The drama trailing the 2016 budget in the Senate continued Thursday with stunning assertions by the Senate leadership.

The troubling revelations came after over two hour closed session where the lawmakers were said to have “thoroughly discussed and taken far reaching decisions on the budget.

After the closed session, Senate President, Abubakar Bukola Saraki, announced that the secret meeting centered on the controversy surrounding the 2016 Appropriation Bill.

He also recalled that they mandated the Senate Committee on Ethics, Privileges and Public Petitions to investigate the matter in order for the Senate to take an informed position.

Saraki then dropped the bombshell.

He said that the Senate discovered from the findings of its Ethics committee that the Senior Special Assistant to the President on National Assembly Matter, Senator Ita Enang, printed and submitted to the Senate a different version of the 2016 budget.

He said that what Enang submitted to the Senate was against the original copy of the Appropriation Bill presented by President Muhammadu Buhari on December 22, 2015.

Saraki did not stop there.

He said that the Senate resolved not to work with a version of the Appropriation Bill not laid before the National Assembly.

He added that the Senate also resolved to consider only the version of Bill presented by President Buhari as soon as they receive soft copy of the original document from the Executive.

He said, “We have received the report of the Committee on Ethics, Privileges and Public Petitions on investigations surrounding 2016 Appropriation Bill.

“Our finding is that Senator Ita Enang, the Senior Special Assistant to the President on National Assembly Matter (SSA) printed copies of the 2016 Appropriation Bill and brought to the Senate.

“We have discovered that what he brought is different from the version presented by Mr. President.

“We have resolved to consider only the version presented by Mr. President as soon as we receive soft copy of the original document from the Executive.”

Chairman, Senate Committee on Media and Public Affairs, Senator Aliyu Sabi Abdullahi also addressed reporters immediately after Senate plenary to throw more light on the claim of a fake budget.

Abdullahi spoke in company with the Vice Chairman of his committee, Senator Ben Murray – Bruce.

He said, “We are here to update you on an issue that has been awash in the media. We are here in continuation of what we have said earlier that the report about a missing budget is not true.

“We don’t have a budget that is missing and we still maintain that we don’t have a budget that is missing.

“But you recall that the Senate President did inform Nigerians that there is issue that a committee was asked to investigate.

“The report of the investigation by the committee on Ethics, Privileges and Public Petition has been submitted in the Executive session because it was a decision we took in the last Executive session on Tuesday.

“Now our findings are this, that Mr. President did lay the budget in the Joint session of the National Assembly.

“Thereafter, the Senate went on recess and upon resumption copies of the document were produced by Senator Ita Enang, who is the Senior Special Assistant to the President on National Assembly Matters for Senate and copies were submitted to both the Senate and the House of Representatives.

“What we found out is that the document submitted by Senator Ita Enang upon our resumption has some differences and discrepancies with what was originally laid by Mr. President in the joint sitting of the National Assembly.

“However, the Senate in defence in its integrity and honour will not work with what has not been laid in the National Assembly.

“We are constitutionally mandated and duty bound to consider only that budget that has been so laid by Mr. President.

“Right now, for reproduction, we are awaiting the soft copy of the originally submitted budget so that the National Assembly can reproduce copies of the budget itself.

“Because if we reproduce ourselves, then we have confidence in the fact that what we reproduced is what was originally submitted to us.

“The institution of the Senate will not and cannot do anything that is illegal. We will not do anything that will not promote the unity, integrity and welfare of Nigerians.

“Some people were saddled with the responsibility to find out what happened.”

Abdullahi reiterated that “the budget submitted by the President is not missing, “we already have copies of it but what we are saying is that for us to reproduce for our members, it is easier, based on the quantum of document that has to be produced, that we get the soft copy of that original version so that we can reproduce it.”

He insisted that “by next week, we want to go down to business, Senators have picked dates to speak during the three days set aside for debate of the 2016 budget.”

Abdullahi also said that the Senate leadership was mandated to speak with all those concerned with the document saying “that was why the Senate President was in touch with Mr. President.”

The Senate spokesperson however refused to speak on the claim by the House of Representatives that it had its own original version of the fiscal document.

He also declined to say what amounted to the differences spotted in the version of the budget submitted by Enang and the original version presented by President Buhari.

“I am not in the position to say the differences between the document submitted by the President and the one brought by Ita Enang. The committee that investigated the issue did not include that in their report,” he claimed.

Abdullahi said that as at the time the Senate President promised to make copies of the budget available to Senators Thursday, “he was working on the assumption that what were brought by the executive were copies of the original copies submitted by Mr. President.”

He noted that “but based on the outcry, it was discovered that there are another version different from what the President gave us.”

The man at the centre of the controversy, Senator Ita Enang, refused to respond to what the Senate President said.

Enang told anxious reporters who crowded his office that he does not want to join issue with the Senate.

Some Nigerian senators said Wednesday they are suspicious the Nigerian presidency is behind the sudden disappearance of the 2016 budget submitted to the National Assembly.
The lawmakers said the intelligence they had so far gathered suggested that the presidency discreetly withdrew the documents to enable it to make some adjustments to it.
The president had presented the budget to a joint session of the legislature in December.
PREMIUM TIMES had reported Tuesday that the senate, during an executive session, declared the documents missing.
The Senate Leader, Mohammed Ndume, sources said, informed the senators, upon resumption from the Christmas/New Year break, that deliberations on the budget could not commence until fresh copies of the documents were obtained from the presidency, Ministry of Finance or its national planning counterpart.
However, some senators, who requested not to be named so as not to anger the presidency, told PREMIUM TIMES they had since realised the budget was discreetly withdrawn by the president in order to make some adjustments.
The senators said the presidency had in the past two weeks been combing through the budgets with a view to removing provisions that had so far exposed the administration to ridicule.
“The executive have now started delivering fresh copies of the budget documents to the National Assembly,” one of the senators said.
“The details in the copies they are delivering are different from those in the version delivered to the National Assembly in December. Some adjustments have been made.”
But the presidency has however denied withdrawing the document.
The Senior Special Assistant to the President on Media and Publicity, Garba Shehu, said only Mr. Buhari could withdraw the budget but had not done so.
He suggested that the issue of missing budgets should not arise because several copies of the document were sent to the legislature.
“Nobody except the president can withdraw the budget; as far as we know, he hasn’t done that,” Mr. Shehu said in a response to PREMIUM TIMES enquiry on the matter Tuesday.
“The copies in their hundreds have been delivered to both chambers of the National Assembly.
“By tradition, once the budget is submitted, it ceases to be our property. Inquiries should be directed to the appropriate quarters.”

When contacted, the Minister of State for National Planning, Zainab Ahmed, expressed shock at reports of missing budget.

She explained that ahead of Tuesday’s resumption of the Senate and House of Representatives, more than 400 copies of the document were delivered to the two chambers on Monday by the printer, for distribution to all members.

“After the official presentation of the budget by the President on December 22, 2015, both hard and soft copies were given to some key members of the Assembly. How can anyone say all the copies are missing?” she said in an interview with PREMIUM TIMES.

“Immediately after the presentation (by Buhari), most of the members went on break. But a printer was given the job to produce the document for distribution to all members on resumption.

“On Monday, the printer delivered more than 400 copies to the National Assembly for distribution to members and their aides. Another 100 copies were delivered this afternoon (Tuesday). Therefore, the same budget cannot be said to be missing.”

Mrs. Ahmed argued that if there is need to withdraw the budget, the same process with which it was presented by the president to the legislature would be followed.

The hard and soft copies of the 2016 budget documents President Muhammadu Buhari handed over to the National Assembly on December 22, 2015 have been declared missing, PREMIUM TIMES can authoritatively report today.
The Nigerian Senate was scheduled to commence deliberation on the proposed budget Tuesday (today).
But Senate Leader, Ali Ndume, shocked lawmakers at a closed-door session, when he told them the budget documents had been stolen, people familiar with the matter told PREMIUM TIMES.
Mr. Ndume, our sources said, explained that deliberation on the budget could therefore not begin until fresh copies of the documents were obtained from the presidency, the Ministry of Finance or that of national planning.
The Chairman, Senate Committee of Appropriation, Danjuma Goje, was subsequently mandated to lead a search for the documents and liaise with the presidency, the Senior Special Assistant to the President on National Assembly Matters, Ita Enang, and the national planning ministry on the matter.
The Senators also resolved that the matter be kept under wraps, saying making it public could embarrass the presidency, the National Assembly and the country.
Our sources said senators of the Peoples Democratic Party accused the presidency of being behind the theft of the documents, an accusation rejected by their All Progressives Congress’ counterparts, saying it was too early to speculate.
Some lawmakers told PREMIUM TIMES they are suspicious that the presidency might have colluded with the management of the National Assembly to quietly withdraw the documents after detecting some discrepancies in them.
“Can you imagine this kind of national embarrassment?” one senator asked. “Documents that were presented to us with fanfare have been stolen.”
The spokesperson for the senate, Aliyu Abdullahi,could not been reached for comments. So also is Mr. Goje, the chairman of the appropriation committee.
President Muhammad Buhari had on December 22,2015 presented a N6.08 trillion budget for the fiscal year 2016 to a joint session of the National Assembly.
It was the first time in three years a Nigerian President would personally present a budget before the National Assembly.
But weeks after the budget was presented to lawmakers, there were speculations that Mr. Buhari had withdrawn the documents to enable him to correct some discrepancies, a claim the presidency and the national planning ministry denied.
In the budget, capital expenditure takes N1.8 trillion, marking a significant over 300 per cent increment from the 2015 vote of N557 billion.
According to the estimate, N396billion is voted for education, being the largest sectoral allocation.
The health sector gets N296 billion while defence has N294 billion.

For 16 years that the Peoples Democratic Party was in power, the federal government exhibited total contempt for the Rule of Law. The Constitution and other laws were breached with impunity while court orders were disobeyed on a regular basis. In the famous case of Attorney-General of Lagos State v Attorney-General of the Federation (2005) 2 WRN 1 at 150 the Supreme Court held that "In our democracy all the Governments of this country as well as organizations and individuals must kowtow to the due process and this they can vindicate by resorting to the courts for redress in the event of any grievance."

One of the reasons why Nigerians voted for the candidate of the All Progressive Congress, General Mohammadu Buhari (rtd) during the last general election was his promise to fight corruption and end impunity in the country. Upon winning the election, President Buhari further pledged to abide by the Rule of Law. To that extent, he has a duty to ensure that all organs and officials of the Government operate within the ambit of the law. In particular, he should not allow overzealous security personnel to engage in any form of impunity and thereby expose the Government to unwarranted embarrassment.

In July last year, the State Security Service (SSS) searched the private residence of former NSA, Col Sambo Dasuki (rtd) at Abuja. When Col Dasuki alleged that his house was illegally searched, I pointed out that the action of the SSS was justified as there was a search warrant validly issued by a magistrate court in the federal capital territory that authorised the search. He was eventually charged with money laundering and criminal diversion of huge sums of public fund before the Federal High Court and the Federal Capital Territory High Court at Abuja. Notwithstanding the gravity of the offences, both courts have admitted him to bail. But after he had met the bail conditions the SSS decided to rearrest him at the gate of Kuje prisons on the ground that investigations have not been concluded in respect of other criminal allegations.

The decision of the SSS to ignore the order admitting Col Dasuki to bail coupled with the failure to re-arraign him on fresh charges is tantamount to impunity in every material respect. If the federal government were aggrieved by the order admitting Col. Dasuki to bail it should have challenged it in the Court of Appeal. Much as the Nigerian people are fully behind the Buhari Administration in the patriotic move to recover the looted wealth of the nation, the federal government should be advised to ensure that the procedure for the loot recovery meets the tenets of the rule of law. The SSS and other security agencies should therefore refrain from allowing corruption to fight back by playing into the hands of the criminal suspects who have committed crimes against humanity by diverting money earmarked for the procurement of arms and armament to fight the terrorists.

In the same vein, the order admitting the leader of the Indigenous People of Biafra, Mr. Nnamdi Kanu, to bail should also be complied with. If the federal government has other charges against both suspects it should file them in the court. There is no provision for keeping criminal suspects at the pleasure of security officials. Meanwhile, all valid and subsisting orders made by courts in favor of criminal suspects should be obeyed without further delay.

To ensure that suspects are no longer held in custody in any part of Nigeria without any legal justification section 34 of the Administration of Criminal Justice Act has imposed a duty on each the Chief Judges to designate a Chief Magistrate and a Judge of the High Court to visit all police stations and other detention centers within their jurisdiction, at least once a month. During such visits, appropriate directives shall be given while any officer who detains any person illegally will be sanctioned.

The Peoples Democratic Party (PDP) has again demanded the release of Olisa Metuh, its spokesman, alleging that he is “inhumanly kept in an underground” cell by the Economic and Financial Crimes Commission (EFCC).

The party said the continued detention of its spokesman by the EFCC without a charge clearly showed the dictatorial character of the President Muhammadu Buhari-led federal government.

In a statement signed by Victor Kwon, its national legal adviser, PDP stated that “relying on a purported ‘holding charge’ said to have been derived from a magistrate to detain Chief Metuh beyond the statutory period allowed by the law is in total violation of the constitution and extant corresponding rulings by several trial and appellate courts in the country”.

“We draw the attention of all Nigerians and the international community to this illegal clamp-down on the opposition spokesman by the EFCC, using a purported holding charge said to have been derived from a magistrate court,” the party said.

“Holding Charge which implies ‘arrest before investigation’ instead of ‘investigation before arrest’ is clearly an aberration and abuse of judicial process which has since been declared by several courts as illegal, null and void, and of no effect as it is totally in contradiction with section 35 (1), (4), (5a) of the constitution of the Federal Republic of Nigeria.

“The PDP is particularly worried that Chief Metuh, since his arrest on Tuesday, is being inhumanly kept in an underground cell where he is daily threatened by officials, who we gathered, have been mounting pressure on him to accept guilt of fictitious figures and implicate PDP leaders.

“The public is very much aware that the EFCC Chairman has visited the Presidential villa at least twice since Chief Metuh was arrested and detained by the commission, ostensibly to get further directives on the case.

“We invite the world to note that President Buhari’s election promise of fighting corruption has now been turned into a man-hunt of PDP leaders, while known corrupt APC leaders are being shielded by the system and rewarded with ministerial positions and other government appointments.

“Our nation is now being turned into a police state with its inherent constitutional violations and infringement on rights of citizens, a scenario which poses grave danger to national stability and survival of our democracy.

“The PDP strongly cautions against the avoidable tension and looming political crisis over the continuous clampdown on our leaders and particularly, the continued incarceration of our spokesperson, Chief Olisa Metuh, who was arrested a few days after he confronted the Federal Government and the APC over their dictatorial pronouncements and actions.

“Our teeming members across the country have so far exercised reasonable restrain, but we caution that there is a limit to what they can stomach in the face of this brazen persecution of our spokesman. The President Buhari-led APC government and the EFCC should therefore hold themselves responsible should there be any breakdown of law and order in the land over this matter.

“We therefore reinforce our demand on the EFCC to respect the course of law and release Chief Metuh immediately or charge him to court in line with the provisions of our laws if it strongly feels it has a case against him.

“Nigerians cannot afford to return to the era of dictatorship where constitutional provisions, respect for lawful processes and personal freedom of citizens under the law are trampled upon. Their response to this might come with very dire consequences.”
