VisaOfficer: Thank you for the enlightenment! I do not have any overstaying for my last 2 visit in the US. But there was a time where my relatives went to a vacation, and on our way back home we were accidentally bumped by a speeding car in our back. Police officer arrived and found my youngest son (around 5 year old by that time). I was given a citation ticket because he is not on a bolster/child seat. Citation ticket was not paid as far as i remember because we need to transfer to my other side of relatives in the states. No other violation made. One last question. Do i still need to get a immigrant lawyer about my case, im just worried about my 235b1 case? Thank you in advance! S |

Good day V.O, Any hope and do you think i'll be cleared today the last day? Read on other forums that some A.P cases were cleared and got issued visa's yesterday. Even someone that his case was on ready as he checked @ 4pm his time he saw issued. |

reeq: Greatings VO http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf has the information on the 2014 poverty guidelines. The petitioner needs to show that he or she earns at least 125% of the threshold (some exceptions for persons in the active military or living in Alaska or Hawaii). If the person filing lists others as dependents on his or her taxes, they should be numbered under question 8. |

cutiecutie: Based on the above, I see no reason at all to worry about anything. I don't think you need an immigration lawyer, but asking a Consular officer if you need an immigration lawyer is like asking a cat if you need a dog. |

Hello VO, I am very frustrated here, I was in Nigeria in April this year to meet my Fiancee again, we went to high school together. I filed I129F for my fiancee. her interview was on 08/25/14 and she got all the documents and all pictures we took when i came back . the interview went well, answered all the questions and the consular Officer just gave her a contact sheet to complete and after that her case will be placed on administrative processing and didnt tell her why ( I did read on Department of State website that the consular officer was supposed to giver her additional document on why they didnt issue her visa). I sent email to LagosIV@state.gov to know why, if she was missing a document or sth, I was gonna give her my 2012 and 2013 tax transcript but IRS took weeks to send them to me and I also moved to a new place that time which delayed my receiving the document in time to send it to her but i did give her my most recent check stubs and letter from my banks. I am not sure what they need or whats going on, on sept 2nd, I received email from USCIS ( I did set up a case update alert when i originally field the petition) that my case is on intial review, I called USCIS they told me they dont have the petition, I called NVC and they said the same thing, I sent another email to LagosIV@state.gov and they could not confirm where the petition was or why it was placed on administrative processing. This is very frustrating, we had originally planned on getting married 10/17/2014, we met on 10/17/2003. we picked the date because its very memorable to us, it will be very diffcult for me to come back to Nigeria to get married on 10/17/2014, I already used up my vacation days when I visited Nigeria in April and I also work two jobs, getting vacation time for the same time period is very diffult for me because HR policies are different and the work week is also different for both of my jobs. depression have kicked in now, any assistance is appreciated. LGS2014696014. Thank you. **update** I went to USCIS office in Milwaukee, WI today 10/01/14 but they said USCIS does not have the petition, last action on my case was that the case was approved in july 2014, how or why the case status changed to initial review on uscis.gov, the immigration officer did not know . I called NVC as well but the petition is not there either. we are getting very frustrated. |

Please i would like to know how long it takes to hear back from USCIS. My fiancee went for a K1 interview in March and she was denied, but was given a 221g paper. I did all necessary inquiries and the package has been sent back to USCIS. So how long will it take to hear back from USCIS. It is now going to 3 months. And is it advisable to file I-130 while still waiting from the USCIS. |

@visaofficer gdevening to you.thanks for your help and support always...i have a quick question...i want to apply for a B1/B2 visa for tourism for my december holiday from school....but i am a bit confused at the moment...i currently dont study in nigeria...i study in tanzania and hold a valid residence permit to study here...do i apply from here or i have to go bck home to apply for my visa....i am been sponsored by my dad...i am in my 2nd year pursuing a bachelors degree in computer science...and i dont knw wat ties i have at the moment...can u pls advice me on what and what to do?thanks alot |

Good day mam, Thanks for a job well done, you are really a blessing to us. My case was completed at the NVC last week and presently waiting for interview date to be scheduled. I called NVC and they said they have not started with November schedule, why is that? Does it mean the embassy have not given NVC their free slots for November? Please ma is there any hope of having a date for October? Is it possible to reschedule and get an earlier date due to my spouse health condition? We heard that the embassy don't open email attachments, how then can we send evidence to back up our request, can we just send the email and put in the explanations? Please ma your response will be greatly appreciated. Thanks |

KweenCee: Hi VO, Yes, we process K3s. K3s are a way of "jumping the queue" for people who have approved I-130s pending with NVC. Once the I-130 is approved, petitioners can file the I-129, which leads to the K3. Personally, I think it's a waste of money, as there is no waiting period for IR1s and CR1s -- as soon as they're approved, they can be scheduled for an interview. But if that's what a family chooses to do, sure, we can process the K3 here. |

NenyeEdu: Hello VO, Good morning, The petition is still here. The case is undergoing administrative processing, which means that we are still investigating. We process these cases as expeditiously as possible. Please note that if you get married, the petition will be rendered invalid and returned to USCIS, and you will need to file all over again. The petition you have filed is for fiances only, and if the beneficiary becomes your spouse, she will no longer be eligible for the K1. |

If the petition has already expired, chances are that they have simply closed the case. You should contact USCIS directly and ask about the status. www.uscis.gov |

NVC asked us a month ago how many cases we can take in November, and we've responded; they haven't scheduled the cases yet, though. Just this week we were asked for our December schedule. @visaofficer hlo sir,plz bear with my bad english i have a ir 2 visa interview this month but yesterday i noticed that there is a mistake in form ds 260,my given name in form is not matching with given name in my passport .it was filled nd submitted by lawyer.he messed up my given name,he forgot to type my last name.will it cause any problem at interview or how it can be corrected? i have few more questions if you dont mind sir :- 1) my sister got her IV few months back nd she is now in states,does this by any means increases my chances of geting my IV visa?? 2) some applicants are denied at their interview cuz they not are qualified for that specific visa category like i read some where a beneficiary who had interview for an ir 4 visa,he was denied nd advised to apply for an ir 2 visa ...doesnt uscis or dhs checks if the beneficiary is eligible for visa category he/she is applying?? 3)i always read on web that visa is temporarily refused nd visaofficer need additional proof or specific documents now why doesnt uscis verify the petition properly nd make sure it doesnt need any additional documents before forwarding it to the embassy ? 4) can a visa officer issue a visa on humanitarian basis or out of sympathy?like a beneficiary has a bonafide relationship with the petitioner nd completely depended upon the petitioner but somehow their relationship is not legally recognized like relationship is adoption based but adoption is not valid 5)does the visa officer verify the validity of documents submitted like adoption deeds,birth certificates etc? or he just makes his decision based upon the interview i mean isnt its the job of uscis or dhs to make sure that all documents are valid nd according to law 6)i know all you need is speak truth at inyerview but can you plz give me any additional tips how to present my self at interview? |

On the other hand, if you and your sister have the same petitioner, and you contradict your sister's account dramatically in your own interview, we will likely have additional questions for both of you. 2) some applicants are denied at their interview cuz they not are qualified for that specific visa category like i read some where a beneficiary who had interview for an ir 4 visa,he was denied nd advised to apply for an ir 2 visa ...doesnt uscis or dhs checks if the beneficiary is eligible for visa category he/she is applying?? IR3s and IR4s are processed by a different section of USCIS than other IRs (they require a completely different petition), so it's hard to imagine that an IR4 who was supposed to be an IR2 would have made it all the way to the interview stage without being identified. We do sometimes see IR2s who ought to be IR3s. These are adopted children who haven't actually lived with the petitioners long enough to qualify as IR2s. It's not USCIS's job to check how long the petitioner and the child actually lived together. 3)i always read on web that visa is temporarily refused nd visaofficer need additional proof or specific documents now why doesnt uscis verify the petition properly nd make sure it doesnt need any additional documents before forwarding it to the embassy ? By law, USCIS is not allowed to adjudicate visa cases; that can only be done by a Consular officer or professional adjudicator. USCIS's role (and KCC's role, for those of you wondering why KCC doesn't disqualify DV cases with pre-existing spouses and children) is simply to be sure the paperwork is complete. Their role is not to be sure that the paperwork is accurate -- just complete. Only Consular officers and professional adjudicators can make a decision in a visa case. (And, in fact, in petition-based IV cases, we Consular officers only have the authority to issue visas. If we don't believe the petitioner and the beneficiary have a qualifying relationship, we don't refuse the visa; we send the petition back to USCIS with a memorandum recommending that the underlying petition should be revoked. At that point, USCIS reviews the case and decides whether or not to revoke the petition.) We sometimes receive angry e-mails from petitioners who say "YOU HAVE TO ISSUE THE VISA BECAUSE USCIS ALREADY APPROVED THE PETITION!" When USCIS approves a petition, that means that all the necessary paperwork has been submitted, so USCIS can approve the petition and send it to post. An approved petition does not mean that a visa will be issued; it means that the case meets the very basic documentary qualifications, and is ready for an officer or adjudicator to investigate further. 4) can a visa officer issue a visa on humanitarian basis or out of sympathy?like a beneficiary has a bonafide relationship with the petitioner nd completely depended upon the petitioner but somehow their relationship is not legally recognized like relationship is adoption based but adoption is not valid No. We can only issue visas to people who qualify and are eligible for them. 5)does the visa officer verify the validity of documents submitted like adoption deeds,birth certificates etc? or he just makes his decision based upon the interview i mean isnt its the job of uscis or dhs to make sure that all documents are valid nd according to law USCIS sees cases from all over the world. It would be almost impossible for a USCIS employee, based in the United States, to recognize every single country's documents and to know if they are valid or not. It's the job of the Consular officer to check the documents. It's easier for us, too, because we live in the countries we serve. An obviously fraudulent document will be a big problem, but what the person says during the interview is much more important than documents. 6)i know all you need is speak truth at inyerview but can you plz give me any additional tips how to present my self at interview? Just tell the truth. Seriously, I love it when on other Nairaland threads people give advice like "Speak confidently! Look the officer straight in the eye! Don't blink! Make a joke to show how comfortable you are!" When people stare at me without blinking and smile too much, I just figure they spend all their free time reading Nairaland. Good morning VO. Im in another jinxed situation and I would love your candid advice. I got a call yesterday that my interview has been rescheduled for the 3rd of october because of the holidays nextweek. It was supposed to be the 7th. Now my dilemma ıs this.. Fedex hasnt delivered by supporting docum ents. They said it will arrive this evening and be ready for pick up first thing in d morning. My appointment ıs by 7am. What do you suggest I do please. I have aged 10 years since yesterday. |

Here are the options: 1. The officer approves the case and the visa is issued. 2. The officer needs more information to make a decision, and the case is placed in administrative processing until the information is available. 3. The officer finds that the applicant has an ineligibility that prevents visa issuance. The case remains pending at post until such time as the applicant obtains a waiver for the ineligibility. 4. The officer finds that the applicant does not have a qualifying relationship with the petitioner. The case is returned to USCIS with a memo outlining the new information. USCIS reviews the information and gives the petitioner a chance to respond. Depending on the response, USCIS will either reaffirm the case and send it back to post, or revoke the underlying petition and close the case. So, technically, officers don't refuse IVs; we send the underlying petitions back to USCIS for revocation. It's a legal distinction. But USCIS does give petitioners a chance to respond before closing the case (unless it's an expired K petition, in which case they usually just close the case). |
