Good day. I am ibrahim and i wish to travel to the uk to live and work with my girlfriend. I must confess i am very ignorant of the requirements needed for spouse to get a visa based on fact that we not yet married undecided.

I was here weeks/months ago, heartbroken about the court verdict in Nigeria on local government issued marriage certificate. I asked the house on their opinions and @justwise advised I push ahead with the application.

I absolutely agree with you that people should not exclude WhatsApp or Facebook messages if available. It's better to be on the safe side and send them even if not required. They can't reject anyone for sending too many documents abi? Worst case, you've wasted paper printing the messages.

My warning is more towards those that may rely primarily on WhatsApp messages as evidence of relationship and don't send many photos or phone records. If these messages is not used in their consideration as my friend advised then that could result in a refusal.

Concerning WhatsApp messages, I can't rule that out. For our application, we had no phone records except WhatsApp messages and whatsapp calls, viber calls, Skype records and Facebook posts. No visit to UK, except hubby's visit to Nigeria for our wedding ceremonies. About 80 pictures containing wedding pictures, school pictures together and casual pictures. We submitted a truck load of WhatsApp messages dating years back, as our main mode of communication.

I'm so sorry ronvlaar, I was waiting on your application result concerning the local goverment issued marriage certificate. Didn't know we will pick up passports same day.I picked mine up yesterday and was successful.

Please is Local Government issued Marriage certificate still valid? We had our wedding at our local government marriage registry. I came across this here and on the internet. I am now beginning to worry. Please are there people in the house who submitted their local government marriage certificate. BIKO!

We have considered your application under paragraph EC-P 1.1 of Appendix FM. However, you do not qualify for entry clearance under the 5-year partner route for the following reasons: (one only reason tho)

Eligibility Financial Requirement
You do not meet the eligibility financial requirement of paragraphs E-ECP 3.1 to 3.4

You have stated you intend to meet this requirement through salaried employment with your sponsor having worked for her current employer for less than 6month. I note you have submitted evidence of her previous employer (Bleep). However if you are using employment with a company for less than 6months, you're required to submit 12months wage slips and bank statements, so we can confirm your sponsor total income is sufficient over the last year.

I note you submitted the following evidences:
Employment letter: Provided confirming salary and start date of July'16 for Bleep and also yyy May '17

Wage slips: Provided for both employments Bleep 19/08/2016 - 20/03/2017 and yyy 31/05/17 - 30/07/2017

Bank statements confirming salary submitted for the period Dec '16 - July '17

Therefore I'm unable to be satisfied you have submitted all of the required evidence to meet this rule.

Right of appeal
You have 28days from the date you receive this decision to appeal.


Meanwhile, we stated clearly we're using both salaried employment plus savings to meet the financial requirement and all evidences were submitted but its very obvious the savings part was neglected and ignored. She had over £25k in her savings for well over a year before we applied.
Job Bleep was paying £17,500 and she stopped in May, got job yyy paying £19,800 till August when we applied. Got another job (present one) paying £19,000.
What I don't get is why the case officer totally ignored the savings part.

Hello ronvlaar, sorry about your refusal. From what you have posted I can try with the little knowledge I have (I stand corrected).

You are using income from the last 12 months. Which means

1st Job August- March (7months) : 17500/12 * 7 = 10, 208.33 ( I did not add August pay as I am not sure of what pay slips say). If August salary on pay slip is lower than the rest( I think the HO uses the lowest income *12 to get annual pay)
2nd Job ( 2 months) : 19800/12 * 2 = 3,300

Savings Calculator: 25000
25000 - 16000 (min savings) / 2.5( valid visa year) = 3,600

Total Financial Requirement: 10,208.33 + 3,300 + 3,600 = 17,108.33 (shortfall of 1,491.67)

Do you have a British Child in UK for exceptional circumstances?

Please seniors in the house, advise.

I think sometimes the case officers just look for any tiny inconsequential reason to refuse visa. I applied with 3 of my daughter, at the end, they only granted I and my last girl and refused my 2 eldest. Their reason was that I didn't register their birth with census immediately after their birth and so they are not sure am their mother. It was a very traumatic experience for me. I had to go for DNA for 3 of us and of course it's 99.99999%. Almost didn't want to travel cos I 've never left them before but I had to at least to see hubby lawyer who already appealed and give him the DNA report.

Thankfully they are with my brother and family and in good hands but their sad faces everyday we do video call tears me apart but wat can I do? Promised them it won't be long but I plan to visit them soonest.

It is well.

Thanks @justwise, coming from you, it means a lot. I am not sure you know the gravity of impact you contribute to couple's applications, by reason of this thread/house. I and hubby intended applying middle of the year but after stumbling on this thread, I realised we were far from ready and would have been rejected. Few months later, after extensive reading and research of manuals over the years from the house, we were ready to apply. To God be the glory, we were successful. Thanks for being avaliable and consistent over the years. Thanks for the joy you bring couples, thanks for uniting homes.

Sorry to hear this bro. I can understand how you and your wife will be feeling right now.... I've been here before. I've noticed one thing and that is Once the application begins to take unnecessarily too long then there's something fishy. Plus also once they start calling ones spouse back and forth then one should suspect a foul play. I actually went through almost the same thing as you did. However I think the reasons for our refusals differ. Mine was refused for salary/work related reasons (wife didn't make up to 18600 at the time and we had to combine jobs). I strongly think yours was refused because of the local government wedding certificate. Please post the reason(s) for refusal so we all can brainstorm on the way forward. Sorry once again Ronvlaar

Hey bro. Just seeing this now.

I guess I was wrong about the reason for refusal being the local government wedding certificate. However the reason for refusal here is somehow. The case worker obviously didn't check the documents submitted to back up the savings in your spouses account.... or perhaps maybe the document was missing.

You have two options now... reapply or appeal. Either way, you will have to wait for a while. While you may a high chance of winning the appeal case (if you are able to convince andshow them the evidence of the £25k savings using a good lawyer) but you may spend a whole lot of money and may have to wait for up to a year or even more for the case to be completed. I decided to just reapply because of time and money involved in the appeal process.....

Finally, like I said in my previous post... if the application is becoming unnecessarily taking too long then something is wrong. Imagine when they actually made a decision on your application to when they sent you an email to pick it up. Mine was the same.... after waiting for almost 6 months for the application, it eventually came refused but the date of refusal was actually over a month after they told me to pick my documents up.

Think very well with your madam on the best way moving forward. Once again.... sorry about the refusal.
