Thanks so much. I got worried that the originating poster did not want to use her foreign nursing job experience cos she doesn't have Canadian license yet. It appeared to me, she might have more years of foreign experience which will boost her applications scores plus the Canadian experience. I dont know why she does not want to use both experiences in the application. License seems not to be an issue with IRCC. License is a big thing with some PNP.

Please does anyone know if Bachelor in Theology from Bigard Memorial Seminary, Enugu is evaluated as degree for Express Entry ECA? (It is 4yrs). Also, their Philosophy degree (3yrs)? If yes, please which of the evaluation bodies favours them more?

Bigard is an affiliate of some Catholic university in Rome (Pontifica Urbaniana University), but I don't know if this helps as Bigard is still the main school. Any ideas on this?

Some Priests I know (Spiritans) who studied in that school and went abroad for further studies got their certificates evaluated successfully, so WES is apt for you for the purpose of express entry. You may want to do a quick search on WES website. But I can bet you're good.

Pls if this person can apply for this NOC despite being regulated why would he or she run away from nursing cos it is regulated? I just want to know what makes the regulations for nursing different from medical laboratory assistant/technicians/technologists as the case may be, that can make people without Canadian license apply? I want to use CEC to get PR but I just realized I have no clue what the NOC code will be. It can’t be nursing since I’m not registered but I was hired because of my naija nursing experience you get. I’ve searched everywhere through Nairaland for pointers but to no avail. Pls help if you have any idea. job description s basically testing people for COVID and processing results. Thank you
At what point does IRCC request and insists on evidence of Canadian license when one told them no Canadian license when creating the profile and still got ITA?

WOW! Congratulations.... Some people's mails never got response after rejection. Congratulations once again.

So after she sent a new reference letter with all the duties and other formats. The VO still asked her to prove a duty was done despite her employer stating it was done? Nawao!!

Big thank you to @GraciousWords @Betterlife2018, and everyone else that responded to this. My sister got her ready for visa email today.

To be fair, her initial letter was not the best, but we wrote back to all the IRCC emails we could find to beg them to reopen the application, flagging that the letter said she was paid and highlighting the part of the letter that showed her role description even though it was a very vague sentience. One week later, she got new letters for all her jobs with specific bullet points for her duties and her exact salary and sent it to all the emails again with plenty of story mapping each Job description from the letter to what it matched in her NOC. The document was about 20 pages.

About three weeks after the first email, she got a letter from the VO saying he had some concerns about another job from her application, and they needed evidence that she did the duties in her letter. Wahala

Luckily for her, she still had access to her email from the Job, so she got emails and documents she worked on and created a doc for the VO. We connected each bullet point from the Job to an item in the NOC and attached evidence from her work email to back each one up with explanations. This was another almost 30-page document.

Two days after sending this doc, she got another letter telling her, her application was reopened, and her application went back to being in progress. A little over a week later, she got another email asking her for Form A, family info form, updated funds, and new police certificates. She sent that over this past weekend, and she got the ready-for visa email today, two weeks after the application was reopened.

I am sure she will post with more exact timelines here, but I wanted to respond to this because it was hard to find information on reconsideration requests when we started the process, so I want people to know that even if you made a mistake and especially if the VO made a mistake, you can challenge IRCC with evidence without a lawyer after a refusal if you were eligible for all your points when you submitted your application; This whole process took six weeks and was much cheaper than submitting a new application financially and time-wise. IMO, march is okay. You may add recent payslips to cover for any perceived gaps.

IMO, it is only information that's needed to confirm if the spouse is truly unaccompanying. My concern however is, why would they want to confirm again since the application already stated it?

25% of your pension fund is what you are entitled to. The issue with pension letter is the clause that says it becomes accessible to you after 4months of disengagement of duty. We have heard stories of some VO raising concerns on that cos they expect you to have unrestricted access to the money but in anyways, pension fund has been successfully used by very many people.

Another option is if you have someone outside to pay for you. But when eventually you are to refund the person, it is most likely going to be via black market. So escaping black market in all options is not likely. Quite annoying to be honest.

Just like I mentioned earlier, he certainly has a very strong case but he's not inclined to seek judicial review. Like you mentioned too, I guess he wasn't psychologically prepared for the stress and cost of the review.

More instructive, was the fact that he's putting the blame on himself cos the period the ITA came was quite busy for him and he couldn't fill the form himself. Someone had to help him with it. So he is feeling guilty of negligence.

Yes it's better to be submitted, scan your ECA with your certificates all together in a pdf and upload under education section.

This is just healthy banter and hopefully for the benefit of those who have not submitted their IELTS and ECA.

The ECA point you make about checklist not asking for scan of ECA report is right. However, the Immigration Act actually asks for the ECA and IELTS reports to be provided not just reference number, this point was clarified in FAQ 45.

It remains to be seen how their courts will adjudicate the matter in a judicial review if an application was rejected due to missing ECA because the applicant was following the checklist only.

Will the judge side with the applicant based on this or refer the applicant to the Immigration Act which IRCC provided access to by telling us how they assess applications against R75 (https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/permanent-residence/economic-classes/federal-skilled-workers/assessing-applications-against-minimum-requirements.html)?

I don't know, as we haven't seen a judicial case on this matter...also the upload instructions for Education do not explicitly state ECA and IELTS. Someone needs to take them to court for us to be certain (like they did for Law degrees, WES and professional degree points).

Based on that I see where you are coming from regarding spouse ECA and WE.......you are scared of see a rejection for something they didn't ask for but eventually claim they needed, which is fair.....I just might need to see a therapist after going through EE..... smiley

Yeah very healthy banter indeed and worth the time. It is motivating to know that you could now view the concern from my Prism.

The Guy's case I mentioned, his was actually returned as incomplete application cos he didn't upload scan copy of ECA. Unfortunately, all his pleas and ECA uploads via web forms were not considered.

He did not even get to know his VO, his application was returned under a month. When he was not getting any feedback from IRCC, a new EE profile was created. He went ahead and complained to the province that issued him nomination, they told him they won't link the nomination to his new profile.

In the long he has taken it in his stride. He was not inclined to try a judicial review, even though he has a very strong case.

Indeed VO decision can be very subjective so it makes treatment of file case specific especially on issues with gray areas. That's why I didn't want to take any chances and err on the side of caution, rather be hyper than deficit cheesy. Thankfully, testimonies abound on both sides so we keep hope alive and wait it out.

After scaling EE application, reinvigoration is necessary smiley

I think I understand the initial poster's concerns and they are valid to be honest. IRCC does requests those info and through people's experiences over the years, many now know how to circumvent this situation. I also didn't know about omitting spouse's education and work even though I wasn't claiming points for them. So I actually uploaded spouse's degree cert in the place holder for education and employment letter in place of RL, then I believe my LOE stated that we don't have an ECA and RL for accompanying spouse because I wasn't claiming points..and my Eligibility was passed without ADR. Now, that's my own personal experience.
Good to know your credibility was passed with ADR. I honestly wish to know why IRCC will put that section there even when applicant can not claim points. With the subjectivity level of VO, anything is possible.

I think if you take time to re-read you’ll see where you’re mixing things up. Ednut has gotten ppr and landed. Gracious and myself have crossed this hurdle and awaiting ppr. So atleast read the advise given, go back and cross check with ircc website and if after everything you’re not convinced still, then carry on as you please.

You do not need to input spouse work history in the WE section, only in personal history. You can include spouse education +ECA+IELTS if claiming points for it. You only include work experience that you the applicant are claiming points/gotten reference letter for in the WE section. All other WE not claimed can go in personal history. Same applies for education. If you do eca for masters only, upload eca, msc and ielts in the provided box. All other studies go in personal history. Don’t stress or confuse yourself or VO.

Thanks, I have actually submitted weeks before now. I only wanted to give heads up to new applicants cos I thought there is a change. But obviously the elders here are saying I should not have put anything in spouse foreign work experience even though it was asked and that it is only ECA and certificate for degree ECA was done that should have been uploaded rather than all post secondary as requested in document checklist. This is in order not to confuse amateur visa officer. Points noted.

For people coming behind to have the right information..... IRCC has given us checklists to use ......staing exactly what docs are needed, why they are needed and who should provide.

Very useful info being shared on NL, WhatsApp and Telegram...but always cross-check with IRCC webpages.
The non canadian work experience for spouse was in a separate section, in the column for just the spouse. After one said No, to spouse Canadian work experience, you still meet this section. I saw it. I had to crosscheck again and again when i noticed document checklist needed spouse WRL, while I had the notion I wont be asked. I did lots of research on NL and cadavisa and it's majorly that they won't ask me for it. Finally, I had to upload spouse WRL since it is in the checklist and I neither picked nor have score for spouse Canada work experience.

I felt i should alert new applicant hence my originating post cos my concern is, if spouse foreign work experience is not important, why put it there again?

About IRCC checklist, I got talking with someone whose application was refused cos he didn't upload his ECA document, meanwhile it is not in any IRCC checklist for it to be uploaded. What they said is, it may be requested later on. So when you see issues like this, one won't want to leave any stone unturned.

Show me where the bolded is stated because it like na another express entry i apply o, because I listed my bsc and 3 other certifications in personal history meanwhile my eca had only bsc and ican aat. You should start reading this thread from part 1. Its people like you that will provide 10 job references instead of providing one or two that have met the 3 years maximum. I cant deal bro lol
In the checklist for education document. It's stated that you MUST PROVIDE proof for all post secondary education. Examples of education include any diploma or degrees. I provided proof for my first degree and other post graduate degrees. Even though I only have ECA for my highest degree.

If you read page 1 very well, one is advised to even upload copy of ECA and IELTS together with all the post secondary school documents.

The EE system typically asks you for documents depending on what you have completed.

If you complete WORK EXPERIENCE/EMPLOYMENT HISTORY for spouse, it will ask you to upload docs...whether or not WORK EXPERIENCE/EMPLOYMENT HISTORY is in Canada.

The system expects that since they have already told us that spouse non-Canadian WORK EXPERIENCE/EMPLOYMENT HISTORY gets ZERO CRS points then it should be included in PERSONAL HISTORY not WORK EXPERIENCE/EMPLOYMENT HISTORY. This is what most people do.

If someone updates nil for spouse WORK EXPERIENCE/EMPLOYMENT HISTORY but IRCC still asks for docs for details updated in PERSONAL HISTORY (I'm extremely surprised that the system would so this though), then statement in red is most appropriate IMO.

There is a section for spouse foreign work experience (as in work outside canada), even though they know it does not add any point (this is different from Canadian work experience and it is about spouse not the principal applicant).

If you skipped that part and went to personal history to fill jobs for spouse, you say the fear of being considered inconsistent is imaginary? Remember one had to provide documents to show proof for schools claimed under personal history even without ECA? Should not one wonder why there is mandatory need to proof school and not also job claimed? Meanwhile their interest is in skilled WORKERS!

Anyways if for whatever reason you dont want them to know that your spouse has any work experience outside Canada, won't it be better to stay on that lane, clean all through, rather than ignore it in a section and say the spouse has work experience in another section?

Is their question seeking to know if one's spouse has foreign work experience irrational/irrelevant and deserves no response?

Lastly, i'm surprised you feel my question and fear about inconsistency is imaginary. You also insinuated that I am not being sensible. I think we can address one another more nicely. I was only asking questions and expressing concerns so that everyone can learn to avoid latent surprises.

There is a contradiction I noticed now from IRCC, when uploading documents during e-APR.

Hitherto, spouse isn't required to upload work reference letter if Canadian experience is not claimed.

But now, once your spouse claims foreign work experience outside canada and it is added in Personal history. The document checklist will require spouse to upload work reference letter. Even though, the work experience was not gained in Canada but a foreign country.

This is to give heads up to new applicants to know how they will navigate it.

I read somewhere and someone advised that a screenshot of IRCC guideline stating WRL not required should be uploaded (makes sense). But IMO, if spouse WRL can be gotten it should be gotten please.

Do what will give you peace of mind.

If you sincerely feel your letter is deficient update it via webform. It costs nothing to send a webform IMO. A document you send by webform should supercede a previous one supplied. You can send the same document weekly until you get confirmation via mail that it has been updated on your file.

If you are satisfied your WRL is ok, then leave it as is.

Pls read page 1, crossing PNP and crossing IRCC are not the same. Again, there are examples of people that crossed PNP and did not cross IRCC due to NOC, one of such is on page 1.

Ps: given what you wrote in red, how did you then choose your NOC?

Thank you very much, I have read page 1, saw the refusal cases and even perused some NOC related judicial reviews, i noticed the cases had more obvious loopholes than mine.

To your question quoted in red, I chose my NOC based on Job title (Medical laboratory technologist as it is called there and medical laboratory scientist as it is called here, so it's pretty straight forward to conclude) and leading statement nailed it . But for some inexplicable reasons, I didn't get to see their own listed main duties at the time. In my mind, I concluded that it's that leading statement that one is expected not to copy and paste.

This kind of panic is normal post submission. Your letter seems okay from what you’ve described. Join telegram/WhatsApp groups with people of the same AOR. When they start passing eligibility, call or order gcms notes to see if you’ve passed too. Imo you should only send the second letter if your eligibility is taking too long to pass or gets a review required.

Alternatively, try to find someone who can assess nocs or who’s gotten PPR with the same NOC so that they can go through your letter and tell you if it’s okay for real or if you need backup.

Is there any document to show for separation? Oftentimes, separation is regarded as a temporary or short term measure, in which case in my opinion you'd have to add spouse POF.

If it's a case of divorce, the divorce certificate would suffice and there may be no need for adding the spouse in POF.

Hi folks, I submitted my application a couple of days ago. It was after I submitted that I got to read some cases of rejection due to NOC duties.

When I got my work reference letter (WRL) for PNP, I followed the format of IRCC basically, and wrote the common daily duties I do at work not knowing that there was a specific duty guide which must be substantially covered even though they don't want copy and paste.

I used same PNP letter for IRCC but now looking at the duties on my letter vis-à-vis IRCC duty guide for my NOC, I feel the duties I used could possibly be considered not substantial enough, depending on who is assessing it, even though I listed up to 7 and none is off but some may be put together to mean One and if that's done, role meaning to role meaning, it'd be about 40-50% as compared to the main duties in IRCC guideline. The lead statement, essential duties and other formats are completely covered though.

Someone said, since I have crossed PNP and it is not as if the WRL is obviously defective except maybe on very critical scrutiny, I should not bother. Rather, it is my Medicals, criminality and POF that would be thoroughly scrutinized the most, except if there is a large gap in other areas that PNP missed.

My question is, should I just wait and pray that my application doesn't get to an over strict assessor or is there something I can do, possibly submitting a new reference letter via web forms. I hope a new WRL won't raise eyebrows and now draw undue attention to my relatively okay WRL while they turn blind eyes to my web forms containing the new WRL?

Sorry for the epistle, I wanted to be as explicit as possible. I want to hear advice on this pls to help me make informed decision. Thanks.

Awesome testimony! What was the former officer erroneously claiming you did not have or include in your POF? Chai, one is just at the mercy of these officers' decisions.

I am a living testimony of rejection in Aug 2019 and PPR Oct 2019. Mine reason was for POF though.
As Graciouswords as suggested and others as well, please do.

I was sending webform everyday with much apology , begging and I attached supporting document to correct the said error,
I was also sending mails daily to available email address that I know are in charge of PR application
I also called IRCC to challenge them that I was not given opportunity to defend my self as written in their law that procedural fairness should be allowed when an officer is in doubt and the applicant should be given chance to explain any area in which the officer needs more clarity

I did this continuously daily for almost two weeks and backed it up with prayer and fasting.

Application was reconsidered and they officially requested new documentation and gave us 7 days to respond. We did and PPR came.

After my approval , I ordered my notes and saw that the VO was changed for the reconsideration and it was stated in the GCMS notes that my rejection was due to officer error.

Never lose hope: make sure you do it right now, address the error, prepare new letters and start sending both webform and email daily. back it up with prayer and they would respond. God's favour all the way

May I ask what document did you put initially to show relationship?
