This is not only done in river state. It's also done in igbo land. If you impregnant a girl without paying her bride price, that child automatically belong to the girl's family and his to bear the girl's sur name.

Story.
That's if the child's father is an idiotic illiterate.

The same Igbo tradition that doesn't allow women inherit property is the one you're referring to.

It's from High Court the mother's people would start receiving judicial beating.

Nigeria's laws supercede Customary laws.

That is why we have courts. You go to the court to claim your legal rights. As long as the child possess half your DNA, you are legally the father.

I never said he shouldn't fight for his place in his son's life. The OP wants to take the child from his mom and I am trying to let him know that no court will give him 100% custody of a two year old. You and your likes are just so stupid. You just come on here to insult without even understanding.

sacx:

You're trying to be clever by half. Our society is run by laws and not traditions. This is why the decrees of the state can override any traditional injunction. Going by the laws, he has a right to be present in his son's life and participate in his development. The attempt to alienate him in the name of traditions will not stand.

Now shift closer let me warn you. Never you litter the public space with verbose arguments and unsubstantiated claims! That's all grin

Where did I mention the court? I am not talking about the law. I am talking about this 15k man's ability to feed and clothe his own son.

The matter on ground is not that they are stealing his son. It is that he cannot provide for his son. Don't let him hoodwink you. If you want to help him - get hima skill, a job, a hustle etc

Let him send 200k worth of baby formula and clothing to the mother and see of he will not be allowed to see his son.

It is not by sperm - without the right nutrition that child can become retarded. To put it bluntly this man is too boy to raise a child. He keeps saying she left him because he is a pauper then why cann't he fix his poverty. Go and get some money biko then fight for your son and impress the mother.

I feel sorry for his ego but he can fix it by getting money rather than this pity party he asked us to organise for him.

Again find below some costings for a child. Please be guided before you insert your peepee and litter the earth with kids to struggle. The human race does not need more hungry kids..... biko.

To whom it may concern.

This is not truth it is a warped sense of what you actually believe to be truth, plus you are not sorry for him, why would you be.

Your write up is really from the perspective of someone who is really illiterate in law or the practice of it. This is why Nigerians will claim intelligence yet haven't turned on all the faculties in their brains yet.

This is the reason we have courts that can carry out DNA tests to determine paternity, even if he is not given sole custody he should never allow another parent usurp his rights away as given by man/law and by nature.

@ poster, fight for what you want no matter the cost, you will be able to look yourself in the mirror as an old man with no regrets. Trust me on this, people often tell you to take the route with the least resistance.

A customary court Won't grant you custody of and infant, Being that he needs More attention now, which can only be granted by the mother,So I'll just advice you to keep contact with him, have an agreement with the Man who's marrying your Ex, that he'll grant you visiting rights and if he or she doesn't agree LAWYER THE Fvck Up and GO TO COURT.

If you live in Lagos and she lives in Lagos, go to your nearest local government, meet the media lawyers (media Centre).
You need her current address. They will send her invitation letter. Tip the delivery man (usually police)

Good luck!

Nigeria: Supreme Court Invalidates Igbo Customary Law Denying Female Descendants the Right to Inherit

(May 6, 2014) On April 14, 2014, the Nigerian Supreme Court, in a unanimous decision, confirmed decisions of two lower courts, which had found unconstitutional an Igbo customary law of succession excluding female offspring from eligibility to inherit the property of their fathers. I wouldn't have had issues with anything you've typed so far if you were drawing your hinge from the law. But it's the same 'traditionally' all over. Again, our society is run by laws, not traditions.

His desire to get full custody of his child is based on the threat to transfer ownership of his child to another man by way of traditions. This is unacceptable in the eyes of the law and could help his case. Remember, he never made this move until he started getting the threats.

Though securing full custody of the child would be extremely difficult if not impossible since he is a toddler, but he would get rights of claim to him and reasonable access, which is something his baby mama and her family are trying to deny him citing their tradition.

Now if this doesn't make sense to you, oya take am cheesy

Muscle does not solve any problem now. Puffing up and down doesnot solve any problem, a man who cannot provide for his family is an infidel says the holy book. Do you think the girl is happy to go and look for a provider for her child while the child's father is alive. Use this anger to make money. The only supremancy is money - he who pays the piper ? dictates the tune. He does not have money to pay piper so the tune is for the step dad. it hurts but the only solution is to understand that as a young man you have a financial clock and get to work making that money - even your mother will not respect you if you cannot provide for your child. curse all you want or provide or keep your peepee away from women.

It is essential to provide for your offspring however if you believe this is the only thing necessary for the well being of a child's psychology then the society you live in in regressing faster than you even realize.

Mr ! a child needs alot of things beside food and diapers - they need love and care BUT they need food and diapers first and that is the job of the father and the mother nurtures while dad is away hustling. Heaven gave the man bigger muscle so he can work and provide for his family- if he is not doing that he will come into disrepute as seen by poster because the mother will be forced to find a provider so she can nurture her son. Look at animals in the jungle it is the same thing. I hate lazy fathers who donot understand thier role - kids are hungry and sufferng and thier father is alive. It is a big shame! Use that ego of na my son to get a job because even your son will avoid you or not respect you when he is grown if you are still poor. Children tolerate a poor mother but never a poor father. Be aware!

Are you willing to be his lawyer in this case? I don't think he should spend all he has to pay one. The boy is his son but he's single and can't cater for a child under two alone, no court will grant him sole custody as he wants. If the lady is wicked she can claim abuse and with a good lawyer he might be denied his rights entirely. Sometimes it's better to settle out of court especially in Nigeria where even our president doesn't obey court orders. If he can't settle with her family my advice is for him to relax, the boy will surely look for him later on.

The case is a walk over in court. The judicial precedent of Edet Vs Essien(browse the case) is enough to grant him the paternal right of his child.
Giving a child to another man to father without the consent of his biological father is illegal and therefore not in the best interest of the child. If OP's lawyer proves that the paternal Grand parents of the child, that is, the parents of OP are capable of taking care of the Child, the Court can grant custody to the grand parents of the child since the very act of the child's mother partaking in illegal adoption itself is not in the best interest of the child .

Please notify the OP.
