He must be prosecuted and sentenced accordingly. Upon conviction he ceases to be a Senator and can no longer stand for an elective office. On a personal note it is as amazing as it is worrisome that despite his HIV positive he is still about irresponsible and sinful lifestyle and could have had blood contact the lady he so violently assaulted and infected her with the HIV he carries.
