emmaus House in Awka, in a reconciliation meeting with the PDP five principal officers in all the 326 wards of the state and members of the PDP executive in all the 21 local government areas of the state, said that Anambra State was PDP state and the party would capture the governorship seat in the election.

He told Governor Obi that PDP will not give him the loopholes he used in capturing the seat he is now occupying because the PDP in Anambra State now is one indivisible family without factions as it was before, which Obi capitalised on, to come to power.

Soludo called on the PDP principal officers in all the 326 wards of the state and local government PDP executives in the state to start reconciliation process immediately they reached their wards, uniting people and bringing new people to the PDP fold in preparation for the 2010 election.

In his response, the PDP caretaker committee secretary in the state, Honourable Tony Mobike, thanked God for uniting PDP once more and promised that the party will accommodate everybody, no matter the factions they formerly belonged to.

Justice Awokulehin agrees to discharge Ibori; UNIBEN reinstates him to give “Founders Day” Lecture after judgment in Asaba
WRITTEN BY SAHARAREPORTERS, NEW YORK
THURSDAY, 19 NOVEMBER 2009 17:23

The sham trial of former Delta State governor, James Ibori, will likely end with a discharge at the Federal High Court in Asaba next Monday before Justice Mercel Awokulehin, the judge Ibori personally nominated to head the kangaroo court which was paid for by the Delta State government.

Ibori's handpicked federal judge, Mercel Awokulehin
And Ibori will leave Asaba for his alma mater, the University of Benin, where he will give a triumphant Founders' Day address, for which he has now been reinstated by the institution after a "cancellation" last week driven by the university community.

Sources in Abuja told Saharareporters that the former Delta State governor, who has been very worried over the failure of Awokulehin to give the agreed ruling which the judge Awokulehin told the court was ready two weeks earlier but could not be delivered because owing to some mundane reasons he offered.

Awokulehin therefore adjourned the ruling till next Monday, November 23 2009. As an angry Ibori left the courtroom, sources told Saharareporters that he told his close aides that Awokulehin was a coward. Later, Awokulehin reportedly reached out to Ibori to apologize that he couldn’t give the ruling as planned because of the petitions written by two groups especially the one written by Edwin Clark, the famous Ijaw elder statesman. He also told Ibori that the he would like to clear with his superior, the Chief Judge of the Federal High Court, Justice Dan Abutu.

Ibori, through Aondoaka, has piled pressure on Abutu, who reportedly gave his blessing to the judgment last night in Abuja where all the nation's judges have been meeting at the annual “Judges Conference.”
It may be party time again on Monday

Awokulehin reportedly shunned the Chief Justice of the federation who asked him to offer a response to the petitions written against him. Instead, Ibori’s lawyer, Emeka Arinze, previously unknown in the case, sent a defence on Awokulehin behalf to the National Judicial Council (NJC) through the office of the Chief Justice of Nigeria, Justice Kutigi.

Ibori assured Awokulehin that the CJN, was on his way out and he need not worry about the old man. Earlier this week, Yar’adua has already forwarded to the Nigerian Senate, the name of another controversial justice of the Supreme Court, Aloysius Katsin- Alu, to replace Kutigi as CJN.

Furthermore, a last minute advice to Awokulehin to recuse himself did not sway him. The EFCC has also kept its own part of the bargain; the agency refused to file any petitions against the brazen act of impropriety by Awokulehin. This is contrary to what the Commission did against a justice of the Court of Appeal in Lagos, Bode Rhodes–Vivour, who was found to be meddling in the case against recently jailed PDP chieftain, Bode George, whose bail application was came up this morning.

To celebrate his triumph in Asaba on Monday, the University of Benin will host him at the same campus where Ibori made a Third Class before commencing a life of greed and corruption. An invitation card distributed on Thursday obtained by Saharareporters, signed by the registrar of the institution, shows that Ibori's lecture, which would amount to a taunt of every Nigerian that abhors corruption and abuse of office, would take place at the main Auditorium, at 3 PM prompt.

The Delta State government has made arrangements for Ibori to fly in a Helicopter from Asaba to Benin as soon as the ruling is concluded sometime after 9 AM. Ibori will return to Asaba later in the day for the parties that have been planned with the cooperation and generosity of Governor Uduaghan's administration.

Ibori calculates that since the Southwark Crown court in London has deffered to the case in Asaba by adjourning twice at the instance of the Asaba case, being discharged on Monday would spell a death knell for the London trial of his associates which comes up the next day , November 24, before judge Christopher Hardy.
Ibori arrives in his own court in Asaba

INDICATIONS have emerged that Delta State Governor Emmanuel Uduaghan would soon assent to the anti-kidnapping bill passed by the state Assembly, which prescribes death penalty for persons caught in the nefarious act.

The state Deputy Governor, Prof. Amos Utuama (SAN), made the indication yesterday while receiving the Chairman of the Police Service Commission (PSC), Mr. Parry Osayande, on behalf of the governor at the Government House, Asaba.

Utuama added: "We are challenging the Police by the passage of a law to amend our Criminal Code in relation to kidnapping.

"Very soon, His Excellency, the governor, will assent to the bill and it will be a criminal offence carrying death penalty for anybody to attempt or even kidnap another. This is a very big challenge to all of those who are enforcers of law because we must stamp out kidnapping in any form, in any shape, in order to a have a very peaceful Delta State", he added.

Yu are still a bloody liar. You claimed Igboa are killed in Saudi, I challenged you to show proof and you are showing me Indonesia? So Indonesia is now Saudi?

The so-called statistics is for drug trafficking outside Nigeria. So tell me the statistics inside Nigeria

Do you know that Kano is leading there?
Do you know that Ekiti is number one in Igbo cultivation, followed by Osun, Edo, Delta Ondo?
Do you know that no Igbo woman has been caught with drug compared to Edo and Yoruba women?

Do you know that most of the fraud cases outside Nigeria are committed by Yoruba?
Do you know who is on the EFCC most wanted list?
To arrive at any data, you have to look at every thing. So my bloody liar fried, go back to work and get more facts.
I have rested that matter. As for what the last poster said, he is very correct. You can hardly see anyone who will want to die outside his domain. Even Nigeria, parents wants to be buried in their villages.

What still baffles me here is that, why would she allow such (even with her husband in Nigeria)? Meanwhile, as for the husband, I know he will not do anything even if he hears that the father is sleeping with his daughter for visa!.

Zimbabwean migrants flee South Africa over job tensions
[/b][/b][/b]

ABOUT 1,500 Zimbabwean migrants have fled their homes in a shantytown in rural South Africa, after tensions erupted with locals over competition for farm jobs.

South Africans on Tuesday physically prevented Zimbabweans workers from getting on to trucks taking them to jobs in the grapelands around De Doorns, about 140 kilometres (85 miles) northeast of Cape Town, said senior police superintendent Hendrik Olivier.

Fearing the incident could lead to further attacks, the Zimbabweans fled their shacks and turned to local authorities. Emergency services have set up a camp for the migrants at a local sports field, he said.

"We put up an internal displaced people camp at the sports field," Agence France Presse (AFP) yesterday quoted him as saying, adding "We put up tents and toilets."

He said the tensions erupted over "the limited resources that are available in the rural areas, and also the limited work opportunities."

Many of the Zimbabweans had seasonal jobs tending grape vines, but South Africans accused them of taking away their work by agreeing to longer hours and lower wages.

The incident sparked sharp memories of the xenophobic violence that rocked the nation in May 2008, in which more than 60 people were killed and tens of thousands forced to flee their homes -- many of whom relocated to camps that have since closed.

Olivier said some of the Zimbabweans had lived in the area for up to three years. Some of their shacks were knocked down by angry neighbours, but many of the Zimbabweans were renting the shacks from South Africans, he added.

Millions of Zimbabweans have fled their country's political and economic turmoil, with many coming to neighbouring South Africa, the continent's economic powerhouse.

Zimbabwe President Robert Mugabe, blamed for plunging his people into starvation, used his platform as Tuesday's opening speaker at the UN anti-hunger summit to decry what he called his neocolonialist foes.

Another longtime African strongman, Moammar Gaddafi, held another nightly soiree at a villa in the Italian capital in the company of hundreds of young ladies selected by a "hostess" agency.

Tunisia's first lady and her bodyguards blocked traffic on roads leading to Via Condotti, a glamorous street of designer boutiques near the Spanish Steps. Rome daily Il Messaggero ran a photo of Leila Zine in front of luxury jewelry store Bulgari.

The images bolstered criticism that the summit called by the UN Food and Agriculture Organization is long on rhetoric and extravagance and short on solutions for the world's one billion hungry.

The meeting was branded a failure within a couple of hours of its start after the 192 participating countries unanimously rebuffed the United Nations' appeal for commitments of billions of dollars in yearly aid to develop agriculture in poor nations.

None of the leaders of the Group of Eight leading industrialized nations attended except for Italian Premier Silvio Berlusconi.

"There is a clear disconnect between what governments are saying, at least the rich governments, and what in fact they are doing," said Flavio Valente, an activist participating in a forum of NGOs held in parallel with the summit.

The G-8 meeting in L'Aquila, Italy, essentially set the agenda for this latest summit by endorsing a strategy shift in fighting hunger: helping farmers in poor country to produce enough food to feed their own people, moving away from decades-long reliance on handouts.

While the G-8 leaders in July approved $20 billion in agricultural development aid in a three-year package, the countries at this UN summit rejected FAO's call to commit themselves to earmark 17 per cent of their foreign aid budgets for agricultural development, which U.N. officials estimated would cost $44 billion yearly.

Ertharin Cousin, the U.S. ambassador to the U.N. agencies in Rome, said the summit wanted to establish the principle that donors should listen to the needs of each country and not decide aid policies on their own.

FAO director-general Jacques Diouf expressed "regret" and frustration that the summit rejected his call to members to fund the new shift in agricultural development policy.

About an hour after the decision, Pope Benedict XVI delivered a speech to the summit condemning opulence and waste in a world where the numbers of hungry have multiplied despite international efforts to combat chronic hunger.

Some of the assembly-room chairs were empty when Mugabe opened Tuesday's proceedings by lashing out at the West and defending land reforms blamed for plunging his people into starvation. He described the policy, which led to thousands of white-owned commercial farms being violently seized in 2000, as a quest for "equity and justice."

He blamed the subsequent meltdown of Zimbabwe's economy on "hostile interventions" by "neocolonialist enemies" that have imposed sanctions on his regime.

Western countries have slapped travel bans and asset freezes on Mugabe and his top aides. The ban does not apply to United Nations summits and Mugabe has attended several Food and Agriculture Organization meetings in the last years.

While last year's FAO summit on soaring food prices rang out with denunciations of Mugabe's showing up at forums aimed at slashing hunger, the Zimbabwe president's speech on Tuesday was widely greeted with silence.

Italian news reports said Mugabe arrived on a private plane with a delegation of more than 60 people - most of them on the sanctions list and taking advantage of the UN summit to visit Europe.

Mugabe "has gallivanted around the world attending UN conferences and of course enjoying the food there when a lot of his people here are scratching the bottom of the barrel," said John Makumbe, a political scientist at the University of Zimbabwe. "It is a sanctions-busting maneuver. It's a shopping trip, taking advantage of the U.N. to actually get into Europe."

General Overseer of The Lord’s Chosen Charismatic Revival Church, Pastor Lazarus Muoka

General Overseer of The Lord’s Chosen Charismatic Revival Church, Pastor Lazarus Muoka has said most of the difficulties confronting Nigerians were symptoms of spiritual problems which need urgent spiritual solution.

He advised Nigerians not to lose hope despite the current unpleasant situation since God has the answer to the current hardship they were facing.

He said in spite of political uncertainty, economic downturn, armed robbery and kidnapping, Nigerians should look up to God for solution.

The cleric said his ministry had in pursuance of divine solution to the country’s problem put in place a two-day revival programme entitled ‘That yoke must break’. The event kicks –off this weekend at the Ijesha, Lagos international headquarters of the church.

According to the cleric, there is no other time that is suitable for deliverance than when man’s courage is failing and there are misery and hopelessness among the people.

"Indeed there is no other time suitable for total deliverance than now when the hue and cry of people throughout this year have so much dominated the philosophy of the citizenry of this country and dampened their sense of self-confidence to the extent that there is a total feeling of misery among the people," he said.

Muoka who spoke through his head of media, Pastor Louis Chidi, as part of revival programme which starts November 21, said the event was designed by God to free Nigerians from all yokes, stressing that the event would also witness a new dimension of the power of God that would bring the country into limelight in the midst other nations.

"The effect of this event will force the nations of the world to begin to see every Nigerian from a positive light and the country as a nation where bribery and corruption are frowned at, freedom of movement assured, security of life guaranteed", he said.

He said the country will begin to experience an atmosphere of freedom that would usher in breakthrough in all spheres of life. "Whether it is the yoke of barrenness, physical deformities or insanity, all shall be broken. The sick shall be healed, those afflicted by evil spirits will be delivered, the captives shall be set free, and the incurable shall receive the touch of God and be cured, while sinners will be led to Christ. The implication of this is that when the citizens are free, the whole country will be free because the siege will cease. This will be the benefits of Nigerians who will participate in the programme," he said.

He said there would be vehicles that would convey participants to and fro the venue the programme from any location in Lagos State at no cost, noting that traffic policemen have also been contracted to ensure free flow of traffic during the event.

My suggestion here is that, we all should join hands and fight that monster called corruption, and kill the brother called crime. No one should see one tribe to be more in it than the other. That way, it will be reduced, at least.

rethink:
The real mafia are the people in the NNPC. When OBJ tried to sell the refinery people kicked against it. The truth is that We Nigerians eat our cake and still want to have it.

We cannot deal with the refinery because they are an army in the NNPC they watch each others back. If you were given power to govern what would you do to an NNPC that has so much RANGER Spirit in ELITE PARASITISM.

Agreed the NNPC were not always like that they became very powerful during the Babangida Era.

If you have eyes watch very well. When OBJ tried take away the only thing(THE REFINERY) that they use to hold the whole Nigeria hostage remember what happened they teamed up threatened nigeria with a strike and so on and so forth. The refinery has never made any profit go and look most refinery in the world make profit.

When Yaradua came he had to abrogate the sale of the refinery. I knew that was a bad move some of the people on NL were very happy some were sad. The cartel is in the NNPC they are the ones that betray Nigeria. Send an angel to NNPC he will have a veery great task.

The reason for this started in the 90s when everybody wanted their kids to work in the NNPC after school. People did all that could do to put their people into the NNPC. The NNPC employed people as the refineries were grinding to a halt. We made the mafia we need to take the power of the Mafia Which is the Refinery and sell it to A NIGERIAN BUSINESS MAN.

We need to increase the price of fuel and allow the market force to take over the oil business. It wll be painful but we shall overcome .

God bless Nigeria
I see. I have always said NNPC is too powerful.
