dear VO, please if someone used their surname, 1st name & 2 middle names in their old travel doc, but now only using their surname, 1st name & 1 middle name in their new travel doc. When completing the ds-260 form and the question says have you ever used other names in the past. do they need to tick yes and enter all the names used in the old travel doc, even though their names hasn't changed, only that they dropped 1 of the 2 middle names used in their old travel doc. All names used (in old & new docs) are on the birth cert. Will be grateful for ur reply. tnx

Good morning vo,
I went for my interview last year at us embassy in Lagos, under the f2a category, guess the US consular was not convinced that she's my wife and he said he would send the petition back to uscis for my wife to give more evidence, it's almost a year and we avnt gotten any response from uscis my wife even hired an immigration lawyer and my wife said that the uscis official said that the US consular in Lagos wrote on our petition that we are siblings and the lawyer has mailed them again but no response still... Pls what can we do to show that we are not siblings... It's really getting us worried.. Will be expecting a response thank you. My nvc case number is LGS2013671033

Hello VO

I just read your input on frontloading a case and my fiance did not send in any picture, call or phone log all he sent was his passport page from 2013 when he visited to 2015 when he filed.....is it a red flag.. because i read that the evidence the fiance provides when filing sometimes determines the denial or approval of the CO because he/she would have fone through the file prior to the interview.

Yes, it's always a good idea to record all the names used on the DS-260.

Given that the case is still with NVC, I have no way of knowing what's happening with it. But it does sound like the case is in their queue to be scheduled for the next available appointment, if you've been told that the petition's been approved and the case is documentarily complete.

I wouldn't usually comment on a case that's been returned with a recommendation for revocation, but the siblings detail intrigued me, so I looked the case up. There's no mention in the case notes or the memo that anyone thought you and the petitioner are siblings -- I'm not sure where your attorney got that. Has USCIS sent the petitioner (or her attorney) an actual letter asking her to respond to the evidence described in the memo? They usually copy the language in our memos verbatim, so you'll see that there's no allegation that you two are biologically related.

Please understand that I can't discuss this case in more detail with you. The next steps are that USCIS will give the petitioner a chance to respond, and will make a decision (revocation or reaffirmation) based on the petitioner's response.

BTW I just did a little happy dance in the office, because the last of our issuable cases that have been awaiting clearance have received clearance. We'll get 'em printed and out of here for you, if my staff ever stops laughing at my bad dancing.

Your fiance will have a chance to submit more evidence when he comes to the interview, and the officer will review the entire file at once. How your fiance talks about the relationship will be much more important than any papers / photos that were or were not included.

What category of immigrant visa? (What relationship does the petitioner have with you, and is the petitioner an American citizen or a Legal Permanent Resident?) Are you an IR1, IR2, IR5, F2A, F2B, F4, etc.?

As long as the interviewing officer believes that you intend to use your non-immigrant visa properly, there shouldn't be a problem. It sounds like you have a good travel history, which is definitely in your favor. Having a pending immigrant petition is not a disqualification from obtaining a non-immigrant visa.

Then once your petition is approved and it is documentarily complete, it will be ready to be scheduled for the next available interview. It usually takes at least six to eight months for NVC to process a petition, sometimes longer. Feel free to contact NVC directly and ask them for an update.
