Hi Good Day,

Can someone help me regarding my situation, im from philippines and i have a problem renewing my U.S visa. Im 31yrs old. The problem is when i was 16yrs old i went to U.S because of my mom's decision. i was cursed by my family since i got pregnant at a early age. So my mom bring me to U.S for me not to see the father of my child. so i overstayed for 3 months because i gave birth,rest and since we do have relatives their we also baptized the child and went back to philippines, after the baptism, and so i am forgiven by my family. (im only 16 at that time im a minor its not my decision to stay there of course i want to be with the father. but i dont have any means because im still dependent to my parents. Me and my family go there a lot of times but no record of overstaying only when i got pregnant that time. 2 years ago i applied for renewing my visa after 14 years. both me and my husband now. (not the father of my child) his visa got renewed and mine denied. I just said the reason of my overstay is because i gave birth and rest also baptized my child which is true. other than that im not really ready to defend my self because its my first time to apply. because before my mom do it for us since we are still dependent. i did not say im a minor that time because im shock i never thought it would happen. - i just realized that i should have explain it better for the consular officer to understand. i just want to visit my relatives and have a vacation with my husband. now my husband visa is no sense if i dont get approved he will not leave for a vacation without me. HELP PLS ANY ADVICE WHAT TO DO? sad FYI: My citizen daughter will not come with us because she is studying here. Thanks

- Someone who has been issued a visa to the United States but did not travel at the specified date as a result of he lost his mother and the company has to reschedule his leave to USA. Will this affect him at the point of entry?

- My friend and his cousin (20years old) want to apply for Tourist/Vacation visa. What visa type is best to apply for, is it family or apply for tourist visa separately?

Hello Fideco,

If your situation has changed since your visa was issued, it is always best to be honest and forthright once you get to the port of entry. Admission into the US is actually the jurisdiction of our colleagues at Customs and Border Protection. For more information, here is their link http://www.cbp.gov/travel/international-visitors#

For tourism, B1/B2 would be the visa class. And again, families are more than welcome to apply together.

Again, we cannot comment or coach on individual cases. The only way to get a direct answer to your question is to reapply and speak to a consular officer at your interview.

However, if you had a lifetime ban, you would have been informed of such during your refusal.

Thanks a lot for the sincere opinion which i believe is the right thing to do, I would def love to schedule an appointment to speak to someone at the embassy regarding my case and not applying for the visa yet but to notify them about my situation but i'm not sure how to get an appointment without having to apply for any visa category, moreover i reapplied several times but never got any question regarding my previous application because each time i'm being denied, i always get the 212 white letter, Would it be better if i just fill in application online then include in the box for reason for being denied in my 1st visa application then analyse the situation because reapplying again i never got a chance to explain my self in most cases due to the fact that i only get to answer questions when i'm being asked.

it's good to see you here on niaraland, kindly assist on this. my first application for US visa was granted and I got 2 years but when I reapply, at the interview my application was not approved/decline but was was issue (additional administrative processing is required, no further action on your part necessary, consular section will contact you when the case is ready) till date I have not receive any email for them for over 3 years. what should i do? if am to reapply, i don't know what to answer to the question on have you been refuse US visa before.

I sincerely ask for your assistance for my complicated situation on non-immigration visa. I was granted my J1 visa in hospitality 2 months ago by the U.S consular. In December 2014, me and my boyfriend held a wedding party, but we did not come to register with authority for a marriage certificate as we havent felt comfortable doing so at that time. Therefore, according to the law, I suppose that I am lawfully single. I declared my single status while filling in DS160. Yet after I got the visa granted, we went to the authority and had our official marriage certificate. My husband came to interview for the visa a month after I arrived in the States. Then an incident happened when the consular officer called to a hotel to do some background checks on me. Since hospitality has its highest turnover rate, some of the new HR people answering the phone somehow said that I was not working in the hotel at that time, which had the VO immediately questioned if I forged documents to participate in hospitality industry in the States. (Of course I did not, I still keep the contract with the hotels I worked with). And they called my parents to check if my husband and I are lawfully married. My husband interviewed for the visa later on and got denied and recorded in his file. They said I was cheating with the hospitality experience to get to the States and all of my relatives, family gave them answers that didnt match each other (). I am trying to clear out the status since I do not know whether my husband or myself got recorded for the visa. I would love to come back to USA as a visitor in the future. Please suggest me a way for petition over this matter. I swear I did not commit perjury as all I want is to bring my husband with me for a year and then we can come back to our home country. We do not have any intention to immigrate to the States. Should my husband apply for the second time and present all the new necessary documents that prove that I did work in hospitality before? And should it be easier for him to be granted a J2 visa?

1). Full Name in Native Alphabet: Do I write my name again here?
2).National Identification Number: I don't have national id card. What do I input?
3).The Location(s) you plan to visit in the U.S: Am going for a 4 days conference, & would be staying in an hotel. Which location should I input, hotel or conference venue?
4).Person/Entity Paying for Your Trip: I own & run the registered business, the conference is to enhance our products and services. The business can sponsor me, and I in turn have adequate funds for the trip. But I don't know which to say, as not to confuse or cast doubt in the mind of the VO.
5).Contact Person Name in the U.S: Also in the dark here, conference / hotel, staffs
6).Organization Name in the U.S.: This I believe should be the conference organisers? Kindly educate.
7).Relationship to You: ?
cool.Have you travelled to any countries within the last five years?: I travel most times to the UK, but my last trip was in 2009 to UK & China, this should be 6years ago, do I state this? So as to bring to the knowledge of the VO about travel history.

Of course having your travel plans change can affect you at the border. If your travel plans have changed, you may be asked about it at the border. If you have nothing to hide, you have nothing to worry about.

Also, the only option for your friend/cousin is a B1/B2 Tourist visa. Family visas are immigrant visas which fall under an entirely different category.

You may believe you were refused for "no reason," but VOs are required to write the justification on each refusal.

That being said, you can re-apply but because you were refused you will not be able to request another expedited appointment per the rules outlined on the U.S. Embassy website.

I'm in a little bind here. My H1b visa expires in Dec. The status itself doesn't expire till April next year. The first time i could not leave the country until after it kicked in October. Is this the same case for renewals? There's no cap gap extension in this case.

If you were refused under section 214(b) then you are eligible to re-apply again.

You should read through some of this thread first - especially the parts where we have clearly stated what the required documents are for a tourist visa and that we don't comment on your chances for getting a visa!

Unfortunately we don't have time to meet with visa applicants just to discuss their cases. If you have received a 212(g) letter then you are not refused - simply placed on hold for some reason. This is usually administrative processing and the letter clearly instructs you on how to proceed.

The form provides an e-mail address that you can contact in the event that your administrative processing proceeds beyond 60 days. Your best bet is to start by sending an e-mail to that address.

I am not sure what your question is - everyone is still eligible to apply for a visa so they will just have to re-apply for the visas if they are interested in travelling. We don't comment on how difficult or easy it is to get visas of various classes.

Look, these questions are all very specific. You should be able to find the answers on your own. In fact, some of them you have answered in your questions. Just answer the questions to the best of your ability and the VO will ask if they require more information.

My question is if my husband has been denied of the visa and recorded in his file because VO officers doubt he committed fraud on forging the work documents, should he re-apply for the visa considering we have the sufficient proof that he did work for the company and he doesnt forge any document ? Is he banned from obtaining the visa in the States once his file is recorded?

As we have stated numerous times, if someone is banned then they will be told that they are banned. If he was refused under 214(b) then he is eligible to re-apply in the future.

I have a very big question here. My parent were visiting me in the US this weekend but they were sent back to Nigeria because the immigration officer called my school to know if I'm still a student at the Sch which unfortunately I'm not in Sch this semester. This is the last thing I expected them to do, but however it has happen and I'm looking for a solution for my parent to be here by nxt year. Already, I just got married to an akata girl and I haven't just put my paperwork in. My question here is that will it be possible for them to visit me again at any point in time when I'm a greencard holder, or when I will graduating? I know I messed up I will really appreciate your help.

I already answered your question in the immigrant visa forum. It is unlikely that your parents will be issued non-immigrant visas.

By their relationship to you - someone who has lied to the system and potentially broken the law - they are tainted. Your best bet may be to apply for immigrant visa once you are able to naturalize, but they are also able to apply again in the future unless they were given a ban when they were turned around.

The medical visa has the same requirements as any other B1/B2 visa. The only difference is that the VO may want to ask you in greater detail about how long the treatment will take, what the treatment is, correspondence with a hospital, cost estimates, and how you plan to pay for the treatment.

If your form is intact and has all of the information, that is all I care about.

That being said, everything can affect your chances at a visa interview.

Am a full time Pastor and a senior member of d church volunteered to sponsur the trip. Pls do I need to go to the embassy with my personal statement of account?
