Above is a typical example of such rascality by Lagos State government just this week. His property is being demolished. He has tenants who were rendered homeless as well as himself. In this instance, are you going to drag a homeless man seriously fighting to stay alive?

There's a thing called "force majeure" in law, no contract is void of it. When unforeseeable events occur, no one is held liable. This scenario can also apply in car rental and hire purchase agreements on Uber. A driver cannot be held liable when there's a car wreck in situations that he doesn't have control over.

Let's paint a scenario you all can relate with and I believe most of you have experienced this one time.

Lanre was called for an interview for a life changing job offer at Ajah and he resides at the maindland. The cost of going to the company via public transport is 6k. He borrowed this money from friends and family with the hope of paying back when he starts work and receive his first salary. This scenario is a typical life of the "TENANT".

Then same day,a driver Mr Adeniyi wakes up in the morning ,a man who doesn't regard the laws of God and man. The bus he has is a sole means of livelihood for himself and his family. This scenario is a typical life of the LANDLORD who builds a house without proper authorisation and approval from government.

Fate brought these two together.Lanre boarded Mr Adeniyi bus from Abule Egba to Ajah and paid a transport fare of 3k naira to the driver. On getting to Oshodi,due to driver's lack of regards for the law,
he passed one way road to beat traffic. LASTMA or Lagos state task force caught up with him and impounded his bus with no hope of ever getting it back.

Poor Mr Adeniyi whose only means of livelihood was taken away from him because of his carelessness and disregard for the law. Lanre who has a job interview at Ajah is stranded at Oshodi without enough money on him.

Force Majeure is only applicable when natural disaster occurs in a legal agreement and it's subjective. Its interesting you are using E-hailing business as an analogy but i don't think they are the same.

Nigerian drivers always have this funny mentality that they do owners a favor. If any driver wrecks my vehicle and claims Force Majeure, Lagos won't be big enough for both of us.

So why did you as a tenant not carry out due diligence before renting? The building was illegal, so why did you pay for it?

LAW AND PRACTICE, TWO STREAMS FLOWING IN DIFFERENT CHANNEL.

Theoretically n practically, it doesn't matter whether u verify the C of O before u contract the building; because, ownership of land in Nigeria is vested in the government (as stipulated in the Land Use Act). Therefore, any excuse stated before the said demolition is just for formality n to sympathize with the public. Govt go claim any land anywhere.

Wonderfully, the Land Use Act made stipulation for "adequate compensation". Whence, it's rightful for the govt to claim or reclaim any land and it's also rightful for the govt to compensate the owner. But what does the law mean by "adequate"?

Practically, govt will demolish a building worth hundredth of millions and compensate the owner in thousands.

During Obasanjo regime, the govt claimed some land and compensate the owners with #10,000 naira, they rejected it for heaven sake!!!. Late Gani( the oracle of the law) challenged the govt n sue her to court for inadequate compensation, after series of appeal, the Court, while interpreting the clause, opined that, the govt is not to be tied down with any specific amount (govt is at will to give any amount as compensation) to come finish common man, court say compensation is not a right but a privilege.... imagine that ...
Well, I forget the case law n I'm not sure if we have a new judicial interpretation now.(moreso, if Dem justice Niki Tobi (the golden voice n interpreter of the law couldn't muscle something better, I doubt the current system)
But, the Niger-deltans n govt (during the same Obasanjo regime) is also a case study of this abuse of our common right.

To our TENANCY LAW IN NIGERIA,
What clauses is actually contained in "agreement n commission" that we pay hugely for?
Did we take our time to input a clause in the agreement that will serve as authority for us before the court of law to hold the landlord to pay for damages we incur for premature termination of a binding contract?
Whatever the case maybe, the landlord have a suitable defence (the "doctrine of frustration "wink
If the court should acquaint this defense ehn.....hmmm
Moreso, "Nemo dat quod non habet" he can't give what he don't have oo.

Government dey insensitive to all this issues o.
Ideally, the govt ought to give "adequate compensation" to landlord, and from that "adequate compensation" ehn, landlord go settle tenants...

Conclusively, in a State, ruled by law, all this issues na small thing...but Nigeria isn't ruled by law. Few weeks back, the Court issued a restraining order say make NLC no go strike, NLC disregard the Court order with contempt and proceed with the strike, funny enough, judiciary joined the strike...what a ridicule.

In such situation, the first thing to do, na to pack ur property exit that building to avoid double wahala....if u have extra coin, u could take a lawyer, perhaps, the case could usher in a new era in our legal system. We all hope for that.

Not really a direct comparison but yes, Lanre should take it as fate, forget the money and go on another bus. He will probably have to borrow more money as conditions has changed. Ade has bought fuel and paid agbero money before living the park, he has also bought gala and bigi so he has no money left to refund the passengers. grin

Like u said earlier in this part of the world everything is upside down. Overseas there is insurance on virtually everything so in the event of an unforseeable catastrophic event, Insurance covers everybody.

There is no way you would build anything in Lagos, that you won't be bamboozled with permits.

Today, Epe is the new rave. I have not seen Lagos state warning people not to buy there. 10 years later, you will hear that the place was for a future nuclear station.

Another problem is secretariat verification, if you go there it's hard to get legit info about a land. You will have to bribe a chain of people only to get a wrong info. Lagos state is not making it easy for some people but you see that drainage own ehn. Na man do himself oh

There is no way you would build anything in Lagos, that you won't be bamboozled with permits.

From Local governments, to LASBCA, na so you go dey pay. So how come nobody told them it was illegal? Why will the government be giving permits for illegal structures?

Today, Epe is the new rave. I have not seen Lagos state warning people not to buy there. 10 years later, you will hear that the place was for a future nuclear station.

It's possible, but nobody will intentionally sink hundreds of millions to build on somewhere illegal.

We take alot of risks in this country and when we have citizens who think that what money cannot do, more money will do it. People just feel they can bribe and settle everybody to get what they want. In my little driving sojourn that has taken me to the nooks and cranny of Lagos, I know many places that were once gully, drainage, swamp and waterways that are now well built and developed estates. There is nobody that has N500m to buy land, build and furnish the house that will not be knowledgeable enough to know where he has investment is an illegal area. The ones that manage to scrap money to build small houses also know the word on the streets. Except it's areas that developers built and sold out or big men and politicians that just sit abroad or in Abuja and buy properties through agents. Anybody that buys land and pays for building licences knows that he has bought land in a waterway or sandfilled area.

Real Estate in Lagos is overhyped and crazily overvalued..
Imagine a plot of land @ ibeju lekkki for 20m .. is that not crazy grin.
Traffic to and from Awoyaya is enough to shave 8 years off one's lifespan.

So where is the legal structure that you want to rent? Most of the demolished houses can't be classed as illegal structures aside those that were clearly built on drainage channels. The link I sent earlier, the house was being demolished because the state government just realized that the area needs to be used for agricultural purposes. The Lagos state government went behind to repurchase the land where the house was built from Omoniles before coming to demolish it which is more like a criminal act

As far as Lagos is concerned, no structure is completely legal. Both tenants and landlords are taking the same measure of risk, anything can happen.

The problem is the banana republic that we found ourselves where law and order is missing. Lagos happens to be the most lawless state in Nigeria.

That's false. All lands in Lagos have their purposes since far back as Jakande era, there are even industrial lands in Lagos. Most land people are buying in Epe today will face the feat because they are agricultural lands. The government didn't just wake up to tag an area as agricultural land.

Force Majeure is only applicable when natural disaster occurs in a legal agreement and it's subjective. Its interesting you are using E-hailing business as an analogy but i don't think they are the same.

Nigerian drivers always have this funny mentality that they do owners a favor. If any driver wrecks my vehicle and claims Force Majeure, Lagos won't be big enough for both of us.

Lol. Interesting. It's not only when there's natural disasters that a force majeure can be activated in a contract, fire outbreaks, accidents are all part of it. In Ehailing, If your driver is at a stop light in traffic and a truck rams into the car from behind leaving it at a near wreck, you cannot hold the driver liable . It's between you and your insurance company, that's if it has comprehensive insurance. If there's no proper insurance, you must count your loss and move on.

Some mechanical issues can even lead to it's activation. You cannot give out a lemon car and be expecting a mouthfull on a weekly basis. The onus is on the driver to activate that clause if an understanding can't be reached where different parts of a car starts to fail at the same time making it impossible for him to carry on driving.

If this sensor goes bad, you will think say na the devil collabote with your village people dey do your car. grin
Cos no matter the solution/repair you do, if you never replaced this sensor, you'll just dey waste money on other things.
As someone said, first scan the car, if the code points to multiple cylinders misfiring, let your mechanic replace your car's cylinder sensor, then come and give testimony. smiley
