If the room was his father's room then he has more right to it than you. According to tradition, you were not supposed to have moved into the space since your brother has a son. You are meant to be a custodian of your brother's stuff until his sons become of age.
If you take this issue to umu nna, the honest ones will tell you the truth. Let this matter rest to avoid deeper family issues. I know you feel disrespected but let it go.

Honestly, he's not dragging anything with you but you're the one dragging something with him.

By right of first born son, his dad owns the house and passed down the ownership to him(through inheritance).

Ur brother is late and he has children.
The normal thing to do since there is no will is to share ur father's property into 2 that is, between u and ur late brother. As ur brother being the first son, his family will first take.
Assuming ur brother is alife 2day, that is the same way it should be done.

My nephew is dragging right with me over our family house his father was my elder brother and the first born in our family we where five in number 2 boys and 3 girls although my female siblings are married .
My parents left us with a family house as the where now late so my brother lives in the landlord palour which was a self con apartment when he was alive although his relationship with his wife didn't work out as the woman wasn't married by my brother but she had kids for him now after my brother death I moved to the apartment as and started living there although I did a little renovation on it and others .
Until I have to travel all in the hustle although I was still in Nigeria but I moved to the northern part of Nigeria only to receive calls from my neighbors that my nephew has break into my apartment and do some retouching in my own house
Note there was never a time I ask them to live the compound or anything infact this is a family house as everyone has a room why must it be that my own.
I need advice as am very very pissed off

The house belongs to the entire family (siblings). Sell if off and give everyone their share, the boy inclusive (your late elder brother’s share).

Landed properties usually turn siblings to enemies, it’s always best to create a will stating what belongs to who.

He doesn't need to build the house since by tradition it is his father's inheritance from your late dad as his first son and as for forfeiting the house,this can only be possible when you have your own house meaning he can't eject you because you are still a son of your father.The Isi obi in Igbo culture belongs to the first son once their father is late.

This is a very dicey and sensitive one to advise you on based on the fact that as much as you should have more right to him as regards your late father's property, however, as Africans who practice a patrilineal system of inheritance, that might be where his entitled guts are emanating from.

You can put him in his place though but if you can avoid any confrontations with him and good on your own, it'd be best to just ignore his kindergarten sense of entitlement and keep doing you.

Do well to make him understand you have a stake in the house as much as his dad did and you won't tolerate his arrogance and disrespect.

Imagine that a king died. But instead of crowning the king's son, they crowned the king's brother. That apartment is not yours in any way. Why not try and build your own house like your farther did? Leave that innocent nephew alone. He has lost a lot already.

First you are the person in the wrong.
Did you inform him or your Umunna before breaking into his late fathers room and disrespecting the deadman?

You are Igbo, you know very well the first son will take the obi, then everyother thing will be shared by the youngest male, and others will choose before him. Aslong as this is your fathers abode, whether in city or village, it does not belong to you in its entireity. You are only a custodian. It belongs to the first son and his offsprings.

Your right is that you cannot be prevented from entering the obi at anytime but your children cannot inherit it. You must establish your own Obi, which your first son will inherit.

So do not disgrace yourself. You are not only
the aggressor, you are totally misinformed, and muschivous by claiming an acknowledged son is a bastard, their are no bastards in Igbo culture. If the woman gavr birth to the son while married to another man, then you may have a case that he is not your brothers son. Unless your father has a will, that is the custom for inheritance.

this not Igbo culture, we do not share things into two.
The legacy of a man will be carried on by the first son in form of his Obi, which must remain undivided so that all members of the family will always have a reference home. After this, if there are enough lands, each male will get a place to establish his abode or Obi, and then whatever remains will be shared equally among the males. Unmarried females will also get land, especially if she has a son that takes her own fathers name. If all a man has is his Obi, his first son inherits it, the others get nothing but have rights to live in the obi till they are ready and able to acquire their own abode.

We are culturally attached to the land of our origin like the jews feel attachment to isreal, thats why we always return home to our fathers land. If we share Obi, it will be liquidated by the uninterested parties and end our identity and affiliation with the land. So this is the reason for not sharing the Obi, and it is well tested with time.

My father was naive enough to knock down his fathers mud house in the 50s and rebuilt it with his own money, when he is the second son. Last last the reality was that he built a house for his brother, while his allocated abode was empty. Thank God for my mum, who then built his obi.

In many parts of igboland,once a woman's bride price isn't paid, all her kids belongs to her Father & not her "supposed husband".

What tribe are you from? If the property is in the city he has no right to it because it belongs to all of you. The best thing is to sell it or your family will descend into the abyss.

My candid advice - anything land or property dispute... you might seem a coward or weak, but smile and yield.

Redouble your efforts and when you become really successful they will come after you and beg with their noses rubbing the ground. I have seen that happen.

Anything land or property... some people are ready to waste you. Kill you literally or give you a slow death spiritually. I have also seen that happen. Maybe your destiny is to become a millionaire.... your potentials will disappear in a flash.

Let me tell you... that so called property might hinder your progress in life because of that emotional attachment to it.

Call Elders into the matter to give hopefully an unbiased judgement. Abide by the ruling and go and make sure you are successful.

For your information,the op that is saying his elder brother did not marry the woman might not even be sure of what he is saying because in Igbo land,there's no way the woman's family would have allowed those children to be staying with the man if he didn't perform any traditional marriage rites no matter how small.

No matter how you want to judge it,that his nephew owns the OBI.

Like someone has said already, the house belongs to the first son. At the fathers death, his eldest surviving son should inherit his property and INHERITANCE. You are only a custodian although no one can make you leave if you don’t want to as it is still your father’s house. But this house doesn’t belong to you. It belongs to the son. He even has the right to sell it. This is according to my tradition and I’m a Bini man.

Nope that one is voluntary I can give my daughter a portion of any of my property
But she doesn't have cultural and traditional right in the sharing of inheritance

See this things are deep even when I want to give my daughter any of my property I must consult my son's for them to be in agreement with me hence if I die tomorrow my son's will reclaim the said property on the ground that they were not informed

I believe this is the accepted tradition in all Nigerian culture. As a Bini man, what the Igbos call “Obi” the residence of the man of the house will always go to the first son irrespective of the location ( City/Village). If the father has other properties, it will be shared amongst all the children (or their families if any is late) including women. This is our tradition. Inheriting the family house doesn’t give the son the right to send any of this siblings or step mom away from the house. They should only leave of their own choosing.
