Offences
1 - Cantankerous live-in lover

2 - Non-attendance of landlord/tenant meetings

3 - Willfully insulting caretaker who is just a messenger for this purpose

OP please judge yourself - If you were a landlord would you tolerate a tenant with these characteristics in your property?! undecided

They are always quick to judge the landlord, I see people also advicing the man to take him to court. A lot of tenant perform all sorts of behaviour in a property that does not belong to them and when you try to point out their wrong calmly, they will flare up saying all sort of thrash.

I am not saying some landlords are not bad but I am just isolating the situation. I hope the Op learns from this experience in his new apartment...

Like seriously, you want us to advise you to stay in someone's house for one year without paying rent?

Honestly, you and your girl friend needs serious beating.

If i were your landlady I will use unknown gunmen to treat your fucck up.

Lakatabah:
Nairalanders, I need your help.

I just moved into this new apartment and within a month to the expiration of my rent, I got a call from the caretaker to see him and he told me they would be is increasing the rent unless I renew before it expires but I didn't have it at that moment and pleaded but he said that's the decision of the owners of the house.

The landlady leaves in the building as well but the caretaker receives rent payment and all for reasons best known to them.

I went to see the landlady and she stood her ground that if I can't pay I should leave. Well, I could deduce her actions for doing this as she had a quarrel with my fiancee and it has been settled but she still had it in her mind.

I don't why people have dumb mentality. A landlady and a tenant cannot quarrel and settle in peace anymore.

I choose to pay the rent increase last year in order to let peace reign. On a norms, I would never pay for such an increase( I mean from 200k to 250k) Now, I just got a letter delivered to me this morning which is a notice to quit as my rent just expired last month.

Normally, when my rent expires or about to, the caretaker will call me and ask when will I be renewing it but this time I didn't get anyone at all which means they actually planned it before now.

They didn't even call me for a meeting to discuss, who does that?

And on the letter, there was no reason stated on the quit notice and it's a 6 months eviction notice. I spoke to my lawyer and she said that's how they do these days issuing quit notice without prior notification even when you're paying constantly.

When I went to see the caretaker, he told me it was because I was absent in the last meeting that was held in the compound. What trash! I rained curses on him to the extent that he couldn't voice out a word again. Apparently, he was shocked as I'm always very gentle.

Are they sharing money in the meeting or what? Or I would leave my business and be in a meeting on a weekday when I can always get what was discussed in the meeting from people that were there.

The reason didn't even go down well with me as it got me really annoyed. I have decided to park out but I want to make sure they see pepper.

Can I stay up to a year or more before moving out?

Please I need your advice, thoughts, and ideas. Thanks in advance and pardon my typos as I'm typing from my phone.

so ? If u know tenancy law very well, landlord doesn't have right to throw tenant property out side the house anyhow unless tenant do something unethical like unable to pay at least three months, fight in the compound, dirty the compound etc. before it warrant eviction.

That is not true. Landlord needs no reason to serve quit notice as long as adequate notice period is given which is at least 6 months. Quit notice and eviction notice are not same. An eviction comes after the quit notice period has expired and the tenant has not moved out.

You can even sue them. Photocopy it to over 50 copies, when you're done, liter the compound with over 25 copies. So that she go know say she don enter one chance grin grin. She go even beg you at last. grin

Its so damn annoying.People who didn’t contribute one bag of cement or even the least shovel of sand when you were struggling to build your house would now move into your house and want to give you shit to eat simply cos they’re paying rent of ordinary 200K that’ll take almost 6 or 7 decades to make-up the total amount you used in building the house. You need to see the nonsense my mother is seeing in the hands of tenants in her own house.Me,I no dey even allow them that chance. Some of them would be deliberately causing you problems in your own compound.May God forbid

if you are given quit notice unjustly, you approach the court, if Care is not taking you will spend one year in the house without paying rent

If in six months he doesn't get an apartment, should he put his load inside the gutter..... The way some landlords treat tenants sometimes is annoying and worrisome. You just increased the rent and the next thing is quit notice. Someone that has been paying , now couldn't pay within a month, you issue a quit notice...

If you know you can quit the apartment in that six months pls do. But sincerely, people like them needs to be dealt with... If e be say the person wey get the house don die self.....
As someone as said, don't think of staying in a house the landlord lives.

God will help you my brother.. Amen

I think you guys get it wrong. You allow emotions to cloud your judgement.

In this particular issue, it's not the business of the landlady or landlord on how his/her tenants get their money to make payment. When you rent a place and sign the tenancy agreement, it's based in the understanding that you can pay. If you couldn't pay anymore, don't expect the landlord to be merciful and allow you stay without paying or at the very least indicating interest to pay at a stated time.
If you were blessed with someone who was extra kind to allow you stay, thats good but that doesn't make another who wouldn't let you stay, evil. It's business. When you purchase goods with agreement to pay before goods are delivered, you don't suddenly expect to have goods delivered to you without paying. Business isn't run by emotions.

Same way you feel some landlords need to be dealt with is same way some tenants need to be dealt with. My late sister had a tenant who owed her a year rent and she was kind enough to let him stay cos he had financial issues. After my sister died, he refused to pay and insisted he wasn't owing any rent. He later agreed that he was owing after we confronted him with his chat and my sister's chat's. He then left the house and kept his wife and kids. He refused to take calls, nor reply messages. The wife claimed that the husband doesn't pick her calls too which was false. To make things easier for him, we told him he should only pay for a year and move out since he has already stayed two years without paying. Guess what he did, we came to the house one day and we saw that this man had packed out of the house. No payment, no call, no messages, nothing.

So I understand why that landlady isn't ready to take shit. Pay up or packout is the logical thing to do.

Na God go punish you for this rubbish when you type since you don't know how to read, if you have nothing meaningful to say just shut up, what do you mean by entitlement mentality, so as a tenant you expect him to be licking her landlady shoes abi, you think in a sane country where the law is working fine this kind of landlady can't get away with this, it's because we are in Nigeria a corrupt country that's why you think a landlord will just wake up one morning and served quit notice.
If I may ask, what kind of meeting are they holding. I think people like you are part of the reason Nigeria is this bad and lawless

dont lick landlord shoes.

Over entitlement mentality on someone else property

You have 12 whole month to look for your next year rent and you claim you don't have it as at expiration of your rent you even want a reminder from your caretaker

You felt too busy to attend meetings in the house you reside, meeting regarding welfare of the house which is part of your core responsibility as a tenant

Your fiancee had a quarel with the owner of the property

You cursed the caretaker of the property

You better start looking for a new place because highest you can get is 3 month from the reciept of the first notice

Only in Nigeria will a Fool download Sokoloan App, read terms and conditions, collect loan spend it on frivolity and when the time to pay reaches he starts causing all sort of menace

You got 6 month quite notice but want a year free rent....

PS; on a lighter note... What if Buhari and Osinbajo decided to stay extra 6 month in Aso Rock Vila and Aguda house while they drag Nigerians to court

I am sure this story is FABRICATED!
But let us use it to catch cruise by assuming it is real. grin

From the Amount you're paying, so it is a BLOODY ONE ROOM you are renting and making all these silly noises, threatening and insulting the caretaker, for what?
You also lied a lot in the story (why l concluded it is not even true) saying you just moved in, and your (one year) rent is about to expire.
Then you went on to say they increased the Rent last Year, meaning this would be your seond year in the house, at the very least!
Amateurs like you should not be writing tales. grin grin

So, it is the Landlords duty to alert you when your rent expires, your own brain is non-functional, right?

But for the sake of others like you, in the real world. let me offer FREE Legal Counselling this Sunday morning:

- If your Rent expires and you have not renewed it, you become a Tenant-at-Will, you are no longer covered by the protection enshrined in the tenancy laws.

- Your Renewal must be Signed, Sealed and Delivered, unfailingly, by the last day of the current Rent/lease.
My advise is that you renew your Rent, at least a Month before it expires, it gives you time to negotiate and take further action, if need be.
Landlords generally respect tenants who dont owe them or wait to be asked to pay their rent.

- For a One year Rent, the Period of "Quit Notice" is Six Months, anything more than that, is at the Owner's discretion but the Law prescribed Six Months.
- The Quit Notice Period can run concurrently with your Rent, that is, if your Rent remains say for example, Six Months, the landlord can issue you with a Six Months Quit Notice, that expires on the Anniversary of your Rent. It is Legal.

- Quit Notice "Period" are NOT Free-of-Rent, as long as you have not dropped the key to the House Owner, you are still occupying the Rent and you are liable for every Penny, till you move out.

- A House Owner will apply for what is called "Menes Profit", from the Court, to recover all the Debt you owe, for the Period you were in the House and did not pay, for any damage you caused to the property while there. If you fail to pay, they will auction your belongings at very ridiculous prices (e.g. your 2015 Camry can be sold for #200,000:00 by the Bailiff of the Court, you have No Say in it. So you better have the cash you are owing ready!) undecided grin

As for the Landlord:
- Your Rent increases must be "Reasonable" though we all know that inflation and price increases in Nigeria are neither predictable nor reasonable. Go and Price a Ton of Iron Rods today and then go back there next week, you will see what l mean. The best way to increase your Rent, in to get New Tenants, standing ones are always arguing and reluctant to pay but they will pay more, in the New Rent they are going.

- You must let your tenant enjoy the use of the property, within reasonable parameters, they are paying for it! Dont disturb them unnecessarily.
- Give then an signed and sealed Rent Agreement which details their rights and obligations to you the owner, as well as yours too them and stick to the letter of the document. Dont just collect "Agreement Fee" without executing a Proper Agreement that can stand in Court.
If you dont, tenants will make a nuisance of you and embarrass you in public. if you cant do it, contact me, l will do it for you for a fee.

-The Quit Notice is not just any other piece of Document, it has a prescribed format or items that must take a particular shape otherwise, it becomes a nullity and is deemed INVALID. Seek direction, if you want to serve it yourself.

- If a tenant is evading Notice, you can paste it on his door but ensure the process is well documented, preferably Video-taped. Find a way to ensure the date it is "pasted on that door", can be verified. There are means and ways of doing that.

- Ensure that all utilities and conveniences provided for, are functioning properly, if there is a breakdown, repair it for your tenant, as long as it is not due to deliberate damage. (Their Deposit should take care of any deliberate damage or that which arises from carelessness.
- Whatever they pay for, ensure they have value for it.

- Follow due process in ejecting an obstinate tenant, dont be acting like a thug and removing roof or breaking doors!
it is not as difficult as people think. You can even DIY the process! The forms are available, fill it and let the Court do the rest.

Generally, l dont take nonsense from Renters (like this Clown that is misbehaving and still asking if he can stay there for one year! By the time l am through with him, he will be going back to his Village, to live in a Hut.) and likewise, l will do everything to protect the interest of a tenant, if the Landlord wants to cheat or oppress the tenant.

But as we can see from the story of this guy, most Tenants (not all, especially those from a certain tribe which l will not mention but l can bet this Poster is from there undecided ) like to take advantage of their Landlord and punish them by with-holding their rent or abusing the use of their Property.

Finally, the Owner of the House will always have the final say! No matter which way you cut it in Court, it is still the tenant that will Vacate the House!.
Before you start threatening or arguing with your House Owner, think about it properly: Do you have the initial outlay to rent another house immediately? If you dont, better pipe down and settle with your Landlord, becoming Homeless can lead to a lot of other problems, which l dont wish for anyone.

How do i contact you

Tact? How is that tact?

If that's tact then why are we clamouring for a change in government instead of just having regards for the constituted authority.
Why not just put up with everything the government throw at you because you have regards for leadership.

Well you call it TACT,I call it ass licking.
Just because you don't want your land lord to give you quit notice, you must do whatever he says even if it doesn't make sense.

I've seen some people doing the most silly things at work just because they don't want to lose their job but will complain bitterly about it in secret.

Nobody will wake up one day and just decide to cause trouble, talking about building your own house cause your land lord is being difficult, let me tell you this, everyone won't be a landlord or land lady, and moving out is not as easy as you put it.

the usual chest beating cheesy, Tact is how to "Bypass" someone that will slap you and you don't stand a chance to hit back.

The question is, does a landlord fall into the class of people that will slap you and you can't slap back.
why chop slap when you know you can hit back

Typical Over entitled tenant. The landlady does not need a reason to serve an eviction notice. It's her property and she can do as she wishes with respect to the law. I know tenants like you. You feel because you pay rent you have some ownership stake in the property. You mentioned your rent expired last month. A responsible tenant would reach out to inquire about rent renewal options. But your type will never do that. Also you mentioned that the landlady made a rent increase last year. Yes, she can increase rent. Do you know how much it cost to buy land and build a property? Also why would your fiance quarrel with the landlady? Una no get respect?

p.s: A quit notice of 6months does not mean you get to live in the apartment free of charge for the next 6months. You will still pay for the 6months. If you like don't pay. She can take you to court and she would win. Nigeria is not as lawless as you people think. One day you would be a landlord and you would understand. Nonsense.
Will the tenant pay the old rate or the new rate for the 6 months period given to him to quit?

They are not duty bound to be kind to him, it is a contractual agreement they are on as long as the terms of the agreement are kept every other issue isn't a concern

If he was living in an apartment in a country that rent is paid monthly like UAE or UK he would have long been evicted

Even in Europe where I live(Milan, Italy), rent are paid monthly.

Thinking of staying in ones property for free for 12months? Do you know the current cost of building materials

Contractual agreement are not meant to be kind, but obeyed. If you can't you would have told them ab-initio.

She has given you quit notice. Just ignore it until she serves you court letter.
On the first summon date, don't go, it would be rescheduled. Maybe 3months.

Then be present at the second hearing at this time ask the judge to give you time to get a lawyer to stand or represent you. The case would be adjourned for another 3months. Now you have stayed 6months.

On the 3rd hearing date, ask the lawyer to find excuse to give you time to file your defense and come up with your own position. The case would be extended by 3months again.

On the Fourth hearing, tell the judge that your finance has really dwindled and that the landlady should give you 6months to 1year to raise another rent fee, you were affected by covid.

After the 6months to 1 year expiration, tell the judge you have managed to raise just 50k and that you are still trying your best to raise it to 300k to get a decent apartment. You will definitely be obliged, cos the court doesn't expect you to sleep on the street or under bridge.

With this strategy you've lived your profit off her and even the fees you paid.

Then gently look for a decent place where the landlord doesn't stay in the same compound or that doesn't depend on rents for survival.

Note: I'm currently in same page with you as my own landlady has given me quit notice as well.
I will vacate her residence next year December

Hello oga writer, I've carefully read your post and the comments of others. Some persons are saying that your fiance was wrong for having a misunderstanding with your landlady, some are also saying you shouldn't have missed the meeting or insulted your caretaker, they are right in their own ways. However, I totally understand how it feels to be in your shoes because I've been there before. According to your story, your landlady is wrong to serve you eviction notice without any wrongdoing. Read the constitution of Lagos state (if that's where your are residing), or that of where you reside, digest it, and understand all that it entails regarding land owners and tenants. Some landowners make themselves demigods and want their tenants to Revere them. Let them take you to court, the court would take nothing less than a year before forcefully evicting you out of the house. It becomes worse if you are a taxpayer of the state you reside in. Since you did nothing wrong, maintain your stand and watch them loose as you would stay long in the house without paying rent.

Get Nigeria's constitution and that of the state you reside in, study them carefully regarding landowners and tenants, then prepare for war

I have not seen this before I made my post, that is the mentality of a lot of Nigerians, they just don't want to pay and it's a pity a lot of landlords don't even want to stress them selves with court issue they just want the tenant to leave so they don't bother with the court wahala.

Tenants from hell.

Funny enough the irony of this whole thing is that it is people like YOU who are the problem of Nigeria. You are talking about in developed countries things like these can't happen,of course because mechanisms have been put in place to ensure you pay your rent. Have you ever heard someone owed rent and wasn't evicted in the so called developed countries you talk about? Countries that ensure that you pay all your bills or get cut off the services.

Mind you the guy has never failed to pay once his rent expires, he has never owe the landlady in question more than a month, even in develope country they give tenant some little time to pay their rent, it's everywhere not only in Nigeria. From the OP statement we can clearly see that the landlady is just being wicked and oppressive that's all I see.

If I were your landlady since you want to frustrate me. The way I so frustrate your life eh! The next apartment/apartments you will pack into before you build your own you will be like ice water.

You get luck self this landlady of yours even loves you.
May be it's because of your foolish fiancee that she wants you out. If not you would have received 3 months notice maximum.

Try it the area I live in Abuja and the landlord/landlady will tell you how it's done.

The estate I once lived in, in Wuse Zone 2, Abuja, if you rent expires and you don't pay, you will pay 5k everyday before you cross the gate (It's part of the agreement).

It is even police that does the job. With heafty bouncers.

To come back house go dey fear you. Very lucky troublesome person you are and you are here blabing.

You and your girlfriend should just carry una wahala ND go!
To be honest, God will punish you if you try to frustrate that innocent woman. sad
