Hi @MreSBee I dont think that should be a problem at all because my hubby applied with an irregular income too and there was a month that seems short. Though i was on wages then. it depends on the employment category you pick. if you choose category A salaried employment (where the sponsor has been with the same employer for 6 months at least) and you submit 6 months pay slips and bank statements, then they use the lowest figure within that 6 months to calculate the annual salary. so if your wife earns less than £1550 in any month within the 6 months submitted that is the figure they will use. so I advise you be careful and not think they will consider only the employer letter. make sure no month is below £1550 and if there is and you are sure she earns more than £18,600 a year then consider using Category A un-salaried (where income are variable) and submit 12 months worth of evidence. Thanks so much for your response. She actually makes well over 1550 per month... her monthly salary is around £1630.... so from, your 9300/6 months (which I believe was come about by dividing 18600 by 2) is well covered with her 1630 monthly. But you didn’t get what I wrote clearly... she actually was paid a few hundreds of pounds less (not £100 as you thought initially). Not sure about how much exactly (I asked her tonight and she’s going to confirm exactly how much was paid for the particular month tomorrow) About what her company will write in her letter, I can categorically tell you that I’m sure the company will write her full annual salary (almost 20k) in the letter. Already, in her employment letter/contract handed to her when she wanted to start the job, it was clearly written there her annual salary. So the company option should be fine. So if this is true, there’s nothing to worry about? Please gurus in the house (Lexusgs430 and Justwise and others) please share your opinions and experiences about the issue raised. cindylee: When you book your appointment, you pick that you want a priority service. Also you will be asked to create a TLS account, When you do this, you can include priority service to your profile and pay for this at the TLS centre during your interview. You cannot have your visa within 10 days. Priority takes 6-10 weeks (this is me assuming that you are applying for a spouse visa). Include your child in your application. You will see the option on the homepage, after logging into visa4uk.fco.gov.uk look up and you will see “apply for myself”, “apply for someone else”, “view my applications”. Click on the second option. |

Lol.... morning mr Lexus Let me summarise my question here. My wife meets the £18600 salary requirement (infact she exceeds it). However, a month out of the past six months (past six months payslips we want to submit), she was sick and was on about 10 days unpaid sick leave. Hence that affected her salary (payslip) for that particular month. For example, she normally would have earned about £1634 per month but earned less than that by a few hundreds of pounds. My question is will that affect the application (especially the salary requirements) in anyway? Please note again, her yearly salary is above 18600. Thanks as I await your response Lexusgs430: |

She’s 6 months in this job already... but I’m going to wait till the 7th month before applying. She can get the P60.... but I’m not sure if it’s going to be the April 2017 one as she started work after the start of the financial year of 2017 Lexusgs430: |

I was working as a warehouse operative and paid on an hourly basis with premiums and bonuses. i was working 11 hours for 5 days in a week and sometimes I worked 6 days a week and other times 12 hours a day. All these caused the variation in my wages then. When my husband applied for his visa, we designed a spreadsheet detailing my gross income and net income for each month to make it easier for the ECO to view my income at a glance because i submitted 28 payslips which was equivalent to 6 months if i was on salary. I have attached the screenshot of the spreadsheet to this post and I hope this would be helpful. MreSBee:

Thanks for your response. But how do they calculate the salaried employment category now. From the application I made in 2016 if I remember properly, I think they just calculate all your earnings with those six months multiply it by 26 weeks (equivalent of six months) and then divide it by 6 or so. Has it changed? I’m not familiar with them using the lowest earning within the six months to calculate. Please educate/update me with the link. Thanks one again. Whitnified: |

@Lexus, there’s something my wife did though. So let me break it down. She had the sick leave which affected her salary in Oct. however she worked overtime at the same work place in November and December hence she earned higher in those two subsequent months, do you think this could augment the overall six months salary in order to meet the requirements. Thanks for your response again and thanks for sharing the screenshot. What you did for your application was amazing honestly (compiling the wages and calculating it to show the total monthly earning).... the ECO at the time would be really pleased with the application cos you made his/her life easier and I’ve actually learnt from it. If I had seen this (screenshot) before my last application in 2016, it would have helped my application greatly as my wife was on hourly wages just like you then but now she earns monthly salary. However I will sit down with her to see if we can compile this kind of list for her salaries in the past six months. The fact is yes, she had less salary in one of the months as a result of sickness but she did overtime in the subsequent 2 months after the sick month where she earned higher so combining the extras of the overtime, I believe she will definitely exceed £9300. To the best of my knowledge, when you are on a salary, being sick for a few days should not affect your salary except your income is based on the number of hours you worked then you are paid at month end. I am a salary earner now and i have taken some sick leaves which did not affect my salary at all. Besides, I don't know why you are trying to complicate issues for your self. That is the essence of the additional information page. You can explain the reason(s) for the income variation for that month there. no one plans to be sick and anything could have happened. Just be as transparent as you can with your application. I did not submit any P60 with my application because i had none for the financial period I applied with (august 2016 to march 2017). MreSBee:Taken from Appendix FM 1.7 (Financial Requirement) I advised you through all the pages of the document. it also gives examples The only difference in Category A between salaried and non-salaried employment is how gross annual salary or employment income is calculated: Where the person is in salaried employment – they must have been paid throughout the period of 6 months prior to the date of application at a level of gross annual salary which equals or exceeds the level relied upon in the application. Therefore the figure used towards the requirement will be the lowest level of annual salary received during the 6 month period. Where the person is in non-salaried employment – the level of gross annual employment income relied upon in the application will be the annual equivalent of the person’s average gross monthly income from non-salaried employment in the 6 months prior to the date of application (where that employment was held throughout that period). To calculate this annualised average for non-salaried employment in Category A the following calculation should be used: (Total gross income from employment held throughout the 6 month period, divided by 6) multiplied by 12 = Income from non-salaried employment that can be counted towards the financial requirement. for my application I am using Category A-Salaried because I know even my lowest in the 6 months exceeds. for yours you can use Category A- unsalaried as her income varied due to sick leave & overtime worked, so they will calculate it as above. You are right about "being sick not affecting the salary" but hers is like that because the period when she was sick was her probational period. Part of her employment policies is that once you are on probational period, your sick leave is not paid for.... after the six months probational period she gets paid for sick leave as well just like in your company. True, i will definitely use the additional information page to give details lol. I just want clarifications on everything...... you know dotting the i's and crossing the t's. Thanks for the clarification. The paragraph in bold was what I was trying to explain earlier about what I know about how they calculate the non salaried employment.... And regarding your advice on using the non salaried employment category for my application, I think that is just what I will do..... I actually am seeking an immigration lawyer's service for my application this time around so i will make sure i run that with the lawyer as well so as to get a professional point of view.
