Whenever I read some posts especially those made by those who have been approved, he smile. Yoruba adage says "eni Koko e ba ye lo mo lo". That he whose Cocoa husbandry is successful is an expert" whereas those that got theirs unsuccessful are not novices but victim of circumstances. A brother applied in April, he has a BSc in Animal Science and wants to go for a Dipolma in Food and Nutrition. I wrote the SOP for him and today, he is on his way to Canada but me n ko, I was refused.
If your application falls in the hands of a good VO, he/she will not hesitate to approve you even without an SOP but if you meet a sadist and racist, I am sorry, no amount of your sweet SOP will change his)her mind

Experience is truly the best teacher, and my Canadian Sucess story made me believe the saying “EVERY DISAPPOINTMENT IS A BLESSING”!!! I know very well my story will motivate or strengthen some people never to give up in whatever that interests them, pursue it desperately like your life depends on it!! Yes I mean it.
Before I proceed, below is my timeline.

Online Application (2nd Application)
Submitted May 9th (10:57pm)
Upfront medicals passed on 11th June
Correspondence letter (today by 10:12am)
Original passport request (today by 10:32am)


This experience is my most difficult experience in life so far, I have always thought I can have anything I want in life but this Canada journey taught me that “Human beings can make any plans they want, but it’s God that decides their Sucess or failure”. I don’t even know where to begin from, but only God, Myself and @frankrobbn1 can tell my tragedy-comedy story.

So exactly a year today 20th June 2018, I submitted a paper route application and It was refused within 4weeks based on family ties, purpose of visit , personal assets and financial assets. Meanwhile, I have a Bsc in Biochemistry with overall CGPA 4.15 and last two year CGPA 4.71 , going for 2year diploma, paid tution fee $8,880cad.
when I received my refusal letter, I cried that very day like never before and till date my first refusal date 18th July,2018 still remains the worst day of my life, and the agent my parents used was just after money. After crying, knowing how bad i needed to leave this country I woke from my comfort zone and began my personal research, this was how I came across this wonderful forum and started reading up!

Through this wonderful platform I met an angel in human form, a motivator, my soulmate and my support system @frankrobbn1, may God bless you richly for me. Frank took his time to explain the errors in my application starting from advising me to secure a masters admission and that is nearly impossible to convince a VO on why diploma and not masters considering my high Gp, and secondly that my application is as empty as anything, I didn’t even submit my family’s information, no assets declared, no employment evidence and so on.

So I began my admission hunt and the devil started his work. Almost all the schools offering my course/ or related course requires a supervisor , and you know how difficult securing a supervisor can be. Some schools I contacted will tell me pump and play that I must identify a supervisor before applying while some will tell me to apply that they will assign me a supervisor once am admitted! I fell to their tricks and lost my application fee, I also tried contacting supervisors all kept turning me down. I kept sending countless mails to different supervisors in different universities all to no avail, some would always come up late with their negative mails of not having space in their lab while some will totally ignore me. I got feed up and I decided to stop sending mails but to call them on phone at least to get a straight forward response rather than waiting for their response that takes weeks and at the end must be negative. I made it as one of my daily activities to call at least 10 supervisors daily, and I did this for months!!! Even the ones that later accepted to supervise me though without funding just all of a sudden will deny even knowing me after I have submitted my application hoping I have secured a supervisor.

In general, I applied to 6 different universities in a space of 8months and all turned me down. I kept asking myself who did I offend? who is after my progress? Through this same wonderful forum I met a very nice fellow @agronat. Immediately he posted about him securing a masters admission with funding, i pm him to put me through, and that was how I realized the vital points/information missing out in my application and the reasons behind my refusals regardless of my high scores. And today am glad that my finally attempt landed me a full fulled scholarship worth $38,076CAD at BROCK UNIVERSITY ONTARIO , 2 years MSc in Biotechnology. Big thanks to @frankrobbn1 for recommending Brock University to me. I nearly craze that day (April 18th, 2019)!!! NB: the scholarship covers my tution and living expenses with extra left, I was also guaranteed a graduate assistantship position. Isn’t God great? This was when I realized that God was preparing something greater for me.

Fast forward to my visa application, guru @frankrobbn1 finished work.. I personally wrote my SOP and LOE, but when frank was done reviewing it I couldn’t recognize my LOE and SOP .. lol, he reconstructed it and was even using the VO’s terms to address every issue. He sold me well and also left the Change for the Visa officer to keep. I can’t thank you enough.., even after I submitted my visa application he took me to a church where I was given 4 days dry fasting and prayers (something I have never done in my life). I’m not the churchious type but this journey brought me closer to God and will forever remain grateful. I will be traveling to lagos next week to submit my passport and at the same time celebrate this wonderful journey that ended well. Seriously my sleep tonight will be very special after one year of dreaming of CANADA �� Lol, and to @justwise thanks for making this platform possible.

Even though I know my application is a little bit tight, I still handed it over to God because I have seen better applications refused, or the acceptance quota being reached as rumored on the forum,I said to God that they will bang the door when it’s my time to enter, I prayed against errors which can come from the VO leading to common refusals, lol, I prayed against bad mood on the head of the VO handling my application. Prayer is the Key.

Hello Guys, please I need help with my SOP, i have written it but need someone to help me vet it, also, I am a bit scared with the fund in my sponsors account, my mom is responsible and she has 9M in her account, landed properties: 4 Bedroom worth, 35M, a Hectare of land valued 15M and also 3 plots of land valued 10M, my tuition is 18,000CAD paid aside the 9M in her account, my fear is do we need to get loan to add more money to the balance of 9m or it's okay ? BTW, I also have 2 properties of 4M in my name

You are very much right. Canada denied me TRV last year in october 11, 2018. I sat down and I just look at everything and I said to myself 'why did l put all my eggs in one basket ?'

I discovered that I needed to try other countries like US, Australia, New Zealand, Germany, Sweden and Norway. I applied to all the countries and I got admission in all. Then I started to consider the cost, the GDP per capital of the countries, post study visa/work visa, minimum wage, job availability after studies, overall economic indexes, and visa refusal rate of nigerians in those countries.

I narrowed down my mind to germany and Norway because no tuition fees up to PhD but you will transfer living expenses to the school before you apply for the student visa. The admission I got in Germany (M.ENG in design and development in automotive and mechanical engineering ) has some conditions like Germany language certificate at A1 level and tuition fees of 3000 euros per year which is still very affordable for me but in Norway, the admission came without no condition and with no tuition fees ( M.sc in Engineering design).

Then, I did all the neccesary things and applied for the study permit and within a month I got the study permit approved.

Some people might say because I was denied the Canadian study permit is the reason I am writing this. Well, my tuition fees in Canada is 20000 canadian dollars per year but with me going to norway now, I did not have to bother myself for tuition fees.

I will advise you really take ur time, wait for ur GCMS and study the actual reasons the VO refused ur Application.. Fall 2020 Is still kinda far.. Dont rush to re-apply, take ur time, prepare well and re-fire.. ma 2 kobo. PEACE

JUDICIAL REVIEW PROCESS


1. What is Judicial Review ?

Here is the standard explanation regarding the judicial review process.

It is very difficult to overturn a visa officer's decision in Federal Court with the judicial review process. This process is a 'judicial review' process, and not an 'appeal', and it is important to note that the vast majority of immigration cases do not succeed. Even if the judge disagrees with the decision of the visa officer, that is not enough to overturn the decision. There needs to be more than disagreeing with the outcome based on the merits.

The Federal Court process is as follows: There are sixty (60) days from the date of the reception of the refusal letter within which to commence the process when the refusal is from overseas, and thirty(30) days when the refusal is from inside Canada. This is the "application for leave and for judicial review".

Written reasons need to be received from the Respondent (the visa office). It can take a few weeks for the written reasons to arrive. After the written reasons arrive, the Applicant has 30 days from the receipt of the written reasons to provide both Affidavit evidence and written argumentation to the Court. Typically, the Affidavit is created within two weeks of the reception of the written decision, and received by the lawyer in pdf. The original is sent to the lawyer by regular mail for storage in the lawyer's file; the original Affidavit does not have to be received by the lawyer within the 30 day period.

Then, the Respondent (the visa office) has 30 days from to provide their Affidavit evidence and their written argumentation to the Court.
In some cases, the Respondent may decide to settle at this point.

After the Respondent has provided their Affidavit evidence and their written argumentation to the Court, the Court decides whether or not to hear the case.
The Court can take a few weeks or a few months to make this decision.
If the Court decides to hear the case, the Court "grants leave", and the matter is set for hearing, usually within the following four to six months.
(If the Court decides not to hear the case, the matter ends there)

Legal fees "application for leave and for judicial review" would cost $4000 including all disbursements, judicial stamp/court fees, photocopies, document binding, service of documents, etc. and inclusive of any HST if it is applicable, and is payable at the outset of the entire process by Visa, MasterCard by e-mailing or faxing the credit card number and expiry date, or by bank draft, money order, cheque.

If the Court decides to hear the case, the Court "grants leave", the parties may submit new affidavits, and the parties may be examined under oath based on their Affidavit. This is where the visa officer may be cross-examined, if necessary. The evidence including the transcript(s) of the examinations under oath is given to the court. Most cases that we do, do not involve examination under oath. The parties may also submit additional written argument. The Court will order the Respondent to submit a copy of the entire file to the Applicant and to the Court.

On the hearing date, only the lawyers attend the oral hearing. There are no witnesses, only Affidavits.
A decision comes usually within 30 days of the oral hearing.
If positive, the visa office usually takes 60 to 90 days to begin re-processing the file.


2. How much time does the entire process take?
It normally takes 9-10 months.

3. How much does the entire process cost?
A qualified Canadian attorney charges 3000-4000 Cad$, cost varies from case to case.

4. Does this fee include everything?
Yes, generally.

5. I am a Canadian citizen, Can I represent my case on own.
Yes (conditions applied).

6. Can every decision (FSW) be challenged in the FCC?
Yes.

7. What are the chances of grant of Judicial Review?
There is no guarantee of such thing.

8. Are there chances when the respondent refuses to fight the case?
Yes, when they find, that a material error has been made by them.
Eg. When a case has been refused on the ground that a particular document has not been submitted by the applicant whereas the document was indeed submitted.

9. I have heard Judges give high deference to the VO, is that right?
Absolutely, Judges can check standard of review, they can interfere if the law has been breached.
In simple words, if they find, VO has not followed the law while making the decision.

10. Can a Judge overturn the VO’s decision?
No , the judge can't do that, the Judge can ask another VO to re-assess the application.

11. Is Canadian judge fair in their judgement?
Absolutely, even a miniscule error done by the Visa Officer is caught.

12. My case is refused due to job duties mismatch, can I go for JR?
Well, you can, if you think there has been an injustice done to you, If you think you have been performing those duties and can prove them.

13. Are there some cases, which have been granted JR on JD? Yes .

14. When there are strong chances of me, winning the case?
Well, when you can prove there has been a mistake committed by the VO or a breach of procedural fairness has been done.

15. I have been made inadmissible under 40 (1) (a) as per IRPA?
It needs a great standard of Procedural Fairness before imposing 40 (1) (a).
(The definition has separately written, will be available soon.)

16. Can I claim for the costs or damages?
Well, you can but costs are hardly awarded.

I was in the bathroom taking my bath and at the same time playing music with my phone, my music got interrupted and it was an email that entered. Still sponging my body I walked close to my phone to see and it was CIC “donotreply”, you have a new message(s) in your account, I didn’t even know when my sponge fell off my hands. Ur funding is very sufficient but we have seen applicant with huge millions as soa been refused. Just make other neccessary documents available and well written then pray.

APPROVAL ALERT GUYS!!!

I was in the bathroom taking my bath and at the same time playing music with my phone, my music got interrupted and it was an email that entered. Still sponging my body I walked close to my phone to see and it was CIC “donotreply”, you have a new message(s) in your account, I didn’t even know when my sponge fell off my hands. I just picked my phone and ran out of the bathroom like that with my soapy body, my mother saw me on the way and was surprised!.. I told her mum the hour is here Canada just replied and I don’t know if it’s a refusal or approval- she shouted and joined me as I run to my room-. As I was logging into my account my hands were uncontrollably and terribly shaking, My mum kept shouting for grace as my account was loading, lo and behold it’s an approval guys.. we laughed and hugged ourselves grin. Now, Let me go back and complete my shower will be back for the full testimony.

Morning guys, I’m so sad right now. I received my BVL this morning and I know what it means already. My school resumes by Sept this year. I don’t know whether to defer my admission or reapply for my visa. Please someone should advise.

My undergraduate course was Urban and regional planning, finished serving in 2017, got a job immediately in a Top real estate company in Lagos as their Urban Planner.

My proposed course of study is Urban and regional planning GIS (Diploma 2 years) at MOHAWK COLLEGE because they are the only one offering the course. And because I intend to further my knowledge in that area or land development, I had to look for the school offering the course.


Now with this document. Is there anything left behind? What didn’t i do right. Please I need suggestions guys. Right now I’m devastated
