Don't pay nothing ... how can an employer enforce you to pay when you left . I would like to see how this works in reality

I think people pay because they think they must pay but if you don't pay I think nothing happens
We are still discussing, they have clearly stated that she has no obligation financially with them if she chooses to leave them.

They conditions is that If she says she is not going on the transfer with them, they company will pay her 3 months salary in advance and terminate her visa immediately.

My new worries is getting a sponsorship job, COS and Visa in 60 days.
We are currently job searching and believing it will happen before the middle of December.

Thank you everyone here for encouraging us with information.

Check your rent contract properly, most I know is 6 month termination period with a month notice both ways (from you or from LL). Unless, yours is different

I also think You should be able to move house with your energy and Wi-Fi contracts.
I will check with my Energy supplier and wifi.

We pay rent 3 monthly upfront payments. Currently, the one we have paid will expire January 8. We are supposed to pay again by January 9 for 3 months till April 8.

I will check the contract and speak with the letting agent too by nexg week.

Thank you everyone for advising us on this issue.

To answer some questions raised.
1. Taxi fare is commuting to and fro work to the new location.
2. Her Employer is a Private Healthcare Provider with over 130 Carehome across the UK. Not an NHS.

Her Union Requested for the contract and the Notice of transfer and RESPONDED THUS: The contract has broad mobility clause in it.

The stated reason for this particular transfer is Redundancy as a Result of shutting down the Nursing Unit of the Carehome.

My worries on this Redundancy cum shutting down the Nursing Unit is this.

1. You transferred her 6 months ago knowing that the home has been struggling for years.
2. You told her on the 2nd of this month about shutting down the Nursing Unit and transfer to another city within the next 26 days.

I appreciate all the help i have gotten on this and others still going to chip in on this.

Receipt?
Yes I have an email. Where the international Recruiter said since "your manager said she doesn't want you in her home". It was not just her they were 3 Black Nurses one from Zimbabwe Resigned and paid them back, my wife and the other guy from Nigeria got transferred to Newcastle and Durham respectively.

One of the other International recruiter said I don't know why she doesn't like Black Nurses in her home.

Baba this is bad and I suspect it is worse than you have stated. This is the UK and you have a very good case for leaving the contract and even get compensated sef. The unions can help you as someone stated but you can explore the angle of mental health and constructive dismissal (TheHRguy may know anout this)
Thank you baba.
Please how do I go about the mental health and constructive dismissal Angle.

I will love explore every possible options.

Following them to Sunderland or Durham is a no no for me as jobs are very limited in those areas.

How do I force their hand untill April is my challenge now.

Do they pay for relocation? Was this a condition in your contract?
If not, you are not obliged to move. Even to move office sef, emplyers have to take it easy with employees not to talk of transfer. And if it's in your contract, you and your family's mental health and stability is a good enough reason to decline, in my opinion.
We don't want to move to any of these places.

Our plan now is to leave them. (3 transfers within one year is unsettling).

They don't pay for this relocation cost, what they do is pay for deposit and first month rent and charge it back for you to pay back small small.

But these are my major challenges with leaving them immediately and also leaving Newcastle as Newcastle do not seems to have a lot of Nursing roles with Sponsorship.

Below are why I am thinking it will be expensive leaving Newcastle Now.

1. We have got tenant contracts that will end April 8 2023.
2. Energy Contract till April 2023 exit fee £300.
3. Wifi Contract till April 2023 exit fee £150.

So the earliest I think we can leave Newcastle is April 2023.

Thinking of what to do between now and April 2023 is mentally draining.

If we accept to go to any of these places in the interim (Which is likely the only option we have now), while looking for job with sponsorship in Manchester or Liverpool or Leeds (I believe they will be more opportunities there especially for me, It was hard for me to find job here in Newcastle due to my family situation and were we live), The cheapest she would spend working 14days a month with taxi is £980. This will put alot of financial burden on us.

In her contract, if she leaves before 3 years she will pay back a certain amount, her colleague left after 6months and she was asked to pay back £4,500.

How do I sail through this turbulent sea.

Can her Union force them to pay for this taxi fare?.

Please dear Ancestors i need all the Advice, help and Encouragement now.

Thank you boss. They have this morning given her an option of yet another transfer to either Durham or Sunderland.

This will be the fourth transfer under one year with them, we never asked for any, and this has been affecting my children and myself work wise, We keep moving because the pay back clause in the Job Contract.

Now that this is not our fault, she is considering switching employer but I do not wish to pay them anything because this whole move here and there are no fault of hers, its affecting her mental health, the kids mental health and my mental health as well.

What is the best way to approach this situation so that we will not pay them back anything.

Truth is my tired is tired of this their inconsistencies.

Dear Ancestors, I have come again with my questions.

My story:

Wife is a Nurse on Tier 2 visa, her employer gave her offer and posted her to Aberdeen, after getting her visa, she was transferred to Edinburgh, getting to Edinburgh and passing her final exam and became full UKRN, her manager said she doesn't like her and as such requested for her to be transferred. (Note only her the 3 black Nurses were all affected).
She was transferred to Newcastle and we have been here for 7 months.
Today her Regional manager informed her that this present Home is going to shutdown by December.

This may mean another transfer?.

This whole thing is affecting our settling down properly and it's mentally draining to say the least.

Please I need advise on how best to Navigate this issue.

Hello family.

Mighty thanks to everyone who's contributed positively to this thread so far. I have a question.

Does a dependent still need to show financial evidence even if the main tier 2 visa holder has a COS from his employer.
It depends.
If your employer ticks maintenence for the applicant and dependants. You don't need POF.
But if the employer says maintenance is only for the applicant, then Dependant needs to show POF. For a Spouse and two kids, you may need about #2m.

Your limit for the lifetime ISA is 4,000 per year. If you reach the 4k in Feb next year, you can't pay in any additional money because February 2023 is still within the tax year of April 6 2022 - April 5 2023. You can only pay in another 4k from April 6 2023, after which the bonus should be paid in time for you to buy in June.
Ok thank you. April 6 2023 booked.

Just to add a couple of points on this discussion about LISAs, because I think they offer the best option for first time buyers now that HTB has been shut.

Although it works on an annual basis, it's not the traditional January - December year. It's the tax year, which runs April 6 - April 5.

What this means is that hypothetically (though they advice you give a week's allowance to be sure the funds settle), on the 5th of April 2023, you can put in 4k and get the 1k bonus, put in another 4k on the 6th April 2023 and get 1k, and then on April 6 2024 put in 4k and get another 1k. That would mean you've put in 12k and gotten 3k free in the space of just over a year, because the bonus takes a month or so to come in after the final payment.

Second thing is that your LISA has to be active for a year before you can withdraw from it to make a purchase without losing the 25%. So if you're looking to buy in less than a year, rethink opening a LISA.
Abeg does this mean that as a current LISA account holder, i can do extra two direct deposits on April 5 & 6 2023 and buy by say June or July.

We currently have a running LISA that started in March this year each account will hit the 4k mark by Feb 2023. So If we pay 8k between April 5&6, it will become 10k by end of April 2023.

Nor vex for my haphazard kwetion.

Good evening ancestors. Thank God that the gbas gbos of student this and that are over.

I want to know something about the tier 2 visa,

If the main applicant (Health and Social care), becomes a dependant to the former dependant (IT sector) of the same tier 2 visa, Will it affect their time for ILR?.

Will their time reset to year 1. OR they can continue counting from the H&SC visa.

I hope i made sense.
Thank you my people, my people.

1 - Yes you can add the LISA to the deposit.

2. The biggest issue with this is that the bank will only take your earnings into consideration which will of course reduce your purchasing power. Secondly If you have a joint account and any money is coming from there or sugar's account for the deposit, your sugar will have to either declare (signed and noted by solicitor) that the money is a gift to you and that they have no stake at all in the house. Thirdly buying in separate names does not reset the first home buyer advantages unless you're not financially linked in any way. It will have to be a completely arms length transaction.

My advice - buy the first one jointly as a family home and you can play shenanigans with any subsequent purchase.
Thank you mma Ticha.
We will buy together. Na to look for Village to call home in the NorthEast be that.

Please do you know if we can transfer our esusu money into our LISA account, Like Block £10k at once without issues.?.

Nor vex say i dey ask to many question.

Option 3 if you are capable, followed by option 1 if 3 is becoming a challenge. Option 2 is a no no if you can help it.

Yes you can pay off the loan if you have the means within the 5 years interest free period.

No HTB is not public fund. It is a loan, Govt has a stake in your home. Remember when you are paying back, you'll be paying the 25% of the value of your property when you come to sell and not actual amount you took from the government.
Thank you for your advice.

Will I still pay the 25% value of my property even after returning their money.

Confirm that you don't need ILR for no 1. Definitely flee from no 2.
If you don't need ILR for no 1, and you are disciplined with money then go with that but you will not be able to buy another property ie one to rent out until you've paid off the government loan. So it also depends on your long term plans
Thank you our Ticha.

Yes we do not need ILR for option one.
With our planning and projection, we will be able to pay down or pay at least 80% of the Government loan before the five years expires.

Secondly we have a Lisa account that will be one year by February 2023, we intend to draw from the Lisa to add to our deposit?.

The plan was to use only my sugars name to buy the first house and later use my name for our second which obviously will be a buy to let but the challenge is I cannot use LISA for a buy to let according to what is written on their site. So thinking of Buying the first together pulling our Lisa together.

Thank you for your advice.

Good evening ancestors.
Thank you for all the advice and survival tips you always drop here for us.

Please na property advice I want this time.

Please I need to know which is better between the following
1. "Help to Buy Scheme."
2. Shared ownership.
3. Saving up my 10-20% Deposit.

I understand that for a Help to buy, one do not pay interest for a certain number of years.

Is it OK to pay the Government HELP off within the non Interest paying year, if one is able to do so?.

Secondly, Is the help to buy scheme classified as Public FUND as we are not entitled to public fund.

Thank you dear worthy ancestors.
